<section id="H34A7844FA19F432E989E50C433D9AD36" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Employment Abundance Act</short-title></quote>.</text></section> <section id="HD87F766D0F6346F5894D358E8A3AE6F5"><enum>2.</enum><header>Federal contractor job classification review</header> <subsection id="HBA665B1D41F6484FADE6AC06D8F4FA88"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act—</text> 
<paragraph id="H74E7BD7D18BA4516AFAF35AE21A0F63E"><enum>(1)</enum><text>the Federal Acquisition Regulatory Council shall issue regulations that require any Federal contractor that enters into a contract subject to the Federal Acquisition Regulation to—</text> <subparagraph id="H11FF49DDB7FF4354931298C4BD40CC17"><enum>(A)</enum><text>conduct a comprehensive review of all job classifications within their Federal contract-related workforce;</text></subparagraph> 
<subparagraph id="H4CFBAD7D7DE3427F8F41931C9F6AEDAD"><enum>(B)</enum><text>identify each position that requires a bachelor’s degree or higher as a condition of employment; and</text></subparagraph> <subparagraph id="H7573158EA8EE4D16A01A10E511672EE9"><enum>(C)</enum><text>determine whether such educational requirements are demonstrably necessary for the performance of essential job functions; and</text></subparagraph></paragraph> 
<paragraph id="H7BB93A2ED2D7474489810FF5AC5E699E"><enum>(2)</enum><text>the Office of Personnel Management shall issue regulations that require each Executive agency (as defined in section 105 of title 5, United States Code) to—</text> <subparagraph id="HD85BB5C025424BD7A129ADB41A7DD5D1"><enum>(A)</enum><text>conduct a comprehensive review of all job classifications within such agency;</text></subparagraph> 
<subparagraph id="H10CF5FA7C58A490293F9FEA58A06C053"><enum>(B)</enum><text>identify each position that requires a bachelor’s degree or higher as a condition of appointment or promotion; and</text></subparagraph> <subparagraph id="H4F22769848B64A4E839DE04FB0B7E2C1"><enum>(C)</enum><text>determine whether such educational requirements are demonstrably necessary for the performance of essential job functions.</text></subparagraph></paragraph> </subsection> 
<subsection id="H1AF49F0924784B9EA8C4B5E8200D2025"><enum>(b)</enum><header>Reporting requirement</header><text display-inline="yes-display-inline">Not later than 180 days after the effective date of the regulations issued pursuant to subsection (a)—</text> <paragraph id="HAF1969DF9D2E40C7ACA8CF193CAB9FAD"><enum>(1)</enum><text>each Federal contractor shall submit to the Federal Acquisition Regulatory Council a report outlining the results of its job classification review, including—</text> 
<subparagraph id="HB74BF91B505F4314BD9151D099EB1FA7"><enum>(A)</enum><text>a list of positions where a degree requirement was determined to lack demonstrable occupational necessity; and</text></subparagraph> <subparagraph id="HA04D7AB012AD481F8092CD1DBDB4DD0F"><enum>(B)</enum><text>a plan to revise such job classifications, including alternative criteria that may be used, such as relevant work experience, certifications, or skills assessments; and</text></subparagraph></paragraph> 
<paragraph id="HDE601752CA544C1FBB1BBD725271030E"><enum>(2)</enum><text>each executive agency shall submit to the Office of Personnel Management a report outlining the results of its job classification review, including—</text> <subparagraph id="H3ADF78D223A94895B31B95D7525AEE41"><enum>(A)</enum><text>a list of positions where a degree requirement was determined to lack demonstrable job necessity; and</text></subparagraph> 
<subparagraph id="H9416CB4B533B4F0FB52CADF762AADA80"><enum>(B)</enum><text>a plan to revise such job classifications by including alternative criteria that may be used, such as relevant work experience, certifications, or skills assessments.</text></subparagraph></paragraph> </subsection> <subsection id="HCFE130EC2DD0415B8DF9622ABFB5D5CD"><enum>(c)</enum><header>Compliance and enforcement</header><text display-inline="yes-display-inline">Failure to comply with the requirements under this section may—</text> 
<paragraph id="H7F8DA55BBC9B41F39C7B5A43DFBABD9F"><enum>(1)</enum><text>for Federal contractors, result in administrative actions, including ineligibility for future Federal contracts, as determined by the Federal Acquisition Regulatory Council; and</text></paragraph> <paragraph id="H19D5DA7CA3FF43E599B451D9D5E37DF3"><enum>(2)</enum><text>for agencies, result in administrative actions under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/75">chapter 75</external-xref> of title 5, United States Code, or other remedies determined by the Office of Personnel Management.</text></paragraph></subsection> 
<subsection id="HE1D859006D18494D9DE19441C9611BB3"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to prohibit Federal contractors or agencies from maintaining educational requirements for a case in which such requirements are shown to be necessary for job performance or are mandated by law, regulation, or professional licensure standards.</text></subsection> <subsection id="H6F56E18EFB4441F9A519342CA35519AE"><enum>(e)</enum><header>Applicability</header><text display-inline="yes-display-inline">This section applies with respect to—</text> 
<paragraph id="HA4157651968E405EB1E8DD3FE09A474D"><enum>(1)</enum><text>any contract entered into on and after the effective date of the regulations issued pursuant to subsection (a)(1); and</text></paragraph> <paragraph id="H2F2B28A78588439581BDD298B6EF2311"><enum>(2)</enum><text display-inline="yes-display-inline">any appointment or promotion occurring on or after the effective date of the regulations issued pursuant to subsection (a)(2).</text></paragraph></subsection></section>
