<section section-type="section-one" id="H0BF5323E411F422D9AC882154D8D01D5"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Lowering Broadband Costs for Consumers Act of 2025</short-title></quote>.</text></section> <section id="H42442ED113FE4BBD81857B4E54C65D1F"><enum>2.</enum><header>Lowering broadband costs for consumers</header> <subsection id="H73B84E0F4B6343DDB66324E12DEEA930"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="HBD98E8DB72534E55BD76B2C43EF4FB54"><enum>(1)</enum><header>Broadband internet access service</header><text>The term <term>broadband internet access service</term> has the meaning given the term in section 8.1(b) of title 47, Code of Federal Regulations, or any successor regulation.</text></paragraph> <paragraph id="H8EFA7D1203B04F878928FBE9FD1F332E"><enum>(2)</enum><header>Broadband provider</header><text>The term <term>broadband provider</term> means a provider of broadband internet access service.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HC7B70C16F2074B5D961B8247CA219E11"><enum>(3)</enum><header display-inline="yes-display-inline">Commission</header><text>The term <term>Commission</term> means the Federal Communications Commission.</text></paragraph> <paragraph id="HB31EB7BE4E624634B73C0BAD8BEBCFD7"><enum>(4)</enum><header>Edge provider</header><text>The term <term>edge provider</term> means a provider of online content or services, including—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H613A786011C140E1A6CB0DAF738DC627"><enum>(A)</enum><text display-inline="yes-display-inline">a digital advertising service;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H4A1134E3443C4AE6B63CF9C95836CB07"><enum>(B)</enum><text display-inline="yes-display-inline">a search engine;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H6A479E1694CC4D0F98007BE6BE2FAC8C"><enum>(C)</enum><text display-inline="yes-display-inline">a social media platform;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H8960CD16AC004CA399515C92281CE7D2"><enum>(D)</enum><text display-inline="yes-display-inline">a streaming service;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H8D86EDA712F84BB58312137F608A8040"><enum>(E)</enum><text display-inline="yes-display-inline">an app store;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H47C4E8D59AD543D8BB2078D78475DC42"><enum>(F)</enum><text display-inline="yes-display-inline">a cloud computing service;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H8445ABC6D87446D596FBBD1A48D86BEF"><enum>(G)</enum><text display-inline="yes-display-inline">an over-the-top messaging service or any other service that enables texting;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H81FA418D36A84AE0A2D94405BD090D47"><enum>(H)</enum><text display-inline="yes-display-inline">a videoconferencing service;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HA62F3A61E7704482A09BBACC3E48098B"><enum>(I)</enum><text display-inline="yes-display-inline">a video gaming service; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H12981BC50EDF4EA8A7ABE6476E002015"><enum>(J)</enum><text display-inline="yes-display-inline">an e-commerce platform.</text></subparagraph></paragraph>
<paragraph id="HEB6BB127DF7A4F57B4D5B84FD97AF4D8"><enum>(5)</enum><header>Eligible telecommunications carrier</header><text>The term <term>eligible telecommunications carrier</term> means a common carrier designated as an eligible telecommunications carrier under section 214(e) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/214">47 U.S.C. 214(e)</external-xref>).</text></paragraph></subsection> <subsection id="H73B86F679BFF49B5BE027A8880B8E4AB"><enum>(b)</enum><header>Lowering broadband costs for consumers</header><text>Section 254(d) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/254">47 U.S.C. 254(d)</external-xref>) is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H9C52F0A455D8495A8AAD5E32E082379F"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>Every</quote> and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HD694B2622D2C4503962DBB51B1F33C54"> <paragraph commented="no" display-inline="no-display-inline" id="HF8EE9BD85DEA4E6683D86B0E9C35AEF0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Every</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H35ADD63AED9C4A5C95D8B7C9F4C17A02"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H955F065CF35D49299042EE4F78F9FFE4"> <paragraph id="HBC21D48904594E2D8C266E9CFB344E5E"><enum>(2)</enum><header>Rulemaking</header> <subparagraph commented="no" display-inline="no-display-inline" id="H689DCBB6AA6D4AB4A5D2EF8B25A3AA8D"><enum>(A)</enum><header>Initial rulemaking</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of the <short-title>Lowering Broadband Costs for Consumers Act of 2025</short-title>, the Commission shall complete a rulemaking to reform the Universal Service Fund by expanding the contribution base so that broadband providers and edge providers, except as provided in paragraph (3) of this subsection, contribute on an equitable and nondiscriminatory basis to the specific, predictable, and sufficient mechanisms established by the Commission to preserve and advance universal service.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HA6A8BE83B90541388578A2C64684C03D"><enum>(B)</enum><header>Revisions</header><text display-inline="yes-display-inline">From time to time after the rulemaking described in subparagraph (A), the Commission may revise the rules adopted under that subparagraph, as necessary, to ensure that broadband providers and edge providers continue to contribute on an equitable and nondiscriminatory basis to the specific, predictable, and sufficient mechanisms established by the Commission to preserve and advance universal service.</text></subparagraph></paragraph> <paragraph id="H20226C50D26044A5BA1DD37F42CDB19F"><enum>(3)</enum><header>Exempted edge providers and broadband providers</header><text>The requirement to contribute described in paragraph (2) shall not apply to—</text>
