<section id="H7BE433434FB64905BE0549A5D20490EA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clean Air and Economic Advancement Reform Act</short-title></quote> or the <quote><short-title>CLEAR Act</short-title></quote>.</text> </section> <section id="H8A8B352F3B884BB2BBF057D13F0F7288" commented="no"><enum>2.</enum><header>Facilitating State implementation of national ambient air quality standards</header> <subsection id="H6E8510711C124B389105D291117C3879" commented="no"><enum>(a)</enum><header>Timeline for review of national ambient air quality standards</header><text display-inline="yes-display-inline">Paragraphs (1) and (2)(B) of section 109(d) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409(d)</external-xref>) are amended by striking <quote>five-year intervals</quote> each place it appears and inserting <quote>10-year intervals</quote>.</text></subsection> 
<subsection id="HE60E8B46B2864384A989FB22671F903F" commented="no"><enum>(b)</enum><header>Consideration of attainability</header><text>Section 109(b)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409(b)(1)</external-xref>) is amended by inserting after the first sentence the following: <quote>If the Administrator, in consultation with the independent scientific review committee appointed under subsection (d), finds that a range of levels of air quality for an air pollutant are requisite to protect public health with an adequate margin of safety, as described in the preceding sentence, the Administrator may, as a secondary consideration in establishing and revising the national primary ambient air quality standard for such air pollutant, consider likely attainability of the standard.</quote>.</text></subsection> <subsection id="H61F63B68277A4CBDB78270555629D290" commented="no"><enum>(c)</enum><header>Opportunity for States To correct deficiency prior to promulgation of Federal implementation plan</header><text display-inline="yes-display-inline">Section 110(c)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7410">42 U.S.C. 7410(c)(1)</external-xref>) is amended—</text> 
<paragraph id="H3065142B4F774DEF89FC6B3EA2D198E6" commented="no"><enum>(1)</enum><text>by striking <quote>at any time</quote>; and</text></paragraph> <paragraph id="H8D6A2722A5854AFF87809DD0E9B62468" commented="no"><enum>(2)</enum><text>by adding at the end the following: <quote>Before promulgating the Federal implementation plan, the Administrator shall give the State at least one year after such finding or disapproval to submit a plan or plan revision to correct the deficiency. If the State submits a plan or plan revision to correct the deficiency, the Administrator may, notwithstanding the 2-year deadline under this paragraph to promulgate a Federal implementation plan, take up to 3 years after such finding or disapproval to promulgate a Federal implementation plan.</quote>.</text></paragraph></subsection> 
<subsection id="H16AD7FDA2D234FD6A30B33003E59EB99" commented="no"><enum>(d)</enum><header>Contingency measures for extreme ozone nonattainment areas</header><text display-inline="yes-display-inline">Section 172(c)(9) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7502">42 U.S.C. 7502(c)(9)</external-xref>) is amended by adding at the end the following: <quote>Notwithstanding the preceding sentences and any other provision of this Act, such measures shall not be required for any nonattainment area for ozone classified as an Extreme Area.</quote>.</text></subsection> <subsection id="HCADBDB93CBBE45438CC0D270FDF1A3F5" commented="no"><enum>(e)</enum><header>Plan submissions and requirements for ozone nonattainment areas</header><text display-inline="yes-display-inline">Section 182 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7511a">42 U.S.C. 7511a</external-xref>) is amended—</text> 
<paragraph id="HCE53AF15D4F74C79AC3ECF4B1038382D" commented="no"><enum>(1)</enum><text>in subsection (b)(1)(A)(ii)(III), by inserting <quote>and economic feasibility</quote> after <quote>technological achievability</quote>;</text></paragraph> <paragraph id="H6E5C43C198E14754B7086A221C54700B" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c)(2)(B)(ii), by inserting <quote>and economic feasibility</quote> after <quote>technological achievability</quote>;</text></paragraph> 
<paragraph id="HAFE9B5DC47E840FAA225254CDCAACC9B" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (e), in the matter preceding paragraph (1)—</text> <subparagraph id="H50250E4ABB1E4195BFB692A14A86FD95" commented="no"><enum>(A)</enum><text>by striking <quote>The provisions of clause (ii) of subsection (c)(2)(B) (relating to reductions of less than 3 percent), the provisions of paragaphs</quote> and inserting <quote>The provisions of paragraphs</quote>; and</text></subparagraph> 
