<section id="H8E86E93495B84C5B8C50A2BD9A64F59C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>End Tenant Credit Screening Act</short-title></quote>.</text></section> <section id="H982DDB45D93D49D2BA5929813EC46919"><enum>2.</enum><header>Use of credit checks prohibited for tenant screening purposes</header> <text display-inline="no-display-inline">Section 604 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681b">15 U.S.C. 1681b</external-xref>) is amended by inserting after subsection (g) the following:</text>

<subsection id="H93E1E929A14A4C249E3116E0E7BA32DC"><enum>(h)</enum><header>Use of certain consumer reports prohibited for tenant screening purposes</header> 
<paragraph id="H7CD681609F3D4B2AA7931C31191EEACF"><enum>(1)</enum><header>Definitions</header><text>For purposes of this section:</text> <subparagraph id="H15340177EAD94ABCAE02E688E69ECAC2"><enum>(A)</enum><text>The term <term>tenant screening purposes</term> when used in connection with a consumer report means a report used for the purpose of evaluating a consumer for rental housing, including whether to approve a consumer’s rental housing application, determining the consumer’s security deposit or other terms of the consumer’s lease, or retention a tenant.</text></subparagraph> 
<subparagraph id="H2421761F56DF442EB83F7380EEF55262"><enum>(B)</enum><text>The term <term>housing provider</term> means any person that leases a unit of residential real estate to an individual.</text></subparagraph></paragraph> <paragraph id="H573093C706EB493890B8229E8D892533"><enum>(2)</enum><header>General prohibition</header><text>Except as provided in paragraph (3), a person, including a prospective or current housing provider, may not use a consumer report or investigative consumer report, or cause a consumer report or investigative consumer report to be procured, with respect to any consumer for tenant screening purposes where any information contained in the report bears on the creditworthiness, credit standing or credit capacity of the consumer.</text></paragraph> 
<paragraph id="HBEDDAAD761FC464284F616BABDDF1133"><enum>(3)</enum><header>Consent irrelevant</header><text display-inline="yes-display-inline">The prohibition described in paragraph (2) shall apply even if the consumer consents or otherwise authorizes the procurement or use of a consumer report for tenant screening purposes, except for a report provided or caused to be provided to the housing provider for reconsideration of denial.</text></paragraph> <paragraph id="HCF9B72DFE9794F888D637B7A01CDE72C"><enum>(4)</enum><header>Reconsideration of denial</header><text display-inline="yes-display-inline">The term “reconsideration of denial” means any procedure or process by which a housing provider reconsiders, on an individualized basis, an application for rental housing that the housing provider has previously rejected after bona fide consideration.</text></paragraph> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
