<section section-type="section-one" id="HD682D20A439A495A840BCC15C2DE20F1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening Transparency and Obligations to Protect Children Suffering from Abuse and Mistreatment Act of 2025</short-title></quote> or the <quote><short-title>STOP CSAM Act of 2025</short-title></quote>.</text></section> <section id="H206CEC6C611249F2BB0EC404C785F438"><enum>2.</enum><header>Protecting child victims and witnesses in Federal court</header> <subsection id="H3B1EE416258749809CB37CC4D830700C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3509 of title 18, United States Code, is amended—</text>
<paragraph id="HA0F74305F85C489A895CD6CC65372C69"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="H551BD359D5964CA9A27BEA436B35CFB8"><enum>(A)</enum><text>in paragraph (2)(A), by striking <quote>or exploitation</quote> and inserting <quote>exploitation, or kidnapping, including international parental kidnapping</quote>;</text></subparagraph>
<subparagraph id="H470BA5F05E4A4069886E733B58060153"><enum>(B)</enum><text>in paragraph (3), by striking <quote>physical or mental injury</quote> and inserting <quote>physical injury, psychological abuse</quote>;</text></subparagraph> <subparagraph id="H3A62FD87EB72408B973DE1B666DC6700" commented="no"><enum>(C)</enum><text>by striking paragraphs (5), (6), and (7) and inserting the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="H6937E5AD013E4791B02722C47C25CD90">
<paragraph commented="no" display-inline="no-display-inline" id="H4490AA34F8C84B2F8AFCEE2B45690D57"><enum>(5)</enum><text display-inline="yes-display-inline">the term <term>psychological abuse</term> includes—</text> <subparagraph id="H2A7F2464C4AF4657AD1F26C4F3353C1B" commented="no"><enum>(A)</enum><text>a pattern of acts, threats of acts, or coercive tactics intended to degrade, humiliate, intimidate, or terrorize a child; and</text></subparagraph>
<subparagraph id="H5A496C4A042A44FFBAD19C8550D2230B" commented="no"><enum>(B)</enum><text>the infliction of trauma on a child through—</text> <clause commented="no" display-inline="no-display-inline" id="HBDA715212A074339BFCB6C0606A340FD"><enum>(i)</enum><text display-inline="yes-display-inline">isolation;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HD278701497A7460DB16E23333014F1AF"><enum>(ii)</enum><text display-inline="yes-display-inline">the withholding of food or other necessities in order to control behavior;</text></clause> <clause commented="no" display-inline="no-display-inline" id="H0DBE91F1C99C45B180727255165CA418"><enum>(iii)</enum><text display-inline="yes-display-inline">physical restraint; or</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HE94CE798ECF14D7C8F42594B7E4C4AA1"><enum>(iv)</enum><text display-inline="yes-display-inline">the confinement of the child without the child's consent and in degrading conditions;</text></clause></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H09D8FF7527D649808C4B6132EDE8E426"><enum>(6)</enum><text display-inline="yes-display-inline">the term <term>exploitation</term> means—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HF305CDEC213E4E3CA67DF562E434D7A5"><enum>(A)</enum><text display-inline="yes-display-inline">child pornography;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H04163373EDF74D2CA0D339E5BDFAB9ED"><enum>(B)</enum><text display-inline="yes-display-inline">child sex trafficking; or </text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H0D5572C07F7C4233BA3569491633A7B9"><enum>(C)</enum><text display-inline="yes-display-inline">an obscene visual depiction of a child;</text></subparagraph></paragraph> <paragraph id="H3EBD5F7FE5234361A02C7BEC5B91C172"><enum>(7)</enum><text>the term <term>multidisciplinary child abuse team</term> means a professional unit of individuals working together to investigate child abuse and provide assistance and support to a victim of child abuse, composed of representatives from—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HCDD93E0630464861B7353E015BA6A1AF"><enum>(A)</enum><text display-inline="yes-display-inline">health, social service, and legal service agencies that represent the child;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H277593B62930475FB0F86E6C8F64F7A3"><enum>(B)</enum><text display-inline="yes-display-inline">law enforcement agencies and prosecutorial offices; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H8668ADCB381F4AD789C657FBB9E20C5C"><enum>(C)</enum><text display-inline="yes-display-inline">children's advocacy centers;</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H2A07FCD5B962466A900B2CCC34585EFC" commented="no"><enum>(D)</enum><text>in paragraph (9)(D)—</text>
