which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committees on <committee-name committee-id="HGO00">Oversight and Government Reform</committee-name>, <committee-name committee-id="HII00">Natural Resources</committee-name>, and <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the criminalization of homelessness on Federal public lands.</official-title></form><legis-body id="H89FE2362FCAD49628C8FE5104EDE33FF" style="OLC"><section id="H75C1BD3CA26B46FBA6C3BA1007145E00" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Housing not Handcuffs Act of 2025</short-title></quote>. </text></section><section id="H9881DE7DD9444433AAE52654A92BF702"><enum>2.</enum><header>Prohibited activities</header><subsection id="HAFEF909781B6472ABAAC601E31861336"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">A Federal agency may not impose a penalty on a homeless individual for a permitted use of public land as described under subsection (b). </text></subsection><subsection id="H90DE3B6D78AF4F48BC89751E6F3F6CA4"><enum>(b)</enum><header>Permitted use of public lands</header><text>A homeless individual may— </text><paragraph id="H742CB2B93EE54F0F8004E19EA52DF326"><enum>(1)</enum><text display-inline="yes-display-inline">conduct life sustaining activities on public land;</text></paragraph><paragraph id="H5F7C40476E3C4B2DAF1957B7ABD8C418"><enum>(2)</enum><text display-inline="yes-display-inline">use and move freely in places of public accommodation (as such term is defined in section 201 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000a">42 U.S.C. 2000a(b)</external-xref>); </text></paragraph><paragraph id="H8A4EFFDD755F47E4BB866CA3EFA0CC11"><enum>(3)</enum><text display-inline="yes-display-inline">solicit, share, accept, or offer food, water, money, or other donations;</text></paragraph><paragraph id="H53DF4411A5484F9E9E5A34899E7E9F21" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">store their possessions and enjoy privacy in their personal property to the same degree as property in a private dwelling, which shall not be subject to unreasonable search and seizure;</text></paragraph><paragraph id="H5D29301DD5EA4269988981A6E1B9E57A"><enum>(5)</enum><text display-inline="yes-display-inline">pray, meditate, worship, or practice religion; </text></paragraph><paragraph id="H1354F9C03EC9446D8C19B8BCD621685C"><enum>(6)</enum><text display-inline="yes-display-inline">occupy a lawfully parked motor vehicle or a recreational vehicle; and</text></paragraph><paragraph id="H34EBCA8366F74AB78002491C447DF824"><enum>(7)</enum><text display-inline="yes-display-inline">relocate a motor vehicle or recreational vehicle being used for life sustaining activities before a citation is issued or the vehicle is towed, retrieve items from a towed vehicle, and retrieve the vehicle from storage at a free or reduced rate upon consideration of ability to pay. </text></paragraph></subsection><subsection id="H2971D5C2A72D4B79901CC22ABAB5B466"><enum>(c)</enum><header>Exception</header><text display-inline="yes-display-inline">The permitted use under subsection (b)(1) shall not be a permitted use if there is adequate alternative indoor space available as described under subsection (d).</text></subsection><subsection id="HBEF2147C989C4FEE979566F533CACCF4"><enum>(d)</enum><header>Adequate alternative indoor space described</header><paragraph id="H44D4D108A95A4BF69AEB4C1CFD418146"><enum>(1)</enum><header>In general</header><text>Adequate alternative indoor space—</text><subparagraph id="HE751320F7F1B4E92A7F4909B60A48B2C"><enum>(A)</enum><text>is a space that—</text><clause id="H266113F7A4BA4EAEB6254801E9A13BF2"><enum>(i)</enum><text>is legally and physically accessible to the homeless individual; </text></clause><clause id="HD8CC0798307D4B72BD46B606DDE59E0F"><enum>(ii)</enum><text>does not require the homeless individual to sacrifice any other right afforded to them under Federal, State, or local law; and </text></clause><clause id="H0E0E1CF329A9421ABA12075ECDF61090" display-inline="no-display-inline"><enum>(iii)</enum><text>is available indefinitely to the individual without requiring daily reapplication, at no charge, and must accommodate any disabilities, as well as pets, partners (whether legally married or not), family members, other support persons, and possessions the individual wishes to bring with them; </text></clause></subparagraph><subparagraph id="H2253DE55BB25488EB1F708551ABBD6E9" display-inline="no-display-inline"><enum>(B)</enum><text>may be a tiny home or similar structure that includes—</text><clause id="H17E5F19EEFE543B98BE066E77E876046"><enum>(i)</enum><text>locking doors;</text></clause><clause id="H4CB5E84678DF476C82A115E589281120"><enum>(ii)</enum><text>appropriate climate control mechanisms based on the location of the home or structure; and </text></clause><clause id="H9578D38176FF4A9F8A1EBCE3A9E8DACB"><enum>(iii)</enum><text>sanitary and cooking facilities or is a part of a community with common sanitary and cooking facilities; or</text></clause></subparagraph><subparagraph id="HB106C94583864DC5981B6E2581F84F48"><enum>(C)</enum><text display-inline="yes-display-inline">may be a permitted parking area that includes sanitary facilities. </text></subparagraph></paragraph><paragraph id="HEFD1E6D0207D4109BA889C5C0B43F46B" display-inline="no-display-inline"><enum>(2)</enum><header>Jurisdiction</header><text>An adequate alternative indoor space in another jurisdiction shall only be deemed an adequate alternative indoor space for the homeless individual if transportation is made available, at no cost to the individual, to ensure the individual can continue to attend to any personal or professional