<section id="H988B2850DCF44622A98A04CC8032E96E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Campus Housing Affordability for Foster Youth Act</short-title></quote>.</text></section> <section id="H822B4B6B44C0447EB729BAF50301BCB6"><enum>2.</enum><header>Removal of prohibition on housing assistance to students</header><text display-inline="no-display-inline">Section 327(a) of the Transportation, Treasury, Housing and Urban Development, the Judiciary, the District of Columbia, and Independent Agencies Appropriations Act, 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/115">Public Law 109–115</external-xref>; 119 Stat. 2506) is amended—</text> 
<paragraph id="H049EF12AA52847FA89F3B3E410C32A2B"><enum>(1)</enum><text>by striking paragraph (1); and</text></paragraph> <paragraph id="H620F017DA4A0456C86090A80943F6078"><enum>(2)</enum><text>by redesignating paragraphs (2) through (6) as (1) through (5), respectively.</text></paragraph></section> 
<section id="HED0B14676CF9421E846BFB6ECFDE3310"><enum>3.</enum><header>Waiver of requirements for certain students</header><text display-inline="no-display-inline">Section 8(o) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)</external-xref>), is amended by adding at the end the following:</text> <quoted-block style="OLC" id="H2274640EFD9D41218321A3D82C282B10" display-inline="no-display-inline"> <paragraph id="H8A4F36365EAA4B00B30B3BA47219ED12"><enum>(23)</enum><header>Waiver of requirements for certain students</header> <subparagraph id="H1B3B54B7D2AC4B158F8AB9C93DEB25D6"><enum>(A)</enum><header>In general</header><text>The Secretary may waive any requirement under this subsection to provide tenant-based assistance under this subsection to an individual who—</text> 
<clause id="H30F1F6045086432CA549C1D87C5FD799"><enum>(i)</enum><text display-inline="yes-display-inline">is a student enrolled in an institution of higher education, as such term is defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>) and including the institutions described in subparagraphs (A) and (B) of section 102(a)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002(a)(1)</external-xref>);</text></clause> <clause id="H6F205504B8004AD982A83E708187907B"><enum>(ii)</enum><text>lives in an on-campus student housing facility maintained by such institution; and</text></clause> 
<clause id="H10D97366C98341DE928F3E56148F42AD"><enum>(iii)</enum><text>is—</text> <subclause id="H3CF165A32299443089EF2E7BC93C4FE0" display-inline="no-display-inline"><enum>(I)</enum><text>in foster care or was in foster care; or</text></subclause> 
<subclause id="HF142F75D2DDA4F8A9745697FB318E132"><enum>(II)</enum><text display-inline="yes-display-inline">a minor child declared emancipated by a court of competent jurisdiction.</text></subclause></clause></subparagraph> <subparagraph id="H1631ABB11A3241AE98546762465F8444"><enum>(B)</enum><header>Treatment of assistance</header><text display-inline="yes-display-inline">Assistance received by an individuals though the waiver described in subparagraph (A) may not be considered a part of the income of such individual for the purposes of—</text> 
<clause id="HDE8AD8D894E74E628B779644CB1593B1">
              <enum>(i)</enum>
 <text display-inline="yes-display-inline">determining eligibility for student financial assistance provided by the Federal Government or offered by an institution of higher education that receives Federal assistance;</text>
            </clause> 
<clause id="H45D42E797844454FB13142E32FE0F4D0"><enum>(ii)</enum><text display-inline="yes-display-inline">calculating income earned from work under a cooperative education program offered by an institution of higher education that receives Federal assistance;</text></clause> <clause id="H865692FD5BA84F918832AA465BFB7657"><enum>(iii)</enum><text display-inline="yes-display-inline">determining eligibility for any living allowance provided under a program established under the National and Community Service Act of 1990; or</text></clause> 
<clause id="H95CD0E49873C494AA5F30C3D836350D9"><enum>(iv)</enum><text>determining the amount of any child support the individual may owe.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body></bill>