<subparagraph id="H0AA09C2F82954F1E97B2D3BC9507E52A" commented="no"><enum>(B)</enum><text>by striking <quote>, and the provisions of clause (ii) of subsection (b)(1)(A) (relating to reductions of less than 15 percent)</quote>; and</text></subparagraph></paragraph> <paragraph id="H88A30E56767A403EA225BE4C2AB0737A" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">in paragraph (5) of subsection (e), by striking <quote>, if the State demonstrates to the satisfaction of the Administrator that—</quote> and all that follows through the end of the paragraph and inserting a period.</text></paragraph></subsection> 
<subsection id="HB5E672927238453AB50828FA05087B7B" commented="no"><enum>(f)</enum><header>Plan revisions for milestones for particulate matter nonattainment areas</header><text display-inline="yes-display-inline">Section 189(c)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7513a">42 U.S.C. 7513a(c)(1)</external-xref>) is amended by inserting <quote>, which take into account technological achievability and economic feasibility,</quote> before <quote>and which demonstrate reasonable further progress</quote>.</text></subsection></section> <section id="HB745F313357E4AF793C904263CFDB15C" commented="no"><enum>3.</enum><header>Emissions beyond control</header> <subsection id="H9EC7E9031FBC43D984B2566398DAEEB3" commented="no"><enum>(a)</enum><header>Exceptional events</header><text display-inline="yes-display-inline">Section 319(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7619">42 U.S.C. 7619(b)</external-xref>) is amended—</text> 
<paragraph id="H637F1B735CFF418AA27FE71989033BBA" commented="no"><enum>(1)</enum><text>in the subsection heading, by inserting <quote><header-in-text level="subsection" style="OLC">Or actions To mitigate wildfire risk</header-in-text></quote> after <quote><header-in-text level="subsection" style="OLC">Events</header-in-text></quote>;</text></paragraph> <paragraph id="H266A03F1966140E9BEE4E36D97F16C6D" commented="no"><enum>(2)</enum><text>in paragraph (1)—</text> 
<subparagraph id="HD468B10286E24A93B0DE142AAB7C6D5D" commented="no"><enum>(A)</enum><text>in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">Definition of exceptional event</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Definitions</header-in-text></quote>;</text></subparagraph> <subparagraph id="H12ABAAA1300E414FAB7A4BD72EA2CFE3" commented="no"><enum>(B)</enum><text>in subparagraph (A), by redesignating clauses (i) through (iv), as subclauses (I) through (IV), respectively;</text></subparagraph> 
<subparagraph id="HA0127798670F42F7A833746439C3165C" commented="no"><enum>(C)</enum><text>by striking <quote>(A)</quote> and all that follows through <quote>an event that—</quote> and inserting the following:</text> <quoted-block style="OLC" id="H0B6799AC7D564A1C986482F278C9F725" display-inline="no-display-inline"> <subparagraph id="HAAA74145794C42F685C8ECD40ABB8069" commented="no"><enum>(A)</enum><header>Exceptional event</header> <clause id="H89705F625D1F48D884C2A2DF502731FA" commented="no"><enum>(i)</enum><header>In general</header><text>The term <term>exceptional event</term> means an event that—</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H89D10BCDE9554E8B8074D3B8BE9D11A8" commented="no"><enum>(D)</enum><text>by amending subclause (III) of subparagraph (A)(i), as redesignated, to read as follows:</text> <quoted-block style="OLC" id="HD0CB0FB94A884FCF93EDDF798D3EB357" display-inline="no-display-inline"> <subclause id="H1384DD7958E2479EB91F572076FF4FF1" commented="no"><enum>(III)</enum><text display-inline="yes-display-inline">is an event that is—</text> 
<item id="H5C9579FB46054DB787896AD067D5B0DF" commented="no"><enum>(aa)</enum><text>a natural event;</text></item> <item id="H20EB756D73284951AAE23471BCEE3100" commented="no"><enum>(bb)</enum><text display-inline="yes-display-inline">caused by a human activity that is intended to mirror the occurrence or reoccurrence of a natural event; or</text></item> 
<item id="HC7B96F8AE0C64F7BA087C88C99C20EAD" commented="no"><enum>(cc)</enum><text>caused by a human activity that is unlikely to recur; and</text></item></subclause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H171132AABC41468CB68050AAD97DFEB4" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">by striking subparagraph (B) and inserting the following:</text> 
