<section id="HB481CC35673C45FA9B18DB0D3CBE9F52" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Advancing Maternal Health Equity Under Medicaid Act</short-title></quote>.</text></section> <section id="HBBDF1B6F782846EA8F2B84B9D0184662"><enum>2.</enum><header>Higher FMAP for increased expenditures under medicaid for maternal health services</header><text display-inline="no-display-inline">Section 1903 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b</external-xref>) is amended—</text> 
<paragraph id="H8E1D442831434774891351F76DF13D2D"><enum>(1)</enum><text>in subsection (a)(5)—</text> <subparagraph id="H2E7300BB84BA4856B31DAFD481B204AC"><enum>(A)</enum><text>by striking <quote>an amount equal</quote> and inserting <quote>(A) an amount equal</quote>; and</text></subparagraph> 
<subparagraph id="HF19DDDDDE0FE405F8440BE142C7C8636"><enum>(B)</enum><text>by adding at the end the following:</text> <quoted-block id="HF625AD93D4474D21BC5FFDAC18C5B32C" style="OLC" display-inline="yes-display-inline"><text>and</text> 
<subparagraph id="H13748DDB469944149B35E1C53A3B2D44"><enum>(B)</enum><text>for calendar quarters beginning on or after January 1 of the year beginning after one year after the date of the enactment of this subparagraph, an amount equal to 90 percent of the amounts by which—</text> <clause id="H1B9295C9CFE2400E8EBAD69E8536EB07"><enum>(i)</enum><text>the sum of the amounts expended which are attributable to the offering, arranging, and furnishing (directly or on a contract basis) under the State plan (or waiver of the plan) of maternal health care services (as described in subsection (b)(6)(B)) for such quarter, exceeds</text></clause> 
<clause id="H46B700E4411E4E468C1B29AF48EB33FA"><enum>(ii)</enum><text>the sum of the amounts expended which are attributable to the offering, arranging, and furnishing (directly or on a contract basis) under the State plan (or waiver of the plan) of such services for the corresponding quarter in the four-quarter period ending on December 31, 2019, plus</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H7D64916D34C34932A3FD7B1C10797F4E"><enum>(2)</enum><text>in subsection (b), by adding at the end the following new paragraph:</text>

<paragraph id="H521256FB224545788B5E8A68EEE188C1"><enum>(6)</enum><header>Accountability and maintenance of effort requirements for additional federal funding for increased expenditures for maternal health care services</header> 
<subparagraph id="HB8255BB8B1664F5E9755D490979E34B3"><enum>(A)</enum><header>In general</header><text>As conditions for receiving the funds the Secretary is otherwise obligated to pay to a State under subsection (a)(5)(B), a State shall meet the following requirements:</text> <clause id="H3353A2D5D77E408288D7B72273D3456E"><enum>(i)</enum><header>Supplement, not supplant</header><text>The State shall use the funds received under such subsection to supplement, not supplant, the level of State funds expended for the offering, arranging, and furnishing (directly or on a contract basis) under the State plan (or under a waiver of the plan) of maternal health care services (as described in subparagraph (B)) through programs and activities in effect as of January 1, 2023.</text></clause> 
<clause id="HE0E52FE9E2EE4FA694B18477A9013C90"><enum>(ii)</enum><header>Use of funds for activities that improve delivery of maternal health care services</header><text>The State shall use the funds received under such subsection for activities that increase the capacity, efficiency, and quality in the provision of maternal health care services.</text></clause></subparagraph> <subparagraph id="HB8DEEF4C2B364180AA6E0088F9613202"><enum>(B)</enum><header>Definitions</header><text>For purposes of this paragraph and subsection (a)(5)(B):</text> 
<clause id="H4EC82B8990FA4E0DB4BA5383865788C1"><enum>(i)</enum><header>Maternal health care services</header><text>Maternal health care services described in this subparagraph are services furnished by a maternity care provider or perinatal health worker, such as the following:</text> <subclause id="HDDB9C41973B34B59A7B73DD82F948BD7"><enum>(I)</enum><text>Prenatal, labor and delivery, and postpartum health care services that are furnished in a licensed and accredited hospital, birth center, midwifery practice, or other health care practice that provides prenatal services, labor and delivery services, and postpartum services.</text></subclause> 
<subclause id="HBA5B9BF099F246F99D2616E6E361FB4A"><enum>(II)</enum><text>Telehealth services during the prenatal and postpartum periods.</text></subclause> <subclause id="H703EA3FECF35435C9113CE0FD9CC90C4"><enum>(III)</enum><text>Home visiting services during the prenatal and postpartum periods.</text></subclause> 
<subclause id="HBF0319299164459494B8EEF54B1FD43F"><enum>(IV)</enum><text>Mental or behavioral health care services for individuals during the prenatal and postpartum periods.</text></subclause></clause> <clause id="H24B0F4A772E54A9BA933C7B329E22414"><enum>(ii)</enum><header>Maternity care provider</header><text>The term <quote>maternity care provider</quote> means a health care provider who—</text> 
<subclause id="HA812D3DFD9714ECD98FB02BE4422F881"><enum>(I)</enum><text>is a physician, physician assistant, midwife who meets at a minimum the international definition of the midwife and global standards for midwifery education as established by the International Confederation of Midwives, nurse practitioner, or clinical nurse specialist; and</text></subclause> <subclause id="HD627FB2D36CD418A87DE65A0D57D33F6"><enum>(II)</enum><text>has a focus on maternal or perinatal health.</text></subclause></clause> 
<clause id="H007214138667469083BECB4EC0E9F489"><enum>(iii)</enum><header>Perinatal health worker</header><text>The term <quote>perinatal health worker</quote> means a doula, community health worker, breastfeeding and lactation educator or counselor, nutritionist or dietitian, childbirth educator, social worker, home visitor, or language interpreter.</text></clause> <clause id="H3A2A4DEAC9384DAFB2631430D31EBC09"><enum>(iv)</enum><header>Postpartum and postpartum period</header><text>The terms <quote>postpartum</quote> and <quote>postpartum period</quote> each refer to the 1-year period beginning on the last day of the pregnancy of an individual.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
