<section id="H575CF576131841859AC9B2B527887241" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fuel Emissions Freedom Act</short-title></quote>.</text></section> <section id="H9FBA741D4AF94A67A7D8DD4AD67090BE" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="H91AD5B1A1BA94573A5B6A09EBE1687E9"><enum>(1)</enum><text>Fuel emissions regulations increase costs for consumers and manufacturers.</text></paragraph> <paragraph id="H92DBBD1B7F3349B6B836BD17036B829E"><enum>(2)</enum><text display-inline="yes-display-inline">Overlapping and ever-changing fuel emissions standards, whether imposed by the Environmental Protection Agency, the State of California, or through Corporate Average Fuel Economy regulations, create long-term uncertainty for manufacturers.</text></paragraph> 
<paragraph id="H56DDBEA30E0A49E28591F3310854EE9F"><enum>(3)</enum><text display-inline="yes-display-inline">This fragmented regulatory environment stifles innovation, disrupts supply chains, and burdens manufacturers and businesses, especially small and medium-sized auto suppliers.</text></paragraph> <paragraph id="H8BB76E33DFA0446A935D1A17D4602A1E"><enum>(4)</enum><text display-inline="yes-display-inline">Conflicting fuel emissions standards force manufacturers to comply with multiple sets of costly and inconsistent regulations, further reducing efficiency and raising production costs, which are ultimately passed onto the consumer.</text></paragraph> 
<paragraph id="H39C4EF04FDEE4ED8B9840944E460803F"><enum>(5)</enum><text display-inline="yes-display-inline">Eliminating fuel emissions standards at the Federal and State level will help restore regulatory certainty, lower costs for families, and strengthen manufacturing in the United States to ensure economic freedom.</text></paragraph></section> <section id="HB7FC9CE483554782997E09B37EFD4A99"><enum>3.</enum><header>Repeal and preemption of certain emission standards</header> <subsection id="H1F1AA99FC4CE4A78A2965D44B58B6FB9" commented="no"><enum>(a)</enum><header>Motor vehicle emission and fuel standards under Clean Air Act</header> <paragraph id="HC11137D744C84181A17BD14EEDD3451F"><enum>(1)</enum><header>Repeal of standards</header><text display-inline="yes-display-inline">Section 202 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7521">42 U.S.C. 7521</external-xref>) is repealed.</text></paragraph> 
<paragraph id="H354FD3E6CF5B497BB072326D4C1AFDD7"><enum>(2)</enum><header>Preemption of State standards</header><text display-inline="yes-display-inline">Section 209 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7543">42 U.S.C. 7543</external-xref>) is amended—</text> <subparagraph id="H86B8C7895B9C4CF3ABA5B4FC669D7AB4"><enum>(A)</enum><text>in subsection (a), by striking <quote>subject to this part</quote>;</text></subparagraph> 
<subparagraph id="H29A95AF2BB4F4793BB54DEE3547DCB29"><enum>(B)</enum><text>by striking subsection (b);</text></subparagraph> <subparagraph id="H0FD3BB5338A44EF9BF7D64D96915F9D0"><enum>(C)</enum><text>in subsection (c), by striking <quote>The preceding sentence shall not apply in the case of a State with respect to which a waiver is in effect under subsection (b).</quote>;</text></subparagraph> 
<subparagraph id="H31F75662D47E4DD8A769FACAB543AB99"><enum>(D)</enum><text>in subsection (e), by striking <quote>Subsection (b) shall not apply for purposes of this paragraph</quote> and all that follows through <quote>The Administrator shall issue</quote> and inserting the following:</text> <quoted-block style="OLC" id="H5944F796022F4AACA9CA046B2C26E76B" display-inline="no-display-inline"> <paragraph id="HE46FD9A2417A4CBC90A675A2B7C99DFD"><enum>(2)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Administrator shall issue</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HEA506BF9A6C342D8AF460802566458EF"><enum>(E)</enum><text>by redesignating subsections (c), (d), and (e) as subsections (b), (c), and (d), respectively.</text></subparagraph></paragraph> </subsection> <subsection id="H307F291A53FA4F2BB4288073760C73A8"><enum>(b)</enum><header>Automobile fuel economy</header> <paragraph id="H850056B8786A4A34AC45EE40E31DEFC0"><enum>(1)</enum><header>Repeal of standards</header><text display-inline="yes-display-inline">Sections 32902 through 32918 of title 49, United States Code, are repealed.</text></paragraph> 
