<official-title display="yes">To require the Administrator of the Environmental Protection Agency to assess certain fees on shipping and other vessels, and for other purposes.</official-title>

<section section-type="section-one" id="H1B5363A616C94DB48A830CFC4CEF7262"> <enum>1.</enum> <header>Short title</header> <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>International Maritime Pollution Accountability Act of 2025</short-title></quote>.</text> </section> <section id="H6C7E62907B8243F8A4C7C0A04AD756D9"> <enum>2.</enum> <header>Findings</header> <text display-inline="no-display-inline">Congress finds that—</text> 
<paragraph id="HB26488D902184941BDF15A44BD538DD8"> <enum>(1)</enum> <text>the greenhouse gas emissions from the marine shipping industry—</text> <subparagraph id="HA80653B672DA4EC19838AF89756179C9"> <enum>(A)</enum> <text>account for nearly 3 percent of total global anthropogenic carbon dioxide emissions; and</text> </subparagraph> 
<subparagraph id="HCC89384AD26240969B4A591AEAC5BA77"> <enum>(B)</enum> <text>are increasing rapidly; and</text> </subparagraph> </paragraph> <paragraph id="HAF0C9C741D834D5197C969FC7C13B1F0"> <enum>(2)</enum> <text>ports are a large source of air pollution and contribute to poor air quality in the neighborhoods surrounding the ports, leading to worse health outcomes for those who live in those neighborhoods.</text> </paragraph> </section> 
<section id="HBBEFB9C9E4464364BF937791DF9D1391"> <enum>3.</enum> <header>Definitions</header> <text display-inline="no-display-inline">In this Act:</text> <paragraph id="H79B6C9734E6D4433AE96E9FDB95656F0"> <enum>(1)</enum> <header>Administrator</header> <text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HED7B9279304048ADA24BB269A32A8D4C"> <enum>(2)</enum> <header>Calendar quarter</header> <text>The term <term>calendar quarter</term> means a period of 3 calendar months that ends on, as applicable, March 31, June 30, September 30, or December 31 of the applicable calendar year.</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H0B4CBC3D6F844B189AE0EC19DF099891"> <enum>(3)</enum> <header>Cargo or freight</header> <text>The term <term>cargo or freight</term> does not include—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HAB56984758984F7295B5CB0FA280ED7A"> <enum>(A)</enum> <text display-inline="yes-display-inline">passengers transported for compensation or hire;</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HC7233D1A04034587BB29E38F2C03E474"> <enum>(B)</enum> <text>fuel intended for use in propelling or powering a vessel;</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H9C46879DA631459B919ED80E3EAA6FA5"> <enum>(C)</enum> <text>ship's stores;</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HAA19258390C74DB7998A085E9CA31569"> <enum>(D)</enum> <text>sea stores; or</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H14E7E72B56E04EF08F3CEF53F20E3A03"> <enum>(E)</enum> <text>the legitimate equipment necessary to the operation of a vessel.</text> </subparagraph> </paragraph> <paragraph id="HAAC4B9048A334AE08BDF437EA8188154"> <enum>(4)</enum> <header>Covered voyage</header> <subparagraph commented="no" display-inline="no-display-inline" id="HC74C1300879744AEB511C8237620E8FE"> <enum>(A)</enum> <header>In general</header> <text display-inline="yes-display-inline">The term <term>covered voyage</term> means a voyage—</text> 
<clause id="HA22B29095AA949C9BB56DE08AD5F3195"> <enum>(i)</enum> <text>made using a self-propelled vessel of 5,000 gross tonnage or more, the primary purpose of which is transporting cargo or freight; and</text> </clause> <clause id="HEA43AB1789874A26A399C751C7EF32DA"> <enum>(ii)</enum> <text>that begins when the vessel leaves the port of origin and terminates when the offloading operations at the final port of call are completed.</text> </clause> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HF98DE058733346D783C5BFC5E92CF4EA"> <enum>(B)</enum> <header>Exceptions</header> <text>The term <term>covered voyage</term> does not include a voyage—</text> <clause commented="no" display-inline="no-display-inline" id="H1E2992884DF6455293128EB4ADB258D2"> <enum>(i)</enum> <text display-inline="yes-display-inline">that has been included as an OCS source (as defined in subsection (a)(4) of section 328 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7627">42 U.S.C. 7627</external-xref>)) because the voyage has the potential to emit any air pollutant as described in subparagraph (C)(i) of that subsection and is, as a result, regulated pursuant to that section;</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="H3BC0611DD5FB4D6CB13EFD53C7C5A3B6"> <enum>(ii)</enum> <text>made for the purposes of transporting military cargo, food aid, or supplies for disaster or emergency relief; or</text> </clause> <clause commented="no" display-inline="no-display-inline" id="H52F13439ABAD4F85A85A43528BAFD431"> <enum>(iii)</enum> <text>made using a Jones Act vessel.</text> </clause> </subparagraph> </paragraph> 
<paragraph id="HFE5549338FFF43798333DBD70DE19C1C"> <enum>(5)</enum> <header>Criteria air pollutant</header> <text>The term <term>criteria air pollutant</term> is within the meaning of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>).</text> </paragraph> <paragraph id="HC979E925200B4AB3BC178F93C08B4C34"> <enum>(6)</enum> <header>Exclusive economic zone</header> <text>The term <term>exclusive economic zone</term> has the meaning given the term in section 107 of title 46, United States Code.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H842A9EE6867240998E30A202011720CA"> <enum>(7)</enum> <header>Final port of call</header> <text>The term <term>final port of call</term>, with respect to a covered voyage, means, as applicable—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HD000ADDFBA9C4890BC77A8EF64B1C049"> <enum>(A)</enum> <text display-inline="yes-display-inline">the port in the United States where the vessel making the covered voyage offloaded the last of the cargo or freight of the vessel ultimately bound for the United States that was onboard the vessel on departure from the port of origin; or</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H9B74522E21F74069AC226F603029DDE5"> <enum>(B)</enum> <text>if the last of the cargo or freight of the vessel ultimately bound for the United States that was onboard the vessel on departure from the port of origin is offloaded in a foreign port, the most recent port of call in the United States prior to offloading the last of the cargo or freight of the vessel that is ultimately bound for the United States.</text> </subparagraph> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H2DE107FDA70C47E286A077BB61E59BB5"> <enum>(8)</enum> <header>Importer</header> <text>The term <term>importer</term> means 1 of the parties that qualifies as an importer of record under section 484(a)(2)(B) of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1484">19 U.S.C. 1484(a)(2)(B)</external-xref>).</text> </paragraph> 
