<section id="H4569592788E047179F1D1630B892E253" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>Tyler’s Law</short-title></quote>.</text></section> <section id="H51B4F6CDE2D4494AB288600F758E4018"><enum>2.</enum><header>Requirement to report certain incidents</header> <subsection id="H4F6081E4203544F9939C27B55B457FC6"><enum>(a)</enum><header>Hospitals</header> <paragraph id="H003CDED79EEF4235BEDFED4EFE1824E4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A hospital shall submit to the Consumer Product Safety Commission written notice of any incident—</text> 
<subparagraph id="H0EE88899817D4EA7A24E7C3C081C2EA2"><enum>(A)</enum><text>involving the death or serious injury of a child;</text></subparagraph> <subparagraph id="H0D9065E44E734356A90EE113BBAA3152"><enum>(B)</enum><text>that results in such hospital providing a service of any kind; and</text></subparagraph> 
<subparagraph id="H57B2CD52F2BF42A1A78B92D7369FC05F"><enum>(C)</enum><text display-inline="yes-display-inline">with respect to which, in the determination of such hospital, the injury or death is associated with a children’s product or a durable infant or toddler product.</text></subparagraph></paragraph> <paragraph id="H3A93C7AA8BDC4C908B5F46AB0922961F"><enum>(2)</enum><header>Contents</header><text>A notice required under paragraph (1) shall include, to the extent available—</text> 
<subparagraph id="HE6731C5A594140A3AFDCC61BFDC2ABE9"><enum>(A)</enum><text>a description of the incident involved, including—</text> <clause id="H957E81A2A74544999B07EBACCBA195BD"><enum>(i)</enum><text>the date of the incident;</text></clause> 
<clause id="H43A1B1F10363427BAF21941EC70B16B1"><enum>(ii)</enum><text>the city and State in which the incident occurred; and</text></clause> <clause id="H4620E7ABB1A24ECDBC50626BA7AC2B32"><enum>(iii)</enum><text>the type of facility where the incident occurred;</text></clause></subparagraph> 
<subparagraph id="HC044618AAE434F6B937A0A15612924F6"><enum>(B)</enum><text>a description of the product involved, including the applicable product code;</text></subparagraph> <subparagraph id="H9E1246F656674E45BA962AFCBBA426B4"><enum>(C)</enum><text display-inline="yes-display-inline">a description of the child involved, including—</text> 
<clause id="H2D7A15FCEDC6455EAA88F29A8E2B6956"><enum>(i)</enum><text>the age, gender, race, and ethnicity of the child;</text></clause> <clause id="H90EBA7B2888B432B96E1E52BBE0859A4"><enum>(ii)</enum><text>the affected body parts of the child; and</text></clause> 
<clause id="H91490AA712D64481A549FB4245D16792"><enum>(iii)</enum><text>any diagnoses the child was given;</text></clause></subparagraph> <subparagraph id="H2784CB70DCAF4663A6FEDE14FE667739"><enum>(D)</enum><text>a description of the role the hospital served in the treatment of the child, including whether the child—</text> 
<clause id="H3DDF38ECC5AC480A895DDAF80A0D12F9"><enum>(i)</enum><text>was treated at the hospital and released;</text></clause> <clause id="HB3E28DC6FDF6464AB2C76C8615D07B35"><enum>(ii)</enum><text>admitted to the hospital;</text></clause> 
<clause id="H492251799F84499F9DF3517223C158AF"><enum>(iii)</enum><text>held for observation at the hospital; or</text></clause> <clause id="H55C32D9207174D3FB3FFFD4164250C6C"><enum>(iv)</enum><text>died before or during treatment at the hospital;</text></clause></subparagraph> 
<subparagraph id="H149E69DEE1104A4B8BDE05532BA8EF6A"><enum>(E)</enum><text>a description of any role played by alcohol, controlled substances, or fire; and</text></subparagraph> <subparagraph id="H26841EC8C0E34EC989AB99B468092443"><enum>(F)</enum><text>any related reports prepared by the hospital.</text></subparagraph></paragraph> 
<paragraph id="H2F4D0A1AE21046E894E64E8E960E3B91"><enum>(3)</enum><header>Timing</header><text>A notice required to be submitted by a hospital under paragraph (1) shall be submitted not later than 7 days after the date on which such hospital makes the applicable determination under paragraph (1)(C).</text></paragraph> <paragraph id="H004871C4159847718087BA5E099F45B0"><enum>(4)</enum><header>Medicare condition of participation</header><text display-inline="yes-display-inline">Section 1866(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395cc">42 U.S.C. 1395cc(a)(1)</external-xref>) is amended—</text> 
<subparagraph id="H85E3C512F98A44CFBC32969E8E62B60F"><enum>(A)</enum><text>in subparagraph (X), by striking <quote>and</quote> at the end;</text></subparagraph> <subparagraph id="HE681378C6FA549ECB93645845CCBC620"><enum>(B)</enum><text>in subparagraph (Y)(ii)(V), by striking the period and inserting <quote>; and</quote>; and</text></subparagraph> 
<subparagraph id="HFEFB6AAECCB245A69B120D8632B1808B"><enum>(C)</enum><text>by inserting after subparagraph (Y) the following new subparagraph:</text> <quoted-block style="OLC" id="H32FD932589B949078AEED3D5AAE49989" display-inline="no-display-inline"> <subparagraph id="HB626ED5D798146A38DD38FD7A464CE45"><enum>(Z)</enum><text display-inline="yes-display-inline">in the case of a hospital, to comply with the requirements of section 2(a) of Tyler’s Law.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> 
<subsection id="H9D04161247C04EF7A1E2B7E82218909B"><enum>(b)</enum><header>Medical examiner and coroner offices</header> 
