which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To authorize funding for electric vehicle charging infrastructure programs to be used for other highway projects, and for other purposes.</official-title></form><legis-body id="HC868D0549B314F2CB61984EB3F4196B6" style="OLC"><section id="HEE82F6005EE7474A991D2D541E8269FF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Highway Funding Flexibility Act of 2025</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="H3E89C43C336A4230A442C49382500270"><enum>2.</enum><header>Optimizing use of National Electric Vehicle Infrastructure Formula program funds</header><subsection commented="no" display-inline="no-display-inline" id="H0A2E5A83390A495A88A04198815C13F9"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="H1002F95A1DF64305A5771785CB82CF3B"><enum>(1)</enum><header>Program</header><text>The term <term>program</term> means the program under paragraph (2) in the matter under the heading <quote><header-in-text level="appropriations-small" style="OLC">highway infrastructure programs</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-intermediate" style="OLC">Federal Highway Administration</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-major" style="appropriations">Department of Transportation</header-in-text></quote> in title VIII of division J of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>; 135 Stat. 1421) (commonly known as the <quote>National Electric Vehicle Infrastructure Formula Program</quote>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6B334F0A76934237A82F26191D3606EC"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB0EDB688127642AF9C5B90471D947EDC"><enum>(3)</enum><header>State</header><text>The term <term>State</term> has the meaning given the term in section 101(a) of title 23, United States Code.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HDD8E7DBF7DE14485AC156871DDBF8CC7"><enum>(b)</enum><header>Optimization of funds</header><paragraph commented="no" display-inline="no-display-inline" id="H5A56C7E617AB4A13B0A2F949CEB67810"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, any amounts made available under the program that are unobligated as of the date of enactment of this Act—</text><subparagraph commented="no" display-inline="no-display-inline" id="HEA89373D7940451C81B6AB80886DA2FE"><enum>(A)</enum><text display-inline="yes-display-inline">shall be used only for—</text><clause commented="no" display-inline="no-display-inline" id="H2BC8C36CC1E74D9D9421E084B52F8F48"><enum>(i)</enum><text display-inline="yes-display-inline">the construction, reconstruction, resurfacing, restoration, rehabilitation, or preservation of a Federal-aid highway;</text></clause><clause commented="no" display-inline="no-display-inline" id="H5DC92161D6DF4D2886844BC758557691"><enum>(ii)</enum><text>a project to replace, rehabilitate, preserve, or protect 1 or more bridges on the National Bridge Inventory under section 144(b) of title 23, United States Code;</text></clause><clause commented="no" display-inline="no-display-inline" id="H7FC1052ADCA3473E99CCB337C94A8964"><enum>(iii)</enum><text>improvements that reduce the number of wildlife-vehicle collisions, such as wildlife crossing structures;</text></clause><clause commented="no" display-inline="no-display-inline" id="HC27B9C4BC1A34939A84E2365D541A823"><enum>(iv)</enum><text display-inline="yes-display-inline">projects to preserve or provide additional parking for commercial motor vehicles that are eligible under section 1401 of MAP–21 (<external-xref legal-doc="usc" parsable-cite="usc/23/137">23 U.S.C. 137</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/112/141">Public Law 112–141</external-xref>); or</text></clause><clause commented="no" display-inline="no-display-inline" id="HFB81E3DCD45845BC8CB778E1E49BC645"><enum>(v)</enum><text>preliminary engineering, engineering, or design-related services directly related to a project described in any of clauses (i) through (iv); and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9824DB2316454A61BCADE6BE975F267E"><enum>(B)</enum><text>may not be used for the purposes described in paragraph (2) in the matter under the heading <quote><header-in-text level="appropriations-small" style="OLC">highway infrastructure programs</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-intermediate" style="OLC">Federal Highway Administration</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-major" style="appropriations">Department of Transportation</header-in-text></quote> in title VIII of division J of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>; 135 Stat. 1421).