<paragraph id="H801CFB9123F640CD98EFF01C01269AD6"> <enum>(9)</enum> <header>Intermediate port</header> <text>The term <term>intermediate port</term>, with respect to a covered voyage, means each foreign port of call of the vessel of the covered voyage between the port of origin and the initial port of call of the vessel in the United States.</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HE1D2FE3C339F46F2BECC62EEAA686D8A"> <enum>(10)</enum> <header>Internal waters</header> <text>The term <term>internal waters</term> has the meaning given the term in section 2.24 of title 33, Code of Federal Regulations (or successor regulations).</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HB890DE09A4114DAFAAA0BA2F4B91E902"> <enum>(11)</enum> <header>Jones Act vessel</header> <text>The term <term>Jones Act vessel</term> means a documented vessel (as defined in section 106 of title 46, United States Code) with a coastwise endorsement under section 12112 of that title.</text> </paragraph> <paragraph id="HAF059FED0CF74C3AB7B81B155DE6A884"> <enum>(12)</enum> <header>Port of origin</header> <subparagraph commented="no" display-inline="no-display-inline" id="H229F5F21DE0144DDAA48D621130B819A"> <enum>(A)</enum> <header>In general</header> <text display-inline="yes-display-inline">The term <term>port of origin</term>, with respect to a covered voyage, means the first port of the vessel making the covered voyage after departing which a majority (by mass) of the cargo or freight of the vessel is ultimately bound for the United States.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HB0A17A42462E4E2B934CED94180D2C32"> <enum>(B)</enum> <header>Clarification</header> <text>In the case in which a vessel, after departing a final port of call for a covered voyage, is carrying cargo the majority (by mass) of which is ultimately bound for the United States—</text> <clause commented="no" display-inline="no-display-inline" id="H2BD2CA286A5A4D1788F1C3ADAC9C8EB4"> <enum>(i)</enum> <text display-inline="yes-display-inline">the vessel shall be considered to be making a new covered voyage; and</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="HD75A35807C7E459CB4DDB756B655C5EA"> <enum>(ii)</enum> <text display-inline="yes-display-inline">the term <term>port of origin</term> for the new covered voyage shall be considered to be the same as the final port of call for the previous covered voyage.</text> </clause> </subparagraph> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H6DBF7CB86C7B451ABBFC4CD6987C51FD"> <enum>(13)</enum> <header>Territorial sea</header> <text>The term <term>territorial sea</term> has the meaning given the term in section 2.22 of title 33, Code of Federal Regulations (or successor regulations).</text> </paragraph> 
<paragraph id="H7A0AA882AEC043008E888B4D2336A07A"> <enum>(14)</enum> <header>Ultimately bound for the United States</header> <text>The term <term>ultimately bound for the United States</term>, with respect to cargo or freight, includes—</text> <subparagraph id="HFAC5103D022C48F3811CF9331C023170"> <enum>(A)</enum> <text>all cargo or freight that is offloaded in the United States by a vessel making a covered voyage; and</text> </subparagraph> 
<subparagraph id="HF01B595F36874540A7692E15C61861A7"> <enum>(B)</enum> <text>all cargo or freight that is—</text> <clause id="H7C524D93AF604CEDAD08FAA335CE6BBE"> <enum>(i)</enum> <text>initially offloaded at an intermediate port; and</text> </clause> 
<clause id="HB26A5E5086504F02ADB43B4CCC85C6AD"> <enum>(ii)</enum> <text>subsequently transported to the United States by sea, land, or air.</text> </clause> </subparagraph> </paragraph> </section> <section id="HF762FAFB32A84A028952274C7F22E36D"> <enum>4.</enum> <header>Reporting requirements</header> <subsection id="HFC631F2FFBBF46E1B51B9FDA42AB84C7"> <enum>(a)</enum> <header>In general</header> <text>Beginning on January 1, 2027, the operator of each covered voyage shall submit to the Administrator the information described in subsection (b).</text> </subsection> 
<subsection id="H9A124C7D9EE545C5A3A38434DC1703AD"> <enum>(b)</enum> <header>Information described</header> <text>The information referred to in subsection (a), with respect to a covered voyage, is—</text> <paragraph id="HC5F68B62522D4FCF8C12F0103AECE6E5"> <enum>(1)</enum> <text>the port of origin;</text> </paragraph> 
<paragraph id="H09E1E323C1D54B78869B2F91A6AA5965"> <enum>(2)</enum> <text>the total distance traveled from the port of origin to the final port of call;</text> </paragraph> <paragraph id="H02030F81569543298F1EAA79D0A8526B"> <enum>(3)</enum> <text>the total time spent traveling between the port of origin and the final port of call;</text> </paragraph> 
<paragraph id="H09FB28026FC441C7ADB50C19232ABEB8"> <enum>(4)</enum> <text>the total mass of each type of fuel consumed between the port of origin and the final port of call;</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HA05BDE2722404CFAA994F81392177A08"> <enum>(5)</enum> <text>the total mass of cargo or freight transported between the port of origin and the final port of call;</text> </paragraph> 
<paragraph id="H5D9B96F370E14A7DA0321F660C05A347"> <enum>(6)</enum> <text>each port of call in the United States;</text> </paragraph> <paragraph id="HB25011A8A5E74C209FA0E457D371E3EB"> <enum>(7)</enum> <text>each intermediate port;</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HDF69180F99CF4F7CA56B12FCCA6A5F8D"> <enum>(8)</enum> <text>the final port of call;</text> </paragraph> <paragraph id="H1D7DA6EA2C6B44DEB712E3FFC828B092"> <enum>(9)</enum> <text>the mass of cargo or freight on board the applicable vessel on leaving the port of origin;</text> </paragraph> 
<paragraph id="H85F4B32F42D44004BF3D818E50EAEE0E"> <enum>(10)</enum> <text>the percentage of cargo or freight (by mass) offloaded or onloaded at any intermediate port, as compared to the capacity of the applicable vessel and the load of the applicable vessel;</text> </paragraph> <paragraph id="H971633E8281549CAB7EFE1C760CB0893"> <enum>(11)</enum> <text>the ultimate destination (by country) of cargo or freight offloaded at intermediate ports;</text> </paragraph> 
<paragraph id="H9174DEA33FDE4B53AF4E0F0B85F98864"> <enum>(12)</enum> <text>the mass of cargo or freight on board the applicable vessel on arrival at or departure from, as applicable, each port of call in the United States;</text> </paragraph> <paragraph id="HA442D73F774C4B72979BCFB31AFD3C43"> <enum>(13)</enum> <text>the total time spent in each port of call in the United States;</text> </paragraph> 
<paragraph id="HB3DB7607051D44859B6A2B9E2444FCD7"> <enum>(14)</enum> <text>the total period of time that the applicable vessel is connected to and reliant on the electrical grid while in port at a port of call in the United States;</text> </paragraph> <paragraph id="H585AA3C953C441A791266506E58A95A4"> <enum>(15)</enum> <text>the total mass of each type of fuel consumed—</text> 
<subparagraph id="HD78048831E674769B586C162691AA448"> <enum>(A)</enum> <text>in any port of call in the United States; and</text> </subparagraph> <subparagraph id="H5DF69DB979FA4895B717307B3A35A7D8"> <enum>(B)</enum> <text>within the exclusive economic zone, the territorial sea, and the internal waters of the United States;</text> </subparagraph> </paragraph> 
<paragraph id="HC1A5645CC1C2446F86577419209126EF"> <enum>(16)</enum> <text>the total period of time spent—</text> <subparagraph id="H8FE34FDF3C25455D965EE8B1B6CC54A2"> <enum>(A)</enum> <text>north of 60 degrees north latitude; or</text> </subparagraph> 
<subparagraph id="H79555282E08347B3808948D7E1F18020"> <enum>(B)</enum> <text>south of 60 degrees south latitude;</text> </subparagraph> </paragraph> <paragraph id="HA7DD61F2D9A3441EBBAABA1A91E57ACD"> <enum>(17)</enum> <text>for each period described in paragraph (16), the total mass of each type of fuel consumed during that period; and</text> </paragraph> 
<paragraph id="H19EBBF6534724F2099FC00028F10A523"> <enum>(18)</enum> <text>any other information that the Administrator determines is necessary to accurately determine the amount of the fees assessed under sections 5 and 6.</text> </paragraph> </subsection> <subsection id="H3F86A4C894804CBCAEAB07F46AA8519E"> <enum>(c)</enum> <header>Deadline</header> <text>The operator of a covered voyage shall submit the information required under subsection (a) for each covered voyage of the operator that ended during a calendar quarter by not later than 30 days after the end of that calendar quarter.</text> </subsection> </section> 
<section id="H22DD031F3132476399C4DBA7769709FD"> <enum>5.</enum> <header>Fee on lifecycle carbon dioxide-equivalent emissions from cargo vessels</header> 