<quoted-block style="OLC" id="H128C3FC6C402487C94793B4CDA473938" display-inline="no-display-inline"> 
<clause id="HA1F8814CF8CB4A72ABEF5699447E8BAE" commented="no"><enum>(ii)</enum><header>Exclusions</header><text>In this subsection, the term <term>exceptional event</term> does not include—</text> <subclause id="H4B103BEA44F14EF6B693F0E1EFC977DB" commented="no"><enum>(I)</enum><text>ordinarily occurring stagnation of air masses;</text></subclause> 
<subclause id="H63126015360E447BA622FD9329868C8E" commented="no"><enum>(II)</enum><text>meteorological inversions; or</text></subclause> <subclause id="HE5A0EE07D04E48E39AAFF67D3CA22E55" commented="no"><enum>(III)</enum><text>air pollution relating to source noncompliance.</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H5FC1188F06174AB8AA208F26D6ECAA8E" commented="no"><enum>(F)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="HDCCE5A9AEC114EF780ADFA423B2E50D8" display-inline="no-display-inline"> <subparagraph id="HB8A85AFDEC7B4CE1BBB110460DCCDBB1" commented="no"><enum>(B)</enum><header>Action to mitigate wildfire risk</header><text display-inline="yes-display-inline">The term <term>action to mitigate wildfire risk</term> means a prescribed fire or similar measure, undertaken in accordance with State approved practices, to reduce the risk and severity of wildfires.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H88C97827D027495EBF8A9678C36A8AE3" commented="no"><enum>(3)</enum><text>in paragraph (2)—</text> <subparagraph id="H2D8AF538A5DD4CEB9D1A4EEC5E84509D" commented="no"><enum>(A)</enum><text>in subparagraph (A)—</text> 
<clause id="H6ADAC9550552464AA8F52EDA742A0C08" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>March 1, 2006</quote> and inserting <quote>18 months after the date of enactment of the <short-title>CLEAR Act</short-title></quote>;</text></clause> <clause id="H5D638F18F3F64748951F2D122D394605" commented="no"><enum>(ii)</enum><text>by inserting <quote>revisions to</quote> before <quote>regulations</quote>; and</text></clause> 
<clause id="H4132FF31141C468D868520930351C6B8" commented="no"><enum>(iii)</enum><text>by adding <quote>or actions to mitigate wildfire risk</quote> before the period at the end;</text></clause></subparagraph> <subparagraph id="HF0B09C2B3248453B8E8B67C44D466DA5" commented="no"><enum>(B)</enum><text>in subparagraph (B)—</text> 
<clause id="H9211481197444CB6AD9422C4E83329DA" commented="no"><enum>(i)</enum><text>by inserting <quote>or action to mitigate wildfire risk</quote> after <quote>an exceptional event</quote>; and</text></clause> <clause id="H163388FA034244618DE6F34A7BC7570B" commented="no"> <enum>(ii)</enum> <text>by striking <quote>paragraph (3)</quote> and inserting <quote>this section</quote>; and</text>
                        </clause></subparagraph> 
<subparagraph id="H5A85AADC6FC94595AAF99110764D5712" commented="no"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="HEB880E07CBC647CD9EB98EA113AE714E" display-inline="no-display-inline"> <subparagraph id="HBB2F993D013247B597BF521AC662574C" commented="no"><enum>(C)</enum><header>Regional analysis</header><text display-inline="yes-display-inline">When more than one State notifies the Administrator of its intent to submit a petition for an exceptional event or an action to mitigate wildfire risk for the same air quality event, the Administrator shall conduct regional modeling and analysis, upon request by one or more States, to satisfy the analysis required for an exceptional event or an action to mitigate wildfire risk petition for such air quality event.</text></subparagraph> 
<subparagraph id="H496792171E024E6387CB6976E4FF6A62" commented="no"><enum>(D)</enum><header>Transparency</header><text display-inline="yes-display-inline">Not later than 12 months after the date of enactment of the <short-title>CLEAR Act</short-title>, the Administrator shall establish and update monthly a public website describing the status of all submitted petitions for exceptional events and actions to mitigate wildfire risk. </text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H17A89D96A35243DF9A9511582582331E" commented="no"><enum>(4)</enum><text>in paragraph (3)(A)—</text> 
<subparagraph id="H3E042E9E56C94F358AE4516386426968" commented="no"><enum>(A)</enum><text>by redesignating clauses (ii) through (v) as clauses (iii) through (vi), respectively; and</text></subparagraph> <subparagraph id="H1C80B939349C4982B32B21F3D9D8B361" commented="no"><enum>(B)</enum><text>by inserting after clause (i) the following:</text> 
