<section id="HA00561F2DF8E44B4AF85395CE3809392" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Homecare for Seniors Act</short-title></quote>.</text></section> <section id="H3D2E421800B9412FA12D4F93950F3BA0"><enum>2.</enum><header>Certain home care expenses treated as qualified distributions from health savings accounts</header> <subsection id="H88C78A6A4B98472A8C1294A06167150B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/223">Section 223(d)(2)</external-xref> of the Internal Revenue Code of 1986 is amended—</text> 
<paragraph id="HCFD57AA890EF496FA4D8D41022D58464"><enum>(1)</enum><text>by striking <quote>medical care (as defined in section 213(d))</quote> in subparagraph (A) and inserting <quote>specified medical care</quote>, and</text></paragraph> <paragraph id="HCDCE10213AB24FA195CA1C8A7F893871"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text> 
<quoted-block display-inline="no-display-inline" id="H822521C91D2748F3B7C5C9FA36621715" style="OLC"> 
<subparagraph id="HCAA2A5D2D194409FACFFEE079493C661"><enum>(E)</enum><header>Specified medical care</header><text display-inline="yes-display-inline">For purposes of this paragraph—</text> <clause id="H6835E92A46F749268053FBCF26AEF7FF"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The term <quote>specified medical care</quote> means medical care (as defined in section 213(d)) and qualified home care.</text></clause> 
<clause id="H5E1EBDAD9E71453696F259D6ED284518"><enum>(ii)</enum><header>Qualified home care</header><text display-inline="yes-display-inline">The term <quote>qualified home care</quote> means a contract to provide 3 or more of the following services in the residence of the service recipient:</text> <subclause id="H31D73FEB59B04AEC8D3FC006E05DC965"><enum>(I)</enum><text>Assistance with eating.</text></subclause> 
<subclause id="H12B817B25C274067AC7C5951AFB2E5F6"><enum>(II)</enum><text>Assistance with toileting.</text></subclause> <subclause id="H6E9B47F07B2B4CABADEF3472DB511A6B"><enum>(III)</enum><text>Assistance with transferring.</text></subclause> 
<subclause id="HF3E088C7C7684B99BD94D861F6C6B9CC"><enum>(IV)</enum><text>Assistance with bathing.</text></subclause> <subclause id="H2AFA197E06DA49D686BD81A2B12577DA"><enum>(V)</enum><text>Assistance with dressing.</text></subclause> 
<subclause id="HEAB6FF4917AE48059E1AE2856797C031"><enum>(VI)</enum><text>Assistance with continence.</text></subclause> <subclause id="H46CA58168243421E904DFED5E4FD1E33"><enum>(VII)</enum><text>Medication adherence.</text></subclause><continuation-text continuation-text-level="clause">Such term shall not include any contract unless the services provided pursuant to such contract are provided by a service provider which is licensed by the State to provide such services or such services are otherwise provided in a manner that is consistent with State requirements.</continuation-text></clause> 
<clause id="HEDDF2A61172D403398E5F7AD9E3E887D"><enum>(iii)</enum><header>Related parties</header><text>The term <quote>qualified home care</quote> shall not include any contract which is, directly or indirectly, between a service provider and a service recipient who are related within the meaning of section 267(b) or 707(b).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HFBD7E256FFA34BF4B1662D759717D751"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply to amounts paid with respect to taxable years beginning after the date of the enactment of this Act.</text></subsection> 
<subsection id="H074CFE32C23541E5BD651678038768E2"><enum>(c)</enum><header>Promotion of public awareness of in-Home service expenses eligible for tax-Free distribution from health savings accounts</header><text>The Secretary of Health and Human Services, in consultation with the Secretary of the Treasury, shall carry out a campaign to increase public awareness of the in-home service expenses that are eligible for tax-free distribution from health savings accounts.</text></subsection></section> </legis-body></bill>