<subsection id="HE9630DC9130A4AA49C91CAD4C75E9A2D"> <enum>(a)</enum> <header>Lifecycle CO<subscript>2</subscript>–e emissions profile for maritime fuels</header> <text>Not later than January 1, 2027, the Administrator shall develop a lifecycle carbon dioxide-equivalent (CO<subscript>2</subscript>–e) emissions profile for each fuel used in maritime shipping to express the emissions from the combustion of that fuel in carbon dioxide-equivalent per unit mass combusted.</text> </subsection> <subsection id="HC6732E0C3D1C45A48BFCAFB7DD84DFCB"> <enum>(b)</enum> <header>Assessment of fee</header> <paragraph id="HF5ED58EE1CCB4150A4C649E190967C17"> <enum>(1)</enum> <header>In general</header> <text>Beginning on January 1, 2027, not later than 30 days after the date on which the Administrator receives from the operator of a covered voyage the information required to be submitted under section 4(a), the Administrator shall assess on the operator a fee with respect to the covered voyage in an amount determined in accordance with paragraph (2).</text> </paragraph> 
<paragraph id="HFD93D6040856433D8265800E1AC26A50"> <enum>(2)</enum> <header>Amount of fee</header> 
<subparagraph id="H4D758156695148DA9E910EF2A03D03E9"> <enum>(A)</enum> <header>In general</header> <text>Subject to subparagraph (B) and subsection (d), the amount of a fee assessed under paragraph (1) with respect to a covered voyage shall be the total sum of, for each type of fuel consumed during the covered voyage, the product obtained by multiplying—</text> <clause id="HF8AA3530894B49188849C4978032E071"> <enum>(i)</enum> <text>the total mass of the fuel consumed during the covered voyage;</text> </clause> 
<clause id="H8BE6D29C30F44BFB8B18320194526E33"> <enum>(ii)</enum> <text>the carbon dioxide-equivalent emissions of the fuel, expressed in metric tons per unit mass of fuel consumed, as determined under subsection (a); and</text> </clause> <clause id="H143F46179C7A4B3C8685A3AE3126DC68"> <enum>(iii)</enum> <text>$150.</text> </clause> </subparagraph> 
<subparagraph id="HCA1B57FE7FBE4BDC9F50E39838273CDB"> <enum>(B)</enum> <header>Adjustments</header> 
<clause id="H281C5DA38FB64B98B5338DF6821D9D53"> <enum>(i)</enum> <header>Inflation</header> <text>Beginning in calendar year 2028, the Administrator shall annually increase the amount described in subparagraph (A)(iii) by the percentage that is equal to the sum obtained by adding—</text> <subclause id="H86273348CD0F4994A5F8873A17FEA924"> <enum>(I)</enum> <text>the rate of inflation, as determined by the Administrator using the changes for the 12-month period ending the preceding November 30 in the Consumer Price Index for All Urban Consumers published by the Bureau of Labor Statistics of the Department of Labor; and</text> </subclause> 
<subclause id="H752D28AD6942471F882DA0E1EE2E9C92"> <enum>(II)</enum> <text>5 percentage points.</text> </subclause> </clause> <clause id="HB0400353FA194B01BC331AACEAC975C0"> <enum>(ii)</enum> <header>Voyages in polar regions</header> <text>For any portion of a covered voyage that involves travel north of 60 degrees north latitude or south of 60 degrees south latitude, the amount described in subparagraph (A)(iii) with respect to fuel consumed during that portion of the voyage, after adjustment under clause (i), if applicable, shall be tripled.</text> </clause> 
<clause id="H481158ABCFA843C2B4F404CEE3D9E14C"> <enum>(iii)</enum> <header>Crediting amounts paid under global economic measure</header> 
<subclause commented="no" display-inline="no-display-inline" id="H7F25FFC826024A9F9DF276B2340F2F18"> <enum>(I)</enum> <header>Definitions</header> <text>In this clause:</text> <item commented="no" display-inline="no-display-inline" id="H1A67A284FDFF401D8EF06F8B5276AA71"> <enum>(aa)</enum> <header>Annex VI</header> <text>The term <term>Annex VI</term> means Annex VI of the International Convention for the Prevention of Pollution from Ships, 1973 (if amended in a substantially similar manner, as determined by the Administrator, to the draft regulations described in Circular Letter No. 5005 of the International Maritime Organization, dated April 11, 2025).</text> </item> 
<item commented="no" display-inline="no-display-inline" id="H950626E5405B43A9AF1CB0C622A39720"> <enum>(bb)</enum> <header>Remedial unit; surplus unit</header> <text>The terms <term>remedial unit</term> and <term>surplus unit</term> have the meanings given those terms under section 3 of Regulation 2 of Annex VI.</text> </item> </subclause> <subclause commented="no" display-inline="no-display-inline" id="H2E0199972CF0487DA6A8AF6330AE50F5"> <enum>(II)</enum> <header>Adjustment</header> <text display-inline="yes-display-inline">For any carbon dioxide-equivalent emissions resulting from a covered voyage for which the operator owes a fee under Annex VI, or would owe a fee under Annex VI but for any surplus units obtained by the operator for the covered voyage, the amount described in subparagraph (A)(iii), after adjustment under clauses (i) and (ii), if applicable, shall be reduced by the applicable Tier 1 or Tier 2 remedial unit cost owed by the operator, or that would be owed by the operator but for the surplus units, for that portion of the covered voyage under Annex VI.</text> </subclause> </clause> </subparagraph> </paragraph> 
<paragraph id="HF61E1682D1D243A495346F6394B0C482"> <enum>(3)</enum> <header>Deadline</header> <text>A fee assessed under paragraph (1) shall be due and payable to the Administrator not later than the later of—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HE61219B7F5D6453394420D40D13A036E"> <enum>(A)</enum> <text display-inline="yes-display-inline">the date that is 30 days after the date on which the fee is assessed; and</text> </subparagraph>

<subparagraph commented="no" display-inline="no-display-inline" id="H8A5D13BCD219432B90880C1F8C23F72A"> <enum>(A)</enum> <text display-inline="yes-display-inline">the amount of the fee shall be increased by 20 percent; and</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H773B21BAC566406E9BCA8D8C50B5EC9C"> <enum>(B)</enum> <text>for each consecutive 30-day period beginning after the date described in paragraph (3), the amount of the fee shall be increased by an additional 20 percent until the date on which the fee is paid to the Administrator.</text> </subparagraph> </paragraph> </subsection> 
<subsection id="HC73FD6CDF65C40F4B60FC39A09D27D39"> <enum>(c)</enum> <header>Alternate fee for imported cargo</header> 
<paragraph id="H1F9A1A8B8AEE4EE492567C57E45A584D"> <enum>(1)</enum> <header>Definition of qualified importing voyage</header> <text>In this subsection, the term <term>qualified importing voyage</term> means a voyage made using a vessel—</text> <subparagraph id="HABA51CA135A3453B8DA6194DB7559415"> <enum>(A)</enum> <text>the primary purpose of which is transporting cargo or freight; and</text> </subparagraph> 
<subparagraph id="H64C161C951B04EBEB2D0A7240509E6D9"> <enum>(B)</enum> <text>that, at a foreign port of call, offloads cargo or freight that is ultimately intended to be transported to the United States by sea, land, or air.</text> </subparagraph> </paragraph> <paragraph id="H6D7016A34D9547FB988BC926878C4442"> <enum>(2)</enum> <header>Requirements</header> <subparagraph id="H69A87D9C51D1472B8618F2F7E5C4D753"> <enum>(A)</enum> <header>Reporting</header> <clause id="H97F705D4F9B84E499C82588C95451AF3"> <enum>(i)</enum> <header>In general</header> <text>Beginning on January 1, 2027, each importer for which a qualified importing voyage has cargo or freight that is bound for the United States shall submit to the Administrator the information described in subsection (b) of section 4 in accordance with that section (except as otherwise provided in clause (ii)).</text> </clause> 
<clause id="H44A9346C2EBD4C68AA6596C511EF0754"> <enum>(ii)</enum> <header>Treatment</header> <text>For purposes of clause (i), any reference contained in section 4(b) to—</text> <subclause id="H65260D0F3648462BAC81A620E8FEF8B1"> <enum>(I)</enum> <text>the <quote>final port of call</quote> shall be considered to be a reference to the foreign port of call within which the cargo or freight of the importer was offloaded from the vessel;</text> </subclause> 
