<section id="H90D7E3B8AE0445CE907BDB88F16EA403" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Transparency in Security Clearance Denials Act</short-title></quote>.</text></section> <section id="HEFB2F55CB0DD4EF7909D78CFF812A191" section-type="subsequent-section"><enum>2.</enum><header>Annual report by Secretary of State on certain adverse security clearance adjudications</header> <subsection id="H19068573A0D84028AFDC125CE364D8F0"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, and annually thereafter, the Secretary of State shall submit to the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate a report that contains, with respect to the 1-year period ending on the date of the submission of the report, the following:</text> 
<paragraph id="HA9A8C49E8F12433F885567E940EA7094"><enum>(1)</enum><text display-inline="yes-display-inline">For each type of covered adjudicative outcome, the number of individuals who received such outcome from the Assistant Secretary of State for Diplomatic Security.</text></paragraph> <paragraph id="HEDACD3E81EA84537BFE8B19F655514A3"><enum>(2)</enum><text display-inline="yes-display-inline">The number of individuals who submitted to the Assistant Secretary of State for Diplomatic Security an appeal with respect to a covered adjudicative outcome, disaggregated by whether the appeal related to assignment restrictions or assignment reviews.</text></paragraph> 
<paragraph id="H009F5567BAA74F8AAD0522D6B1CB6AFC"><enum>(3)</enum><text>The success rate of such appeals.</text></paragraph> <paragraph id="H6E9074EA91E94742984933312E3846E9" display-inline="no-display-inline"><enum>(4)</enum><text>A description of the considerations and criteria used by such employees to determine whether a covered adjudicative outcome is warranted.</text></paragraph></subsection> 
<subsection id="HD636158F919045B6AC245822A0EB5F2D"><enum>(b)</enum><header>Disaggregation of data</header><text>The data specified in paragraphs (1) through (3) of subsection (a) shall also be disaggregated by the following:</text> <paragraph id="HBCCF74095268492FB8C22DBA9750D47C" display-inline="no-display-inline"><enum>(1)</enum><text>Position held by the individual, including by the following:</text> 
<subparagraph id="H1FB183224A31496094E403534B4B8554"><enum>(A)</enum><text>Foreign Service officer.</text></subparagraph> <subparagraph id="H45E0DA6378D6480AADD61F81EA25EE17"><enum>(B)</enum><text>Civil service employee.</text></subparagraph> 
<subparagraph id="H41ABBA9D1F7846ED9135599F389518D3"><enum>(C)</enum><text>Other position.</text></subparagraph></paragraph> <paragraph id="HD44FC71156D9481880655C13F958E4F3"><enum>(2)</enum><text>Ethnicity, national origin, and race, to the extent such information is available.</text></paragraph> 
<paragraph id="HAB330ECE2D8F464FA2B99D03371152D2"><enum>(3)</enum><text display-inline="yes-display-inline">Gender, to the extent such information is available.</text></paragraph></subsection> <subsection id="HDC19DCDDAE594582835046F43507610D"><enum>(c)</enum><header>Initial report scope</header><text>Notwithstanding the 1-year period described in subsection (a), the first report submitted pursuant to the requirements of that section shall be with respect to the period beginning on January 1, 2024, and ending on the date of the submission of such first report.</text></subsection>
<subsection id="HD9783FF4981142DEA8FD32513A7DFF59"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="HB1E6CDF365D64DAA83BE159A8170DF37"><enum>(1)</enum><header>Continuous vetting</header><text display-inline="yes-display-inline">The term <quote>continuous vetting</quote> has the meaning given that term in section 6601 of the Damon Paul Nelson and Matthew Young Pollard Intelligence Authorization Act for Fiscal Years 2018, 2019, and 2020 (<external-xref legal-doc="usc" parsable-cite="usc/50/3352">50 U.S.C. 3352</external-xref>).</text></paragraph> 
<paragraph id="HF74467A1960F45909706B9BD8218F7C3"><enum>(2)</enum><header>Covered adjudicative outcome</header><text>The term <quote>covered adjudicative outcome</quote> means the following:</text> <subparagraph id="H52B2266724D84B62ABD669412093EF1B" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">With respect to an initial security clearance background investigation, an adjudication that was unfavorable and resulted in a denial, suspension, or revocation of a security clearance.</text></subparagraph> 
<subparagraph id="H03A7F017964A4D3887D4DCD38CE468B9"><enum>(B)</enum><text display-inline="yes-display-inline">With respect to a periodic reinvestigation, an adjudication that was unfavorable and resulted in a denial, suspension, or revocation of a security clearance.</text></subparagraph> <subparagraph id="H8432E2E36513463391CDC5ECFEDF5F3A"><enum>(C)</enum><text display-inline="yes-display-inline">With respect to a program of continuous vetting, a denial, suspension, or revocation of a security clearance taken by an authorized adjudicative agency as a result of such continuous vetting.</text></subparagraph></paragraph> 
<paragraph id="H6F1CA0DE5E1640859AC6300EAACF1B87"><enum>(3)</enum><header>Periodic reinvestigation</header><text display-inline="yes-display-inline">The term <quote>periodic reinvestigation</quote> has the meaning given that terms in section 3001 of the Intelligence Reform and Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/50/3341">50 U.S.C. 3341</external-xref>).</text></paragraph></subsection></section> </legis-body></bill>