<subparagraph id="HABA7768B26434F018714B87E8424DA42"><enum>(A)</enum><text>an edge provider that—</text> <clause commented="no" display-inline="no-display-inline" id="H270A26699E014674872D1135B9CA68C3"><enum>(i)</enum><text display-inline="yes-display-inline">transmitted less than 3 percent of the estimated quantity of broadband data that was transmitted in the United States during the most recent year, as determined by the Commission; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HBE6D6B7FE9BC4A90B3CD4A4D32348C05"><enum>(ii)</enum><text>earned less than $5,000,000,000 in revenue in the United States during the most recent year; or</text></clause></subparagraph> <subparagraph id="H3F825BF747FC446297F26A51E75B406F"><enum>(B)</enum><text>an edge provider or broadband provider or class of edge providers or broadband providers if the revenue of the provider is such that the level of contribution of the provider to the preservation and advancement of universal service would be de minimis.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HB8BB869A203F43F1910D5904AC7F037E"><enum>(4)</enum><header>Broadband provider; edge provider defined</header><text display-inline="yes-display-inline">In this subsection, the terms <term>broadband provider</term> and <term>edge provider</term> have the meanings given those terms in section 2 of the <short-title>Lowering Broadband Costs for Consumers Act of 2025</short-title>.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HB243A0804D764E39A19F38C7B3DCE1AF"><enum>(c)</enum><header>Supporting broadband providers</header> <paragraph commented="no" display-inline="no-display-inline" id="HB9595850A8D8434D8F38F9EE81D7F93D"><enum>(1)</enum><header display-inline="yes-display-inline">Adoption of mechanism</header><text>Not later than 18 months after the date of enactment of this Act, the Commission shall complete a rulemaking to adopt a new mechanism under the high-cost program of the Universal Service Fund that will provide specific, predictable, and sufficient support for expenses incurred by a broadband provider that is an eligible telecommunications carrier in providing supported services to the extent that such expenses are not otherwise recovered from revenues earned from the assessment of just, reasonable, and affordable rates on end users in high-cost areas or from other universal service support mechanisms.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H34690B0CF8CE48F2A6D18D5F3F5F2AA0"><enum>(2)</enum><header>Limit on eligible telecommunications carriers</header><text>The Commission shall ensure that not more than 1 eligible telecommunications carrier for any area receives support from the mechanism adopted through the rulemaking conducted under paragraph (1).</text></paragraph></subsection> <subsection id="H43DFD11DF72343E09A6F8BC52107FD7A"><enum>(d)</enum><header>Enforcement by the Federal Communications Commission</header> <paragraph id="HB2A8E1A73A2C4A67B0FA7D764DDA6D1A"><enum>(1)</enum><header>Powers of Commission</header><text>Except as otherwise provided, the Commission shall enforce this Act in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151 et seq.</external-xref>) were incorporated into and made a part of this Act.</text></paragraph>
<paragraph id="H5BA2F13B0FFF4DE6B2A7AC185A45FA10"><enum>(2)</enum><header>Penalties, privileges, and immunities</header><text>Any person who violates this Act shall be subject to the penalties and entitled to the privileges and immunities provided in the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151 et seq.</external-xref>).</text></paragraph></subsection> <subsection id="H43FEA33B46A0450D9857EB5C95D2F3E9"><enum>(e)</enum><header>Purpose; rule of construction</header> <paragraph commented="no" display-inline="no-display-inline" id="H0DAD21BB8BC24F40BDB0AAF7C1A029E3"><enum>(1)</enum><header display-inline="yes-display-inline">Purpose</header><text>The purpose of this section is to direct the Commission to require contributions to the Universal Service Fund from edge providers and broadband providers and to modify the high cost program to promote affordable and available broadband.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HA483620734A64B749319662FDAEA278C"><enum>(2)</enum><header display-inline="yes-display-inline">Rule of construction</header><text>Nothing in this section shall be construed to provide the Commission with—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HC1FF034E3F9A4C6A8AC230E1D0463B6F"><enum>(A)</enum><text display-inline="yes-display-inline">any new authority over broadband providers; or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HA8605A58AAD046A9B4E96AD5FCDCDB05"><enum>(B)</enum><text display-inline="yes-display-inline">any authority over edge providers other than as described in paragraph (1).</text></subparagraph></paragraph></subsection></section> </legis-body></bill>
