<section id="HCA468D37834A4A7BB0E8139E860DD66E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ruthie and Connie LGBTQI Elder Americans Act of 2025</short-title></quote>.</text></section> <section id="HF68005F5276D42AEB1ED4CCBB014909B"><enum>2.</enum><header>Definitions</header> <subsection id="H2A577B4266EB413D918FCF150C2BCE41"><enum>(a)</enum><header>In general</header><text>Section 102 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3002">42 U.S.C. 3002</external-xref>) is amended—</text> 
<paragraph id="H3F0D49CEBCB24C6CAD3FC132A38EEA6A"><enum>(1)</enum><text>in paragraph (24)—</text> <subparagraph id="HE2BFCA5A03B541B6AB1AECD55EDB4050"><enum>(A)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text></subparagraph> 
<subparagraph id="H6E32FAE47B14413AB860CDCF0D8065D8"><enum>(B)</enum><text>in subparagraph (C)(ii), by striking the period and inserting <quote>; and</quote>; and</text></subparagraph> <subparagraph id="H2A167AAEE70348289C5BB3F06C2C9499"><enum>(C)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H5ACD501E7F2E4620942F990485E54E11" style="OLC"> 
<subparagraph id="H1BCF749048614A0EA3A6AE62C13AB3DF"><enum>(D)</enum><text>status as an LGBTQI individual and status as an HIV individual.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="HB95CD7B4BE844824923A2D11347A7E3D"><enum>(2)</enum><text>by redesignating—</text> 
<subparagraph id="HBB08498AD3514919868DC28103AA6C33"><enum>(A)</enum><text>paragraphs (36) through (56) as paragraphs (38) through (59), respectively; and</text></subparagraph> <subparagraph id="H288A38BDFCDB42B8962DC89BBC140B17"><enum>(B)</enum><text>paragraphs (34) and (35) as paragraphs (36) and (37), respectively;</text></subparagraph></paragraph> 
<paragraph id="HB8F340F164364F0DA047212287E2A301"><enum>(3)</enum><text>by inserting after paragraph (33) the following:</text> <quoted-block display-inline="no-display-inline" id="H0EECD4795C8A4133A491105BDC012CC6" style="OLC"> <paragraph id="H5F9E048213EC402EA404BF9E6954C2BB"><enum>(34)</enum><text display-inline="yes-display-inline">The term <quote>HIV</quote>, used with respect to an individual, means living with human immunodeficiency virus;</text></paragraph> 
<paragraph id="HDB670A8B18CF4820889C6AF55C8304A3"><enum>(35)</enum><text display-inline="yes-display-inline">The term <term>LGBTQI</term>, used with respect to an individual, means a lesbian, gay, bisexual, transgender, queer, or intersex individual.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="HDAA3B6EA6F294D29808B32EBF2A4FC23"><enum>(4)</enum><text>by inserting after paragraph (37), as so redesignated, the following:</text> 
<quoted-block display-inline="no-display-inline" id="H3E97408478ED41FC9A31DF783040055F" style="OLC"> 
<paragraph id="H1A8C242B8EB245F4B19FD695754AFCD0"><enum>(38)</enum><text display-inline="yes-display-inline">The term <term>minority</term>, used with respect to an individual, includes a lesbian, gay, bisexual, transgender, queer, or intersex individual.</text></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H0B03D8D033BC431F8D31C99BD4121B76"><enum>(b)</enum><header>Conforming amendment</header><text>Section 215(e)(1)(J) of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3020e-1">42 U.S.C. 3020e–1(e)(1)(J)</external-xref>) is amended by striking <quote>minorities</quote> and inserting <quote>minority individuals</quote>.</text></subsection></section> 
<section id="H5DCC84521C094DD29463C636B39FB535"><enum>3.</enum><header>Administration on aging</header> 
<subsection id="HC206F1D5A0D34F27B01BA2BA17B89692"><enum>(a)</enum><header>Establishment of administration; Office of the LGBTQI Inclusion</header><text>Section 201 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3011">42 U.S.C. 3011</external-xref>) is amended—</text> <paragraph id="H7AA4545C41954744AC0D382E668BDA5B"><enum>(1)</enum><text>in subsection (d)(3)(J), by inserting before the semicolon the following: <quote>, including the effectiveness of such services in meeting the needs of LGBTQI older individuals</quote>; and</text></paragraph> 
<paragraph id="HD9EA8823091E4856AD88463807BA55D7"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HE34309D100C5409EB5870D5869A80EC1" style="OLC"> <subsection id="HD4044441F0274717A55C65B5DB685B11"><enum>(h)</enum><text>The Assistant Secretary is authorized to designate within the Administration a person to have responsibility for addressing issues affecting LGBTQI older individuals.</text></subsection> 