business. </text></paragraph></subsection><subsection id="H1C1A763CCE8C4477A0C2E7914E7C324B" commented="no"><enum>(e)</enum><header>Enforcement</header><paragraph id="H7C68D7AD9D2F42659BC0AC79B51ED7CE" commented="no"><enum>(1)</enum><header>Attorney general</header><text display-inline="yes-display-inline">The Attorney General may bring a civil action in an appropriate district court of the United States against a government official who violates subsection (a) for equitable relief, including temporary, preliminary, or permanent injunctive relief and costs described under paragraph (3). </text></paragraph><paragraph id="H30991B2FCA0A4F74AE6021D38B2C4CEE" commented="no"><enum>(2)</enum><header>Private right of action</header><text display-inline="yes-display-inline">Any individual harmed by an violation of subsection (a) may bring a civil action in an appropriate district court of the United States against a government agency or official that violates subsection (a) for equitable relief, including temporary, preliminary, or permanent injunctive relief and costs described under paragraph (3). </text></paragraph><paragraph id="HE13270A92F3E44C0B648D53CB0D5BC8F" commented="no"><enum>(3)</enum><header>Costs</header><text>With respect to an action brought under paragraph (1) or (2), the court shall award costs of litigation, as well as reasonable attorney’s fees, to any prevailing plaintiff. A plaintiff shall not be liable to a defendant for costs or attorney’s fees in any non-frivolous action under this section.</text></paragraph></subsection><subsection id="H42E2055BCFFF49C2ABC50A22333BFC7B" commented="no"><enum>(f)</enum><header>Necessity defense</header><paragraph id="H741F65ECE54D4A5397DE54E9644C1F0A" commented="no"><enum>(1)</enum><header>In general</header><text>It shall be an affirmative defense for a homeless individual charged with any violation of law criminalizing a life-sustaining activity, that the individual had no access to an adequate alternative indoor space in which to undertake the prohibited conduct. </text></paragraph><paragraph id="H6A4AC694B06B4AE3A98724F21B267C58" commented="no"><enum>(2)</enum><header>Duty</header><text display-inline="yes-display-inline">The appropriate court shall notify the individual of the availability of the affirmative defense under paragraph (1). There shall be a rebuttable presumption that adequate alternative indoor space was not available to the homeless individual.</text></paragraph></subsection><subsection id="H06D31CDBA97D471B8CB6BD2642386FD0"><enum>(g)</enum><header>Rules of construction</header><paragraph id="HE16268184D604DBE9376FBF39D5913D9"><enum>(1)</enum><header>In general</header><text>A court shall liberally construe any provision of this Act to effectuate the purposes of the Act.</text></paragraph><paragraph id="HA0C00DD78D5F4F7A8CEE1C712EF092F4"><enum>(2)</enum><header>Rule of construction</header><text>Nothing in this Act shall be construed to authorize Federal, State, or local government to interfere with an individual’s right to be free from facing punishment for a housing status condition, or to diminish or in any way negatively affect an individual’s constitutional right be free from cruel and unusual punishment, or to displace any other remedy for violations of the individual’s constitutional rights. </text></paragraph></subsection><subsection id="H3712CE9252534CAAB9E5B4CFDE3E1EB8"><enum>(h)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H1A45C097D256488E85FC92732B0FCD30"><enum>(1)</enum><header>Homeless individual</header><text display-inline="yes-display-inline">The term <quote>homeless individual</quote> shall have the meaning given such term in section 103 of the Stewart B. McKinney Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11302">42 U.S.C. 11302</external-xref>). </text></paragraph><paragraph id="HE3510722C02F4CC08AA44E8F88A4583F" display-inline="no-display-inline"><enum>(2)</enum><header>Housing status</header><text>The term <quote>housing status</quote> means the actual or perceived status of having or not having housing, or being at risk of being homeless.</text></paragraph><paragraph id="HA40D91F6CA17400D8D9E9C31C84EADFF"><enum>(3)</enum><header>Life sustaining activities</header><text>The term <quote>life sustaining activities</quote> includes moving, resting, sitting, standing, lying down, sleeping, protecting oneself and personal property from the elements, eating, and drinking.</text></paragraph><paragraph id="HB7662366E8BB44D88E479F8F3C178D2F"><enum>(4)</enum><header>Cars</header><text>The term <quote>cars</quote> shall have the meaning given the term <quote>motor vehicle</quote> under section 17101 of title 40, United States Code. </text></paragraph><paragraph id="H1CF00A02F56C4E809F257D4B83709073"><enum>(5)</enum><header>Public land</header><text>The term <quote>public land</quote> means any property that is owned or leased, in whole or in part, by the United States, including areas adjacent to Federal property upon which there is an easement for public use and that is held open to the public, such as plazas, courtyards, parking lots, sidewalks, public transportation facilities and services, public buildings, underpasses and lands adjacent to roadways, and parks, such as those defined or administered under titles 23, 36, 43, or 50 of the Code of Federal Regulations.</text></paragraph><paragraph id="H210CBF6A6C634D598ED2AB725770E17C"><enum>(6)</enum><header>Recreational vehicle</header><text>The term <quote>recreational vehicle</quote> has the meaning given such term in section 3282.15 of title 24, Code of Federal Regulations (as defined on the date of the enactment of this Act). </text></paragraph></subsection></section></legis-body></bill>
