<section id="H63A547EC063F451E862A18893A528188" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Employee Rights Act</short-title></quote>.</text></section> <section id="HD40E5F73ACF24041B3171B55D61DE476"><enum>2.</enum><header>Enhanced employee rights for lawful workers</header> <text display-inline="no-display-inline">Section 9(a) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/159">29 U.S.C. 159(a)</external-xref>) is amended by striking <quote>designated or selected for the purposes of collective bargaining</quote> and inserting <quote>, for the purposes of collective bargaining selected by secret ballot of employees in an election conducted by the Board,</quote>.</text></section> 
<section id="HDD1B476B524E46C28922A4F2093771E1"><enum>3.</enum><header>Union voting for employees who do not have lawful status</header> 
<subsection id="HB99B02ABB5D64E728ED0DF8D7CF9DD9D"><enum>(a)</enum><header>National Labor Relations Act</header><text display-inline="yes-display-inline">Section 9 of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/159">29 U.S.C. 159</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" id="HF53CB0A8C5DF49CAA7F758C70FBD430C" display-inline="no-display-inline"> <subsection id="H0E1F452D805341C78A966939677477C8"><enum>(f)</enum><text display-inline="yes-display-inline">Any employee who does not have lawful status under the immigration laws (as such term is defined in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>)) shall not—</text> 
<paragraph id="HD7E729118CA74507B9E417A4EC6DE8A9" display-inline="no-display-inline"><enum>(1)</enum><text>be eligible to vote in any election (including an election by a secret ballot) conducted by the Board under this section, and any vote cast by such an employee in any such election shall not be valid; or</text> <subparagraph id="HC4477A789C0F40DBA45CB23C022C85DD" indent="up1"><enum>(A)</enum><text>be considered an employee for the purposes of any petition described in subsection (c) or (e).</text></subparagraph></paragraph></subsection> <after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HBF2C9F818B0B4B8AA58213B0170000F7"><enum>(b)</enum><header>Labor Management Relations Act</header><text>Section 209(b) of the Labor Management Relations Act, 1947 (<external-xref legal-doc="usc" parsable-cite="usc/29/179">29 U.S.C. 179(b)</external-xref>) is amended by adding at the end the following: <quote>Any such employee who does not have lawful status under the immigration laws (as such term is defined in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>)) shall not be entitled to vote in any such secret ballot.</quote>.</text></subsection> <subsection id="H3EC85D6C33DA4C16B3C80C0653ED23F8"><enum>(c)</enum><header>Labor-Management Reporting and Disclosure Act</header><text>Section 401 of the Labor-Management Reporting and Disclosure Act of 1959 (<external-xref legal-doc="usc" parsable-cite="usc/29/481">29 U.S.C. 481</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H2AFE9F37F6DA4DB7BEABA62E977FAE3C" display-inline="no-display-inline"> 
<subsection id="H988EEF2CD6364B2FA70BCA51093CF472"><enum>(j)</enum><text display-inline="yes-display-inline">Any employee who does not have lawful status under the immigration laws (as such term is defined in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>)) and who is a member of a labor organization shall not be entitled to vote in any election conducted by a labor organization under this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> </section> <section id="H520E78EC07BA42F4B1BFE364ACA532C6"><enum>4.</enum><header>Employee privacy</header> <subsection id="H078E336E1E944D788F1DC53B0AFDD9E4"><enum>(a)</enum><header>Notice of rights and protections; voter registration lists</header><text>Section 8 of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/158">29 U.S.C. 158</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H08E191D3A0D3493D9122B654980D4AAB" display-inline="no-display-inline"> 
<subsection id="H9C0395AA74374C06AE8A4BAE7B9B9C6C"><enum>(h)</enum> 
