<section id="H01DA62DE843D4E80AC5D85AF638146A3" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Giving Alien Migrants Back through Lawful Excise Redistribution Act</short-title></quote> or the <quote><short-title>GAMBLER Act</short-title></quote>.</text></section> 
<section id="H3518601FC0CF417AB26B9A91625F6E1E"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds as follows:</text> <paragraph id="H956C4E70BAB745819630DCF106754BAC"><enum>(1)</enum><text display-inline="yes-display-inline">Bold and decisive action must be undertaken to make America safe again, by protecting communities from the harms of illegal migration.</text></paragraph> 
<paragraph id="HCE0B249D74E94F088826840E12B69571">
        <enum>(2)</enum>
 <text>The cost of making America safe again—apprehending, detaining, and deporting illegal aliens—should not fall on average American citizens.</text>
      </paragraph> 
<paragraph id="H534107C4DCBB4156867290F78B927776"><enum>(3)</enum><text>The Department of Justice reports the average cost to house an illegal alien is more than $150 per day, with an average detention time of 55 days prior to deportation.</text></paragraph> <paragraph id="H56C9D0C251744E30BA0DA08A890FCD04"><enum>(4)</enum><text display-inline="yes-display-inline">The record $4.25 billion appropriated to U.S. Immigration and Customs Enforcement for alien detention and removal operations in fiscal year 2024 was not sufficient to keep up with the surge of aliens.</text></paragraph> 
<paragraph id="HCF57FE0B89FF4B9EA6ED7910F79D769A"><enum>(5)</enum><text>Congressional Budget Office estimates show that outlays for benefits provided to aliens and their children will total $177 billion by fiscal year 2034 if we do not change course.</text></paragraph> <paragraph id="HAEF192EB6671412895FFD2FDAB730B0B"><enum>(6)</enum><text>Illegal migration has cost American citizens enough already; we must seek innovative ways to fund the process of apprehension, detention, and deportation without raising taxes.</text></paragraph></section> 
<section id="H8573A3526C734F6086D135D9B88D04AD"><enum>3.</enum><header>Border Enforcement Trust Fund</header> 
<subsection id="HE850B947B93B473B85DA3B2E53163399"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/98">chapter 98</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text> <quoted-block id="H164A66460D8C4638AFA4FC62B8595940"> <section id="H925018F73FAD4F8EA689D900F1415287"><enum>9512.</enum><header>Border Enforcement Trust Fund</header> <subsection id="H69DDB710E6FD4FE9949DCF9E3D1BF61C"><enum>(a)</enum><header>Creation of trust fund</header><text>There is established in the Treasury of the United States a trust fund to be known as the <quote>Border Enforcement Trust Fund</quote>, consisting of such amounts as may be appropriated or credited to such fund as provided in this section or section 9602(b).</text></subsection> 
<subsection id="H76B3B01315734156A76DA3EB2716E2C8"><enum>(b)</enum><header>Transfers to trust fund</header><text>There are hereby appropriated to the Border Enforcement Trust Fund amounts equivalent to the taxes received in the Treasury under chapter 35 after the date of the enactment of this section.</text></subsection> <subsection id="HA3AF18926A3C49E4BC27E0FC9BE947A7"> <enum>(c)</enum> <header>Expenditures</header> <text display-inline="yes-display-inline">Amounts in the Border Enforcement Trust Fund shall only be available, to extent provided in appropriation Acts, to U.S. Immigration and Customs Enforcement under the ‘‘U.S. Immigration and Customs Enforcement—operations and support’’ account for necessary expenses for enforcement, detention, and removal operations.</text>
            </subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