<subclause id="HFEB97E81E2CC4B1DBC5E116F6329428B"> <enum>(II)</enum> <text>the <quote>covered voyage</quote> shall be considered to be a reference to the qualified importing voyage; and</text> </subclause> <subclause id="H5802C9D7B5CB461CA3898710E6AC80F9"> <enum>(III)</enum> <text>the <quote>port of origin</quote> shall be considered to be a reference to the port at which the cargo or freight bound for the United States was onboarded.</text> </subclause> </clause> </subparagraph> 
<subparagraph id="H116B9A611194447CB7B38C133F81434A"> <enum>(B)</enum> <header>Fee</header> 
<clause id="HB8D329E8EE3B4B5E87FF71481723D35E"> <enum>(i)</enum> <header>In general</header> <text>Beginning on January 1, 2027, not later than 30 days after the date on which the Administrator receives from an importer described in subparagraph (A)(i) the information required to be submitted under that subparagraph, the Administrator shall assess on the importer the fee described in subsection (b) in accordance with that subsection, but the amount of that fee shall be adjusted as follows:</text> <subclause commented="no" display-inline="no-display-inline" id="H53761D3493204372B99E106B94764F36"> <enum>(I)</enum> <text>The amount of the fee shall be prorated for the share (by mass) of the cargo or freight on the vessel making the qualified importing voyage that is ultimately bound for the United States that is being imported by the importer.</text> </subclause> 
<subclause commented="no" display-inline="no-display-inline" id="HA56549D7AA80493097125D48E27EDBAA"> <enum>(II)</enum> <text>After the adjustment described in subclause (I), the amount of the fee shall be reduced by the amount of the fee, if any, otherwise assessed on the qualified importing voyage pursuant to subsection (b).</text> </subclause> </clause> <clause id="HA0138D31BB2A4EEB87E66CFD53EB2110"> <enum>(ii)</enum> <header>Treatment</header> <text>For purposes of clause (i), any reference in subsection (b) to the <quote>covered voyage</quote> shall be considered to be a reference to the qualified importing voyage.</text> </clause> </subparagraph> 
<subparagraph id="H55701EB14B564A3594C0A82DB883D694"> <enum>(C)</enum> <header>Enforcement</header> <text>An importer described in subparagraph (A)(i) may not import the cargo or freight from a qualified importing voyage into the United States until the importer—</text> <clause id="H9D16BED07B524EE3BCA4A7E3C3B76A89"> <enum>(i)</enum> <text>submits the information required under subparagraph (A); and</text> </clause> 
<clause id="HC3C23001D9B342B5AE3D21EBEEC7CBB7"> <enum>(ii)</enum> <text>pays the fee assessed under subparagraph (B).</text> </clause> </subparagraph> </paragraph> </subsection> <subsection commented="no" display-inline="no-display-inline" id="HADB31969EAF24D87A15CC96FCF6843B5"> <enum>(d)</enum> <header>Recognition of foreign pollution fees</header> <text>If a vessel with cargo or freight ultimately bound for the United States, or an operator of such a vessel, is subject to a pollution-based fee by the country of the port of origin of the vessel, any fee assessed on the operator of the vessel or an importer with cargo or freight on that vessel under this section shall be—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H65C196EBD61B4449A5683F3E51D8BFC4"> <enum>(1)</enum> <text>if the fee from the other country is equal to or more than 50 percent of the fee that would otherwise be assessed under this section, reduced by 50 percent; and</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H0B68F467CA674017B67C89EB5ABF7A71"> <enum>(2)</enum> <text>if the fee from the other country is less than 50 percent of the fee that would otherwise be assessed under this section, reduced by an amount equal to the amount of the fee from the other country.</text> </paragraph> </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HB77AF5FE2C4E4FF7B298098C9128F082"> <enum>(e)</enum> <header>Sunset provision</header> <text>This section ceases to apply on the date on which the Administrator publishes in the Federal Register a determination that the International Maritime Organization or another agency of the United Nations has instituted and is enforcing a global fee on lifecycle carbon dioxide-equivalent emissions from operators of covered voyages that is in an amount equal to or greater than the fees assessed for a covered voyage under this section.</text> </subsection> </section> <section commented="no" display-inline="no-display-inline" id="H3F5D3B79FE63487FBCED152F85AA6B8C"> <enum>6.</enum> <header>Fees on criteria air pollutants</header> <subsection commented="no" display-inline="no-display-inline" id="HC54F780A6D94435A87B0D0F6C4D71C93"> <enum>(a)</enum> <header>Emissions profile</header> <text>Not later than January 1, 2027, the Administrator shall develop a lifecycle emissions profile for each fuel used in maritime shipping to express the emissions from the combustion of that fuel of each of nitrogen oxides, sulfur dioxide, and fine particulate matter (PM<subscript>2.5</subscript>) per unit mass combusted.</text> </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H5EF964771E4F4E7DB145BC9EACC42CE3"> <enum>(b)</enum> <header>Assessment of fee</header> 
<paragraph id="H6BA98A187FE547D6A37C5EFAC448E293"> <enum>(1)</enum> <header>In general</header> <text>Beginning on January 1, 2027, not later than 30 days after the date on which the Administrator receives from the operator of a covered voyage the information required to be submitted under section 4(a), the Administrator shall assess on the operator a fee with respect to the covered voyage in an amount determined in accordance with paragraph (2).</text> </paragraph> <paragraph id="H3F3ED1AEE5B34CCC937CC3029071935A"> <enum>(2)</enum> <header>Amount of fee</header> <subparagraph id="HDEDD0B9AEDE04D43BBA32E3204B174AC"> <enum>(A)</enum> <header>In general</header> <text>Subject to subparagraph (B), the amount of a fee assessed under paragraph (1) shall be the total sum of, for each type of fuel consumed during the covered voyage—</text> 
<clause id="H3075BB82240243BE8B7117076D96E637"> <enum>(i)</enum> <text>the product obtained by multiplying—</text> <subclause id="H9F4B1B674A1B4AA9A825EBE6AF3ADD5C"> <enum>(I)</enum> <text>the total mass of the fuel consumed during the covered voyage within the exclusive economic zone, the territorial sea, and the internal waters of the United States;</text> </subclause> 
<subclause id="HA408ACA4EABA4B308AC61105353E9F50"> <enum>(II)</enum> <text>the quantity of nitrogen oxides emitted by the consumption of the fuel, expressed in pounds per unit mass of fuel consumed, as determined under subsection (a); and</text> </subclause> <subclause id="H9E81E03EEC2A4B28BC9A54E8C2D83562"> <enum>(III)</enum> <text>$6.30;</text> </subclause> </clause> 
<clause id="H0F4DA77B25674C79B8EA4F36D7AD7990"> <enum>(ii)</enum> <text>the product obtained by multiplying—</text> <subclause id="H2582DA086C9C45359F9CEA3B017A3B70"> <enum>(I)</enum> <text>the total mass of the fuel consumed during the covered voyage within the exclusive economic zone, the territorial sea, and the internal waters of the United States;</text> </subclause> 
<subclause id="HAE11E371DDBE4F97B0C1DA46FFBB67BC"> <enum>(II)</enum> <text>the quantity of sulfur dioxide emitted by the consumption of the fuel, expressed in pounds per unit mass of fuel consumed, as determined under subsection (a); and</text> </subclause> <subclause commented="no" display-inline="no-display-inline" id="HF2705A85D32F4E9DB8FC6F9589BB4AB7"> <enum>(III)</enum> <text>$18; and</text> </subclause> </clause> 
<clause commented="no" display-inline="no-display-inline" id="H778888A554744C718E0A537AF4107AC6"> <enum>(iii)</enum> <text>the product obtained by multiplying—</text> <subclause id="H07E15DD805524434A3576E5B11BF3A1C"> <enum>(I)</enum> <text>the total mass of the fuel consumed during the covered voyage within the exclusive economic zone, the territorial sea, and the internal waters of the United States;</text> </subclause> 
