<section id="H06F53927A47542FC995D8B8EA8539214" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prohibition of Medicaid Funding for Conversion Therapy Act</short-title></quote>.</text></section> <section id="H75BCBA6CF35E4C46BE87590ACC0DE48E" section-type="subsequent-section"><enum>2.</enum><header>Prohibition on Medicaid payments for conversion therapy</header> <subsection id="H175952BD80B14B3FA9A8AE199AC4AEA6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1902 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref>) is amended—</text> 
<paragraph id="H8E51B39FFED6429EB649B0F988406D50"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="H6F46AFF5D94E45E6A32EA48922733033"><enum>(A)</enum><text>in paragraph (86), by striking <quote>and</quote> at the end;</text></subparagraph> 
<subparagraph id="HAEB2F1B9D61E42D1960829E6CA883B54"><enum>(B)</enum><text>in paragraph (87), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph> <subparagraph id="H7B5C19A814AA4238AD7F0B384682C2B9"><enum>(C)</enum><text>by inserting after paragraph (87) the following new paragraph:</text>

<paragraph id="HB062BC257DEE42E9AF4069906CA9C2F8"><enum>(88)</enum><text display-inline="yes-display-inline">provide that, beginning with the first day of the first quarter that begins on or after the date of enactment of this paragraph, no payment may be made under the plan with respect to conversion therapy (as defined in subsection (uu)) furnished to an individual enrolled under the plan (or a waiver of such plan).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H5DD277FDF9D24AFA8F58101A1F479A64"><enum>(2)</enum><text>by adding at the end the following new subsection:</text>

<subsection id="HBF7575FAEBB44F21970BBC07591E419B"><enum>(uu)</enum><header>Conversion therapy; Gender identity; Person; Sexual orientation</header><text display-inline="yes-display-inline">For purposes of subsection (a)(88) and this subsection:</text> <paragraph id="H5DC15C35D01F4C1AA227A7ADD464ADBE"><enum>(1)</enum><header>Conversion therapy</header><text display-inline="yes-display-inline">The term <term>conversion therapy</term>—</text> 
<subparagraph id="H0D72BDED6D9B45C59872A88289AB5BE6"><enum>(A)</enum><text>means any practice or treatment by any person that seeks to change another individual’s sexual orientation or gender identity, including efforts to change behaviors or gender expressions, or to eliminate or reduce sexual or romantic attractions or feelings toward individuals of the same gender, if such person receives monetary compensation in exchange for any such practice or treatment; and</text></subparagraph> <subparagraph id="HAF2C7300F3D84C1BAD98F1D4D375771E"><enum>(B)</enum><text>does not include any practice or treatment, which does not seek to change sexual orientation or gender identity, that—</text> 
<clause id="HC0BEB64478284B45875B53C62AA9E9C3"><enum>(i)</enum><text>provides assistance to an individual undergoing a gender transition; or</text></clause> <clause id="H7C480DCDE8F34C538954A1ACB07E7948"><enum>(ii)</enum><text>provides acceptance, support, and understanding of a client or facilitation of a client’s coping, social support, and identity exploration and development, including sexual orientation-neutral interventions to prevent or address unlawful conduct or unsafe sexual practices.</text></clause></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H5A76B102070F4E388F56D3F7F3DA2A7C"><enum>(2)</enum><header display-inline="yes-display-inline">Gender identity</header><text display-inline="yes-display-inline">The term <term>gender identity</term> means the gender-related identity, appearance, mannerisms, or other gender-related characteristics of an individual, regardless of the individual’s designated sex at birth.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H954B2A129BEB43D0A720493FC9AE34BB"><enum>(3)</enum><header display-inline="yes-display-inline">Person</header><text>The term <term>person</term> means any individual, partnership, corporation, cooperative, association, or any other entity.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HB4BE850D69D740E78F1736F5BB28395C"><enum>(4)</enum><header display-inline="yes-display-inline">Sexual orientation</header><text display-inline="yes-display-inline">The term <term>sexual orientation</term> means homosexuality, heterosexuality, or bisexuality.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H497E74BB5606442F9456B4371DA195AA"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 1903(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(i)</external-xref>) is amended—</text> 
<paragraph id="H3360C32150E942F488102B740B112833"><enum>(1)</enum><text>in paragraph (26), by striking <quote>or</quote> at the end;</text></paragraph> <paragraph id="H8DD2596D05A643DEA305CFA6954142CC"><enum>(2)</enum><text>in paragraph (27), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph> 
<paragraph id="HC7354998ABC9481485933639E4EEA536"><enum>(3)</enum><text>by inserting after paragraph (27) the following new paragraph:</text> <quoted-block display-inline="no-display-inline" id="HF70FF7ACA30B4614B216A4B2A58D2899" style="OLC"> <paragraph id="H98C89612062B48969FADD84A975C18E2"><enum>(28)</enum><text display-inline="yes-display-inline">with respect to any amount expended for conversion therapy (as defined in section 1902(uu)) on or after the date described in section 1902(a)(88).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>
