<section id="H41A57BFF211B40CFBDF32F7C4FE56261" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restoring Biological Truth in Government Act</short-title></quote>.</text></section> <section id="H0E1D71804C364622980B72A27735CC04"><enum>2.</enum><header>Prohibition on asking about gender identity on any executive agency form or survey</header> <subsection id="H42F1491BCF934648990DAC15B616E54A"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">With respect to any collection of information conducted by or for an executive agency through a form or survey, the head of such agency—</text> 
<paragraph id="H4FC7628E543E4028868D5130DF5A58ED"><enum>(1)</enum><text display-inline="yes-display-inline">may not—</text> <subparagraph id="H1A4A1B643C224ED19785C108F382F748"><enum>(A)</enum><text>solicit or obtain any information regarding the gender identity of an individual; and</text></subparagraph>
<subparagraph id="HB8A2AE3753BC4D928FFD4FCC6501C74E"><enum>(B)</enum><text display-inline="yes-display-inline">provide an option to select or mark on the form or survey that sex or gender of an individual is something other than male or female; and</text></subparagraph></paragraph> <paragraph id="H480F943CA2E34FDAB010E94258A12EA7"><enum>(2)</enum><text display-inline="yes-display-inline">shall reject the submission of any such form or survey that provides a response other than male or female to a required question on sex or gender.</text></paragraph></subsection> 
<subsection id="HFC81A26D7DDC43F4B44EB22751DC630B"><enum>(b)</enum><header>OMB guidance</header><text>Not later than 180 days after the date of enactment of this Act, the Director of the Office of Management and Budget shall issue guidance to the heads of covered agencies on the implementation of the provisions of this section.</text> </subsection> <subsection id="HA2ECE9C946024C1AAE58C0B241B7D21D"><enum>(c)</enum><header>Definitions</header><text>In this Act:</text> 
<paragraph id="HD028490455494C7EB18ECC48871D8D2B"><enum>(1)</enum><header>Executive agency</header><text>The term <term>executive agency</term> means an establishment in the executive branch of the Federal Government, including—</text> <subparagraph id="HE5F7E9FA974541719F5A9853714F048E"><enum>(A)</enum><text>the Executive Office of the President;</text></subparagraph> 
<subparagraph id="HF32BCD1821084F3893029F5A5F9C59BA"><enum>(B)</enum><text>any executive department;</text></subparagraph> <subparagraph id="H1BE88D4BFEE24DC8841CC9EAD3BE82C6"><enum>(C)</enum><text>any independent regulatory agency;</text></subparagraph> 
<subparagraph id="H3584EF239B8D44608FBA4237F893DB43"><enum>(D)</enum><text>any military department;</text></subparagraph> <subparagraph id="H5A979BFC07194D25B0D1A7036F8A0E64"><enum>(E)</enum><text>any government corporation; and</text></subparagraph> 
<subparagraph id="H62C1780F696B43338F3787BAFD0C56CD"><enum>(F)</enum><text>any government-controlled corporation.</text> </subparagraph></paragraph> <paragraph id="H0D36139605B64CF8A84DA84B6FBA3AFD" commented="no"><enum>(2)</enum><header>Female</header><text>The term <term>female</term> means an individual who naturally has, had, will have, or would have, but for a developmental or genetic anomaly or historical accident, the reproductive system that at some point produces, transports, and utilizes eggs for fertilization.</text></paragraph> 
<paragraph id="H7BD228CBF83B4465B1697A7C0CD480E4" commented="no"><enum>(3)</enum><header>Gender</header><text>The term <term>gender</term>—</text> <subparagraph id="HC3A8075640C34D398FE00093D4A0DFC8" commented="no"><enum>(A)</enum><text>means—</text> 
<clause id="HF86942C198C64E48B6F5B3B26F2AC4AC" commented="no"><enum>(i)</enum><text>males, females, or the natural differences between males and females, unless such term is otherwise specified or used alone (rather than with or as an adjective modifying other words); and</text></clause> <clause id="HB2EDC7B23E5C489F8F3BCFA5E260E6AD" commented="no"><enum>(ii)</enum><text>a synonym for sex; and</text></clause></subparagraph> 
<subparagraph id="H79F4058FE7974BB086C6C3EF0ED2CADC" commented="no"><enum>(B)</enum><text>does not mean gender identity, experienced gender, gender expression, or gender roles.</text></subparagraph></paragraph> <paragraph id="H608173C7193345DDBD4AB652E4DE1AF8" display-inline="no-display-inline"><enum>(4)</enum><header>Gender identity</header><text>The term <term>gender identity</term> does not mean sex or gender.</text></paragraph> 
<paragraph id="H6DA0F20B7A4046AC801B99881A2AFFE1"><enum>(5)</enum><header>Male</header><text>The term <term>male</term> means an individual who naturally has, had, will have, or would have, but for a developmental or genetic anomaly or historical accident, the reproductive system that at some point produces, transports, and utilizes sperm for fertilization.</text></paragraph> <paragraph id="H30C97D658FE84B27AA9DB773041E8241"><enum>(6)</enum><header>Sex</header><text>The term <term>sex</term> means the biological determination as to whether an individual is male or female.</text></paragraph></subsection></section>