<quoted-block style="OLC" id="HE28ADB7DEC99455DA4CD2FDC33E0BB1F" display-inline="no-display-inline"> 
<clause id="H3C208AEBB5E143E284D8FE10B75F6B7E" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">the principle that actions to mitigate wildfire risk can play an important role in reducing the magnitude and frequency of wildfires;</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="HAA3247018232420284517A42BC64AC0E" commented="no"><enum>(5)</enum><text>in paragraph (3)(B)—</text> 
<subparagraph id="HF6AF4C28AA884B168899AA9898043604" commented="no"><enum>(A)</enum><text>in clause (i), by inserting <quote>or action to mitigate wildfire risk</quote> before <quote>must be</quote>;</text></subparagraph> <subparagraph id="H010DFD2E9E10435EBB322EF84B5EFFE2" commented="no"><enum>(B)</enum><text>by amending clause (ii) to read as follows:</text> 
<quoted-block style="OLC" id="HCC65842F987E4E719731B5CCDABBC40E" display-inline="no-display-inline"> 
<clause id="H1E21CBB035424430BCC64BA1775C0587" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">a clear causal relationship must exist, or be reasonably expected to exist, between the measured exceedances of a national ambient air quality standard and the exceptional event or action to mitigate wildfire risk to demonstrate that the exceptional event or action to mitigate wildfire risk caused a specific air pollution concentration at a particular air quality monitoring location;</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H52B060F01F6D42309299CD191E8D63FD" commented="no"><enum>(C)</enum><text>by amending clause (iv) to read as follows:</text> 
<quoted-block style="OLC" id="H77582D0532DC4F1E9FCBDC73246F37EA" display-inline="no-display-inline"> 
<clause id="HD8661C3E767D44A4BDB0388DE5CB812D" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">there are criteria and procedures for the Governor of a State to petition the Administrator to exclude air quality monitoring data that is directly due to exceptional events or actions to mitigate wildfire risk from use in determinations by the Administrator with respect to—</text> <subclause id="H66CF425A773949339686EA7A8FC723B0" commented="no"><enum>(I)</enum><text>area or source exceedances or violations of the national ambient air quality standards;</text></subclause> 
<subclause id="HA6DE8BFE15DD4CCF8A2521892D99D0E1" commented="no"><enum>(II)</enum><text display-inline="yes-display-inline">the designation, redesignation, classification, or reclassification of an area;</text></subclause> <subclause id="HF729C62BEFB54D77822D8180FF916029" commented="no"><enum>(III)</enum><text>the demonstration by a State of attainment of a national ambient air quality standard;</text></subclause> 
<subclause id="H11564D009FBD4971B0D1ACC51DDD790D" commented="no"><enum>(IV)</enum><text>attainment determinations;</text></subclause> <subclause id="HF01014D9E1FF427B88D8DD6F02CD9607" commented="no"><enum>(V)</enum><text>attainment date extensions;</text></subclause> 
<subclause id="H92B59EEE40E94323874299E4A13DFB6A" commented="no"><enum>(VI)</enum><text>finding a State implementation plan to be inadequate; or</text></subclause> <subclause id="H8871640294214B529B315C8BCBBD9A93" commented="no"><enum>(VII)</enum><text>preconstruction demonstrations under section 165(a)(3).</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HD298DD656CCE4FCE962CAB1828E1A65A" commented="no"><enum>(6)</enum><text>by striking paragraph (4).</text></paragraph></subsection> <subsection id="H9068B8A79256440FA76459FABC1B7A85" commented="no"><enum>(b)</enum><header>Applicability of sanctions and fees if emissions beyond control</header><text display-inline="yes-display-inline">The Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) is amended by inserting after section 179B the following new section:</text> 
<quoted-block style="OLC" id="HA66BAA449F9D4097A7DAC4DE1982408C" display-inline="no-display-inline"> 
<section id="HDD53793DC8FE47CE8DD67668B112AC04" commented="no"><enum>179C.</enum><header>Applicability of sanctions and fees if emissions beyond control</header> 
<subsection id="HA40AAC5D843C453CA784AE009F7100E2" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act, with respect to any nonattainment area that is classified under section 181 as a Severe Area or an Extreme Area for ozone or under section 188 as a Serious Area for particulate matter, no sanction or fee under section 179 or 185 shall apply with respect to a State (or an area or source therein) on the basis of a deficiency described in section 179(a), or the failure to attain a national ambient air quality standard for ozone or particulate matter by the applicable attainment date, if the State demonstrates that the State would have avoided such deficiency, or such standard would have been attained, but for one or more of the following:</text> <paragraph id="HF85186CE8AB94C9F8E35000BA7C4EBCC" commented="no"><enum>(1)</enum><text>Emissions emanating from outside the nonattainment area.</text></paragraph> 
