<section id="H18A9D2E456824367847AA2B152D08ABF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Food Chemical Reassessment Act of 2025</short-title></quote>.</text></section> <section id="HF17402AEF48843C6B9C09E3A6EE28634"><enum>2.</enum><header>Food safety reassessments</header><text display-inline="no-display-inline">Section 409 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/348">21 U.S.C. 348</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H854FD99E61C746CA938A7D9A76497988"><enum>(l)</enum><header>Food safety reassessments</header> 
<paragraph id="HA07AE4555CC646E692B31DB7042E1549">
                        <enum>(1)</enum>
                        <header>In general</header>
 <text display-inline="yes-display-inline">Not less frequently than once every 3 years beginning with 2026, the Office of Food Chemical Safety, Dietary Supplements, and Innovation (referred to in this section as the <quote>Office</quote>), shall systematically and continuously reassess the safety of not less than a combination of 10 of the following substances (or classes thereof):</text>
                        <subparagraph id="H7764F7D4F7ED4CBDB00E6F141B216EA9">
                            <enum>(A)</enum>
 <text display-inline="yes-display-inline">Food additives marketed pursuant to an order under subsection (c).</text>
                        </subparagraph>
                        <subparagraph id="H2CB18EDC6A07492EBBECD595EF5A13A6">
                            <enum>(B)</enum>
 <text display-inline="yes-display-inline">Color additives, as defined in section 201(t).</text>
                        </subparagraph>
                        <subparagraph id="H491F33AE82A64D09BCA97D5C2E8CAAE7">
                            <enum>(C)</enum>
 <text>Substances generally recognized as safe for use in food (as defined in section 201(s)).</text>
                        </subparagraph>
                        <subparagraph id="H8069176C15E745559AD682C7114A0B50">
                            <enum>(D)</enum>
 <text display-inline="yes-display-inline">Prior-sanctioned substances, or classes thereof (as described in section 201(s)(4)).</text>
                        </subparagraph>
                        <subparagraph id="H33960B20AD274372BEFE832929B294F6">
                            <enum>(E)</enum>
 <text display-inline="yes-display-inline">Food contact substances, as defined in subsection (h)(6).</text>
                        </subparagraph>
                    </paragraph> 
<paragraph id="HA8E7C93CAFE848B89A02E51589EE1E95"><enum>(2)</enum><header>Public notice</header><text display-inline="yes-display-inline">The Secretary shall provide public notice of the determinations made from each reassessment conducted under paragraph (1).</text></paragraph> <paragraph id="H740E40240B0E4D6886BE0A97618E1C39"><enum>(3)</enum><header>Effect of reassessment</header><text>The Secretary shall—</text> 
<subparagraph id="H6B2611275D9D4B09A727C9F04BEE7617"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of a reassessment of a substance described in subparagraph (A) of paragraph (1), amend or repeal a regulation under subsection (c) issued with respect to such substance if such reassessment demonstrates that the substance is not safe;</text></subparagraph> <subparagraph id="H19FD84EA7D2F45F59EC20C8FB7EC972F"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a reassessment of a substance described in subparagraph (B) of paragraph (1), amend or repeal a regulation under section 721 issued with respect to such substance if such reassessment demonstrates that the substance is not safe;</text></subparagraph> 
<subparagraph id="H809F4AAEA8064FEF812B797FA6A45059"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of a reassessment of a substance described in subparagraph (C) of paragraph (1), make public on the website of the Food and Drug Administration the determination that—</text> <clause id="H0A9C1E78F35B4BF8A1018BC27702CD31"><enum>(i)</enum><text display-inline="yes-display-inline">any such substance is safe for purposes of this subsection and establishing the conditions of use, if any, under which any such substance or class of substances can be used safely; or</text></clause> 