<subclause id="HBD7231E9CAB44F1DA624B85C270480E8"> <enum>(II)</enum> <text>the quantity of fine particulate matter emitted by the consumption of the fuel, expressed in pounds per unit mass of fuel consumed, as determined under subsection (a); and</text> </subclause> <subclause commented="no" display-inline="no-display-inline" id="H1C7FF7D7754647D9B5E2A5E6E4D2F6DF"> <enum>(III)</enum> <text>$38.90.</text> </subclause> </clause> </subparagraph> 
<subparagraph id="H490203385E32476FB83DC351138DEEAC"> <enum>(B)</enum> <header>Inflation adjustment</header> <text>Beginning in calendar year 2028, the Administrator shall annually increase the amounts described in clauses (i)(III), (ii)(III), and (iii)(III) of subparagraph (A) by the percentage that is equal to the sum obtained by adding—</text> <clause id="H9F0B5695D11D4B538E076A7931FCA681"> <enum>(i)</enum> <text>the rate of inflation, as determined by the Administrator using the changes for the 12-month period ending the preceding November 30 in the Consumer Price Index for All Urban Consumers published by the Bureau of Labor Statistics of the Department of Labor; and</text> </clause> 
<clause id="HB9DF52463D3F471995A0504DC1BC362A"> <enum>(ii)</enum> <text>5 percentage points.</text> </clause> </subparagraph> </paragraph> <paragraph id="HCAAFEE5D56B241ED859C6FA3F05A1A7D"> <enum>(3)</enum> <header>Deadline</header> <text>A fee assessed under paragraph (1) shall be due and payable to the Administrator not later than the later of—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H0FACE5F0F2DE4A5CAC9EFB0E9D4B8317"> <enum>(A)</enum> <text display-inline="yes-display-inline">the date that is 30 days after the date on which the fee is assessed; and</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HCC39AA3B591242CEA39B5FD535ABD2B4"> <enum>(B)</enum> <text>the end of the calendar year in which the fee is assessed.</text> </subparagraph> </paragraph> 
<paragraph id="H257AB82DB9B24DCEA13245E777F47DC5"> <enum>(4)</enum> <header>Penalty</header> <text display-inline="yes-display-inline">If an operator fails to pay a fee assessed under paragraph (1) by the date described in paragraph (3)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H8D320F9B33D145A69F68D916D35359C1"> <enum>(A)</enum> <text display-inline="yes-display-inline">the amount of the fee shall be increased by 20 percent; and</text> </subparagraph> 
<subparagraph id="H1B4760A9E0DB450BB70273D35EA9ECAA" commented="no" display-inline="no-display-inline"> <enum>(B)</enum> <text>for each consecutive 30-day period beginning after the date described in paragraph (3), the amount of the fee shall be increased by an additional 20 percent until the date on which the fee is paid to the Administrator.</text> </subparagraph> </paragraph> </subsection> </section> <section commented="no" display-inline="no-display-inline" id="HEB96CF2E7D324E7082182B55D0FB8158"> <enum>7.</enum> <header>Decarbonizing shipping and ports</header> <subsection commented="no" display-inline="no-display-inline" id="HA6CDC6DE19AF4FD687F2CDDFEE31FA6A"> <enum>(a)</enum> <header>Modernizing the Jones Act fleet</header> <paragraph commented="no" display-inline="no-display-inline" id="HCFC8927377294536A6804B81A370CE66"> <enum>(1)</enum> <header>Definitions</header> <text>In this subsection:</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HA63BC3F3783C4CB7AB7DAD78E41C16C9"> <enum>(A)</enum> <header>Administrator</header> <text>The term <term>Administrator</term> means the Administrator of the Maritime Administration.</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H7C2D9EFED12048D983AA2B155A39A9AF"> <enum>(B)</enum> <header>Low-carbon fuel</header> <text display-inline="yes-display-inline">The term <term>low-carbon fuel</term> means a marine fuel the lifecycle carbon dioxide-equivalent emissions of which is at least 90 percent less than the lifecycle carbon dioxide-equivalent emissions of marine fuel oil.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HDA25DEAD7F574A67832CF76C07B40CBE"> <enum>(C)</enum> <header>Program</header> <text>The term <term>program</term> means the program established under paragraph (2).</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H6117826310174924880034BFF5290BAB"> <enum>(D)</enum> <header>Vessel of the United States</header> <text>The term <term>vessel of the United States</term> has the meaning given the term in section 116 of title 46, United States Code.</text> </subparagraph> </paragraph> 
<paragraph id="H40F0F22B48454283B9790C6CF4868D6F"> <enum>(2)</enum> <header>Establishment</header> <text>For fiscal year 2029 and each fiscal year thereafter, there are appropriated, out of any funds in the Treasury not otherwise appropriated, to the Maritime Administration an amount equal to 25 percent of the amounts collected pursuant to fees assessed under sections 5 and 6 during the previous calendar year to award grants, rebates, and low-interest loans, as determined appropriate by the Administrator, to eligible entities—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H04CC0EAB2DF6441AA3D7C7A201F674B2"> <enum>(A)</enum> <text display-inline="yes-display-inline">to replace existing Jones Act vessels that use marine fuel oil for propulsion power with vessels that are exclusively propelled using batteries, low-carbon fuels, or other zero-emissions technologies; or</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HF89C4DE7C36840DDAF14474BE79B3C56"> <enum>(B)</enum> <text>to retrofit existing Jones Act vessels that use marine fuel oil for propulsion power into vessels that are exclusively propelled using batteries, low-carbon fuels, or other zero-emissions technologies.</text> </subparagraph> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HB01E67D216F2487F882C1B0E76CB7B14"> <enum>(3)</enum> <header>Modeled off Diesel Emissions Reduction Act</header> <text>To the extent practicable, the Administrator shall develop an application process, provide public notification, inform eligible entities of zero-emissions technologies, and submit to Congress an evaluation and report on the efficacy of the program in a manner similar to the national grant program of the Administrator of the Environmental Protection Agency under subtitle G of title VII of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16131">42 U.S.C. 16131 et seq.</external-xref>).</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H9D1E18E125DD4CFA859C9041791A0E58"> <enum>(4)</enum> <header>Eligible entities</header> <text>An entity eligible for an award under the program is an owner of a Jones Act vessel that currently uses marine fuel oil for propulsion power.</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H57E99F000A9B412082A7B0063A7F42EE"> <enum>(5)</enum> <header>Selection</header> <subparagraph id="H4875C9D8A2E945ED8C71BE71A2A964CA"> <enum>(A)</enum> <header>Application</header> <text>An eligible entity seeking an award under the program shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator may require, which shall include a certification that an award under the program will be used, as applicable—</text> 
<clause commented="no" display-inline="no-display-inline" id="H80788A39339643A49C8DB07A19BF5E1B"> <enum>(i)</enum> <text display-inline="yes-display-inline">to purchase, or enter into a contract for the construction of, a vessel that exclusively uses a battery or low-carbon fuels for all propulsion power; or</text> </clause> <clause commented="no" display-inline="no-display-inline" id="H17A76997CB15482093B0B9CB0CD11B95"> <enum>(ii)</enum> <text>to retrofit an existing Jones Act vessel that uses marine fuel oil for propulsion power into a vessel that is propelled using batteries or low-carbon fuels.</text> </clause> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H1121750727EA4361A9403E7E8C80A961"> <enum>(B)</enum> <header>Priority</header> <text>In selecting the recipients of awards under the program, the Administrator shall give priority to entities the replacement or retrofit of whose vessels would—</text> <clause commented="no" display-inline="no-display-inline" id="H9CD21032F1004260B029A796D4191D04"> <enum>(i)</enum> <text>maximize the reduction of greenhouse gas emissions;</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="H0DB5281FAEC14723ABB167AF46309600"> <enum>(ii)</enum> <text>maximize the public health benefits from the reduction of criteria air pollutants;</text> </clause> <clause commented="no" display-inline="no-display-inline" id="HF089C0993A214D239220F3F6476C6695"> <enum>(iii)</enum> <text>maximize water quality in ports and other bodies of water;</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="HB615334E4C1B43819058014954541EDD"> <enum>(iv)</enum> <text>maximize public health and environmental benefits from every dollar spent under the program; and</text> </clause> <clause id="H47D457378EA946EFA571BFF3F7C5BAF7"> <enum>(v)</enum> <text>alleviate air pollution in poor air quality areas, including—</text> 
