R. 4277</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250702">July 2, 2025</action-date><action-desc><sponsor name-id="D000230">Mr. Davis of North Carolina</sponsor> (for himself and <cosponsor name-id="B001301">Mr. Bergman</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend Title XIX of the Social Security Act to clarify that rural emergency hospitals are treated as outpatient hospitals for purposes of Medicaid payment, and for other purposes.</official-title></form><legis-body id="H77521F93FF1946B99F0C0D4CA52D81DC" style="OLC"><section id="H78723256BC414F0DB5C7B4A098CDBD00" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rural Emergency Hospital Financial Stability Act</short-title></quote>.</text></section><section id="HDA9C46A6E6C0488F8F01FF2373AFD1FC"><enum>2.</enum><header>Clarification of Medicaid payment for rural emergency hospitals</header><subsection id="HEE0B585A2A9340769F279858702C1276"><enum>(a)</enum><header>Amendment to Medicaid statute</header><text display-inline="yes-display-inline">Paragraph (2)(A) of Section 1905(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)</external-xref>) is amended by inserting the following after <quote>outpatient hospital services</quote>: <quote>(including rural emergency hospital services, as defined in section 1861(kkk), when such services are available),</quote>;</text></subsection><subsection id="HA89E776570FF4D9DA9AB2384FE5051DB"><enum>(b)</enum><header>Nursing facility amendment</header><text display-inline="yes-display-inline">Paragraph (4)(A) of Section 1905(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)</external-xref>) is amended by inserting <quote>but including services provided in a nursing facility that is a distinct part unit of a rural emergency hospital, as defined in section 1861(kkk)(2)</quote> after <quote>diseases</quote>.</text></subsection><subsection id="HCA5AD1CD3B454EF8936B0D29F3C2ACDB"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this Act shall take effect on the date of enactment, and shall apply to services furnished on or after such date.</text></subsection></section><section id="H6C9B68279F2F44B6AE2EACDF8CC928E2"><enum>3.</enum><header>Rulemaking</header><text display-inline="no-display-inline">Not later than 12 months after the date of enactment of this Act, the Secretary of Health and Human Services shall issue final regulations to carry out the amendments made by this Act.</text></section></legis-body></bill>