<clause id="H952D2E6618A74D46934B44365541CB4E"><enum>(ii)</enum><text display-inline="yes-display-inline">any such substance or class of substances is unsafe for purposes of this section;</text> </clause></subparagraph> <subparagraph id="H1FAB17618A12405FA530B487E96689BE"><enum>(D)</enum><text display-inline="yes-display-inline">in the case of a reassessment of a substance described in subparagraph (D) of paragraph (1), revoke the prior-sanctioned use of the substance if such reassessment demonstrates the prior-sanctioned use of such substance may be injurious to health; and</text></subparagraph> 
<subparagraph id="H0A939690543442958E66505C75E3091C"><enum>(E)</enum><text display-inline="yes-display-inline">in the case of a reassessment of a substance described in subparagraph (E) of paragraph (1), determine that a pre-market notification under subsection (h) for the food contact substance involved is no longer effective if such reassessment demonstrates that the use of such substance is not safe.</text></subparagraph></paragraph> <paragraph id="HC1518689215043178E0A1C08424BCB0E"><enum>(4)</enum><header>Determination of substances subject to reassessment</header> <subparagraph id="H9B32E401DE55404397630F10983BC8D6"><enum>(A)</enum><header>In general</header><text>In determining which substances or classes of substances to reassess under paragraph (1), the Secretary shall prioritize substances or classes thereof by public health need.</text></subparagraph> 
<subparagraph id="H372D647A12494D609499E3C9342909C9"><enum>(B)</enum><header>First substances subject to reassessment</header><text>The Secretary may select, as the first 10 substances (or classes thereof) to be reassessed under this subsection, the following:</text> <clause id="H9F8965466251412FBA62F565AF394D38"><enum>(i)</enum><text>Tert-butylhydroquinone.</text></clause> 
<clause id="HEB3AE6B659CE486CB9B7B940F6C17014"><enum>(ii)</enum><text>Titanium dioxide.</text></clause> <clause id="HC0030A1446D1421FAD6907769F168CB4"><enum>(iii)</enum><text>Red dye 40, yellow dye 5, yellow dye 6, blue dye 01, blue dye 02, and green dye 03.</text></clause> 
<clause id="H283EAF7CCD37499C8FC568C502287521"><enum>(iv)</enum><text>Perchlorate.</text></clause> <clause id="H75073221B0644577AFF67A5FDBA9FBE0"><enum>(v)</enum><text>Butylated hydroxyanisole (BHA).</text></clause> 
<clause id="HE5CEE6CA8DBA4B2A969BBCB4CF1CFA34"><enum>(vi)</enum><text>Butylated hydroxytoluene (BHT).</text></clause> <clause id="H4CF5D81DD06A425395354A52779F8294"><enum>(vii)</enum><text>Trichloroethylene, methylene chloride, benzene, and ethylene chloride.</text></clause> 
<clause id="H2CCBDD531403472FBE2692268C804343"><enum>(viii)</enum><text>Propyl gallate.</text></clause> <clause id="H16BE7AC47FF1401C81FB34764BEF59E2"><enum>(ix)</enum><text>Sodium benzoate.</text></clause> 
<clause id="H323F3152F7A54293910801B9C4171403"><enum>(x)</enum><text>Sodium nitrite.</text></clause></subparagraph></paragraph> <paragraph id="HE7C0E1C3CCA34A9AAE586D52A1DCC73F"><enum>(5)</enum><header>Rule of construction</header><text>Nothing in this subsection alters the authority or duties of the Secretary with respect to the administration and enforcement of the preceding provisions of this section.</text></paragraph> 
<paragraph id="H62E0611576804097BD6D1D9D96A1029E"><enum>(6)</enum><header>Food advisory committee</header><text>Not later than 180 days after the date of enactment of the Food Chemical Reassessment Act of 2025, the Secretary shall re-establish the Food Advisory Committee to advise the Secretary with respect to—</text> <subparagraph id="H1A25BBB78B064FEC90DC9C8EF11D88D5"><enum>(A)</enum><text>the standards for reassessments conducted under this section; and</text></subparagraph> 
<subparagraph id="H4786207240B245798B6B4147CB706CEB"><enum>(B)</enum><text>the process and methods necessary to complete the work of the Office.</text></subparagraph></paragraph> <paragraph id="H682EE42A02BD4DA3A9ECC4385154EA80"><enum>(7)</enum><header>Class defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>class</term>, with respect to substances referred to in paragraph (1), means a group of chemicals that are chemically similar or cause similar or related pharmacological effects.</text></paragraph></subsection> <after-quoted-block>.</after-quoted-block></quoted-block></section>