<subclause commented="no" display-inline="no-display-inline" id="H9F7FF50E40BD4FBB96F3C8B23E014C57"> <enum>(I)</enum> <text display-inline="yes-display-inline">areas identified by the Administrator of the Environmental Protection Agency as in nonattainment or maintenance of national ambient air quality standards promulgated under section 109 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409</external-xref>) for criteria air pollutants; and</text> </subclause> <subclause commented="no" display-inline="no-display-inline" id="H19AA8784FDA24425BBEA253C8140E934"> <enum>(II)</enum> <text>other areas that receive a disproportionate quantity of air pollution, as determined by the Administrator of the Environmental Protection Agency.</text> </subclause> </clause> </subparagraph> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H21D4C3A39FBD48B6A378A39B5DA408E7"> <enum>(6)</enum> <header>Clawback</header> <text>If the Administrator determines that the recipient of an award under the program has violated the certification required under paragraph (5)(A), the Administrator shall seek reimbursement of the full amount of the award provided to the recipient.</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H39554217203A4761948093419627AA83"> <enum>(7)</enum> <header>Modernizing vessels of the United States</header> <text>If the Administrator determines that no existing Jones Act vessels are eligible to receive funding under the program, for the duration of that determination, paragraphs (2) through (6) shall be applied by substituting <quote>vessel of the United States</quote> for <quote>Jones Act vessel</quote>.</text> </paragraph> 
<paragraph id="HB83CB41646BB4DC68A1B1FBC9939A6AB"> <enum>(8)</enum> <header>Program administration</header> <text>Of the amounts made available under paragraph (2) each fiscal year, the Administrator may use not more than 1 percent for the management and oversight of the program.</text> </paragraph> </subsection> <subsection id="HAEBE47C9D00F403385ECA5FA71333B2D"> <enum>(b)</enum> <header>Research and development for low-Carbon maritime fuels and low-Emission maritime technologies</header> <paragraph commented="no" display-inline="no-display-inline" id="HD4B4102467F74F11BA3858CA714771E4"> <enum>(1)</enum> <header>Definition of eligible entity</header> <text display-inline="yes-display-inline">In this subsection, the term <quote>eligible entity</quote> means—</text> 
<subparagraph id="HFE65EF89E6594299AF567096FE7F37AC"> <enum>(A)</enum> <text>a State (including the District of Columbia and territories of the United States), regional, local, or Tribal government;</text> </subparagraph> <subparagraph id="H6A7CCE33EDFC42F1B828A825B0F15B75"> <enum>(B)</enum> <text>a maritime shipping or logistics company;</text> </subparagraph> 
<subparagraph id="HDEBF19235A4343D1880CF95762501717"> <enum>(C)</enum> <text>a port authority;</text> </subparagraph> <subparagraph id="H262FBEB35D7C4A8BA5ED13A3C3340C1D"> <enum>(D)</enum> <text>an accredited institution of higher education;</text> </subparagraph> 
<subparagraph id="H14AC9AA5062044B19B62E46045C80D6F"> <enum>(E)</enum> <text>a research institution;</text> </subparagraph> <subparagraph id="H71CF144BC1DC47BEADD5C0C3CA40B492"> <enum>(F)</enum> <text>a person engaged in the production, transportation, blending, or storage of sustainable maritime fuel in the United States or feedstocks in the United States that may be used to produce sustainable maritime fuel;</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H17AC7BB5E8D1406385674BD606C3876E"> <enum>(G)</enum> <text display-inline="yes-display-inline">a person engaged in the development, demonstration, or application of low-emission maritime technologies; and</text> </subparagraph> <subparagraph id="H9F2661DF90754322BD01624FFFFAD745"> <enum>(H)</enum> <text>a nonprofit entity or nonprofit consortium with experience in sustainable maritime fuels, low-emission maritime technologies, or other clean transportation research programs.</text> </subparagraph> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H3200125242A2433BAE5FA681B50E8AE6"> <enum>(2)</enum> <header>Establishment</header> <text>For fiscal year 2029 and each fiscal year thereafter, there are appropriated, out of any funds in the Treasury not otherwise appropriated, to the Department of Energy an amount equal to 25 percent of the amounts collected pursuant to fees assessed under sections 5 and 6 during the previous calendar year to award competitive grants to eligible entities to carry out projects in the United States—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HEB089F6500D34E9BBD1BB7982AD97EA5"> <enum>(A)</enum> <text display-inline="yes-display-inline">to produce, transport, blend, or store low-carbon maritime fuels; or</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H8E0FDC327DFB42CB925D020B92801893"> <enum>(B)</enum> <text display-inline="yes-display-inline">to develop, demonstrate, or apply low-emission maritime technologies.</text> </subparagraph> </paragraph> <paragraph id="H0DF5CA08E3E3444AA77C493F95945F49"> <enum>(3)</enum> <header>Priority</header> <text>In awarding grants under the program established under paragraph (2), the Secretary of Energy shall give priority to projects that maximize—</text> 
<subparagraph id="HAA94DD47D462467D8DD7BF3E0CFC22DF"> <enum>(A)</enum> <text>the domestic production and deployment of sustainable maritime fuels or the use of low-emission maritime technologies in commercial maritime;</text> </subparagraph> <subparagraph id="H5085C48896BA423F9BB1F9BDBDE5423A"> <enum>(B)</enum> <text>reductions in greenhouse gas emissions;</text> </subparagraph> 
<subparagraph id="H4A65C75F8B5E4D7F9096C55ED815BB8A"> <enum>(C)</enum> <text>public health benefits from criteria air pollutant reductions;</text> </subparagraph> <subparagraph id="H9AE036A5A27B47308D708F618DE717BD"> <enum>(D)</enum> <text>water quality in ports and other bodies of water;</text> </subparagraph> 
<subparagraph id="H22CA8C433EA5479E83A894A4F17B402C"> <enum>(E)</enum> <text>public health and environmental benefits from every dollar spent under that program; and</text> </subparagraph> <subparagraph id="H55EA10CB93BA4D629ECBDE35C80A2A59"> <enum>(F)</enum> <text>the creation of new jobs in the United States.</text> </subparagraph> </paragraph> 
<paragraph id="H8000B57E718C423D93CA1B4872509A0C"> <enum>(4)</enum> <header>Program administration</header> <text>Of the amounts made available under paragraph (2) each fiscal year, the Administrator may use not more than 1 percent for the management and oversight of the program established under that paragraph.</text> </paragraph> </subsection> <subsection commented="no" display-inline="no-display-inline" id="HCDDA5E182D2E4545898A20CAD8C5DA29"> <enum>(c)</enum> <header>Workforce development</header> <paragraph commented="no" display-inline="no-display-inline" id="H3B998095BA09447CA82D53229728B0E5"> <enum>(1)</enum> <header>Definitions</header> <text>In this subsection:</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H3E55EE87859E48BB86C7CB30C466CAE1"> <enum>(A)</enum> <header>Low-carbon fuel</header> <text display-inline="yes-display-inline">The term <term>low-carbon fuel</term> means a marine fuel the lifecycle carbon dioxide-equivalent emissions of which is at least 90 percent less than the lifecycle carbon dioxide-equivalent emissions of marine fuel oil.</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H56518B6D6900499F823EF506BF0C2623"> <enum>(B)</enum> <header>Maritime academy</header> <text>The term <term>maritime academy</term> means—</text> 