<clause commented="no" display-inline="no-display-inline" id="HC65EB82A57DB4071A558773C0775EF9F"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>genitals</quote> and inserting <quote>anus, genitals,</quote>; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="H594406384C264F74990D8FF951DDDA5A"><enum>(ii)</enum><text>by striking <quote>or animal</quote>;</text></clause></subparagraph>
<subparagraph id="H5FCB870FFA0045238B8E1F040490FBCB"><enum>(E)</enum><text>in paragraph (11), by striking <quote>and</quote> at the end;</text></subparagraph> <subparagraph id="H740C4C108E6C482CAD76E7134A6F914E"><enum>(F)</enum><text>in paragraph (12)—</text>
<clause commented="no" display-inline="no-display-inline" id="H34A2C9607B1741C1BB795D737606D876"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>the term <term>child abuse</term> does not</quote> and inserting <quote>the terms <term>physical injury</term> and <term>psychological abuse</term> do not</quote>; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="H474CCA509CF041148A1E144D67B8959F"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking the period and inserting a semicolon; and</text></clause></subparagraph>
<subparagraph id="H1A2FBCB4C21041C081FDE963A7EF3B54"><enum>(G)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HB1A4FDAD78C144598C5171AE9638F38B"> <paragraph id="H1FE837653C204804883DA0FB3D6BF5A1"><enum>(13)</enum><text>the term <term>covered person</term> means a person of any age who—</text>
<subparagraph id="HB9E000EAC338444D9B972ECC97CFC962"><enum>(A)</enum><text>is or is alleged to be—</text> <clause id="H2085DBEEAFFC4B7CA4BE501AE29C45A3"><enum>(i)</enum><text>a victim of a crime of physical abuse, sexual abuse, exploitation, or kidnapping, including international parental kidnapping; or</text></clause>
<clause id="H59FBC3C6831046C89917D3E63967D918"><enum>(ii)</enum><text>a witness to a crime committed against another person; and</text></clause></subparagraph> <subparagraph id="H255EB671F7EA4B1CABE0852D6D2165BD"><enum>(B)</enum><text>was under the age of 18 when the crime described in subparagraph (A) was committed;</text></subparagraph></paragraph>
<paragraph id="H6AB63DB08E7C41B2BF177D5A5B4F6F6E"><enum>(14)</enum><text>the term <term>protected information</term>, with respect to a covered person, includes—</text> <subparagraph id="H0DAA8246FCB44038A6391E31C235971E"><enum>(A)</enum><text>personally identifiable information of the covered person, including—</text>
<clause id="H9FE2AFEF608D49888081126BD0CF3A60"><enum>(i)</enum><text>the name of the covered person;</text></clause> <clause id="H62853AD1DED24604A1E89A0E2CF47EF2"><enum>(ii)</enum><text>an address;</text></clause>
<clause id="H6F95C5DEB58943659D84A45C5810DC35"><enum>(iii)</enum><text>a phone number;</text></clause> <clause id="HDAC7FA01659D41D795BA935DDBB2A162"><enum>(iv)</enum><text>a user name or identifying information for an online, social media, or email account; and</text></clause>
<clause id="H9BA9D660466F42B28AA90C1EB0926530"><enum>(v)</enum><text>any information that can be used to distinguish or trace the identity of the covered person, either alone or when combined with other information that is linked or linkable to the covered person;</text></clause></subparagraph> <subparagraph id="H1BCE230ED24D41CA9BEB0AF23EFCFFFB"><enum>(B)</enum><text>medical, dental, behavioral, psychiatric, or psychological information of the covered person;</text></subparagraph>