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE085439DAE1F45C2ACA9DA77B21C8DEA"><enum>(2)</enum><header>Future fiscal years</header><text>Notwithstanding any other provision of law, any funds made available for the program for any fiscal year beginning after the date of enactment of this Act shall be distributed to States in accordance with the program on October 1 of that fiscal year and used as described in paragraph (1).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H17206B4CB43B44E585E5627CBB650D30"><enum>(c)</enum><header>Set-Asides</header><paragraph commented="no" display-inline="no-display-inline" id="HCDB5AFED57B14C3A8BD29D7ADE5B18DC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary shall distribute to States in accordance with paragraph (3)—</text><subparagraph commented="no" display-inline="no-display-inline" id="H4B0FD79DD4064CB8A8D9CFE91654EDD2"><enum>(A)</enum><text display-inline="yes-display-inline">any unobligated amounts under the program that are set aside for the Joint Office described in the program; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H013D719F50B54172A9000B51C37882CC"><enum>(B)</enum><text display-inline="yes-display-inline">any unobligated amounts under the program that are set aside for grants to States or localities that require additional assistance to strategically deploy electric vehicle charging infrastructure.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H97E0397B82464EEC8901084936275447"><enum>(2)</enum><header>Future fiscal years</header><text>Notwithstanding any other provision of law, any funds described in paragraph (1) that are made available for any fiscal year beginning after the date of enactment of this Act shall be distributed to States in accordance with paragraph (3) on October 1 of that fiscal year and used as described in paragraph (4).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6635B4BCB1854E09A57F69CFFEF54918"><enum>(3)</enum><header><?oxy_delete author="mshanks" timestamp="2025-06-18T01:27:25.6841234-04:00" content="Distribution The"?><?oxy_insert_start author="mshanks" timestamp="2025-06-18T01:27:25.6841234-04:00"?>Distribution</header><text display-inline="yes-display-inline">The<?oxy_insert_end?> amounts distributed under paragraphs (1) and (2) shall be distributed so that each State receives an amount equal to the proportion that—</text><subparagraph id="H6E41CCBC7DD749E5B636D0BFF6D8F5D2"><enum>(A)</enum><text>the amount apportioned to the State for the applicable fiscal year under section 104(c) or section 165 of title 23, United States Code; bears to</text></subparagraph><subparagraph id="H81229ECB1D1148339196160B0636C5BC"><enum>(B)</enum><text>the total amount apportioned to all States for that fiscal year under section 104(c) and section 165 of that title.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFAE7A6030F5C4F8F9274D93505F0A119"><enum>(4)</enum><header>Use of funds</header><text>Amounts distributed under paragraphs (1) and (2) shall be used as described in subsection (b)(1).</text></paragraph></subsection><subsection id="HD9AFD6A9235B4708BB1347F694943C1F"><enum>(d)</enum><header>Treatment</header><text>The amounts described in subsections (b) and (c) shall—</text><paragraph id="H5E52C18931D449E2B575D3B4B465BF84"><enum>(1)</enum><text>not be subject to any obligation limitation for Federal-aid highway and highway safety construction programs;</text></paragraph><paragraph id="H4737A9BFBB9D4006B5D7CF1EBB9A8180" commented="no"><enum>(2)</enum><text>remain available until the date the funds would have remained available under the program; and</text></paragraph><paragraph id="HB1F2508508E249C395BDFEC636FC0AFF"><enum>(3)</enum><text>be in addition to any other funding apportioned to States under section 104(c) and section 165 of title 23, United States Code.</text></paragraph></subsection><subsection id="H503AC00C49E74F1BACD250C4771B82DA"><enum>(e)</enum><header>Requirements</header><text>Amounts described in subsections (b) and (c) shall be—</text><paragraph id="H92A6D684C8AB44DF841653BCA6FF6064"><enum>(1)</enum><text>except as otherwise provided in this section, administered as if apportioned under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code;</text></paragraph><paragraph id="HD000348F8BA84DD683112E12E75599D3"><enum>(2)</enum><text>subject to the requirements of section 11101(e) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/23/101">23 U.S.C. 101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC7686EA75E2F4355A02742DE74120AD0"><enum>(3)</enum><text display-inline="yes-display-inline">subject to section 120 of title 23, United States Code.