<section id="HEA9672A7F2154E6F83E0C2475788ACFA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>NRC Office of Public Engagement and Participation Act of 2025</short-title></quote>.</text></section> <section id="HC57513317EAE40248E16F9B0323A96FE"><enum>2.</enum><header>Office of Public Engagement and Participation</header> <subsection id="H2D11DAF0ABDF4EA78F001C70BEE1EF53"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the Commission an office to be known as the Office of Public Engagement and Participation.</text></subsection>
<subsection id="H1420A9B3455C48AAB9E2255471BE53D8"><enum>(b)</enum><header>Director</header>
<paragraph id="H8EA70332C27944BEB9F008F545529A02"><enum>(1)</enum><header>In general</header><text>The Office shall be administered by a Director.</text></paragraph> <paragraph id="HB7BCF67F2CE64ADEB182151A1438D56C"><enum>(2)</enum><header>Appointment</header><text>Subject to the approval of the Commission, the Chairman shall appoint the Director.</text></paragraph>
<paragraph id="H17AA9C0C173E4868943241E19548F51E"><enum>(3)</enum><header>Term</header><text>Subject to paragraph (7), the Director shall serve for—</text> <subparagraph id="H7466B7C20C2640DEB668DE8B0CDABB9D"><enum>(A)</enum><text>a term of five years; and</text></subparagraph>
<subparagraph id="H76BD1C6A0CE74293B4E2262F7E853548"><enum>(B)</enum><text>no more than two terms.</text></subparagraph></paragraph> <paragraph id="HB28F4E0EA6F9498180F7D8F8991F3A11"><enum>(4)</enum><header>Duties</header><text>The Director—</text>
<subparagraph id="H0CA032011E124D8FBEEC842CCECFD88B"><enum>(A)</enum><text>shall be responsible for the discharge of the functions of the Office; and</text></subparagraph> <subparagraph id="H22A69ABBDF8D4B109BB39305FDFC81FA"><enum>(B)</enum><text>may appoint, and assign the duties of, staff of the Office as necessary to carry out the functions of the Office.</text></subparagraph></paragraph>
<paragraph id="HF03A087F6B9C4EF3ACDB54B54F2FC813"><enum>(5)</enum><header>Compensation</header><text>The Director shall be compensated at a rate of pay not greater than the maximum rate of pay prescribed for a senior executive in the Senior Executive Service under section 5382 of title 5, United States Code.</text></paragraph> <paragraph id="HFBADF8368EA74906A8D8184C80A9271C"><enum>(6)</enum><header>Removal</header> <subparagraph id="H0D35ACAB75484BDFA685AC36291C678F"><enum>(A)</enum><header>In general</header><text>Subject to the approval of the Commission to initiate an action, the Chairman or a member of the Commission may initiate an action for removal of the Director.</text></subparagraph>
<subparagraph id="H9B9B4A8883EC4735B225C168B3F92B17" commented="no"><enum>(B)</enum><header>Removal limitations</header><text>The Commission may remove the Director for inefficiency, neglect of duty, or malfeasance in office but for no other cause.</text></subparagraph></paragraph> <paragraph id="HD852E9FAB0D54EE789CC13A2343FF23E" commented="no"><enum>(7)</enum><header>Expiration of term</header><text>A Director may continue to serve after the expiration of the term of such Director until a successor is appointed.</text></paragraph></subsection>
<subsection id="H9B923CBD3F9E43B3B02A8B6E6BACE54C"><enum>(c)</enum><header>Functions of the Office</header>
<paragraph id="H41141A5E5B8342FC9FE1BFE37C684FE7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The functions of the Office shall be to—</text> <subparagraph id="HDC2B6487BF4C4D63B46645A20F7014E9"><enum>(A)</enum><text>support public participation in proceedings before the Commission;</text></subparagraph>
<subparagraph id="H134EFC847FC145B884D6FD686366C169"><enum>(B)</enum><text>advocate for the public interest within the jurisdiction of the Commission;</text></subparagraph> <subparagraph id="H9086ECA524964860B8E39C270F3BB659"><enum>(C)</enum><text>provide educational, legal, and technical guidance and assistance to members of the public with respect to participating in proceedings before the Commission, including guidance on submitting comments, contentions, and hearing requests;</text></subparagraph>