<subparagraph id="HF7B81EEDC37A4B8697BB18815BF5BB68"><enum>(C)</enum><text>educational or juvenile justice records of the covered person; and</text></subparagraph> <subparagraph id="HD295C0C7A2E045B68F284F0BF0A42D79"><enum>(D)</enum><text>any other information concerning the covered person that is deemed <quote>protected information</quote> by order of the court under subsection (d)(5);</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H48516D6479F842F0969B7B64A9FEF589"><enum>(15)</enum><text display-inline="yes-display-inline">the term <term>child pornography</term> has the meaning given the term in section 2256(8); and</text></paragraph> <paragraph id="H32D2D842ECC4444ABC704444606A7A59"><enum>(16)</enum><text>the term <term>obscene visual depiction of a child</term> means any visual depiction prohibited by section 1466A involving an identifiable minor, as that term is defined in section 2256(9).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="HC1A275666C65436B830DB4F9678B738E"><enum>(2)</enum><text>in subsection (b)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H139DA0EE8F6E430BBDE3E854D0373850"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)(C), by striking <quote>minor</quote> and inserting <quote>child</quote>; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H0C45B008667846AEBB6BC4DA17832A48"><enum>(B)</enum><text>in paragraph (2)—</text> <clause commented="no" display-inline="no-display-inline" id="H90B1DA6E706147C58E70D518FC1A4C93"><enum>(i)</enum><text display-inline="yes-display-inline">in the heading, by striking <quote><header-in-text style="USC" level="paragraph">Videotaped</header-in-text></quote> and inserting <quote><header-in-text style="USC" level="paragraph">Recorded</header-in-text></quote>;</text></clause>

<subclause commented="no" display-inline="no-display-inline" id="H89CB3F3D9BBC4ECE909FAF60BE8609F3"><enum>(I)</enum><text display-inline="yes-display-inline">in clause (ii), by striking <quote>that the child's deposition be taken and preserved by videotape</quote> and inserting <quote>that a video recording of the child's deposition be made and preserved</quote>;</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="H656C6FAE68BC46129BFD01ACFAE0D711"><enum>(II)</enum><text>in clause (iii)—</text>
<item commented="no" display-inline="no-display-inline" id="HF7562E9A9F9B40DCB9368BF5EC622403"><enum>(aa)</enum><text display-inline="yes-display-inline">in the matter preceding subclause (I), by striking <quote>videotape</quote> and inserting <quote>recorded</quote>; and</text></item> <item commented="no" display-inline="no-display-inline" id="H8FAC093210A243CAA87C5F21EE257453"><enum>(bb)</enum><text>in subclause (IV), by striking <quote>videotape</quote> and inserting <quote>recording</quote>; and</text></item></subclause>

<subparagraph id="HEE656F99AA154E648BCFECB89FE07CD3"><enum>(B)</enum><text>in paragraph (2)—</text> <clause id="H2258DBD69E9E4C37837EC68F6A054EE4"><enum>(i)</enum><text>by striking <quote>the name of or any other information concerning a child</quote> each place the term appears and inserting <quote>a covered person’s protected information</quote>;</text></clause>

<clause id="H928BE188EFB24E4BA918A17847D8D6B6"><enum>(i)</enum><text>in subparagraph (A)—</text> <subclause id="H62920088F2284E6892173F021B2158BD"><enum>(I)</enum><text>by striking <quote>a child from public disclosure of the name of or any other information concerning the child</quote> and inserting <quote>a covered person's protected information from public disclosure</quote>; and</text></subclause>
<subclause id="H0293115187B64CFFB1D988503268068A"><enum>(II)</enum><text>by striking <quote>, if the court determines that there is a significant possibility that such disclosure would be detrimental to the child</quote>;</text></subclause></clause> <clause id="H86DC2DA30C224F5BBA9941593DFC0D20"><enum>(ii)</enum><text>in subparagraph (B)—</text>
<subclause id="H4A98F28E57B34BDB83B38F392F7D6804"><enum>(I)</enum><text>in clause (i)—</text> <item id="HA50D4F90F4BA4AC3863566AD521CFB7E"><enum>(aa)</enum><text>by striking <quote>a child witness, and the testimony of any other witness</quote> and inserting <quote>any witness</quote>; and</text></item>
<item id="HB59DEB4D32664E9F97496A4C32C87674"><enum>(bb)</enum><text>by striking <quote>the name of or any other information concerning a child</quote> and inserting <quote>a covered person's protected information</quote>; and</text></item></subclause> <subclause id="H2BFB8605B3CC49F6AAE801EFA346EF3F"><enum>(II)</enum><text>in clause (ii), by striking <quote>child</quote> and inserting <quote>covered person</quote>; and</text></subclause></clause>