<paragraph id="HA50A9102E8954706BE41809AA428C514" display-inline="yes-display-inline"><enum>(1)</enum><text>Whenever the Board directs an election under section 9(c) or approves an election agreement, the employer of employees in the bargaining unit shall, after the Board directs such election or approves such election agreement, provide a voter list to a labor organization that has petitioned to represent such employees. Such voter list shall include the names of all employees in the bargaining unit and not more than one additional form of personal contact information for the employee (such as a telephone number, an email address, or a mailing address) chosen by the employee in writing. The voter list shall be provided in a searchable electronic format generally approved by the Board unless the employer certifies that the employer does not possess the capacity to produce the list in the required form. Not later than nine months after the date of enactment of the Employee Rights Act, the Board shall promulgate regulations implementing the requirements of this paragraph.</text></paragraph> <paragraph id="H8F01222D2F0740F79ABAA344D814DEAF" indent="up1"><enum>(2)</enum><text>It shall be an unfair labor practice for an employer to violate any requirement under this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H09493019DA0F4402B541FE2C3B2B052B"><enum>(b)</enum><header>Labor organization use of personal information</header><text>Section 8(b) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/158">29 U.S.C. 158(b)</external-xref>) is amended—</text> <paragraph id="H1AC74F88732F4E588708663D0BA900D9"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (6), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="H215EBE19966942D3AC65F5A1BAC383F1">
                    <enum>(2)</enum>
 <text>in paragraph (7)(C), by striking <quote>services.</quote> and inserting <quote>services;</quote>;</text>
                </paragraph> 
<paragraph id="H34B77FE70CA946D4B6D834F997BADDE3"><enum>(3)</enum><text>in the matter following paragraph (7)—</text> <subparagraph id="H4DA7A885E8E641A1946E0EC258A5D59C" commented="no"><enum>(A)</enum><text>by adjusting the margin two ems to the left; and</text></subparagraph> 
<subparagraph id="H3343EC0CB67C4ED58B95335AB475CC25" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>Nothing in this paragraph</quote> and inserting <quote>Nothing in paragraph</quote>; and</text></subparagraph></paragraph> <paragraph id="HA84283FC35B545E7953FE46FBB37F622" commented="no"><enum>(4)</enum><text>by inserting after subparagraph (C) of paragraph (7), as so amended, the following:</text>

<paragraph id="HDA17B12816FA4365B3D17D7E8EBCAFD3" commented="no"><enum>(8)</enum><text>to fail to protect the personal information of an employee received for an organizing drive, to use such information for any reason other than a representation proceeding, or to use such information after the conclusion of a representation proceeding;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H13BEB505F1FC497EBCFB8AC2A7C94640"> <enum>(c)</enum> <header>Right not To subsidize labor organization nonrepresentational activities</header> <text>Title I of the Labor-Management Reporting and Disclosure Act of 1959 (<external-xref legal-doc="usc" parsable-cite="usc/29/411">29 U.S.C. 411 et seq.</external-xref>) is amended by adding at the end the following:</text>

            <enum>106.</enum>
            <header>Right not to subsidize labor organization nonrepresentational
              activities</header>
 <text display-inline="no-display-inline">No employee’s labor organization dues, fees, assessments, or other contributions shall be used or contributed to any person, organization, or entity for any purpose not directly related to the labor organization’s collective bargaining or contract administration functions on behalf of the represented unit employee unless the employee member, or nonmember required to make such payments as a condition of employment, authorizes such expenditure in writing, after a notice period of not less than 35 days. An initial authorization provided by an employee under the preceding sentence shall expire not later than 1 year after the date on which such authorization is signed by the employee. There shall be no automatic renewal of an authorization under this section.</text>
          </section>

        </quoted-block>
      </subsection></section> 
<section id="H5ABDF400D2CB41E785986C547D333B2C"><enum>5.</enum><header>Employment relationships</header> 
<subsection id="H1840524D385344318500C20E08E46A75"><enum>(a)</enum><header>Criteria for determining employee status under the fair labor standards act</header><text>Section 3(e) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(e)</external-xref>) is amended—</text> <paragraph id="HC2CD7D1385524AE6969D8D95AE57C06C"><enum>(1)</enum><text>by redesignating paragraphs (2), (3), and (4) as paragraphs (3), (4), and (5), respectively;</text></paragraph> 