<subsection id="HCA994B8655DD4F7A9D44772DDE034FC3"><enum>(i)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="H2C1344875FF44256AF15634900C14F7D"><enum>(1)</enum><text>There is established in the Administration an Office of LGBTQI Inclusion (referred to in this subsection as the <quote>Office</quote>).</text></paragraph> <paragraph id="HC90F912A9E574CCFA91635E0FDB37666" indent="up1"><enum>(2)</enum> <subparagraph commented="no" display-inline="yes-display-inline" id="H905C2C452132432D8977ED9F5E947D97"><enum>(A)</enum><text>The Office shall be headed by a Director of LGBTQI Inclusion (referred to in this subsection as the <quote>Director</quote>) who shall be appointed by the Secretary.</text></subparagraph> 
<subparagraph id="HC2DF6E2B71074813A279E1AB6611CB8D" indent="up1"><enum>(B)</enum><text>The Office shall include an Assistant Director of LGBTQI Policy (referred to in this subsection as the <quote>Assistant Director</quote>) who shall be appointed by the Director to assist the Director in carrying out this subsection, including by carrying out the activities under paragraph (4).</text></subparagraph></paragraph> <paragraph id="HA6BFB5B9CEA6471C84E2E6C5E28E7647" indent="up1"><enum>(3)</enum><text>The Director shall—</text> 
<subparagraph id="HB9C28919E64C4D1698CE6A4731D27242"><enum>(A)</enum><text>coordinate activities within the Department of Health and Human Services, and between other Federal departments and agencies, to assure a continuum of improved services for LGBTQI older individuals;</text></subparagraph> <subparagraph id="H059526A10A1D44268BBEFF5093F2B711"><enum>(B)</enum><text>promote access to aging services and supports for LGBTQI older individuals;</text></subparagraph> 
<subparagraph id="H3F670A41ED764BBE9B0709F3B346FD77"><enum>(C)</enum><text>collect and disseminate information related to the challenges experienced by LGBTQI older individuals; and</text></subparagraph> <subparagraph id="H9A6CEE490C5B494A96A2A515EEBDCD83"><enum>(D)</enum><text>administer and evaluate grants that will expand access to aging services and supports for LGBTQI older individuals.</text></subparagraph></paragraph> 
<paragraph id="HFBA6CFD9ECE648C5B346230EE2F2A9DF" commented="no" indent="up1"><enum>(4)</enum><text>The Assistant Director shall—</text> <subparagraph id="H68FACF3CA5D1426A8B1C579783AB4EBC" commented="no"><enum>(A)</enum><text>serve as the effective and visible advocate on behalf of LGBTQI older individuals—</text> 
<clause id="HE7C6E082C9744542B1979F526383552C" commented="no"><enum>(i)</enum><text>within the Department of Health and Human Services and with other departments and agencies of the Federal Government regarding all Federal policies affecting such individuals; and</text></clause> <clause id="H7D9F5CC59D2747018E509A7F06CD76BD" commented="no"><enum>(ii)</enum><text>in the States to promote the enhanced delivery of services and implementation of programs, under this Act and other Federal Acts, for the benefit of such individuals;</text></clause></subparagraph> 
<subparagraph id="HBFBD9323BA054EDAAC32472058F3534E" commented="no"><enum>(B)</enum><text>support, conduct, and arrange for research in the field of LGBTQI aging with a special emphasis on gathering statistics on LGBTQI older individuals;</text></subparagraph> <subparagraph id="H14D85E6482F44048A7A401033804EFCB" commented="no"><enum>(C)</enum><text>collect and disseminate information related to challenges experienced by LGBTQI older individuals; and</text></subparagraph> 
<subparagraph id="H92BC21D9B1574497A95073C5298162B0" commented="no"><enum>(D)</enum><text>recommend policies and priorities beneficial to LGBTQI older individuals and promote the implementation and adoption of culturally competent care and services for such individuals.</text></subparagraph></paragraph> <paragraph id="HA72495E309DE4D6EB0D3778F2C494B51" indent="up1"><enum>(5)</enum><text>Not later than 5 years after the date of enactment of this Act and every 5 years thereafter, the Director shall submit to Congress a report describing the activities carried out under this subsection during the preceding 5 years.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H0763E24E9E6E4294AE6E0EB31BE2494E"><enum>(b)</enum><header>Functions of Assistant Secretary</header><text>Section 202 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3012">42 U.S.C. 3012</external-xref>) is amended—</text> <paragraph id="H5746C60E261C460BA9E330950BE821C6"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph id="HA08B6B7932004ADAA9DF0E5808B13B89"><enum>(A)</enum><text>in paragraph (16)(A)(ii), by inserting <quote>, and separately specifying the number of such individuals who are LGBTQI individuals</quote> before the semicolon;</text></subparagraph> <subparagraph id="H5322C40D85014975AD1519FE5ED862FD"><enum>(B)</enum><text>in paragraph (33), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph> 