<clause id="HF2BCF4BF281B4440AD67AD0E2981EAB4"><enum>(iii)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HFCF67314C6334FA196FC1DA4D3C49348"> <subparagraph id="HBDD108C847CE493787EBC1DA466FC354" indent="up1"><enum>(C)</enum> <clause commented="no" display-inline="yes-display-inline" id="HD6E0F5854F7249228AD2E8400340A02C"><enum>(i)</enum><text>For purposes of this paragraph, there shall be a presumption that public disclosure of a covered person’s protected information would be detrimental to the covered person.</text></clause>
<clause indent="up1" id="H736AC0E1F4AA449DB1C7A8AF340BAD41"><enum>(ii)</enum><text>The court shall deny a motion for a protective order under subparagraph (A) only if the court finds that the party opposing the motion has rebutted the presumption under clause (i) of this subparagraph.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph> <subparagraph id="HE63DD6C4BE56420C9B233CD9879E943E"><enum>(D)</enum><text>in paragraph (4)—</text>
<clause id="H4F06090CE6934C82B03EB05EA6F5ADB2"><enum>(i)</enum><text>by striking <quote>This subsection</quote> and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HA343A2BF3EED4421A4DE30568B88EB93"> <subparagraph id="HDDEA8EC0B58A44489CB032D472E8A620"><enum>(A)</enum><header>Disclosure to certain parties</header><text>This subsection</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause>

<subclause id="HAEEEA90A32914D108BABEBC70AC8E2C3"><enum>(II)</enum><text>by striking <quote>or an adult attendant, or to</quote> and inserting <quote>an adult attendant, a law enforcement agency for any intelligence or investigative purpose, or</quote>; and</text></subclause></clause> <clause id="HD5E661FA43B640BEA18980F25C619DCA"><enum>(iii)</enum><text>by adding at the end the following:</text>

<subparagraph id="H8A15C7A03A124D77A30BCE325106FC2D"><enum>(B)</enum><header>Request for public disclosure</header><text>If any party requests public disclosure of a covered person’s protected information to further a public interest, the court shall deny the request unless the court finds that—</text> <clause id="H12A08322D4134A898674E4CF39CA4F01"><enum>(i)</enum><text>the party seeking disclosure has established that there is a compelling public interest in publicly disclosing the covered person’s protected information;</text></clause>
<clause id="H50AB88F135964C8A9E1F52130B11EAAB"><enum>(ii)</enum><text>there is a substantial probability that the public interest would be harmed if the covered person’s protected information is not disclosed;</text></clause> <clause id="H5647A2F191B24F2086D60D460641CAAA"><enum>(iii)</enum><text>the substantial probability of harm to the public interest outweighs the harm to the covered person from public disclosure of the covered person’s protected information; and</text></clause>
<clause id="HB8461E9AECAA40DC837A44A126FE2AB0"><enum>(iv)</enum><text>there is no alternative to public disclosure of the covered person’s protected information that would adequately protect the public interest.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph> <subparagraph id="HEE83A11055AF47FB9EFFC82C11D143EC"><enum>(E)</enum><text>by adding at the end the following:</text>

<paragraph id="H0D4442B46F2D41C9A9717FE2D81F6791"><enum>(5)</enum><header>Other protected information</header><text>The court may order that information shall be considered to be <quote>protected information</quote> for purposes of this subsection if the court finds that the information is sufficiently personal, sensitive, or identifying that it should be subject to the protections and presumptions under this subsection.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H9D7F84ACAD804753B84FFA0DE30A818E"><enum>(4)</enum><text>by striking subsection (f) and inserting the following:</text>

<subsection id="H3707A96EA23B4311BF13F64AE12BC04C"><enum>(f)</enum><header>Victim impact statement</header>