<paragraph id="H624DFD77B11F43A3ABC7A8EF8E7DF971"><enum>(2)</enum><text>in paragraph (1), by striking <quote>paragraphs (2), (3), and (4)</quote> and inserting <quote>paragraphs (3), (4), and (5)</quote>; and</text></paragraph> <paragraph id="H35C434F334A64EDF9EA8B588F10B5F86"><enum>(3)</enum><text>by inserting after paragraph (1) the following:</text>

<paragraph id="HEBBA0E62F6F6445D9E44E937A18B7BA8" indent="up1"><enum>(2)</enum> 
<subparagraph id="HD27E95BA35C4490ABC87B27E0376D307" display-inline="yes-display-inline"><enum>(A)</enum><text>An individual shall be determined to be an independent contractor rather than an employee of another person if—</text> <clause id="HBB4B16008B064CD790814659F478EFF8" indent="up1"><enum>(i)</enum><text>such other person does not exercise significant control over the details of the way the work is performed by the individual, without regard to any control the other person may exercise over the final result of the work performed; and</text></clause> 
<clause id="H868D1B2DABCE40E4895B0E4B690B54D3" indent="up1"><enum>(ii)</enum><text>while performing such work, the individual has the opportunities and risks inherent with entrepreneurship, such as the discretion to exercise managerial skill, business acumen, or professional judgment.</text></clause></subparagraph> <subparagraph id="H090F158D2A7543D0BC61FDDB4967E664" indent="up1"><enum>(B)</enum><text>The following factors may not be used in determining that an individual is an employee of another person:</text> 
<clause id="H3CCAAC6497584F5CA7FA179EC6656609"><enum>(i)</enum><text>Whether such other person requires the individual to comply with legal, statutory, or regulatory requirements.</text></clause> <clause id="H989868B9C3AC47F993BEB53FB6C54C7E"><enum>(ii)</enum><text>Whether such other person requires the individual to comply with health and safety standards that are more stringent than otherwise applicable health and safety standards.</text></clause> 
<clause id="HE9FF87BB88994BD7B243A49F0E6CB048"><enum>(iii)</enum><text>Whether such other person requires the individual to carry insurance of any kind.</text></clause> <clause id="H3AB93E80FC354E20A9FA62F746863330"><enum>(iv)</enum><text>Whether such other person requires the individual to meet contractually agreed-upon performance standards, such as deadlines.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HB3CE1B85C00749A1817BAD7734B929E3"><enum>(b)</enum><text>Section 2(3) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/152">29 U.S.C. 152(3)</external-xref>) is amended—</text> <paragraph id="H1A35583E5C874193963316455B086F6E"><enum>(1)</enum><text>by striking <quote>(3) The term <term>employee</term> shall</quote> and inserting the following:</text>

<paragraph id="H578E7DFDCC5A4F929B882147C3F12B69"><enum>(3)</enum> 
<subparagraph id="H09AB0175C6FF47559C2C22EA9921EDCD" display-inline="yes-display-inline"><enum>(A)</enum><text>The term <term>employee</term> shall</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H48FA6C1010164054AB205FD6E149DF00"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H248D5F0599D4453EBE1C36C58D7DED7B" style="OLC"> 
<subparagraph id="HFAB061899EA84A8397D586663D7282F8"><enum>(B)</enum><text>Section 3(e)(2) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(e)(2)</external-xref>) shall be used in determining whether an individual is an independent contractor or an employee of another person.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H5123946B26D94F3397B4B663677B3493"><enum>(c)</enum> <paragraph id="HDB40D0D856214372A987ACF81BEE5987" display-inline="yes-display-inline"><enum>(1)</enum><header>National labor relations act</header><text>Section 2(2) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/152">29 U.S.C. 152(2)</external-xref>) is amended—</text> 
<subparagraph id="HF089044A7258469D850C1B2E520FA09B"><enum>(A)</enum><text>by striking <quote>The term <term>employer</term></quote> and inserting <quote>(A) The term <term>employer</term></quote>; and</text></subparagraph> <subparagraph id="H1650D192551D457BA02549C85C070DA6"><enum>(B)</enum><text>by adding at the end the following:</text>