<subparagraph id="HD38EFDD1CED2433A88B9389AA0D3160F"><enum>(D)</enum><text>coordinate assistance available to persons participating or proposing to participate in proceedings before the Commission; and</text></subparagraph> <subparagraph id="H7120B816F4484B50B1A30453A3E4C329"><enum>(E)</enum><text>coordinate assistance to the public with respect to authorities exercised by the Commission.</text></subparagraph></paragraph>
<paragraph id="HB493401512FB430CA6ABC6FD8A7408DB" commented="no"><enum>(2)</enum><header>Compensation of fees</header><text display-inline="yes-display-inline">Notwithstanding section 502 of the Energy and Water Development Appropriations Act, 1993 (<external-xref legal-doc="usc" parsable-cite="usc/5/504">5 U.S.C. 504</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/102/377">Public Law 102–377</external-xref>), the Commission may, under rules promulgated by the Commission, provide compensation for reasonable attorney’s fees, expert witness fees, and other costs of participating in any proceeding before the Commission to any person whose participation substantially contributed to the approval, in whole or in part, of a position advocated by such person, if the Commission determines that—</text> <subparagraph id="HC200E07DBF1F46DFA39D5A1862874BF1" commented="no"><enum>(A)</enum><text>the proceeding is significant; and</text></subparagraph>
<subparagraph id="H3F51D32C0B56408EB82CFF6B099E5152" commented="no"><enum>(B)</enum><text>the participation of such person in such proceeding without receipt of compensation constitutes a significant financial hardship to such person.</text></subparagraph></paragraph></subsection> <subsection id="H7F7852D7FF91450CB57075D04AA14E98"><enum>(d)</enum><header>Independent Office</header><text>The Chairman shall take appropriate actions to ensure the independence of the Office within the Commission, including independence from other officers and employees of the Commission.</text></subsection>
<subsection id="H9367AE4D4BBA4F3EA6D27764963D2CD0"><enum>(e)</enum><header>Annual report</header>
<paragraph id="H9C823F44616B45DBA9067E8A4A1C7FB1"><enum>(1)</enum><header>In general</header><text>Not later than one year after the date of enactment of this Act, and annually thereafter, the Director shall submit to Congress a report on the activities of the Office.</text></paragraph> <paragraph id="H46E6E5695B3D4B1082137007E17518C8"><enum>(2)</enum><header>Requirements</header><text>Each report under paragraph (1) shall include—</text>
<subparagraph id="HA773719FDC314AF7BF2344859F10666A"><enum>(A)</enum><text>the number and types of requests for assistance received by the Office during the preceding year; and</text></subparagraph> <subparagraph id="H4CFD5EC3E1C04D36872B9A3319FF2D91"><enum>(B)</enum><text>an assessment of the most common difficulties encountered by members of the public with participating or proposing to participate in proceedings before the Commission in the preceding year.</text></subparagraph></paragraph></subsection>
<subsection id="HFFFE3EBB55364FC2892BFD64C22E5901"><enum>(f)</enum><header>No effect on existing public engagement standards</header><text>Nothing in this Act shall be interpreted as reducing the standards for the Commission to engage the public in any proceedings or decisions.</text></subsection> <subsection id="HDB3D1775F1E34BA4B0CC318C98908B0E"><enum>(g)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="H1B3359F94C6946D59C9D05FE53788E14"><enum>(1)</enum><header>Chairman</header><text>The term <term>Chairman</term> means the Chairman of the Commission.</text></paragraph> <paragraph id="H4E482795E36149EDABAA1FC77069D68B"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the Nuclear Regulatory Commission.</text></paragraph>
<paragraph id="H4000AD461FB5404A8B312BBE945F8D20"><enum>(3)</enum><header>Office</header><text display-inline="yes-display-inline">The term <term>Office</term> means the Office of Public Engagement and Participation established under subsection (a).</text></paragraph></subsection></section> </legis-body></bill>