<paragraph id="H9410FD1C7536416C8CE09A4B7C3C984C"><enum>(1)</enum><header>Probation officer</header><text>In preparing the presentence report pursuant to rule 32(c) of the Federal Rules of Criminal Procedure, the probation officer shall request information from the multidisciplinary child abuse team, if applicable, or other appropriate sources to determine the impact of the offense on a child victim and any other children who may have been affected by the offense.</text></paragraph> <paragraph id="HBECFD1E59CF3446797A8A369C21E4C44"><enum>(2)</enum><header>Guardian ad litem</header><text>A guardian ad litem appointed under subsection (h) shall—</text>
<subparagraph id="H32BBF3E5895D4A72A1FF8C1BB502D045"><enum>(A)</enum><text>make every effort to obtain and report information that accurately expresses the views of a child victim, and the views of family members as appropriate, concerning the impact of the offense; and</text></subparagraph> <subparagraph id="H6B46989AA7D7432FBEA7E85D25FD17DC"><enum>(B)</enum><text>use forms that permit a child victim to express the child's views concerning the personal consequences of the offense, at a level and in a form of communication commensurate with the child's age and ability.</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>
<paragraph id="H046CEDE1AD7845FFB55BC2631AF93CE6"><enum>(5)</enum><text>in subsection (h), by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H4974652BB7344B54A4A5F47AB54D044D"> <paragraph id="H4E8811925DCC461BAC4E2399B4430E0A"><enum>(4)</enum><header>Authorization of appropriations</header> <subparagraph id="H0D159DD16C7E471D8C047BBDE9AD44E5"><enum>(A)</enum><header>In general</header><text>There is authorized to be appropriated to the United States courts to carry out this subsection $25,000,000 for each fiscal year.</text></subparagraph>
<subparagraph id="H3485DBF0539848848934452AD99FFDEE"><enum>(B)</enum><header>Supervision of payments</header><text>Payments from appropriations authorized under subparagraph (A) shall be made under the supervision of the Director of the Administrative Office of the United States Courts.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H7869E5A7F1624FAFA9332DCCBBCBD557"><enum>(6)</enum><text>in subsection (i)—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HC3D0D19731E04D2E95A155869FD8FCE9"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>A child testifying at or attending a judicial proceeding</quote> and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HA06A998EDF47422B9A2F950998E367A9"> <paragraph id="HEE31F9502AB3440989BDE90E687F6819"><enum>(1)</enum><header>In general</header><text>A child testifying at a judicial proceeding, including in a manner described in subsection (b),</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H4645FB9EEEA74EB79C368BD32CB8AA64"><enum>(B)</enum><text>in paragraph (1), as so designated—</text> <clause commented="no" display-inline="no-display-inline" id="H2A649E3703B746BBBC4AA82E353D6B75"><enum>(i)</enum><text display-inline="yes-display-inline">in the third sentence, by striking <quote>proceeding</quote> and inserting <quote>testimony</quote>; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H6C30FF779B8E4574ADC5E7698953CD27"><enum>(ii)</enum><text>by striking the fifth sentence; and</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H4129A8C1ACEE4E6A8F9D5D89CE26FACD"><enum>(C)</enum><text>by adding at the end the following:</text>

<paragraph id="HDC730EF2B9AA40D1B635DB63C87BB9B1"><enum>(2)</enum><header>Recording</header><text>If the adult attendant is in close physical proximity to or in contact with the child while the child testifies—</text> <subparagraph id="H7AECDE31F9724002A8B8553FA5E01AAB"><enum>(A)</enum><text>at a judicial proceeding, a video recording of the adult attendant shall be made and shall become part of the court record; or</text></subparagraph>
<subparagraph id="HD5B3E28F0CC141C9AA68D6D757EF23A0"><enum>(B)</enum><text>in a manner described in subsection (b), the adult attendant shall be visible on the closed-circuit television or in the recorded deposition.</text></subparagraph></paragraph> <paragraph id="H2B98B7AA0EDC4013ABD69D911C1FABCB"><enum>(3)</enum><header>Covered persons attending proceeding</header><text>A covered person shall have the right to be accompanied by an adult attendant when attending any judicial proceeding.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="H30126EE9761C4153B866E7304E771C6F"><enum>(7)</enum><text>in subsection (j)—</text> <subparagraph id="HEADEA4BC20C149C3A5F73B2BB6B8D086"><enum>(A)</enum><text>by striking <quote>child</quote> each place the term appears and inserting <quote>covered person</quote>; and</text></subparagraph>