<subparagraph id="HA87C27FA7F4F42EF83A933D45E921E6B"><enum>(B)</enum><text>An employer may be considered a joint employer of the employees of another employer only if each employer directly, actually, and immediately, and not in a limited and routine manner, exercises significant control over the essential terms and conditions of employment of the employees of the other employer, such as hiring such employees, discharging such employees, determining the rate of pay and benefits of such employees, supervising such employees on a day-to-day basis, assigning such employees a work schedule, position, or task, or disciplining such employees.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H13DF8713B4004E338DACCD7C87FE7BCF"><enum>(2)</enum><header>Fair labor standards act of 1938</header><text>Section 3(d) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(d)</external-xref>) is amended—</text> 
<subparagraph id="H3DC4C7EABFB94A99ADC1E030CD61A44A"><enum>(A)</enum><text>by striking <quote><quote>Employer</quote> includes</quote> and inserting <quote>(1) <quote>Employer</quote> includes</quote>; and</text></subparagraph> <subparagraph id="H923A9420DFDD41C6983CA706069B1CF2"><enum>(B)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H401BE175A5AE422BBB097BD0E28A2E7B" style="OLC"> 
<paragraph id="H05B3C30BBDF64C3CA43D9E0DF6A0E2BC"><enum>(2)</enum><text>An employer may be considered a joint employer of the employees of another employer for purposes of this Act only if each employer meets the criteria set forth in section 2(2)(B) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/152">29 U.S.C. 152(2)(B)</external-xref>) except that, for purposes of determining joint-employer status under this Act, the terms <term>employee</term> and <term>employer</term> referenced in such section shall have the meanings given such terms in this section.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> <subsection id="HE339610D2B824687B616399702387F22"><enum>(d)</enum><header>Provision of technical assistance</header><text>Notwithstanding any other provision of law, under the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>), the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/151">29 U.S.C. 151 et seq.</external-xref>), or any other Federal law, none of the following may be construed, alone or in combination with any other factor, as establishing an employer and employee relationship between a franchisor (or any employee of the franchisor) and a franchisee (or any employee of the franchisee):</text> 
<paragraph id="HDD40351ED7814761BE06B1A97696DED7"><enum>(1)</enum><text>The franchisor (or any employee of the franchisor) provides the franchisee (or any employee of the franchisee) with, or requires such franchisee (or any employee of the franchisee) to use, a handbook, or other training, on sexual harassment, human trafficking, workplace violence, discrimination, or opportunities for apprenticeships or scholarships.</text></paragraph> <paragraph id="H0C5BF6A6EC154E4BA06124128DBB85CB"> <enum>(2)</enum> <text>The franchisor (or any employee of the franchisor) requires the franchisee (or any employee of the franchisee) to adopt a policy on sexual harassment, human trafficking, workplace violence, discrimination, opportunities for apprenticeships or scholarships, child care, or paid leave, including a requirement for such franchisee (or any employee of the franchisee) to report to the franchisor (or any employee of the franchisor) any violations or suspected violations of such policy.</text>
        </paragraph></subsection></section> 
<section id="H7EB8A2A8F19C4C8DA6CA14585A070FBB"><enum>6.</enum><header>Tribal sovereignty</header><text display-inline="no-display-inline">Section 2 of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/152">29 U.S.C. 152</external-xref>) is amended—</text> <paragraph id="H9620672A96954209931BCF23E562646B"><enum>(1)</enum><text>in paragraph (2), by inserting <quote>or any Indian Tribe, or any enterprise or institution owned and operated by an Indian Tribe and located on its Indian lands,</quote> after <quote>subdivision thereof,</quote>; and</text></paragraph> 
<paragraph id="HE92C4064B4B24074AC61502E47283B49"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block id="H72816A994A2F4843B7519AC5175F3378" style="OLC"> <paragraph id="H234DF938B4D843EFBB5CFC7CC71BFBC6"><enum>(15)</enum><text>The term <term>Indian Tribe</term> means any Indian Tribe, band, nation, pueblo, or other organized group or community which is recognized as eligible for the special programs and services provided by the United States to Indians because of their status as Indians.</text></paragraph> 