<paragraph id="HABFA7050DBF942EB8D5FB3244411253C"><enum>(2)</enum><header>Preemption of State standards</header><text>Section 32919 of title 49, United States Code, is amended—</text> <subparagraph id="H38A82059C8CD4DDB97C9F9A777608BAA"><enum>(A)</enum><text>in subsection (a)—</text> 
<clause id="HD223376670AE4AEB9827FAD38859ABF4"><enum>(i)</enum><text>by striking <quote><header-in-text level="subsection" style="USC"><enum-in-header>(a)</enum-in-header> General.</header-in-text>—When an average fuel economy standard prescribed under this chapter is in effect, a State</quote> and inserting <quote>A State</quote>; and</text></clause> <clause id="HF7658808E0514C0299A79CBC16A6ACE4"><enum>(ii)</enum><text>by striking <quote>covered by an average fuel economy standard under this chapter</quote>; and</text></clause></subparagraph> 
<subparagraph id="H8DFCA8EEBDE447C79E21E1DA10677EC3"><enum>(B)</enum><text>by striking subsections (b) and (c).</text></subparagraph></paragraph> <paragraph id="H4D1ECAB5371C4AC09CEEC135E84528B6"><enum>(3)</enum><header>Table of sections amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/329">chapter 329</external-xref> of title 49, United States Code, is amended by striking the items relating to sections 32902 through 32918.</text></paragraph> </subsection> 
<subsection id="H698B7EF137AB450586571C53EC93F37C" commented="no"><enum>(c)</enum><header>Nullification of standards</header><text display-inline="yes-display-inline">Any Federal regulation issued pursuant to section 202 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7543">42 U.S.C. 7543(b)</external-xref>) or sections 32902 through 32918 of title 49, United States Code, or any State law, regulation, or executive order issued pursuant to section 209(b) of such Act, as each such section was in effect on the day before the date of enactment of this Act, is hereby nullified and shall have no force or effect.</text></subsection> <subsection id="HADF71A5D220C4B188CF157D184C3E704"><enum>(d)</enum><header>References</header><text display-inline="yes-display-inline">Any reference in any other Federal law, Executive order, rule, regulation, or delegation of authority, or any document of or pertaining to a standard established under section 202 or 209(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7521">42 U.S.C. 7521</external-xref>; 7543(b)) or section 32902 through 32918 of title 49, United States Code, is deemed void and unenforceable.</text></subsection></section>
<section id="HAF1C3E45541A4471A630AD92836E2F68"><enum>4.</enum><header>Prohibition on fuel emission standards</header>
<subsection id="HB1047682DD8A4F37A410033DBEB7CEF3"><enum>(a)</enum><header>Federal preemption</header><text display-inline="yes-display-inline">Notwithstanding any other law, the Federal Government may not establish, enforce, or maintain fuel emission standard for motor vehicles.</text></subsection> <subsection id="HA742F46995AD4A3682AFD286B4BE5D7D"><enum>(b)</enum><header>State prohibition</header><text>A State, or political subdivision thereof, may not enforce or maintain any fuel emission standards for motor vehicles.</text></subsection>
<subsection id="HAEA8FF98170E4F5B966CAC2301527DF6"><enum>(c)</enum><header>Preemption of standards</header><text display-inline="yes-display-inline">Any Federal or State law, regulation, or executive order that establishes fuel emissions standards for motor vehicles is hereby nullified and shall have no force or effect.</text> </subsection></section> </legis-body></bill>