<paragraph id="H3BD0515E18F14352B11262F72BBA929C" commented="no"><enum>(2)</enum><text>Emissions from an exceptional event (as defined in section 319(b)(1)).</text></paragraph> <paragraph id="H20A0F726741742D886833905E6440F35" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">Emissions from mobile sources to the extent the State demonstrates that—</text> 
<subparagraph id="H931D10CE52A44FB185AB53B1792CA62A" commented="no"><enum>(A)</enum><text>such emissions are beyond the control of the State to reduce or eliminate; and</text></subparagraph> <subparagraph id="H8BC1E254BD0E4ABE816C387658F5BA01" commented="no"><enum>(B)</enum><text>the State is fully implementing such measures as are within the authority of the State to control emissions from the mobile sources.</text></subparagraph></paragraph></subsection> 
<subsection id="H501F338D8F7E4CF0A3C09D8375633028" commented="no"><enum>(b)</enum><header>No effect on underlying standards</header><text display-inline="yes-display-inline">The inapplicability of sanctions or fees with respect to a State (or an area or source therein) pursuant to subsection (a) does not affect the obligation of a State, area, source, or other entity under other provisions of this Act to establish and implement measures to attain a national ambient air quality standard for ozone or particulate matter.</text></subsection> <subsection id="H15B7CE6233E34728B6A8CB4823725056" commented="no"><enum>(c)</enum><header>Periodic renewal of demonstration</header><text display-inline="yes-display-inline">For subsection (a) to continue to apply with respect to a State (or an area or source therein), the State involved shall renew the demonstration required by subsection (a) at least once every 5 years.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H13C139068AC94893919C78CC68B09EAF" commented="no"><enum>4.</enum><header>Clean Air Scientific Advisory Committee</header> 
<subsection id="H030BBA6481BE47ECAE7681381698BF33" commented="no"><enum>(a)</enum><header>Composition of independent scientific review committee</header><text display-inline="yes-display-inline">Section 109(d)(2)(A) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409(d)(2)(A)</external-xref>) is amended—</text> <paragraph id="HFBD0F75DB8A040EABA7193145DD42D20" commented="no"><enum>(1)</enum><text>by striking <quote>one person representing State air pollution control agencies</quote> and inserting <quote>three persons representing State air pollution control agencies</quote>; and</text></paragraph> 
<paragraph id="HFFE5062C679B4C94A69E3C1A48DF1EEB" commented="no"><enum>(2)</enum><text>by adding at the end the following: <quote>The persons representing State air pollution control agencies shall be from geographically diverse areas with at least one person representing a State located in Region 1, 2, 3, or 5 of the Environmental Protection Agency, one person representing a State located in Region 4, 6, or 7 of the Environmental Protection Agency, and one person representing a State located in Region 8, 9, or 10 of the Environmental Protection Agency.</quote>.</text></paragraph></subsection> <subsection id="HE4885CFC1A8C4332BCB12E11A540AC7E" commented="no"><enum>(b)</enum><header>Consideration of adverse public health, welfare, social, economic, or energy effects</header><text display-inline="yes-display-inline">Section 109(d)(2) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409(d)(2)</external-xref>) is amended by adding at the end the following:</text>

<subparagraph id="H3E15FC41E7E14BD28B205CD11C72B844" indent="up2" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">Prior to establishing or revising a national ambient air quality standard, the Administrator shall request, and such committee, after receiving public comments, shall assess and provide advice under subparagraph (C)(iv) regarding any adverse public health, welfare, social, economic, or energy effects which may result from various strategies for attainment and maintenance of such national ambient air quality standard.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> </legis-body></bill>