<paragraph id="H152FFD3119BF428E8F40CB96232D5A04"><enum>(16)</enum><text>The term <term>Indian</term> means any individual who is a member of an Indian Tribe.</text></paragraph> <paragraph id="H94027D836EF44BD58009B5D338D0BBC3"><enum>(17)</enum><text>The term <term>Indian lands</term> means—</text> 
<subparagraph id="H06856A2FE7FF44AF84F43CC5F699A2CF"><enum>(A)</enum><text>all lands within the limits of any Indian reservation;</text></subparagraph> <subparagraph id="HD70D1A89ECDD4F66A38BA3BA894DDC20"><enum>(B)</enum><text>any lands title to which is either held in trust by the United States for the benefit of any Indian Tribe or Indian or held by any Indian Tribe or Indian subject to restriction by the United States against alienation; and</text></subparagraph> 
<subparagraph id="H4842B5443B884AFEA7A99CD2788A4569"><enum>(C)</enum><text>any lands in the State of Oklahoma that are within the boundaries of a former reservation (as defined by the Secretary of the Interior) of a Federally recognized Indian Tribe.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H0E3753329BBF4A0E96017EE91BB9E088"><enum>7.</enum><header>Independent negotiating</header> <subsection id="HCB9698FCF7D643D38490DBEA5C9BF442"><enum>(a)</enum><header>Unfair labor practices</header><text>Section 8 of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/158">29 U.S.C. 158</external-xref>) is further amended—</text> 
<paragraph id="H992EAC96F9BD4D25945FAAF360DA0154"><enum>(1)</enum><text>in subsection (a)(3)—</text> <subparagraph id="H52A528457FD846F39012D92036870425"><enum>(A)</enum><text>by striking the <quote>or</quote> before <quote>(B)</quote>; and</text></subparagraph> 
<subparagraph id="H3B20A3D3CF6540C3860350FADC779DA0"><enum>(B)</enum><text>by striking <quote>membership;</quote> and inserting <quote>membership, or (C) if, in a covered State, the employee has ceased to be a member of a labor organization or pay an exclusive representative</quote>; and</text></subparagraph></paragraph> <paragraph id="H98401FACB3EC419FB777841DA1950159" commented="no"> <enum>(2)</enum> <text display-inline="yes-display-inline">in subsection (b) by inserting after paragraph (8), as added by section 2(b)(2) of this Act, the following:</text>

 <text>in a covered State, to represent or bargain on behalf of employees who have ceased to be a member of a labor organization or pay an exclusive representative;</text>

              <enum>(10)</enum>
 <text>in a covered State, to interfere with employees who have ceased to be a member of a labor organization or pay an exclusive representative engaged in independent negotiating;</text>
            </paragraph>

              <enum>(11)</enum>
 <text>in a covered State, to restrain or coerce employees who have ceased to be a member of a labor organization or pay an exclusive representative from engaging in independent negotiating; and</text>

        </paragraph></subsection> 
<subsection id="HD84A8B33B2A04514A464DC43467AB984"><enum>(b)</enum><header>Exclusion of workers engaged in independent negotiating from representation</header><text>Section 9(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/159">29 U.S.C. 159(a)</external-xref>) is amended—</text> <paragraph id="H56956F866CCD45F7B9690A2753CAABB0"><enum>(1)</enum><text>by inserting <quote>(other than any employee who has elected to engage in independent negotiating)</quote> after <quote>all the employees</quote>;</text></paragraph> 
<paragraph id="H5A39F98AC5794CFB8B52CD8693F1381A"><enum>(2)</enum><text>by inserting <quote>, in a State or Territory that is not a covered State,</quote> before <quote>any individual</quote>; and</text></paragraph> <paragraph id="H24DBABCDE0C84766AF18F52F94F08C3C"><enum>(3)</enum><text>by inserting <quote>and, in a covered State, an individual employee shall engage in independent negotiating with their employer if such employee has ceased to be a member of a labor organization or pay an exclusive representative</quote> after <quote>in effect</quote>.</text></paragraph></subsection> 
<subsection id="H54002303A9DF47CEB4B909C27FE52D0F"><enum>(c)</enum><header>Independent negotiating and covered state defined</header><text>Section 2 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/152">29 U.S.C. 152</external-xref>) is further amended by adding at the end the following:</text> <quoted-block id="HD9F4D924557148E5A9F7669D874FB1F6" style="OLC"> <paragraph id="H72A7E147F2D345B6A8AAD4DA17463097"><enum>(18)</enum><text>The term <term>independent negotiating</term> means, in a unit located in a covered State with an exclusive representative for the purposes of collective bargaining, negotiating between an employer and an individual employee as though such employee were not in such a unit and without regard to the existence of a collective-bargaining contract or agreement.</text></paragraph> 
