<section id="H8E3EB58CD8C94701B47046D514A36FDD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Saving Hazardous And Declining Environments Act</short-title></quote> or the <quote><short-title>SHADE Act</short-title></quote>.</text></section> <section id="H42BCA800F6344201B0C5BF0C97B01340" section-type="subsequent-section"><enum>2.</enum><header>Tree planting grant program</header> <subsection id="HD67E5A35311B4B928EA26798851127A7"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of Housing and Urban Development, in coordination with the Secretary of Agriculture, acting through the Chief of the Forest Service, shall, not later than 180 days after any amounts are appropriated under subsection (f), establish a grant program under which the Secretary shall award grants to eligible entities to plant qualifying trees in eligible areas.</text></subsection> 
<subsection id="HC6945237CFA64A02B71E652E9C70076E"><enum>(b)</enum><header>Notice of funding opportunity</header><text>The Secretary shall, not later than 180 days after the date of the enactment of this Act, publish a notice of funding opportunity for the grant program established under subsection (a).</text></subsection> <subsection id="HA92BA47D30A544C2A0364E99D750EAF7"><enum>(c)</enum><header>Applications</header> <paragraph id="HA349F5E2E62A4840B137F92648D71AB7"><enum>(1)</enum><header>In general</header><text>An eligible entity that seeks to receive a grant under subsection (a) shall submit an application to the Secretary at such time, in such form, and containing such information as the Secretary may require.</text></paragraph> 
<paragraph id="HD74BE9FB91EF4A39AFD78B8D5207219E"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">An application submitted under paragraph (1) shall include a 5-year timeline and budget for the planting and maintenance associated with any qualifying trees awarded.</text></paragraph> <paragraph id="H6F791F8563454C0B82DC304ECB26AB6B"><enum>(3)</enum><header>Community involvement</header><text display-inline="yes-display-inline">The Secretary shall require eligible entities to develop a public participation plan to ensure that residents of the area in which a project is to be implemented are involved in decision-making about the project and such public participation plan may include—</text> 
<subparagraph id="HABC34E165995427A80630D879F9D39B4"><enum>(A)</enum><text>opportunities for local nonprofits to be involved;</text></subparagraph> <subparagraph id="H2ACEC745BD5D4266B30DBA112B7EA18A"><enum>(B)</enum><text>opportunities for public input; and</text></subparagraph> 
<subparagraph id="H409A940B7D8043C18EAC6E69365E56A0"><enum>(C)</enum><text>demonstrated support from the community.</text></subparagraph></paragraph></subsection> <subsection id="H693F9E662D214A5691EE76AA31553031" display-inline="no-display-inline"><enum>(d)</enum><header>Selection</header><text display-inline="yes-display-inline">When awarding grants under subsection (a), the Secretary shall give priority to eligible entities that, as determined by the Secretary, have a housing policy plan that will minimize the displacement of current residents.</text> </subsection> 
<subsection id="HDEFEF9694B5D410DBB4D5E2D8F3424D0" display-inline="no-display-inline"><enum>(e)</enum><header>Use of amounts</header><text>An eligible entity that receives a grant under subsection (a) shall use amounts provided to cover costs associated with—</text> <paragraph id="H6FC17906BA7A4EAAA067F7B9921466DE" display-inline="no-display-inline"><enum>(1)</enum><text>implementing the tree planting project in an eligible area, including—</text> 
<subparagraph id="H80CA1CD3D51C45E29DD344CBDF82EC22"><enum>(A)</enum><text>planning and designing the planting activity;</text></subparagraph> <subparagraph id="H44BE1FC321314C0AA9B3322E4D4447D9"><enum>(B)</enum><text>purchasing qualifying trees; and</text></subparagraph> 
<subparagraph id="HAD161FF28C4949FE876934F32F38EB81"><enum>(C)</enum><text>preparing the site and conducting planting, including the labor and cost associated with the use of machinery;</text></subparagraph></paragraph> <paragraph id="HC917CC8A50A5493C93B4563C8DD86770"><enum>(2)</enum><text>maintaining and monitoring planted trees for a period of up to 5 years to ensure successful establishment of the qualifying trees;</text></paragraph> 
