<section id="H10C94ECE2ADA481C8A64B627F682D2DC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Addressing Hostile and Antisemitic Conduct by the Republic of South Africa Act of 2025</short-title></quote>.</text></section> <section id="H0EC04A40EED94F66A70EF07C6B967502"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="H6F64F746D9124ED6B7AD926EDC655CE3"><enum>(1)</enum><text>The Government of the Republic of South Africa has, in recent years, engaged in repeated diplomatic and legal actions targeting the State of Israel and Jewish communities under the guise of international law.</text></paragraph> <paragraph id="HC4ADCFA635AC4225AF16E71C39EB6D81"><enum>(2)</enum><text>These actions include the misuse of international legal institutions to advance politically motivated and antisemitic narratives inconsistent with objective human rights norms.</text></paragraph> 
<paragraph id="H4FED6029CFEB42D79B1829E8912286EC"><enum>(3)</enum><text>The Government of South Africa has increasingly aligned itself with authoritarian regimes and global actors hostile to United States national interests and democratic values.</text></paragraph> <paragraph id="HDBB49A4FA0BC46B4A550AB5B89BB9298"><enum>(4)</enum><text>United States taxpayer dollars must not be used to subsidize governments that engage in or legitimize such conduct.</text></paragraph></section> 
<section id="HBC3A15A990E24F929A1E6735E9A649AC"><enum>3.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States to—</text> <paragraph id="H5F716F7FD8064F07B593AC5505CEE8F4"><enum>(1)</enum><text>oppose antisemitic actions and rhetoric in any international forum;</text></paragraph> 
<paragraph id="HE3BE4015600D476497538F300A385727"><enum>(2)</enum><text>hold foreign governments accountable for abuse of international institutions for political targeting; and</text></paragraph> <paragraph id="H321D6054BE6C450ABF84FFB0332C2A82"><enum>(3)</enum><text>respond proportionately to governments that engage in hostility toward United States allies and international stability.</text></paragraph></section> 
<section id="H7D4C0658C0A4497E9B7F6D8F772BB9CD"><enum>4.</enum><header>Suspension of direct assistance to the Government of South Africa</header> 
<subsection id="H8D12F73CAD9B45B7ACEF25E71C53036D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, no funds may be obligated or expended to provide direct assistance to the Government of South Africa unless the Secretary of State certifies to Congress that such Government—</text> <paragraph id="HA2D6FB2FB8FF4A99A2E2DA13ECFC6F48"><enum>(1)</enum><text>has ceased all formal support for international legal actions that unfairly target the State of Israel or Jewish individuals based solely on religious or ethnic identity;</text></paragraph> 
<paragraph id="HD9884FB6D50A4BC69012C725FA0F12BB"><enum>(2)</enum><text>has implemented meaningful reforms to address corruption within state institutions; and</text></paragraph> <paragraph id="HD8A263759C1844398721D8B0BD3436B5"><enum>(3)</enum><text>has engaged constructively with United States diplomats regarding the normalization of international legal standards and the protection of religious minorities.</text></paragraph></subsection> 
<subsection id="HB129C17CAD9E45D9B285056847CE43B3"><enum>(b)</enum><header>Exceptions</header><text>The prohibition in subsection (a) shall not apply with respect to the following:</text> <paragraph id="H50D3124F7C144A158C77D79C27DCE981"><enum>(1)</enum><text>Humanitarian aid.</text></paragraph> 
<paragraph id="H2D97DE1E43E44864902847ABF0491554"><enum>(2)</enum><text>Public health programs administered by nongovernmental organizations.</text></paragraph></subsection></section> <section id="HBB417C72C354484AAAF6E535600919EA"><enum>5.</enum><header>Targeted sanctions against South African officials</header> <text display-inline="no-display-inline">The President shall impose sanctions under the Global Magnitsky Human Rights Accountability Act against any current or former official of the Government of South Africa who—</text> 
<paragraph id="HFF5753F647C640D0A987FBF755378D8D"><enum>(1)</enum><text>promotes or implements antisemitic policies or rhetoric in an official capacity;</text></paragraph> <paragraph id="HA97FE66B6141405AB42F41017B89DDEB"><enum>(2)</enum><text>uses public office to unjustly target the State of Israel or Jewish individuals through international courts or diplomatic platforms; or</text></paragraph> 
<paragraph id="H79C013AFFBBE4727B2BA4897ED366699"><enum>(3)</enum><text>engages in gross corruption, including the misuse of foreign aid or public funds.</text></paragraph></section> <section id="HA12C10EB66EC45B79E2B3CE2F73F41F2"><enum>6.</enum><header>Report</header> <subsection id="H1C02A3EFCA9A41B091BC9E97ACE91728"><enum>(a)</enum><header>Initial report</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of State shall submit to Congress a report detailing—</text> 
<paragraph id="H0FC4D8F6F8E54040AA15156CBE49FA24"><enum>(1)</enum><text>all legal, diplomatic, or rhetorical actions taken by the Government of South Africa in the past five years targeting the State of Israel, Jews, or Jewish institutions; and</text></paragraph> <paragraph id="H3C08B129BD7A4A35BCEEBAEA895ECBDF"><enum>(2)</enum><text>a summary of United States assistance provided to South Africa, including military training, law enforcement support, and financial assistance.</text></paragraph></subsection> 
<subsection id="H4B36C817339743C49766D66E7686D81A"><enum>(b)</enum><header>Annual update</header><text>The report required by subsection (a) shall be updated and resubmitted annually for 3 years following the date of the enactment of this Act.</text></subsection></section> <section id="HF7891844D6A14043A4580A8E036F590C"><enum>7.</enum><header>Termination</header><text display-inline="no-display-inline">The provisions of sections 4 and 5 shall terminate upon certification by the President to Congress that the Government of South Africa has—</text> 
<paragraph id="HCC7728AF927B46F7930A30CB1931DB72"><enum>(1)</enum><text>ceased participation in politically motivated international legal actions against allies of the United States;</text></paragraph> <paragraph id="HD000362852C64D7A943DD5DDE5663AF4"><enum>(2)</enum><text>implemented institutional reforms sufficient to prevent further abuse of international law and reduction of corruption; and</text></paragraph> 
<paragraph id="H452D9D1E95A142C6A22C7D13A7540012">
        <enum>(3)</enum>
 <text>taken concrete steps to improve diplomatic and security cooperation with the United States and its democratic allies.</text>
      </paragraph></section> 
<section id="H3E1BCD6068A8461884BA459B0FABFC7A"><enum>8.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act may be construed to—</text> <paragraph id="HAD82B9A0F63C4B11B7776B2E39D6AF96"><enum>(1)</enum><text>prohibit United States diplomatic engagement with the Government of South Africa;</text></paragraph> 
<paragraph id="HB758EED334104E038D0E9F532004E05A"><enum>(2)</enum><text>restrict private humanitarian or charitable assistance; or</text></paragraph> <paragraph id="HE51461EC32764BCCBA098AE704F49123"><enum>(3)</enum><text>affect trade agreements or tariffs not directly linked to the behavior addressed in this Act.</text> </paragraph></section>