<paragraph id="H7D97CEC5D89C454C868B74E3EF83F8A0"><enum>(19)</enum><text>The term <term>covered State</term> means a State or Territory which prohibits the execution or application of agreements requiring membership in, or payment to, a labor organization as a condition of employment.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="H093A0997995344CAB154717A09ED5939"><enum>8.</enum><header>Diversity, equity, or inclusion</header><text display-inline="no-display-inline">Section 8(b) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/158">29 U.S.C. 158(b)</external-xref>) is further amended by inserting after paragraph (12), as added by section 7(a)(2) of this Act, the following:</text>

<paragraph id="H2955D77031874A439AF930D09FC24D1A"><enum>(12)</enum><text display-inline="yes-display-inline">to include any provision in a collective bargaining agreement that mandates or promotes diversity, equity, or inclusion initiatives, including preferences, mandates, policies, programs, activities, or guidance related to personal characteristics of an individual and is not related to the qualifications or performance required for a job, unless such initiatives are required by Federal, State, or local law.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H1418B7D6064448EF8D4C1A06B9802D5E" display-inline="no-display-inline"><enum>9.</enum><header>Freedom from union violence act</header><text display-inline="no-display-inline">Section 1951 of title 18, United States Code, is amended to read as follows:</text>

<section id="H3B3D63856E6948C4A3D735C00742F348"><enum>1951.</enum><header>Interference with commerce by threats or violence</header> 
<subsection id="H2525F50813084334B39B2466F014AA23"><enum>(a)</enum><header>Prohibition</header><text>Except as provided in subsection (c), whoever in any way or degree obstructs, delays, or affects commerce or the movement of any article or commodity in commerce, by robbery or extortion, or attempts or conspires so to do, or commits or threatens physical violence to any person or property in furtherance of a plan or purpose to do anything in violation of this section, shall be fined not more than $100,000, imprisoned for a term of not more than 20 years, or both.</text></subsection> <subsection id="HB36AF7DD4A134197B7ADAB27A426B78C"><enum>(b)</enum><header>Definitions</header><text>For purposes of this section—</text> 
<paragraph id="HFE36134BEC094F0D89A2D5103414718F"><enum>(1)</enum><text>the term <term>commerce</term> means any—</text> <subparagraph id="H146331EAF5174B499A67383DE9FA4169"><enum>(A)</enum><text>commerce within the District of Columbia, or any territory or possession of the United States;</text></subparagraph> 
<subparagraph id="H8B46803991B546FFA1F38517FCC6419A"><enum>(B)</enum><text>commerce between any point in a State, territory, possession, or the District of Columbia and any point outside thereof;</text></subparagraph> <subparagraph id="HE2FC936C9EC0454BB160CF7FB59817DF"><enum>(C)</enum><text>commerce between points within the same State through any place outside that State; and</text></subparagraph> 
<subparagraph id="H13510896EA9C4E0C9607BB18517D499C"><enum>(D)</enum><text>other commerce over which the United States has jurisdiction;</text></subparagraph></paragraph> <paragraph id="H7A247AC8A9014F3583A09967ADA893C9"><enum>(2)</enum><text>the term <term>extortion</term> means the obtaining of property from any person, with the consent of that person, if that consent is induced—</text> 
<subparagraph id="H7D9E2AE47C7C44F4A51C8C7A73A31D32"><enum>(A)</enum><text>by actual or threatened use of force or violence, or fear thereof;</text></subparagraph> <subparagraph id="H084F98833D8345C18E5CEF26CEAECAE7"><enum>(B)</enum><text>by wrongful use of fear not involving force or violence; or</text></subparagraph> 
<subparagraph id="H79F1D40A74574AC38F7F100A17A73E3A"><enum>(C)</enum><text>under color of official right;</text></subparagraph></paragraph> <paragraph id="H16B3E82F45AA445399CC95C320D83DE9"><enum>(3)</enum><text>the term <term>labor dispute</term> has the same meaning as in section 2(9) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/152">29 U.S.C. 152(9)</external-xref>); and</text></paragraph> 
