<official-title display="yes">To amend section 41733 of title 49, United States Code, to require that applications to provide compensated basic essential air service include a contingency plan to continue air service in the event of a disruption, and for other purposes.</official-title>

<section id="H5EB2BE0DF85B4FBEB16C0300ECC3B48D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Essential Air Service Reliability Act of 2025</short-title></quote>.</text></section> <section id="HECB55A12715A44A79B98F628CAC135B0"><enum>2.</enum><header>Basic essential air service availability of compensation</header> <subsection id="HBD995ACBC2C2432B81A40360592F5528"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 41733(c) of title 49, United States Code, is amended—</text> 
<paragraph id="H96D287D737D34262BFD69EC436707B35"><enum>(1)</enum><text>by redesignating paragraph (2) as paragraph (4); </text></paragraph> <paragraph id="H8D5766640147463D8542DD8C37ED691C"><enum>(2)</enum><text>in paragraph (1)—</text> 
<subparagraph id="HBB886047C59845C2A6E81C15C03A76A5"><enum>(A)</enum><text>by striking <quote>(1) If the Secretary</quote> and inserting the following: </text> <quoted-block style="USC" id="HEEC955E0E6E24D67AD7079937CB6543F" display-inline="no-display-inline"> <paragraph id="HA3028440B7AA4A6C83B514A2589C1FD1"><enum>(1)</enum><header>Application</header><text display-inline="yes-display-inline">If the Secretary</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H1C20538796BA4E43B6E4BD9E29D7490F"><enum>(B)</enum><text>by inserting after <quote>compensation under this section.</quote> the following new paragraph:</text> <quoted-block style="USC" id="H8D47485C4CFD4792B282EE038853CE00" display-inline="no-display-inline"> <paragraph id="H2F8F943AD446437DA82A2BAE7428D7B7"><enum>(2)</enum><header>Requirement</header><text display-inline="yes-display-inline">For any application submitted pursuant to paragraph (1), such application shall include a contingency plan that provides for the continuation of air service to the eligible place in the event of a disruption that is not related to weather.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HCAA48DC53B544A08B705B9917C13D420"><enum>(C)</enum><text>by striking <quote>In selecting an applicant,</quote> and inserting the following:</text> <quoted-block style="USC" id="HA4A32624328F4C66AB52997D21E64BE6" display-inline="no-display-inline"> <paragraph id="HBAA516DFC90F4B31987CC16C5ECC48CB"><enum>(3)</enum><header>Considerations</header><text display-inline="yes-display-inline">In selecting an applicant,</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HC71A2C4F13BF4EC3A5DC15BCECC451EC"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (4), as so redesignated, by striking <quote>Under guidelines</quote> and inserting <quote><header-in-text level="paragraph" style="USC">Rate of compensation.</header-in-text>—Under guidelines</quote>.</text></paragraph></subsection> <subsection id="H9B90506AAC944EFFAEF7C19A58C7C2BA"><enum>(b)</enum><header>Applicability</header><text>The Secretary of Transportation shall ensure that the amendment made by section 2(a)(2)(B) shall apply not later than 180 days after the date of enactment of this Act.</text> </subsection> 
<subsection id="H4BAB9776C37F4724B08FA7ED1008FD51"><enum>(c)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 41736(c)(2)(A) of title 49, United States Code, is amended by striking <quote>section 41733(c)(1)</quote> and inserting <quote>section 41733(c)</quote>. </text></subsection></section> </legis-body> </bill>