<subparagraph id="HE4FF0413A62B42E88E815E869E322AF7"><enum>(B)</enum><text>in the fourth sentence—</text> <clause id="H721CB932FA54455B8DB830A8E8CD1122"><enum>(i)</enum><text>by striking <quote>and the potential</quote> and inserting <quote>, the potential</quote>;</text></clause>
<clause id="H539ADE76ED0D4DB89B594BB592F4C483"><enum>(ii)</enum><text>by striking <quote>child's</quote> and inserting <quote>covered person's</quote>; and</text></clause> <clause id="H911CB0B249E244A5A0FE69DFE3EDA268"><enum>(iii)</enum><text>by inserting before the period at the end the following: <quote>, and the necessity of the continuance to protect the defendant's rights</quote>;</text></clause></subparagraph></paragraph>
<paragraph id="H9191AEF1C9C04930B0D45C4978526716"><enum>(8)</enum><text>in subsection (k), by striking <quote>child</quote> each place the term appears and inserting <quote>covered person</quote>;</text></paragraph> <paragraph id="H55C5CB2113FE49FC823556467CF75AEF"><enum>(9)</enum><text>in subsection (l), by striking <quote>child</quote> each place the term appears and inserting <quote>covered person</quote>; and</text></paragraph>
<paragraph id="H935B8F7BBC8B425AABDCBD0C829F151B"><enum>(10)</enum><text>in subsection (m)—</text> <subparagraph id="HE6D3FF844EBC4B35B454FFED29169346"><enum>(A)</enum><text>by striking <quote>(as defined by section 2256 of this title)</quote> each place it appears;</text></subparagraph>
<subparagraph id="H75013DA06CE74ECEBC4682BA220E3CE2"><enum>(B)</enum><text>by inserting <quote>or an obscene visual depiction of a child</quote> after <quote>child pornography</quote> each place it appears except the second instance in paragraph (3);</text></subparagraph> <subparagraph id="H4EE88D93AD0449559E63A4DA94A89E16"><enum>(C)</enum><text>in paragraph (1), by inserting <quote>and any civil action brought under section 2255 or 2255A</quote> after <quote>any criminal proceeding</quote>;</text></subparagraph>
<subparagraph id="HEA925CCA8B754B81A8ED4A36111CE62D"><enum>(D)</enum><text>in paragraph (2), by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H4A8987DF0B694A149BC454C1359BFA5F"> <subparagraph id="H79F477AC99E240BBB8D94527D8172D08" indent="up1"><enum>(C)</enum> <clause commented="no" display-inline="yes-display-inline" id="H988A4CB622834EB78A424FD71F0ED99E"><enum>(i)</enum><text>Notwithstanding rule 26 of the Federal Rules of Civil Procedure, a court shall deny, in any civil action brought under section 2255 or 2255A, any request by any party to copy, photograph, duplicate, or otherwise reproduce any property or material that constitutes child pornography or an obscene visual depiction of a child.</text></clause>
<clause id="H67C1BBBF4D4E48408AD21C3543DD153E" indent="up1"><enum>(ii)</enum><text>In a civil action brought under section 2255 or 2255A, for purposes of paragraph (1), the court may—</text> <subclause commented="no" display-inline="no-display-inline" id="HD1EC37D869474BA289848EC6C31604D5"><enum>(I)</enum><text>order the plaintiff or defendant to provide to the court or the Government, as applicable, any equipment necessary to maintain care, custody, and control of such property or material; and</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="H8B2CB05819324D0B92326CB933FCA5D7"><enum>(II)</enum><text>take reasonable measures, and may order the Government (if such property or material is in the care, custody, and control of the Government) to take reasonable measures, to provide each party to the action, the attorney of each party, and any individual a party may seek to qualify as an expert, with ample opportunity to inspect, view, and examine such property or material at the court or a Government facility, as applicable.</text></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H03DD36B5C2BD4EA79EB376046CB1A012"><enum>(E)</enum><text>in paragraph (3)—</text>
