<section id="H3E21B13FF1414B61B6A09ED8C629AC97" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>PREP Repeal Act</short-title></quote>.</text></section> <section id="HF840F38081DD4D41A1CC0EB49DDC47D9"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="H3E93191E3BB542D3867B32F4A318226C"><enum>(1)</enum><text display-inline="yes-display-inline">Liability shields granted under section 319F–3 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d-6d">42 U.S.C. 247d–6d</external-xref>) have undermined public trust and accountability during public health emergencies.</text></paragraph> <paragraph id="HE28A18EF798D43509476C78AD28EBEB5"><enum>(2)</enum><text>The ability of citizens to seek redress for injury or harm is a fundamental principle of justice and due process.</text></paragraph> 
<paragraph id="H27EAB802353D41BDBBD07AC904344B30"><enum>(3)</enum><text>The Public Readiness and Emergency Preparedness Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/148">Public Law 109–148</external-xref>) (commonly referred to as the <quote>PREP Act</quote>) has enabled regulatory capture and legal immunity for pharmaceutical manufacturers at the expense of individual rights.</text></paragraph></section> <section id="HCDD91CC93D4B432BA47DACA4B4342920"><enum>3.</enum><header>Repeal of liability immunity for pandemic products</header> <subsection id="HBDB446C42E854831A7F433F61EC9CE7B"><enum>(a)</enum><header>Repeals</header><text display-inline="yes-display-inline">The following sections are repealed:</text> 
<paragraph id="H479F81402E6544F49730DF7AB623D21B"><enum>(1)</enum><text display-inline="yes-display-inline">Section 319F–3 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d-6d">42 U.S.C. 247d–6d</external-xref>).</text></paragraph> <paragraph id="HB100ECBB8FB94EA8B21C947BFCB94420"><enum>(2)</enum><text>Section 319F–4 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d-6e">42 U.S.C. 247d–6e</external-xref>).</text> </paragraph></subsection> 
<subsection id="HEA7D3A9790214C95992ECB97BB2A505C" commented="no"><enum>(b)</enum><header>Rescission</header><text display-inline="yes-display-inline">The unobligated balances of amounts in the Covered Countermeasure Process Fund, as established by section 319F–4(a) of the Public Health Service Act (42 U.S.C. 247d–6e(a)), as in effect on the day before the date of enactment of this Act, are rescinded.</text></subsection> <subsection id="H1AEC22E8251C43EE940476B0D35C0683" commented="no"><enum>(c)</enum><header>References</header> <paragraph id="HD0E4EA86338A45A5B141B44914A4A6A0" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Any reference in Federal law to a section described in subsection (a) or a provision thereof shall be construed to be a reference to such section or provision as in effect on the day before the date of enactment of this Act.</text></paragraph> 
<paragraph id="HE60FD6CD36DD48C8B085480FBC2FB29A" commented="no"><enum>(2)</enum><header>Amendment</header><text display-inline="yes-display-inline">Section 565(b)(1) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/360bbb-4">21 U.S.C. 360bbb–4(b)(1)</external-xref>) is amended by striking <quote>319F–3,</quote>.</text></paragraph></subsection></section> <section id="H01B564B2B0234B68BD84A8E0F3A1E9B6"><enum>4.</enum><header>Preservation of existing rights</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to limit the ability of any person to pursue civil remedies under Federal or State law for injury or harm arising from the development, administration, or distribution of any—</text> 
<paragraph id="H80B138EF1EC343FF80D67B897921BC77"><enum>(1)</enum><text>drug or device (as such terms are defined in section 201 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321</external-xref>));</text></paragraph> <paragraph id="H03EB0FB39EA647FAB1B4021D8F20B01A"><enum>(2)</enum><text>biological product (as defined in section 351(i) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/262">42 U.S.C. 262(i)</external-xref>)); or</text></paragraph> 
<paragraph id="HF9041B887F664054831D6C3B5470539A"><enum>(3)</enum><text>covered countermeasure (as defined in section 319F–3(i) of the Public Health Service Act (42 U.S.C. 247d–6d(i)), as in effect on the day before the date of enactment of this Act).</text> </paragraph></section> <section id="H55340B9E27DA4FB495BE074FBB47EDF0"><enum>5.</enum><header>Application</header><text display-inline="no-display-inline">This Act, including the repeals under section 3(a), shall only apply with respect to actions, claims, or proceedings that—</text> 
<paragraph id="HC434E7D5A1E0430ABFC6A67B7948D1A7"><enum>(1)</enum><text>on the date of enactment of this Act, are pending (including actions, claims, or proceedings for which a right of appeal has not been exhausted); or</text></paragraph> <paragraph id="H54ECAD503AF54D84871FE3A245633B87"><enum>(2)</enum><text>are commenced on or after such date of enactment.</text></paragraph></section> 
<section id="H293C590379B847A5BCD35E7214398931"><enum>6.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or the application thereof to any person or circumstance is held invalid, the remainder of the Act and the application of such provision to other persons or circumstances shall not be affected.</text></section> </legis-body></bill>