<paragraph id="H82F9FE728F0E4803B11543C784F5476D"><enum>(4)</enum><text>the term <term>robbery</term> means the unlawful taking or obtaining of personal property from the person or in the presence of another, against his or her will, by means of actual or threatened force or violence, or fear of injury, immediate or future—</text> <subparagraph id="H71834D862382405C913ACC1CF023ED5A"><enum>(A)</enum><text>to his or her person or property, or property in his or her custody or possession; or</text></subparagraph> 
<subparagraph id="H4425605E0BA44F849E42E7FE41A3B988"><enum>(B)</enum><text>to the person or property of a relative or member of his or her family, or of anyone in his or her company at the time of the taking or obtaining.</text></subparagraph></paragraph></subsection> <subsection id="H155140B2203043E39F67BE7E53A59E4C"><enum>(c)</enum><header>Exempted conduct</header> <paragraph id="H5817B8261EDB4E0F9B3D1D7B45F9C8F7"><enum>(1)</enum><header>In general</header><text>Subsection (a) does not apply to any conduct that—</text> 
<subparagraph id="H1C0126FA060242BFA1BBC0452B57D489"><enum>(A)</enum><text>is incidental to otherwise peaceful picketing during the course of a labor dispute;</text></subparagraph> <subparagraph id="H3131F467FD94489293ECA62F61567076"><enum>(B)</enum><text>consists solely of minor bodily injury, or minor damage to property, or threat or fear of such minor injury or damage; and</text></subparagraph> 
<subparagraph id="HBF386158CCB44435942152E1FB5BCDC9"><enum>(C)</enum><text>is not part of a pattern of violent conduct or of coordinated violent activity.</text></subparagraph></paragraph> <paragraph id="HA8EB547F1F454188AFFB04E2648BC62A"><enum>(2)</enum><header>State and local jurisdiction</header><text>Any violation of this section that involves any conduct described in paragraph (1) shall be subject to prosecution only by the appropriate State and local authorities.</text></paragraph></subsection> 
<subsection id="HC68090DC5FDD4A58B1C69B1AF0430BAC"><enum>(d)</enum><header>Effect on other law</header><text>Nothing in this section shall be construed—</text> <paragraph id="H5A0439665BBF403AB80D77CCF908D09A"><enum>(1)</enum><text>to repeal, amend, or otherwise affect—</text> 
<subparagraph id="H810A2DB5DADB4D5FB4BAE92DE206FB69"><enum>(A)</enum><text>section 6 of the <act-name parsable-cite="CLAY">Clayton Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/17">15 U.S.C. 17</external-xref>);</text></subparagraph> <subparagraph id="H5A3C50779690442EABD46E2148B472A2"><enum>(B)</enum><text>section 20 of the <act-name parsable-cite="CLAY">Clayton Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/29/52">29 U.S.C. 52</external-xref>);</text></subparagraph> 
<subparagraph id="H4D1E658C28BC4E5A873E3A5F7D6BD76D"><enum>(C)</enum><text>any provision of the Norris-LaGuardia Act (<external-xref legal-doc="usc" parsable-cite="usc/29/101">29 U.S.C. 101 et seq.</external-xref>);</text></subparagraph> <subparagraph id="HED123D4C4416414F82154A3B99A14A79"><enum>(D)</enum><text>any provision of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/151">29 U.S.C. 151 et seq.</external-xref>); or</text></subparagraph> 
<subparagraph id="H5AF39B34D3D8492B81A021E695595CA4"><enum>(E)</enum><text>any provision of the Railway Labor Act (<external-xref legal-doc="usc" parsable-cite="usc/45/151">45 U.S.C. 151 et seq.</external-xref>); or</text></subparagraph></paragraph> <paragraph id="HC7D63175AD8A4289B2A0C3BC7648190E"><enum>(2)</enum><text>to preclude Federal jurisdiction over any violation of this section, on the basis that the conduct at issue—</text> 
<subparagraph id="H68DDA2F971C84C529810C8285C964445"><enum>(A)</enum><text>is also a violation of State or local law; or</text></subparagraph> <subparagraph id="H102D811AC36E4BA5BE4EBF14BDABECC0"><enum>(B)</enum><text>occurred during the course of a labor dispute or in pursuit of a legitimate business or labor objective.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H43FE0453AFAB4DECA19087B71A083D29"><enum>10.</enum><header>Unlawful harassment</header><text display-inline="no-display-inline">Section 8(a)(3) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/158">29 U.S.C. 158(a)(3)</external-xref>) is amended by adding after <quote>Provided,</quote> the following: <quote>that nothing in this section shall be construed to prevent an employer from taking action to protect employees from discriminatory, harassing, or demeaning language or conduct, including during organizing campaigns or strikes: Provided further,</quote>.</text></section> </legis-body></bill>
