<section id="H54F089BA7B2D4DAA832517D2F1AA5636" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pilot and Aircraft Privacy Act of 2025</short-title></quote> or the <quote><short-title>PAPA Act of 2025</short-title></quote>.</text></section> <section id="H12EF1A284FC4492E97C1F7AD27EBBBBE"><enum>2.</enum><header>Use of data from automatic dependent surveillance-broadcast</header> <subsection id="H7FE73F6E3A2D47A9855774D3C4613F26"><enum>(a)</enum><header>Limitation on use of data</header><text>Data from automatic dependent surveillance-broadcast may not be used by any person, governmental agency, or other entity to identify aircraft for the purpose of obtaining revenue from the owner or operator of such aircraft without the consent of such owner or operator.</text></subsection> 
<subsection id="H040408A7B82B4277B52DDBC2AEADEDBB"><enum>(b)</enum><header>Use of data by air traffic controllers</header><text>Automatic dependent surveillance-broadcast data—</text> <paragraph id="H4032FD3260274C328C304B7DE145DE13"><enum>(1)</enum><text>may be used to assist air traffic controllers in tracking aircraft and improving air traffic safety and efficiency; and</text></paragraph> 
<paragraph id="H304AB0F54EE041549F0A270EE57A27E3"><enum>(2)</enum><text>may not be used for any proposed purpose other than the purpose under paragraph (1) unless the Secretary of Transportation, after notice and an opportunity for public comment, determines that such data may be used for such proposed purposes consistent with this section.</text></paragraph></subsection></section> <section id="H09AAC211BDFA4BA3A715766E423A959F"> <enum>3.</enum> <header>Limit on use of ADS–B data</header> <text display-inline="no-display-inline">Section 46101(c) of title 49, United States Code, is amended by striking <quote>the Administrator of the Federal Aviation Administration may not</quote> and inserting <quote>neither the Administrator of the Federal Aviation Administration nor any other Federal, State, local, territorial, or Tribal official may</quote>.</text>

<section id="H55B4BD4334F64A228A345E9486820D29"><enum>4.</enum><header>Imposition of fees on general aviation aircraft</header> 
<subsection id="H36C543702C5145ED815E38A3E4F60BA4"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/401">Chapter 401</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text> <quoted-block id="HB274F9ECCC10400F9C9CF8472613CD9A" style="USC"> <section id="H207252CEBB8745A488EE4F33DF386B12"><enum>40133.</enum><header>Imposition of fees on general aviation aircraft</header> <subsection id="HA151A00E7F8C4A24A497F39A07CDBE14"><enum>(a)</enum><header>Public availability</header><text>Prior to imposing a landing or takeoff fee on general aviation aircraft, the owner or operator of a public-use airport (as defined in section 47102) shall make available to the public—</text> 
<paragraph id="H42749B33C6A940FA99521E1EF8018549"><enum>(1)</enum><text>all efforts such owner or operator has undertaken to reduce non-airside related expenses;</text></paragraph> <paragraph id="HE7C6A1BEAB2745FE9E04CB6C7D9A394A"><enum>(2)</enum><text display-inline="yes-display-inline">all efforts such owner or operator has undertaken to obtain revenues from sources other than general aviation aircraft;</text></paragraph> 
<paragraph id="H486F2823DE2346F4A865E98395A658CE"><enum>(3)</enum><text display-inline="yes-display-inline">the total cost estimate of the airside safety projects that such owner or operator plans to undertake, the amount or percentage of the fees imposed on general aviation aircraft that will be used to pay for such projects, and an estimated timeline to collect such amount; and</text></paragraph> <paragraph id="HA45767868BE6454C942E31EDD388A11E"><enum>(4)</enum><text>an assessment of the impact of any fees on the health and vitality of general aviation and on the pilots, students, nonprofit organizations and businesses that support or rely on general aviation in the area of the airport.</text></paragraph></subsection> 
<subsection id="H646FBCE06D42460399E0D288DA929A04"><enum>(b)</enum><header>Use of fees</header><text>Any revenues derived from fees imposed on general aviation aircraft described in subsection (a) may only be used for airside safety projects.</text></subsection> <subsection id="HCD1C3061FEAC4437A210EF111ABC5537"><enum>(c)</enum><header>Regulations</header><text>The Administrator of the Federal Aviation Administration may promulgate such regulations or impose such reporting requirements as may be necessary to implement this section.</text></subsection> 
<subsection id="H8C4CF76E319B464084DA9C0A4C3CF766"><enum>(d)</enum><header>General aviation aircraft defined</header><text>In this section, the term <quote>general aviation aircraft</quote> means an aircraft that is being used for personal, recreational, flight training, or for purposes other than scheduled airline operations or military flights.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H091A800541B24D7D84AB74A7299A3121"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/401">chapter 401</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>