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H60901C72E4664A5C9634BE3F5DE52967"><enum>3.</enum><header>Optimizing use of charging and fueling infrastructure grant funds</header><subsection commented="no" display-inline="no-display-inline" id="HB8FB2043D6264AF395711EA5E791D442"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="H521EF2E29A0D4B2398A3047B6FF5588C"><enum>(1)</enum><header>Program</header><text>The term <term>program</term> means the grant program under section 151(f) of title 23, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEAF8AF899A3048AF9AC065DC9A1F26B7"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFAED0FDE12A842BAAF6741817311ECA9"><enum>(3)</enum><header>State</header><text>The term <term>State</term> has the meaning given the term in section 101(a) of title 23, United States Code.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA47996752E0C40B9AC0EA9486678CD12"><enum>(b)</enum><header>Optimization of funds</header><paragraph commented="no" display-inline="no-display-inline" id="H80644B8369AB48CF80525CEAD35D0652"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Notwithstanding any other provision of law, the Secretary shall distribute to States in accordance with paragraph (3) any amounts made available to carry out the program that are unobligated as of the date of enactment of this Act.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5E59AD1F3CB2488E8C113743EEDF9845"><enum>(2)</enum><header>Future fiscal years</header><text>Any amounts made available to carry out the program for a fiscal year that begins after the date of enactment of this Act shall be distributed to States in accordance with paragraph (3) on October 1 of that fiscal year.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA5A85C3E8FDC47A6964B77B4DFA0A5E0"><enum>(3)</enum><header>Distribution</header><text display-inline="yes-display-inline">The amounts distributed under paragraphs (1) and (2) shall be distributed so that each State receives an amount equal to the proportion that—</text><subparagraph id="HDF735DFDBEA44F7BBE879CBC8A581E40"><enum>(A)</enum><text>the amount apportioned to the State for the applicable fiscal year under section 104(c) or section 165 of title 23, United States Code; bears to</text></subparagraph><subparagraph id="HFDEC07CE8A0841F3BCB52EED677A59E9"><enum>(B)</enum><text>the total amount apportioned to all States for that fiscal year under section 104(c) and section 165 of that title.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H54FBB39E15EB4C3FA542411F5AC6DEA1"><enum>(4)</enum><header>Uses of funds</header><text>Any amounts distributed under paragraphs (1) and (2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="H12F5C824F00C4FD389E5E09F47121F27"><enum>(A)</enum><text>shall be used only for the purposes described in section 2(b)(1)(A); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE2476089CD994095A3AC42BED83D9384"><enum>(B)</enum><text>may not be used for any purposes described in the program.</text></subparagraph></paragraph></subsection><subsection id="HF58A0285A1A64ADF89FBD56EEA5470C6"><enum>(c)</enum><header>Treatment</header><text>The amounts described in subsection (b) shall—</text><paragraph id="H665E61EFDBA640FE8C0B47BADBC0EF41"><enum>(1)</enum><text>be subject to any obligation limitation for Federal-aid highway and highway safety construction programs;</text></paragraph><paragraph id="H04AE4814D67541E395846663B78160EA" commented="no"><enum>(2)</enum><text>remain available until the date the funds would have remained available under the program; and</text></paragraph><paragraph id="H11BCB6E90B364349BAF5A7A3967746AB"><enum>(3)</enum><text>be in addition to any other funding apportioned to States under section 104(c) or section 165 of title 23, United States Code.</text></paragraph></subsection><subsection id="HA06BF2D040E64453B521BEE6DB539183"><enum>(d)</enum><header>Requirements</header><text>Amounts described in subsection (b) shall be—</text><paragraph id="H88B5698F9A6748D59E15F5A202BACE4D"><enum>(1)</enum><text>except as otherwise provided in this section, administered as if apportioned under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code;</text></paragraph><paragraph id="H8589412459F14DC4924663B1CCE00487"><enum>(2)</enum><text>subject to the requirements of section 11101(e) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/23/101">23 U.S.C. 101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3CF8640010D54D9AB2F58A48E9540E6C"><enum>(3)</enum><text display-inline="yes-display-inline">subject to section 120 of title 23, United States Code.</text></paragraph></subsection></section></legis-body></bill>
