R. 394</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250114">January 14, 2025</action-date><action-desc><sponsor name-id="L000596">Mrs. Luna</sponsor> (for herself and <cosponsor name-id="M001211">Mrs. Miller of Illinois</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To increase penalties for child pornography.</official-title></form><legis-body id="H94298D2AC30441BABC26B6FDA50EB92B" style="OLC"><section id="HA36BB32A898244DBAEF323CC980BF2FE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Holding Child Predators Accountable Act</short-title></quote>.</text></section><section id="H5C5AD58546684D208517DE6C245EBC3B"><enum>2.</enum><header>Possession of child porn</header><subsection id="HC42EFBB5C1784BB4A6CED6251B8A03BC"><enum>(a)</enum><header>Obscenity</header><text display-inline="yes-display-inline">Section 1466A of title 18, United States Code, is amended—</text><paragraph id="H31B1CEA3A77248B4992C04BC6E414524"><enum>(1)</enum><text>in subsection (a), by striking <quote>shall be subject to the penalties provided in section 2252A(b)(1), including the penalties provided for cases involving a prior conviction</quote> and inserting <quote>shall be fined and punished by death or imprisoned for life</quote>; and </text></paragraph><paragraph id="H01F588820B184D89A9829542E1BB7798"><enum>(2)</enum><text>in subsection (b), by striking <quote>shall be subject to the penalties provided in section 2252A(b)(2), including the penalties provided for cases involving a prior conviction</quote> and inserting <quote>shall be fined and punished by death or imprisoned for life</quote>.</text></paragraph></subsection><subsection id="H5821A314BCAB41CA8A4AB7F64878C17F"><enum>(b)</enum><header>Exploitation material</header><text>Subsection (b) of section 2252 of title 18, United States Code, is amended to read as follows:</text><quoted-block style="USC" display-inline="no-display-inline" id="H366F05BCAF454D80823B14178D7B37C1"><subsection id="HF6009E5943D5471C87DF84EEE16587CF"><enum>(b)</enum><text display-inline="yes-display-inline">Whoever violates, or attempts or conspires to violate paragraph (1), (2), (3), or (4) of subsection (a) shall be fined and punished by death or imprisoned for life.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB0B0316794FF4124846B9F9EC49A7B3A"><enum>(c)</enum><header>Pornography material</header><text display-inline="yes-display-inline">Subsection (b) of section 2252A of title 18, United States Code, is amended to read as follows:</text><quoted-block style="USC" id="H34537B1DFF084189972DC4010CC925CE" display-inline="no-display-inline"><subsection id="HC630FEF6140D41798E2C510FE363F9CE"><enum>(b)</enum><text display-inline="yes-display-inline">Whoever violates, or attempts or conspires to violate paragraph (1), (2), (3), (4), (5), (6), or (7) of subsection (a) shall be fined and punished by death or imprisoned for life.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