<clause commented="no" display-inline="no-display-inline" id="HDC42E5465A0946E4AC975FB9F1EE4245"> <enum>(i)</enum> <text display-inline="yes-display-inline">the United States Merchant Marine Academy;</text> </clause> <clause commented="no" display-inline="no-display-inline" id="HAE4B4D22E6564CE991F0499E70A6EB6D"> <enum>(ii)</enum> <text>a State maritime academy; and</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="H0BF83E252B0F4E77B8442370E9F83CA9"> <enum>(iii)</enum> <text>a center of excellence for domestic maritime workforce training and education designated under section 51706(a) of title 46, United States Code.</text> </clause> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H56A17E83997C46D8B9ABE8E31C1B8428"> <enum>(C)</enum> <header>Program</header> <text>The term <term>program</term> means the program established under paragraph (2).</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H66EB9AAF73294D8DB41381AE113A1075"> <enum>(D)</enum> <header>Zero-emission port equipment or technology</header> <text>The term <term>zero-emission port equipment or technology</term> has the meaning given the term in section 133(d) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7433">42 U.S.C. 7433(d)</external-xref>) (as in effect on January 1, 2025).</text> </subparagraph> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HDF519A41F96145A8BC6C9B64C66D3F76"> <enum>(2)</enum> <header>Establishment</header> <text>For fiscal year 2029 and each fiscal year thereafter, there are appropriated, out of any funds in the Treasury not otherwise appropriated, to the Environmental Protection Agency an amount equal to 5 percent of the amounts collected pursuant to fees assessed under sections 5 and 6 during the previous calendar year to award grants and rebates to support workforce training and development for the maintenance and operation of zero-emission port equipment or technology and vessels that are propelled using batteries or low-carbon fuels, including training, programming, and curriculum development at maritime academies on the maintenance and operation of zero-emission port equipment or technology and vessels that are propelled using batteries or low-carbon fuels.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H36A72F111AB94285AD86DAF4A32D2189"> <enum>(3)</enum> <header>Eligible entities</header> <text>An entity eligible to receive an award under the program is—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H280E9B27289245AA8F38D910A1A2C0C4"> <enum>(A)</enum> <text>a State (including the District of Columbia and territories of the United States), regional, local, or Tribal agency that has jurisdiction over a port authority or a port;</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H92835E99C1BE438F8C49D036D5C0EE9F"> <enum>(B)</enum> <text>a port authority;</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HF1353EC8C3634108AEF9842590CAEE25"> <enum>(C)</enum> <text>an air pollution control agency;</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HD882E2C7B0AF4EEE9B316AA465942882"> <enum>(D)</enum> <text>a maritime academy; and</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H75738B0DDBD247E498CA38C80B660DE7"> <enum>(E)</enum> <text>a private entity that—</text> 
<clause commented="no" display-inline="no-display-inline" id="H51D4ADAC6FFB4D5F8A25B60A291F4FE7"> <enum>(i)</enum> <text display-inline="yes-display-inline">applies for a grant under this subsection in partnership with an entity described in any of subparagraphs (A) through (D); and</text> </clause> <clause commented="no" display-inline="no-display-inline" id="H0CEF08342A84428BBF54F78CC5B98F80"> <enum>(ii)</enum> <text>owns, operates, or uses—</text> 
<subclause commented="no" display-inline="no-display-inline" id="HA4B9D20608AE4A3E87CB143BE993590B"> <enum>(I)</enum> <text display-inline="yes-display-inline">vessels, the primary purpose of which are transporting cargo or freight, that are propelled using batteries or low-carbon fuels; or</text> </subclause> <subclause commented="no" display-inline="no-display-inline" id="HA9C1BB98A4BD496D8169CBC521E5BEF1"> <enum>(II)</enum> <text display-inline="yes-display-inline">the facilities, cargo-handling equipment, transportation equipment, or related technology of a port.</text> </subclause> </clause> </subparagraph> </paragraph> 
<paragraph commented="no" id="H4DFACD2C463C41759341652681F2ADCB"> <enum>(4)</enum> <header>Application</header> <text>An eligible entity seeking an award under the program shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator may require.</text> </paragraph> <paragraph id="H649CBB6C4A324FD19FE80E3ECFE69D36"> <enum>(5)</enum> <header>Program administration</header> <text>Of the amounts made available under paragraph (2) each fiscal year, the Administrator may use not more than 1 percent for the management and oversight of the program.</text> </paragraph> </subsection>

<paragraph commented="no" display-inline="no-display-inline" id="H1C98C4633389416FB62D38AF43BF6D4A"> <enum>(1)</enum> <header display-inline="yes-display-inline">Establishment</header> <text>For fiscal year 2029 and each fiscal year thereafter, there are appropriated, out of any funds in the Treasury not otherwise appropriated, to the Environmental Protection Agency an amount equal to 10 percent of the amounts collected pursuant to fees assessed under sections 5 and 6 during the previous calendar year to award grants, rebates, or low-interest loans, as determined appropriate by the Administrator—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HF30CF5C89A224A5CAA0FE9AACEC231A3"> <enum>(A)</enum> <text display-inline="yes-display-inline">to replace or retrofit existing harbor craft, except for ferry vessels, with vessels that use batteries for all propulsion power; and</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H5722B741014746769DC0E85E6E3EC5EB"> <enum>(B)</enum> <text>to support workforce development and training to support the maintenance, charging, fueling, and operation of vessels described in subparagraph (A).</text> </subparagraph> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H2DF898122BEE456BB1E9D592B46F615E"> <enum>(2)</enum> <header>Modeled off Diesel Emissions Reduction Act</header> <text>To the extent practicable, the Administrator shall develop an application process, provide public notification, inform eligible entities of zero-emissions technologies, and submit to Congress an evaluation and report on the efficacy of the program established under paragraph (1) in a manner similar to the national grant program of the Administrator under subtitle G of title VII of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16131">42 U.S.C. 16131 et seq.</external-xref>).</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H0FFBFC075EF74CF1AE2290EE5FFC5D5C"> <enum>(3)</enum> <header>Eligible entities</header> <text>An entity eligible to receive an award under the program established under paragraph (1) is—</text> <subparagraph id="HC849188152EE4387A0914B6C40E890D2"> <enum>(A)</enum> <text>a State (including the District of Columbia and territories of the United States), regional, local, or Tribal agency that has jurisdiction over a port authority or a port;</text> </subparagraph>

<clause commented="no" display-inline="no-display-inline" id="HE823810B4F154A2FA200BF927ECF5B28"> <enum>(i)</enum> <text display-inline="yes-display-inline">applies for an award under this subsection in partnership with an entity described in subparagraph (A) or (B); and</text> </clause> <clause commented="no" display-inline="no-display-inline" id="H8ADB75CF3FB14E5FA6DB1FCFAFBF5460"> <enum>(ii)</enum> <text>owns, operates, or uses harbor craft, except for ferry vessels.</text> </clause> </subparagraph> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H0F342DCFA0D74C9EBF4D66063F9D4ACB"> <enum>(4)</enum> <header>Selection</header> 
