                                    <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Foreign Americium Disposal and Storage Act of 2025</short-title></quote> or the <quote><short-title>FADS Act of 2025</short-title></quote>.</text>

                                    <enum>2.</enum>
                                    <header>Clarification of authority to dispose of certain fissile
                                                or radiological materials</header>
                                    <subsection id="H4BCE68809D954DF19C73740BD7929E4E">
                                                <enum>(a)</enum>
                                                <header>Findings</header>
 <text>Congress finds the following:</text> <paragraph id="H21462B1552304232854104D1149A010B"> <enum>(1)</enum> <text display-inline="yes-display-inline">While United States-origin americium-241 (Am–241) sealed sources recovered by the National Nuclear Security Administration of the Department of Energy may be disposed of at the Waste Isolation Pilot Plant (WIPP), Russian-origin Am–241 sources may not be.</text>
                                                </paragraph>
                                                <paragraph id="H79DA21C900B8401FB8F3A0C9D8FD2257">
                                                  <enum>(2)</enum>
 <text>Section 2(19) of the WIPP Land Withdrawal Act of 1991 identifies WIPP as the location for the disposal of <quote>radioactive waste materials generated by atomic energy defense activities</quote>.</text>

                                                  <enum>(3)</enum>
 <text>The Am–241 sources of concern that may not currently be eligible for disposal at WIPP have the same isotopic properties and are often colocated with sources that are eligible for disposal at WIPP.</text>

                                                  <enum>(4)</enum>
 <text>Russian-origin sealed sources, once confirmed to meet the WIPP Waste Acceptance Criteria, should be eligible for disposal at WIPP.</text>
                                                </paragraph>

                                                  <enum>(5)</enum>
 <text>The Carlsbad Field Office of the Department estimates the volume to be disposed is equivalent to 1 to 2 shipments a year and will have a negligible impact on WIPP operations.</text>
                                                </paragraph>
                                                <paragraph id="HCFBD9831E6C0455C9CD8896E56DEBAAC">
                                                  <enum>(6)</enum>
 <text>The Department, the Nuclear Regulatory Commission (NRC), and the international community have identified Am–241 as a radioisotope that should be protected due to the possibility of its use in a radiological dispersal device.</text>

                                                  <enum>(7)</enum>
 <text display-inline="yes-display-inline">As part of its defense nuclear nonproliferation mission, the National Nuclear Security Administration recovers thousands of disused sealed sources from domestic and international facilities.</text>
                                                </paragraph>

                                                  <enum>(8)</enum>
 <text display-inline="yes-display-inline" >Codifying a disposition pathway for these Am–241 sources will allow the National Nuclear Security Administration to accelerate their removal and reduce the availability of material that could be used in a dirty bomb.</text>
                                                </paragraph>
                                    </subsection>
                                    <subsection id="H6230C412E3934429899FD0EC8561C11D">
                                                <enum>(b)</enum>
                                                <header>Clarification</header>
 <text>Section 3132(c)(1) of the Ronald W. Reagan National Defense Authorization Act for Fiscal Year 2005 (<external-xref legal-doc="usc" parsable-cite="usc/50/2569">50 U.S.C. 2569(c)(1)</external-xref>) is amended by adding at the end the following new subparagraph:</text>

              <enum>(i)</enum>
 <text display-inline="yes-display-inline">The collection, storage, and safe disposal of the materials described in clause (ii) as waste materials generated by atomic energy defense activities for the purpose of disposal of such materials at WIPP (as defined in section 2(19) of the Waste Isolation Pilot Plant Land Withdrawal Act (<external-xref legal-doc="public-law" parsable-cite="pl/102/579">Public Law 102–579</external-xref>; 106 Stat. 4777)).</text>
            </clause>
            <clause id="H24F97096A6DB42F59A3B52414D964500" indent="up1">
              <enum>(ii)</enum>
 <text>The materials described in this clause are proliferation-attractive fissile materials or radiological materials that—</text>
              <subclause id="H1005EDCFB4D14641BC7F413456C7C106">
                <enum>(I)</enum>
 <text>contain transuranic elements of foreign-origin; and</text> </subclause> <subclause id="HFD1886D8DBF94CC882FB105B63BEB2CD"> <enum>(II)</enum> <text>but for subclause (I), are similar to proliferation-attractive fissile materials or radiological materials covered by this section.</text>
              </subclause>
            </clause>
