R. 4014</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250613">June 13, 2025</action-date><action-desc><sponsor name-id="N000193">Mr. Nunn of Iowa</sponsor> (for himself and <cosponsor name-id="R000622">Mr. Riley of New York</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code, to establish criminal penalties for the reckless importation or handling of dangerous agricultural pathogens.</official-title></form><legis-body id="H34B7AE524AF24EAE95418F3D0BF6B11F" style="OLC"><section id="H6B919C70F0794FA992928637A75F72BA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Lethal Agricultural and National Threats (PLANT) Act</short-title></quote>.</text></section><section id="H867C03540BE24D5084A8C541F138733E"><enum>2.</enum><header>Reckless importation of dangerous agricultural pathogens</header><text display-inline="no-display-inline">Title 18 U.S.C. is amended by inserting after section 175b the following:</text><quoted-block style="USC" id="HA57DDE0BDDE2450491FF2CAF6CC816F4" display-inline="no-display-inline"><section id="H1F5DD3A1D69B4A43AEF171C7A8166660"><enum>175c.</enum><header>Reckless importation of dangerous agricultural pathogens.</header><subsection id="H6950D167C43F4AE28179C470B995282A" display-inline="no-display-inline"><enum>(a)</enum><header>Offense</header><text>Whoever knowingly or recklessly imports a biological agent, toxin, or organism—</text><paragraph id="HA1BCE0BD6437494595388732DF8FD1EC"><enum>(1)</enum><text>without the required permit or authorization from the U.S. Department of Agriculture or other appropriate agency; and</text></paragraph><paragraph id="H09D78064AEE0495A8D75165432953700"><enum>(2)</enum><text>where such agent, toxin, or organism is designated by regulation as a high-risk agricultural pathogen capable of causing significant harm to U.S. crops, livestock, or agricultural ecosystems,</text></paragraph><continuation-text continuation-text-level="subsection">Shall be fined under this title or imprisoned not more than 10 years, or both.</continuation-text></subsection><subsection id="H4C5A90A672154B8F86462E12A3FD7C51"><enum>(b)</enum><header>Aggravating factors</header><text>If the offense:</text><paragraph id="HDC762693059B42E395FC9CC42A98D8F4"><enum>(1)</enum><text>involves concealment of origin;</text></paragraph><paragraph id="H29AD6748321E42C4B2A5C19562D0F408"><enum>(2)</enum><text>is committed by a person acting on behalf of, or funded by, a foreign government; or</text></paragraph><paragraph id="H8654CDEF08C140A9BF44E3C02838B8A8"><enum>(3)</enum><text>results in actual economic damage exceeding $1,000,000;</text></paragraph><continuation-text continuation-text-level="subsection">Then the term of imprisonment may be up to 20 years.</continuation-text></subsection><subsection id="HBFCB44851B254406AB56DF268023DA60"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HF4462869BFFF4B54949A7752847245F6"><enum>(1)</enum><text>the term <quote>recklessly</quote> means the person consciously disregarded a substantial and unjustifiable risk that the pathogen could cause significant harm.</text></paragraph><paragraph id="H77EA98595D90458F90F0D21E616C4007"><enum>(2)</enum><text>the term <quote>high-risk agricultural pathogen</quote> shall be defined by the Secretary of Agriculture and published via regulation.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
