<section id="H350F2EEB721C4355A2591DF039B4FF1B" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guarding U.S. Authority for Removal and Detention Act</short-title></quote> or the <quote><short-title>GUARD Act</short-title></quote>.</text></section> 
<section id="HB2E5362BBE95446890D771B0605E3096"><enum>2.</enum><header>Amendment to the posse comitatus act</header><text display-inline="no-display-inline">Section 1385 of title 18, United States Code, is amended—</text> <paragraph id="H67FB0D996C3B4D8B97A155B97F39E448"><enum>(1)</enum><text>by striking <quote>Whoever</quote> and inserting <quote><header-in-text level="subsection" style="USC"><enum-in-header>(a)</enum-in-header></header-in-text> Whoever</quote>; and</text></paragraph> 
<paragraph id="HC36BF71E3AA34B50AFE4AC733481F9E1"><enum>(2)</enum><text>by adding at the end the following new subsection:</text> <quoted-block style="USC" id="H603873735CE34914A33B0B5BD1BBEEDA" display-inline="no-display-inline"> <subsection id="H9A0FD0517C3F435A9E80AB58B34FFB9F"><enum>(b)</enum><header>Exceptions</header><text display-inline="yes-display-inline">Subsection (a) shall not apply to the use of members of the National Guard—</text> 
<paragraph id="H197A8ED72C8F4A659D6D6D348157F57C"><enum>(1)</enum><text>performing State duty under orders issued by the Governor of such State; or </text></paragraph> <paragraph id="H2B34FF7B0F364A3F85ACDCE899E0D01D"><enum>(2)</enum><text>performing duty under title 10 or 32, if such members are used exclusively for—</text> 
<subparagraph id="HD4FFA0EB1AAC451A8B38D6105E67C2E8"><enum>(A)</enum><text>the enforcement of the immigration laws (as such term is defined in section 101 of the Immigration and Nationality Act (8 U.S.C.1101)), including the apprehension or detention of aliens unlawfully present in the United States, and the execution of orders of removal issued under the immigration laws; or</text></subparagraph> <subparagraph id="H5084B7C7CA624C028A7C30CE7571BAC0"><enum>(B)</enum><text>border security operations.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H1F893E130E244813A69122002FD8E481"><enum>3.</enum><header>Assaulting immigration enforcement personnel</header> 
<subsection id="HF7B1E0AE54234A1A9283DAD966192977"><enum>(a)</enum><header>Assault on Federal Immigration Officers or State Law Enforcement Assisting Immigration Operations</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/7">Chapter 7</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text> <quoted-block style="USC" id="H79A848AFF8AB4423B495A7D5DBB1F2E6" display-inline="no-display-inline"> <section id="H2CAFB50B18014D83BF73972AE4111833"><enum>119A.</enum><header>Assault on immigration enforcement officers</header> <subsection id="HCEA0CC0A4017486F97D96B75C232D834"><enum>(a)</enum><text>Whoever knowingly assaults, resists, opposes, impedes, intimidates, or interferes with—</text> 
<paragraph id="H707432A7508B4DFF89226D8868726555"><enum>(1)</enum><text>any officer or employee of U.S. Immigration and Customs Enforcement, U.S. Customs and Border Protection, or any other Federal immigration enforcement agency; or</text></paragraph> <paragraph id="H2F89C5B3083245AC8491F9F2B1421C5C"><enum>(2)</enum><text>any State or local law enforcement officer acting under Federal authority or in active assistance of Federal immigration enforcement operations in the performance of their official duties, or on account of the performance of such duties,</text></paragraph><continuation-text continuation-text-level="subsection">shall be fined under this title and imprisoned not less than 5 years and not more than 20 years.</continuation-text></subsection> 
<subsection id="H74587D90AFDB403A92804A555AAA2943"><enum>(b)</enum><text>If bodily injury results from the acts committed in violation of subsection (a), the term of imprisonment shall be not less than 10 years and not more than 30 years.</text></subsection> <subsection id="HD519ED154CD94307BD3469B1DD4A202C"><enum>(c)</enum><text>If death results from the acts committed in violation of subsection (a), the offender shall be subject to imprisonment for life or the death penalty.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD01F93D0F3854A93992E8295DB1C1636" commented="no"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/7">chapter 7</external-xref> of title 18, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/18/119">section 119</external-xref> the following:</text> <quoted-block style="USC" id="H127C0D765B7548E98E44285CD3FB8822" display-inline="no-display-inline"> <toc regeneration="no-regeneration"> <toc-entry level="section">119A.