<clause commented="no" display-inline="no-display-inline" id="H9044CE95503E40D6951269663322C862"><enum>(i)</enum><text display-inline="yes-display-inline">by inserting <quote>and during the 1-year period following the date on which the criminal proceeding becomes final or is terminated</quote> after <quote>any criminal proceeding</quote>;</text></clause> <clause id="H293FAEBB91884C53BA32601707A904D9"><enum>(ii)</enum><text>by striking <quote>, as defined under section 2256(8),</quote>; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H00DF41A166654893A6728158EAAB3092"><enum>(iii)</enum><text>by inserting <quote>or obscene visual depiction of a child</quote> after <quote>such child pornography</quote>.</text></clause></subparagraph></paragraph></subsection> <subsection id="H30004AFC70474811BB7E50F76A50BA48"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply to conduct that occurs before, on, or after the date of enactment of this Act.</text></subsection></section>
<section id="HF0EFA3A8050F44BEB741DFC0709A4546"><enum>3.</enum><header>Facilitating payment of restitution; technical amendments to restitution statutes</header><text display-inline="no-display-inline">Title 18, United States Code, is amended—</text> <paragraph id="H60B38E4C90B54237B0DDA85A49C32396"><enum>(1)</enum><text>in section 1593(c)—</text>
<subparagraph id="H1702B8D08D1848EF97B8BDC6D826E408"><enum>(A)</enum><text>by inserting <quote>(1)</quote> after <quote>(c)</quote>;</text></subparagraph> <subparagraph id="H82FC4856B08C438985D555BA831608E6"><enum>(B)</enum><text>by striking <quote>chapter, including, in</quote> and inserting the following:</text>

<paragraph id="HCA5183E0AD824F718064C8A7D205E025"><enum>(2)</enum><text>this chapter.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H273E1B8DA6C6473D8DFED3A0F8DD80B8"><enum>(B)</enum><text>in subsection (b)—</text>
<clause id="H91BF81E111AA4108BAFADDB586E373B9"><enum>(i)</enum><text>in paragraph (1), by striking <quote><header-in-text level="paragraph" style="USC">Directions</header-in-text>.—Except as provided in paragraph (2), the</quote> and inserting <quote><header-in-text level="paragraph" style="USC">Restitution for child pornography production</header-in-text>.—If the defendant was convicted of child pornography production, the</quote>; and</text></clause> <clause id="HAC427B2BFE774F98AC51068BBFC2423F"><enum>(ii)</enum><text>in paragraph (2)(B), by striking <quote>$3,000.</quote> and inserting the following: “—</text>

<subparagraph id="HA947E40119C842A2958AB432404DF230"><enum>(C)</enum><text>in subsection (c)—</text> <clause id="H52068E0B55514894A021A2451402EAFF"><enum>(i)</enum><text>by striking paragraph (1) and inserting the following:</text>

<paragraph id="HFF5E239B2F524DB8A8FBC5F3E0246939"><enum>(1)</enum><header>Child pornography production</header><text>For purposes of this section and section 2259A, the term <term>child pornography production</term> means—</text> <subparagraph id="H7182BF75D1764DA0B295A88AD440D23F"><enum>(A)</enum><text>a violation of, attempted violation of, or conspiracy to violate section 1466A(a) to the extent the conduct involves production of a visual depiction of an identifiable minor;</text></subparagraph>
<subparagraph id="H697E7C9B52254601958B0BEF82CB484E"><enum>(B)</enum><text>a violation of, attempted violation of, or conspiracy to violate section 1466A(a) involving possession with intent to distribute, or section 1466A(b), to the extent the conduct involves a visual depiction of an identifiable minor—</text> <clause id="H280E80B56E784E9AACC646EFF2B36E63"><enum>(i)</enum><text>produced by the defendant; or</text></clause>
<clause id="H7ADF916CA3284C989EDBA74568FA1E0B"><enum>(ii)</enum><text>that the defendant attempted or conspired to produce;</text></clause></subparagraph> <subparagraph id="H20A986A0E7E647E49D171B9D002EF67B"><enum>(C)</enum><text>a violation of subsection (a), (b), or (c) of section 2251, or an attempt or conspiracy to violate any of those subsections under subsection (e) of that section;</text></subparagraph>