<paragraph id="H2D9DD497545E4B69BE24471C4AB1146A"><enum>(3)</enum><text>training activities associated with the project; and</text></paragraph> <paragraph id="HEF4A25F075354B91811D0A5EC250C9B8"><enum>(4)</enum><text>other relevant costs, as determined by the Secretary.</text></paragraph></subsection> 
<subsection id="HB549458E3A9A491B854C4B35D6E34338"><enum>(f)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out the Program $50,000,000 for each of fiscal years 2026 through 2036.</text></subsection> <subsection id="HE84CC93DA34B421894760C01DDD40FF7"><enum>(g)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HBB0C5D4313FA43A19606748CDD1A6BE4"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text> <subparagraph id="H519880D423CF4156A1B09D9D02C7C77A"><enum>(A)</enum><text>a State, Territory, or Tribal agency;</text></subparagraph> 
<subparagraph id="H0AEF4B81AB9E48EAA088F2D9ECA589B8"><enum>(B)</enum><text>a local government entity;</text></subparagraph> <subparagraph id="HCE6B1F33A2AF4343A8777CA7B4D19AD6"><enum>(C)</enum><text>an Indian Tribe; and</text></subparagraph> 
<subparagraph id="H236CD95E203C4ECE92E02B1A3E229020" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">a nonprofit organization that works with a State, Territory, or Tribal agency, a local government entity, or an Indian Tribe.</text></subparagraph></paragraph> <paragraph id="H30C9F9DB973D4F05BD2F8BAB3FF1CB91"><enum>(2)</enum><header>Eligible areas</header><text>The term <term>eligible area</term> means a redlined area or an intra-urban heat island effect area.</text></paragraph> 
<paragraph id="H0149A5D9B1E845D082F4A98A943C195F"><enum>(3)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term <term>Indian tribe</term> in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph> <paragraph id="H56A10CE3C5A04255A3639BFB62C8FD6C" commented="no"><enum>(4)</enum><header>Intra-urban heat island effect area</header><text display-inline="yes-display-inline">The term <term>intra-urban heat island effect area</term> means an area within a city that, as determined by the Secretary in coordination with the Director of the National Oceanic and Atmospheric Administration and the heads of other agencies as the Secretary determines appropriate, has lower tree canopy coverage and higher maximum daytime summer temperatures compared to adjacent or nearby areas within the same city.</text></paragraph> 
<paragraph id="H21D5E18D3C85465596E36BE32E363996"><enum>(5)</enum><header>Local governmental entity</header><text>The term <term>local governmental entity</term> means any municipal government or county government with jurisdiction over local land use decisions.</text></paragraph> <paragraph id="H97F4A0B4277248A6BAB4B59694F0F7F4"><enum>(6)</enum><header>Nonprofit organization</header><text display-inline="yes-display-inline">The term <term>nonprofit organization</term> means an organization that is described in <external-xref legal-doc="usc" parsable-cite="usc/26/170">section 170(h)(3)</external-xref> of the Internal Revenue Code of 1986.</text> </paragraph> 
<paragraph id="HBABEB9D9565247DD880B5F51BC102B6A"><enum>(7)</enum><header>Qualifying tree</header><text>The term qualifying tree means a tree that—</text> <subparagraph id="HFB6C2FCD0066439FB07D24E00051A929"><enum>(A)</enum><text>is a species that is not an invasive species in the eligible area in which such tree is to be planted; and</text></subparagraph> 
<subparagraph id="H36FFB3821AB84F2BAEB74139FC0DA0DF"><enum>(B)</enum><text>is not a species that is, in the eligible area at the time of planting, being attacked by an invasive species, unless the eligible entity has a plan to limit the risk of death of the tree to be planted.</text></subparagraph></paragraph> <paragraph id="H5F11AF798D264718A643055623C3167B"><enum>(8)</enum><header>Redlined area</header><text display-inline="yes-display-inline">The term <term>redlined area</term> means a census tract graded as <quote>hazardous</quote> or <quote>definitely declining</quote> in maps drawn by the Home Owners’ Loan Corporation that are, as of the date of enactment of this Act, low-income communities.</text> </paragraph> 
<paragraph id="HA24C38A07FFA4D9488A54F2043DF2869"><enum>(9)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Housing and Urban Development.</text></paragraph></subsection></section> </legis-body></bill>
