<section id="H0AAFC8075276479BA1822367082DA694" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>School Resource Officer Reform Act</short-title></quote>. </text></section> <section id="H625F76D2AA4A4BB6AAA6204D58125C7A" display-inline="no-display-inline"><enum>2.</enum><header>Exclusion of compensation of certain school resource officers</header> <subsection id="HB09A5AAC5AC247A19E06A1ECD511B866"><enum>(a)</enum><header>Employee compensation</header> <paragraph id="H103345359AB246519232B6632FA86932"><enum>(1)</enum><header>In general</header><text>Part III of subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting before section 140 the following new section:</text>

<section id="H0D3F436245C14CF8993D6FB15E9429D7"><enum>139J.</enum><header>Compensation of certain school resource officers</header> 
<subsection id="H259653B4B40542B9AA3DF50A9EC44B12"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Gross income shall not include compensation received by a qualified school resource officer for service as such an officer.</text></subsection> <subsection id="H21512B610D9E4CFD82D90A5538E8CEAE"><enum>(b)</enum><header>Qualified school resource officer</header><text>For purposes of this section, the term <term>qualified school resource officer</term> means a retired peace officer who is employed as an armed school resource officer at an elementary school or secondary school (as such terms are defined in section 8101 of the Elementary and Secondary Education Act of 1965).</text></subsection> 
<subsection id="HA18ED9A5591648B9A8CCBE16CCD20EF6" commented="no"><enum>(c)</enum><header>Retired peace officer</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>retired peace officer</term> means an individual who is separated from service in good standing from service with a State or local agency as a law enforcement officer.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="HA6C5BAD82D554025945D04A9E51ED65D"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections for part III of subchapter B of chapter 1 is amended by inserting before the item relating to section 140 the following new item:</text>

<toc-entry level="section">Sec. 139J. Compensation of certain school resource officers.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HDC337D9FFE0046DDAE32250D056292CF"><enum>(b)</enum><header>Payroll taxes</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/3121">Section 3121(a)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>or</quote> at the end of paragraph (22)(B), by striking the period at the end of paragraph (23) and inserting <quote>; or</quote>, and by inserting after paragraph (23) the following new paragraph: </text> <quoted-block style="OLC" id="HDE1E497C7EC647089F29DBA1C55B5CF4" display-inline="no-display-inline"> <paragraph id="HC0B03687E6C643B79B8675FAE5BAF932"><enum>(24)</enum><text display-inline="yes-display-inline">any compensation which is excludable from the gross income of the employee under section 139J.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HFD0D6C7C8DEC4C92B9FBEC11FAFD00BD"><enum>(c)</enum><header>Wage withholding</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/3401">Section 3401(a)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>or</quote> at the end of paragraph (22), by striking the period at the end of paragraph (23) and inserting <quote>, or</quote>, and by inserting after paragraph (23) the following new paragraph: </text> <quoted-block style="OLC" id="H68A5030DF46947AAB8D1C952953A4C38" display-inline="no-display-inline"> <paragraph id="H0506977B5F23407D9F809F256E6FA5CE"><enum>(24)</enum><text display-inline="yes-display-inline">for compensation which is excludable from the gross income of the employee under section 139J.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD8E8502411E74AA98DEC06C3FDADE27A"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to compensation for services after the date of the enactment of this Act.</text></subsection></section> <section id="H3AA86F028428438BB9E51D5A81D3B8B4"><enum>3.</enum><header>School resource officers eligible for public safety officers' death benefits</header><text display-inline="no-display-inline">Section 1204(9) of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10284">34 U.S.C. 10284(9)</external-xref>) is amended by inserting <quote>school resource,</quote> after <quote>parole,</quote>. </text></section>