<subparagraph id="HF42174D40EA94716AF392A670132A2DA"> <enum>(A)</enum> <header>Application</header> <text>An eligible entity seeking an award under the program established under paragraph (1) shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator may require, which shall include a certification that an award under the program will be used to purchase a vessel that exclusively uses a battery for all propulsion power.</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HCCFDE4E37A874154B42FD1A1428E3657"> <enum>(B)</enum> <header>Priority</header> <text>In selecting the recipients of awards under the program established under paragraph (1), the Administrator shall give priority to entities the replacement or retrofit of whose harbor crafts with vessels that use batteries for all propulsion power would—</text> 
<clause commented="no" display-inline="no-display-inline" id="H641858E23E434993A8A440530B6A6956"> <enum>(i)</enum> <text>maximize the reduction of greenhouse gas emissions;</text> </clause> <clause commented="no" display-inline="no-display-inline" id="H1EB17947F68F4860B3D9CBC4AFB79B94"> <enum>(ii)</enum> <text>maximize the public health benefits from the reduction of criteria air pollutants;</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="H0372778CA50D4D8D88B3FA93052188B9"> <enum>(iii)</enum> <text>maximize water quality in ports and other bodies of water;</text> </clause> <clause commented="no" display-inline="no-display-inline" id="HD7D18F2BFD644DA0A968D39D0B33C5F4"> <enum>(iv)</enum> <text>maximize public health and environmental benefits from every dollar spent under the program; and</text> </clause> 
<clause id="H37D13B7607C148EB9BA8BCB83588095C"> <enum>(v)</enum> <text>alleviate air pollution in poor air quality areas, including—</text> <subclause commented="no" display-inline="no-display-inline" id="H352328DC8C654D6C9FB03A7B8169FAF1"> <enum>(I)</enum> <text display-inline="yes-display-inline">areas identified by the Administrator as in nonattainment or maintenance of national ambient air quality standards promulgated under section 109 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409</external-xref>) for criteria air pollutants; and</text> </subclause> 
<subclause commented="no" display-inline="no-display-inline" id="HD023ACA1BBBE46A78FAD03666B23A16D"> <enum>(II)</enum> <text>other areas that receive a disproportionate quantity of air pollution, as determined by the Administrator.</text> </subclause> </clause> </subparagraph> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HFFDD3C094B504F719A6A77254F7C01A7"> <enum>(5)</enum> <header>Clawback</header> <text>If the Administrator determines that the recipient of an award under the program established under paragraph (1) has violated the certification required under paragraph (4)(A), the Administrator shall seek reimbursement of the full amount of the award provided to the recipient.</text> </paragraph>

<clause commented="no" display-inline="no-display-inline" id="H7E47858E7689497A885FC8E42377D6FA"> <enum>(ii)</enum> <text>owns, operates, or uses ferry or crew vessels.</text> </clause> </subparagraph> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H0EE1F08B446147058B1AE5FB6BAACFA2"> <enum>(4)</enum> <header>Selection</header> <subparagraph id="H927CEB1DD4D04AC0B5EB890E1B60D34F"> <enum>(A)</enum> <header>Application</header> <text>An eligible entity seeking an award under the program established under paragraph (1) shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator may require, which shall include a certification that an award under the program will be used to purchase a vessel that exclusively uses a battery for all propulsion power.</text> </subparagraph>

<paragraph commented="no" display-inline="no-display-inline" id="HAD3E7FD7C45548B08FB2976AE9EF130E"> <enum>(1)</enum> <header display-inline="yes-display-inline">Establishment</header> <text>For fiscal year 2029 and each fiscal year thereafter, there are appropriated, out of any funds in the Treasury not otherwise appropriated, to the Environmental Protection Agency an amount equal to 5 percent of the amounts collected pursuant to fees assessed under sections 5 and 6 during the previous calendar year to provide grants, rebates, or low-interest loans, as determined appropriate by the Administrator, to create fenceline air monitoring at port boundaries and in communities located within 1 mile of a port boundary.</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HEB590C3BFDB54B70A9480FEE2A61871E"> <enum>(2)</enum> <header>Eligible entities</header> <text>An entity eligible to receive an award under the program established under paragraph (1) is—</text>

<subparagraph id="H302A70006D1B4654A7BF69940759FB5B"> <enum>(E)</enum> <text>a nonprofit entity or nonprofit consortium with experience in air pollution monitoring.</text> </subparagraph> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H33130061E3CF4DD39F3BD7A9F2788750"> <enum>(3)</enum> <header>Application</header> <text>An eligible entity seeking an award under the program established under paragraph (1) shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator may require.</text> </paragraph> 
<paragraph id="HA10053D860BA4B19A778475D7EF86F3D"> <enum>(4)</enum> <header>Program administration</header> <text>Of the amounts made available under paragraph (1) each fiscal year, the Administrator may use not more than 1 percent for the management and oversight of the program established under that paragraph.</text> </paragraph> </subsection> <subsection commented="no" display-inline="no-display-inline" id="H8878F60CC7DC49EFAD915DBBA892DEC0"> <enum>(g)</enum> <header>Funding of existing programs</header> <paragraph commented="no" display-inline="no-display-inline" id="HA6A8FD0DD10E41469B8EE5B0554264E8"> <enum>(1)</enum> <header>Clean ports program</header> <text>For fiscal year 2029 and each fiscal year thereafter, there are appropriated, out of any funds in the Treasury not otherwise appropriated, to the Environmental Protection Agency an amount equal to 15 percent of the amounts collected pursuant to fees assessed under sections 5 and 6 during the previous calendar year to carry out the program established under section 133 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7433">42 U.S.C. 7433</external-xref>).</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H9BC164BEE2EF4ED5B89E757559861C9B"> <enum>(2)</enum> <header>Oceans and coastal security</header> <text display-inline="yes-display-inline">For fiscal year 2029 and each fiscal year thereafter, there are appropriated, out of any funds in the Treasury not otherwise appropriated, to the National Oceanic and Atmospheric Administration an amount equal to 3 percent of the amounts collected pursuant to fees assessed under sections 5 and 6 during the previous calendar year for deposit into the National Oceans and Coastal Security Fund established under section 904(a) of the National Oceans and Coastal Security Act (<external-xref legal-doc="usc" parsable-cite="usc/16/7503">16 U.S.C. 7503(a)</external-xref>).</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HEB0C6EB9199F4941B37015C090B53C04"> <enum>(3)</enum> <header>Marine Debris Foundation</header> <text>For fiscal year 2029 and each fiscal year thereafter, there are appropriated, out of any funds in the Treasury not otherwise appropriated, to the Department of Commerce an amount equal to 2 percent of the amounts collected pursuant to fees assessed under sections 5 and 6 during the previous calendar year to carry out subtitle B of title I of the Save Our Seas 2.0 Act (<external-xref legal-doc="usc" parsable-cite="usc/33/4211">33 U.S.C. 4211 et seq.</external-xref>).</text> </paragraph> </subsection> </section>
