<section id="H7786AA07DD7544F3A226362FDF4996FF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wild Horse and Burro Protection Act of 2025</short-title></quote>.</text></section> <section id="H56891E79B91E4C5D89A2C3C745CD144D"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="H10E3C741E69B45718B751044BAFFD511"><enum>(1)</enum><text display-inline="yes-display-inline">As part of efforts to control equine populations under law, the Bureau of Land Management is directed to humanely capture wild free-roaming horses and burros for adoption.</text></paragraph> <paragraph id="H2D0D8F7BFD934A5AA04906DD76D5A55A"><enum>(2)</enum><text>The use of helicopters to chase equines over prolonged distances, usually on rough terrain, is particularly dangerous, and can frighten the animals and lead to deadly situations, often miles from public view.</text></paragraph> 
<paragraph id="HD10A34C242214BE9875FC731C9C1C170"><enum>(3)</enum><text>Public observation of roundups is typically limited, thereby restricting public access to the government operation.</text></paragraph> <paragraph id="HB92C7054543B4189804286B0CC5E6C41"><enum>(4)</enum><text>Scientific research shows that more humane and cost-effective alternatives exist to control equine populations, including fertility controls.</text></paragraph> 
<paragraph id="H805A695440664B9E89DD9FE4B82A70DB"><enum>(5)</enum><text>Since fiscal year 2012, over $69.5 million in taxpayer dollars have funded roundup operations to remove federally protected wild horses and burros from the range.</text></paragraph> <paragraph id="H69DFE174AF134796ADB96526FF5F6847"> <enum>(6)</enum> <text>In the past five years (2020–2024), at least $36.7 million has been spent on roundups, including over $6 million paid to helicopter roundup contractors in fiscal year 2022 alone.</text>
      </paragraph> 
<paragraph id="HBE1BF6EAE8864D1E9EF34E9A184F1421"><enum>(7)</enum><text>Since 2012, the Bureau of Land Management has administered fewer than 800 fertility control treatments per year on average. In fiscal year 2012, 1,045 treatments were applied; in fiscal year 2024, 1,038 treatments.</text></paragraph> <paragraph id="H09A1A72E627449D4BBAED2254CCCF529"><enum>(8)</enum><text>Historically, the Bureau of Land Management’s Wild Horse and Burro Program has spent less than one percent of its budget on implementing fertility controls.</text></paragraph> 
<paragraph id="H05ED8F65F7EE40799EEB381A43A253E8"><enum>(9)</enum><text>The elimination of helicopters from the Bureau of Land Management’s gatherings would provide a more humane method of capturing equines, and provide significant savings to taxpayers.</text></paragraph> </section> <section id="H3D622271DFA04FD683A90898540DFF6F"><enum>3.</enum><header>Amendments to the Wild Free-roaming Horses and Burros Act</header><text display-inline="no-display-inline">Section 9 of the Act commonly known as the Wild Free-roaming Horses and Burros Act (<external-xref legal-doc="public-law" parsable-cite="pl/92/195">Public Law 92–195</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/16/1338a">16 U.S.C. 1338a</external-xref>) is amended—</text> 
<paragraph id="HC3106C53C1114DBEB1BEDD239DFFC0B7"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>In administering this Act</quote> and inserting <quote><header-in-text level="subsection" style="OLC"><enum-in-header>(a) </enum-in-header>In general</header-in-text>.—In administering this Act</quote>;</text></paragraph> <paragraph id="H3EBF4B96412646BD856B14B5567AD4F7"><enum>(2)</enum><text>by striking <quote>helicopters or, for the purpose of transporting captured animals, motor vehicles</quote> and inserting <quote>motor vehicles for the purpose of transporting captured animals or aircraft only in compliance with subsection (b) of this section</quote>;</text></paragraph> 
<paragraph id="H139E5A2659C143338D374707361C1DD7"><enum>(3)</enum><text>by striking <quote>fixed-wing aircraft, or helicopters, or to</quote> and inserting <quote>or</quote>; and</text></paragraph> <paragraph id="HFCA3AF4F81F1429991BB8EA00D840FBD"><enum>(4)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="H2BDF876A0E194268B61AFC8E6D954D39" display-inline="no-display-inline"> 
<subsection id="H8FC6864783924AF7A9044BD35661DBF1"><enum>(b)</enum><header>Phased elimination of certain uses of aircraft</header><text display-inline="yes-display-inline">In administering this Act, during the 2-year period after the date of the enactment of the <short-title>Wild Horse and Burro Protection Act of 2025</short-title>, the Secretary shall phase out the use or contracts for the use of helicopters or fixed-wing aircraft for the purposes of rounding up or gathering wild free-roaming horses and burros, ensuring an effective reduction in the reliance on these methods each year until all such practices have been terminated.</text></subsection> <subsection id="H6ADB5A1E126F4EF8B33394DEEF17A7F7"><enum>(c)</enum><header>Requirement for use of cameras on aircraft</header><text>Any helicopter or aircraft used for the purposes of rounding up or gathering wild horses and burros shall be equipped with one or more cameras to record the roundup or gather operation. The Secretary shall ensure such footage is made available as part of the corresponding agency roundup or gather report.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HBD7ECCD0E41A4FD5917C00FFFB4ECB1F"><enum>4.</enum><header>GAO Report</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the Comptroller General shall submit, to the Committee on Natural Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate, a report that describes—</text> <paragraph id="H1252ABDF9DAB4B3EB381E44D6F8EFFCD"><enum>(1)</enum><text>humane alternatives to the use of helicopters and fixed-wing aircraft in managing wild free-roaming horse and burro populations;</text></paragraph> 
<paragraph id="H3879C915849B4C0B92733E92E7B26682"><enum>(2)</enum><text>job creation opportunities presented by the use of such humane alternatives; and</text></paragraph> <paragraph id="H78B2D36AE8E248018C73AC627F6F6A22"><enum>(3)</enum><text>the effects of aircraft, including unmanned aircraft systems, on wild free-roaming horse and burro populations.</text></paragraph></section>