<subparagraph id="H0014EF6C93CB46559A9F1C2EC4528857"><enum>(C)</enum><text>in paragraph (34), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph> <subparagraph id="H9921AC1B1AFD4F169F926E0277791852"><enum>(D)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HDB58A9CD74AC439CB34606D25B25A54E" style="OLC"> 
<paragraph id="H3536731E2499491796EC74E70952ADA2"><enum>(35)</enum><text>conduct studies and collect data to determine the services that are needed by LGBTQI older individuals.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="HAFAFCE498D574CDE99B2B02A8AF48145"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HC3EEAA6530474FE5BF52BDEFFE09ADFD" style="OLC"> 
<subsection id="HB42E1A68ED3E4409A796656598E4298F"><enum>(j)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="HA2F63B54238243528DBE1D13E66692A6"><enum>(1)</enum><text display-inline="yes-display-inline">The Assistant Secretary shall, directly or by grant or contract, establish and operate the National Resource Center on Lesbian, Gay, Bisexual, Transgender, Queer, and Intersex Aging (in this subsection referred to as the <term>Center</term>).</text></paragraph> <paragraph id="HB4471194B4B04B5DAF0FED352BC5DFB0" indent="up1"><enum>(2)</enum><text>To address the unique challenges faced by LGBTQI older individuals, the Center shall provide national, State, and local organizations, including those with a primary mission of serving LGBTQI individuals and those with a primary mission of serving older individuals, with the information and technical assistance the organizations need to effectively serve LGBTQI older individuals.</text></paragraph> 
<paragraph id="H81DF4E8B0F1748358AA515F6E0A43DAB" indent="up1"><enum>(3)</enum><text>The Center shall have 3 primary objectives, consisting of—</text> <subparagraph id="H642D71A3B95B4ED88E8D99B2F9513681"><enum>(A)</enum><text>educating aging services organizations about the existence and special needs of LGBTQI older individuals;</text></subparagraph> 
<subparagraph id="H85DDB63586764200A2471418FC765FB2"><enum>(B)</enum><text>sensitizing LGBTQI organizations about the existence and special needs of older individuals; and</text></subparagraph> <subparagraph id="H0FBE76639AFC43D78A51A7F7B1869D05"><enum>(C)</enum><text>providing educational resources to LGBTQI older individuals and their caregivers.</text></subparagraph></paragraph> 
<paragraph id="H747E1956CECF44F085703735D5F5EC52" indent="up1"><enum>(4)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H19D37813884A4465B8C7FFDEB09367A1"><enum>(A)</enum><text>To be eligible to receive funds under this subsection, an entity—</text> <clause id="HA93AEC9F459A4F6AB0332AECFEA26BD8" indent="up1"><enum>(i)</enum><text>shall have demonstrated expertise in working with organizations or individuals on issues affecting LGBTQI individuals;</text></clause> 
<clause id="HC518C888E79148879C3813255733AF4A" indent="up1"><enum>(ii)</enum><text>shall have documented experience in providing training and technical assistance on a national basis or a formal relationship with an organization that has that experience; and</text></clause> <clause id="H520DFA3FD3B74600B3E27DFB1071F227" indent="up1"><enum>(iii)</enum><text>shall meet such other criteria as the Assistant Secretary shall issue.</text></clause></subparagraph> 
<subparagraph id="H7DF41A34A4CF44AEB7C068C29D185153" indent="up1"><enum>(B)</enum><text>To be eligible to receive funds under this subsection, an entity shall submit an application to the Assistant Secretary at such time, in such manner, and containing such information as the Assistant Secretary may require.</text></subparagraph></paragraph> <paragraph id="HFB3CA5B6A57941DE80061C9B35EFDF84" indent="up1"><enum>(5)</enum><text>The Assistant Secretary shall make available to the Center on an annual basis such resources as are necessary for the Center to carry out effectively the functions of the Center under this Act and not less than the amount of resources made available to the National Resource Center on LGBTQI Aging, existing on the day before the date of enactment of the <short-title>Ruthie and Connie LGBTQI Elder Americans Act of 2025</short-title>, for fiscal year 2026.</text></paragraph> 
