<section id="H5D2922BEB63B46DDA251F8A37F2BBF97" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Respectful Treatment of Unborn Remains Act of 2025</short-title></quote>.</text></section> <section id="HD9E85D06355B4B57B8395E8B2A2FE650" section-type="subsequent-section"><enum>2.</enum><header>Prohibition of fetal remains in publicly owned water systems</header><text display-inline="no-display-inline">Part H of title IV of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/289">42 U.S.C. 289 et seq.</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H9500D96EE74B48B7AE5C6BDC7AD20FB0" display-inline="no-display-inline"> 
<section id="H7BABA6BFCCB140899C06671BADFE1DB0"><enum>498F.</enum><header>Prohibition of fetal remains in publicly owned water systems</header> 
<subsection id="HABCFE50A633F4EF083FA9E0987613B36"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">An abortion provider may not cause fetal remains to be placed into a publicly owned water system.</text></subsection> <subsection id="HE6E70C7A9E7A42C985AB48EE6D8A037D"><enum>(b)</enum><header>Penalties for violation</header><text display-inline="yes-display-inline">An abortion provider who violates subsection (a) shall be fined in accordance with title 18, United States Code, imprisoned not more than 5 years, or both.</text></subsection> 
<subsection id="HF19CE1A515CA470C9839F2E3B8D968CA"><enum>(c)</enum><header>No liability for individual upon whom abortion is performed</header><text>Notwithstanding any other provision of law, an individual upon whom an abortion is performed shall not be liable for any offense related to a violation of subsection (a) with respect to such abortion.</text></subsection> <subsection id="HD68377B15A0E4183A63BBA8841A3C6E2"><enum>(d)</enum><header>Relation to other law</header><text>Nothing in this section may be construed to preempt a State or local requirement that prohibits an abortion provider from causing fetal remains to be placed into a publicly owned water system.</text></subsection> 
<subsection id="H0BCFD888F66E4816ACCD197D283BBA03"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HBFE0F8D97712473D88069F059145C27A"><enum>(1)</enum><header>Abortion</header><text>The term <quote>abortion</quote> means a procedure involving the use or prescription of a device or substance—</text> 
<subparagraph id="HE47D69FE1501415396844C206EFDC822"><enum>(A)</enum><text>to intentionally kill the unborn child of an individual known to be pregnant; or</text></subparagraph> <subparagraph id="H657BE5E1478A4E3DACB7519E3B6BA3E9"><enum>(B)</enum><text>to intentionally terminate the pregnancy of such an individual, unless such termination is conducted with the intent to—</text> 
<clause id="H392C56A494484AF2835CCE35BAF7E861"><enum>(i)</enum><text>produce a live birth and preserve the life and health of such child; or</text></clause> <clause id="H39813A2B290C4A93BEF8A453E52AA719"><enum>(ii)</enum><text>remove a dead unborn child from the body of such an individual.</text></clause></subparagraph></paragraph> 
<paragraph id="H892C1C6BDCC7410F82BDFBB9E14C0266"><enum>(2)</enum><header>Abortion provider</header> 
<subparagraph id="H18150B87D75241898C932922F3199A71"><enum>(A)</enum><header>In general</header><text>The term <quote>abortion provider</quote> means an individual who performs an abortion.</text></subparagraph> <subparagraph id="H112FA2E448414340BAF8AD49A4CF6052"><enum>(B)</enum><header>Exclusion</header><text>The term <quote>abortion provider</quote> does not include, with respect to an abortion, the individual upon whom the abortion is performed.</text></subparagraph></paragraph> 
<paragraph id="HD5D6A434D5AD4F6C9844BB091840DF23"><enum>(3)</enum><header>Fetal remains</header><text>The term <quote>fetal remains</quote> means—</text> <subparagraph id="H8233CC6F77B44605A2CC8802BC7E324F"><enum>(A)</enum><text>the remains of an aborted fetus (or a portion thereof); and</text></subparagraph> 
<subparagraph id="H2A6990EBB92847E89E1E52136E940A1C"><enum>(B)</enum><text>any other medical waste associated with an abortion.</text></subparagraph></paragraph> <paragraph id="H440350EC72A946939558E58AD4DF9D12"><enum>(4)</enum><header>Publicly owned water system</header><text>The term <quote>publicly owned water system</quote> means a system of facilities owned or controlled by a Federal, State, or local government entity, the purpose of which is to provide, transport, or treat water, including the drains, pipes, and other devices that connect to such system.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
