<section id="H8B0D45E542DE433DBEAAF2DB3B5C0C72" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Foreign Adversary Federal Offense Act of 2025</short-title></quote>.</text></section> <section id="H0313D1E722F64CDA9126F24CD49721D8"><enum>2.</enum><header>Economic espionage</header><text display-inline="no-display-inline">Section 1831 of title 18, United States Code, is amended—</text> 
<paragraph id="HCB52A1F6BE1E44739D8937A1908B3ECF"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), in the matter following paragraph (5), by striking <quote>except as provided in subsection (b),</quote> and inserting <quote>except as provided in subsection (b) or (c),</quote>; and</text></paragraph> <paragraph id="HA941493205DF4BC1BCA1442B00F9AA37"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block style="USC" id="H0F4B037409F84A5395A2F0F402D1BD1D" display-inline="no-display-inline"> 
<subsection id="HB8EF99F111714F6A89EC439F91E10A20"><enum>(c)</enum><header>Special penalties</header><text display-inline="yes-display-inline">The following additional penalties shall apply in the case of an offense under subsection (a):</text> <paragraph id="H844C369358CF4A8E96661477B8228114"><enum>(1)</enum><text display-inline="yes-display-inline">Whoever commits such an offense to advance the interests of a covered nation (as such term is defined in section 4872 of title 10) shall, except as otherwise provided in paragraph (2), be—</text> 
<subparagraph id="H990DC93FC9F94B5785B73067AC26A510"><enum>(A)</enum><text>fined not more than $5,000,000 or imprisoned not less than 10 years and not more than 15 years, or both, and shall be ineligible for supervised release; or</text></subparagraph> <subparagraph id="HF54C0A5F0B5B4A7D894D3B36D15C3475"><enum>(B)</enum><text display-inline="yes-display-inline">if the offense resulted in severe harm to economic or national security fined not more than $5,000,000 or imprisoned not less than 10 years and not more than 20 years, or both, and shall be ineligible for supervised release.</text></subparagraph></paragraph> 
<paragraph id="H2C4765A6D2A444C7AAAD0FEEFD34E679"><enum>(2)</enum><text display-inline="yes-display-inline">In the case of an organization that commits such an offense to advance the interests of a covered nation (as such term is defined in section 4872 of title 10), such organization shall be fined not more than the greater of $20,000,000 or 5 times the value of the stolen trade secret to the organization, including expenses for research and design and other costs of reproducing the trade secret that the organization has thereby avoided.</text></paragraph></subsection> <subsection id="H933676416889415D87C12A12FA5F8C9B"><enum>(d)</enum><header>Severe harm to economic or national security</header><text display-inline="yes-display-inline">For purposes of subsection (c), an offense will be considered to have resulted in severe harm to economic or national security if the offense was relating to the transmission of any nonpublic information relating to the security, design, operation, or vulnerability of critical infrastructure as defined in section 1016(e) of the Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism (USA PATRIOT ACT) Act of 2001 (<external-xref legal-doc="usc" parsable-cite="usc/42/5195c">42 U.S.C. 5195c(e)</external-xref>) and where such information, if acted upon, would pose a significant threat of the incapacitation or destruction of such infrastructure.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H685AAB7761544160B878C8781387B273"><enum>3.</enum><header>Gathering, transmitting or losing defense information</header><text display-inline="no-display-inline">Section 793 of title 18, United States Code, is amended, in the matter following subsection (f), by inserting after <quote>imprisoned not more than ten years, or both</quote> the following: <quote>, except that, if the violation of any of the foregoing provisions of this section was committed to advance the interests of a covered nation (as such term is defined in section 4872 of title 10), then the offender shall be fined under this title or imprisoned not less than 15 years and not more than any term of years or for life, or both</quote>.</text> </section> </legis-body></bill>