<paragraph id="HCB5E41C57BA04863959E8615C293F7AA" indent="up1"><enum>(6)</enum><text>The Assistant Secretary shall develop and issue operating standards and reporting requirements for the Center.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> <section id="HC92092477E53438092AFA687B6A23CA5"><enum>4.</enum><header>Grants for State and community programs on aging</header><text display-inline="no-display-inline">Section 301(a)(2) of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3021">42 U.S.C. 3021(a)(2)</external-xref>) is amended—</text> 
<paragraph id="H5D6141493CEC46FEA192BF2C24DFBC54"><enum>(1)</enum><text>in subparagraph (E), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph> <paragraph id="H3D97796CB5CF4AC780BF6B560B3EFC6A"><enum>(2)</enum><text>by redesignating subparagraph (F) as subparagraph (G); and</text></paragraph> 
<paragraph id="H62D5E2AB8C4D44499C3741EA8D345956"><enum>(3)</enum><text>by inserting after subparagraph (E) the following:</text> <quoted-block display-inline="no-display-inline" id="HACB3590E7D724F53A1EDB7C266A26CCD" style="OLC"> <subparagraph id="H910EF879CF80407CA3C8F5245FBB789C"><enum>(F)</enum><text>organizations that serve LGBTQI individuals; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H0745EA7171C84772AD7FBD62E46942B3"><enum>5.</enum><header>Activities for health, independence, and longevity</header><text display-inline="no-display-inline">Section 411(a)(11) of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3032">42 U.S.C. 3032(a)(11)</external-xref>) is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H9D7E6D849DD64F4E8C69CF77F5F97E50" style="OLC"> <paragraph id="H5D4CE42DAE6C4284BBB7E523555C1FDA"><enum>(11)</enum><text>conducting activities of national significance to promote quality and continuous improvement in the support and services provided to individuals with greatest social need, through activities that include needs assessment, program development and evaluation, training, technical assistance, and research, concerning—</text> 
<subparagraph id="H9F17554CEBF14B0A819EE914C07CBFA6"><enum>(A)</enum><text>addressing physical and mental health, disabilities, and health disparities;</text></subparagraph> <subparagraph id="H39882FA0B1184BF39ED1993F6FE51511"><enum>(B)</enum><text>providing long-term care, including in-home and community-based care;</text></subparagraph> 
<subparagraph id="HC46232A8A0DF4019917B40929A33391C"><enum>(C)</enum><text>providing informal care, and formal care in a facility setting;</text></subparagraph> <subparagraph id="HFEF6103F1ABD4649A8E5C877E331061A"><enum>(D)</enum><text>providing access to culturally responsive health and human services; and</text></subparagraph> 
<subparagraph id="H3FAB48DE36534EA2984547258263FA7F"><enum>(E)</enum><text>addressing other gaps in assistance and issues that the Assistant Secretary determines are of particular importance to older individuals with greatest social need.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H59A8D33E41A448DA81B373122F5FCFBA"><enum>6.</enum><header>Data on discrimination</header><text display-inline="no-display-inline">Section 712 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3058g">42 U.S.C. 3058g</external-xref>) is amended—</text> 
<paragraph id="H398656A19C3F4C95980F26BC5B517C28"><enum>(1)</enum><text>in subsection (a)(3)—</text> <subparagraph id="HDA9ED8F67A0E467498BDD025727DE4FB"><enum>(A)</enum><text>by redesignating subparagraphs (F) through (J) as subparagraphs (G) through (K); and</text></subparagraph> 
<subparagraph id="H9AC39D8170354395B1D5C7436EEE4CDC"><enum>(B)</enum><text>by inserting after subparagraph (E) the following:</text> <quoted-block display-inline="no-display-inline" id="H9C11299F6AF5423AAFACF006B8F91757" style="OLC"> <subparagraph id="H16A0062B0AF447459CD93EBD338A1231"><enum>(F)</enum><text display-inline="yes-display-inline">collect and analyze data, relating to discrimination against LGBTQI older individuals on the basis of actual or perceived sexual orientation, gender identity, or sex characteristics (including intersex traits) in the admission to, transfer or discharge from, or lack of adequate care provided in long-term care settings, and shall include the analyses in the reports described in subsection (h)(1);</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H6FA3ACDEB9904596A91A73ADB305045E"><enum>(2)</enum><text>in subsection (h)(6), in the matter preceding subparagraph (A), by striking <quote>(A) through (G)</quote> and inserting <quote>(A) through (H)</quote>.</text></paragraph></section> </legis-body></bill>