<paragraph id="HE410624509FF466980C336A5C095E762"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A medical examiner or coroner office shall submit to the Consumer Product Safety Commission written notice of any incident—</text> <subparagraph id="H5032F04940914DFDB3AECE4AE183AC41"><enum>(A)</enum><text>involving the death of a child;</text></subparagraph> 
<subparagraph id="H0FC839278E27448282109CF81442E36F"><enum>(B)</enum><text>that results in such office providing a service of any kind; and</text></subparagraph> <subparagraph id="HE6D33BC26BD64B61A0D78985B6AC68DB"><enum>(C)</enum><text display-inline="yes-display-inline">with respect to which, in the determination of such office, the death is associated with a children’s product or a durable infant or toddler product.</text></subparagraph></paragraph> 
<paragraph id="HFFF21C701BDB4E72A1DB0E5FDC1AD068"><enum>(2)</enum><header>Contents</header><text>A notice required under paragraph (1) shall include, to the extent available—</text> <subparagraph id="H42ACA43D8A7A4FE691453E0BDB1AD431"><enum>(A)</enum><text>a description of the incident involved, including—</text> 
<clause id="H88F9A972BAE0427AB707FCD8E6AD318D"><enum>(i)</enum><text>the date of the incident;</text></clause> <clause id="HB23E5F11AB314AD58297105C1A11922C"><enum>(ii)</enum><text>the city and State in which the incident occurred;</text></clause> 
<clause id="HC2702A3A0DAF46598FA83CE3E55F8A31"><enum>(iii)</enum><text>the type of facility where the incident occurred;</text></clause> <clause id="H103B69197C384BAE92CDE2603A78BF02"><enum>(iv)</enum><text display-inline="yes-display-inline">any medical treatment provided in response to the incident, including any reports relating to such treatment; and</text></clause> 
<clause id="H600951085743472F8CF2AFCF1BD88598"><enum>(v)</enum><text>the cause of death;</text></clause></subparagraph> <subparagraph id="H44EEF08445774845977B853A2F413C39"><enum>(B)</enum><text>a description of the product involved, including the applicable product code;</text></subparagraph> 
<subparagraph id="H5451EF2DDEBC4348B5248DA702AF7AA6"><enum>(C)</enum><text display-inline="yes-display-inline">a description of the child involved, including the age, gender, race, and ethnicity of the child;</text></subparagraph> <subparagraph id="HE3A70CD73E4841EE9BF152D192777CF2"><enum>(D)</enum><text>a description of any role played by alcohol, controlled substances, or fire; and</text></subparagraph> 
<subparagraph id="H691B3B932B5948718BE88DF252749A2B"><enum>(E)</enum><text>any related reports prepared by the office involved.</text></subparagraph></paragraph> <paragraph id="H1BF433B612DE424E9F715CBC8D12627B"><enum>(3)</enum><header>Timing</header><text>A notice required to be submitted by an office under paragraph (1) shall be submitted not later than 7 days after the date on which such office makes the applicable determination under paragraph (1)(C).</text></paragraph> 
<paragraph id="H1A0137A33DFA4438A4CABC293877FE9D"><enum>(4)</enum><header>Enforcement</header><text display-inline="yes-display-inline">A medical examiner or coroner office that fails to comply with this subsection during a fiscal year shall be ineligible for a Medical Examiner Coroner Office Accreditation grant under the Strengthening the Medical Examiner-Coroner System Program of the Department of Justice during the following fiscal year.</text></paragraph></subsection> <subsection id="HF1D8D8E45EFA40FBB657EC84A7F79663"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H07BEF0120B1E4AC5875199ECA2A610D7"><enum>(1)</enum><header>Child</header><text>The term <term>child</term> means an individual under the age of 18 years.</text></paragraph> <paragraph id="HA92E0C8F5C1B44E79648AE1535009293"><enum>(2)</enum><header>Children's product</header><text display-inline="yes-display-inline">The term <term>children's product</term> has the meaning given such term in section 3(a) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2052">15 U.S.C. 2052(a)</external-xref>).</text></paragraph> 
<paragraph id="H5A153FA73A434C298594D0501430F5C1"><enum>(3)</enum><header>Durable infant or toddler product</header><text display-inline="yes-display-inline">The term <term>durable infant or toddler product</term> has the meaning given such term in section 104(f) of the Consumer Product Safety Improvement Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/15/2056a">15 U.S.C. 2056a(f)</external-xref>).</text></paragraph> <paragraph id="H8699534BFF674C2D9C7E5A7B2829DCE4"><enum>(4)</enum><header>Hospital</header><text display-inline="yes-display-inline">The term <term>hospital</term> has the meaning given such term in section 1861(e) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(e)</external-xref>).</text></paragraph> 
<paragraph id="HDB05582901DA40199D9AB40FEAC612F2"><enum>(5)</enum><header>Product code</header><text display-inline="yes-display-inline">The term <term>product code</term> means, with respect to a product, the product code used for such product in the NEISS Coding Manual and the NEISS Product Code Comparability Table of the Consumer Product Safety Commission, as in effect on the date of the applicable incident.</text></paragraph></subsection> <subsection id="HFEF142D373344B339A7685C25C754604"><enum>(d)</enum><header>Applicability</header><text>This section shall apply to incidents involving the death or serious injury of a child that occur on or after the date that is 180 days after the date of the enactment of this Act.</text></subsection></section>