<subparagraph id="H277DED9188BF430BAB02EEB28251F751"><enum>(D)</enum><text>a violation of section 2251A;</text></subparagraph> <subparagraph id="HD1813063D05D4D77B08A4000E5FC3584"><enum>(E)</enum><text>a violation of section 2252(a)(4) or 2252A(a)(5), or an attempt or conspiracy to violate either of those sections under section 2252(b)(2) or 2252A(b)(2), to the extent such conduct involves child pornography—</text>
<clause id="H0F3C40519B0C4D84988C09D61CCB80EC"><enum>(i)</enum><text>produced by the defendant; or</text></clause> <clause id="H6D9DACB303624F0CA18CC7C5B53BB7E0"><enum>(ii)</enum><text>that the defendant attempted or conspired to produce;</text></clause></subparagraph>
<subparagraph id="H1C3BF13A420E4EF48D21110AF5759AA8"><enum>(F)</enum><text>a violation of subsection (a)(7) of section 2252A, or an attempt or conspiracy to violate that subsection under subsection (b)(3) of that section, to the extent the conduct involves production with intent to distribute;</text></subparagraph> <subparagraph id="H35EF260633FC4B918B1467E9B24B1AF2"><enum>(G)</enum><text>a violation of section 2252A(g) if the series of felony violations involves not fewer than 1 violation—</text>
<clause id="HBCDF8A535FC943EAB48B99EB42198831"><enum>(i)</enum><text>described in subparagraph (A), (B), (E), or (F) of this paragraph;</text></clause> <clause id="HAA9813AA9AB2465AA93022B3A7066D25"><enum>(ii)</enum><text>of section 1591; or</text></clause>
<clause id="HE807C966B6994F71BA9044AF0072472A"><enum>(iii)</enum><text>of section 1201, chapter 109A, or chapter 117, if the victim is a minor;</text></clause></subparagraph> <subparagraph id="H547717B67F074A5FA9FCFF1E675CEB85"><enum>(H)</enum><text>a violation of subsection (a) of section 2260, or an attempt or conspiracy to violate that subsection under subsection (c)(1) of that section;</text></subparagraph>
<subparagraph id="H78BBEA37B5724F19A350628760ADD24F"><enum>(I)</enum><text>a violation of section 2260B(a)(2) for promoting or facilitating an offense—</text> <clause id="H04D004F5597F4459ABA38EBBAAAEF308"><enum>(i)</enum><text>described in subparagraph (A), (B), (D), or (E) of this paragraph; or</text></clause>
<clause id="HBE2AD2AD703641BA893E0645DA4552DC"><enum>(ii)</enum><text>under section 2422(b); and</text></clause></subparagraph> <subparagraph id="HEC40179431B74927B2AEB4DCAB0AC0AB"><enum>(J)</enum><text>a violation of chapter 109A or chapter 117, if the offense involves the production or attempted production of, or conspiracy to produce, child pornography.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause>
<clause id="H72BCBCA568B241F28E10B3865F2E9E4C"><enum>(ii)</enum><text>by striking paragraph (3) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H80EE142A29434DB7B740013212F4688B"> <paragraph id="HD0B37EE9D631471A92AE7EA2484C7400"><enum>(3)</enum><header>Trafficking in child pornography</header><text>For purposes of this section and section 2259A, the term <term>trafficking in child pornography</term> means—</text>
<subparagraph id="HF1A76BEE47184F21864FBA4633AB0E1E"><enum>(A)</enum><text>a violation of, attempted violation of, or conspiracy to violate section 1466A(a) to the extent the conduct involves distribution or receipt of a visual depiction of an identifiable minor;</text></subparagraph> <subparagraph id="H1497A6CE33A74868B6676AB6E5D71451"><enum>(B)</enum><text>a violation of, attempted violation of, or conspiracy to violate section 1466A(a) involving possession with intent to distribute, or section 1466A(b), to the extent the conduct involves a visual depiction of an identifiable minor—</text>
<clause id="HEDE66B850FAD4C10944D50F04E67058B"><enum>(i)</enum><text>not produced by the defendant; or</text></clause> <clause id="H7A0C2ECBC7D04B828505D9E1769B1482"><enum>(ii)</enum><text>that the defendant did not attempt or conspire to produce; </text></clause></subparagraph>
<subparagraph id="H651074C7E41248E1B5974B5C04F42CD8"><enum>(C)</enum><text>a violation of subsection (d) of section 2251 or an attempt or conspiracy to violate that subsection under subsection (e) of that section;</text></subparagraph> <subparagraph id="H29C871C6E4FC42499D17E52CF39D60E9"><enum>(D)</enum><text>a violation of paragraph (1), (2), or (3) of subsection (a) of section 2252, or an attempt or conspiracy to violate any of those paragraphs under subsection (b)(1) of that section;</text></subparagraph>
<subparagraph id="HE1481D890F5B47C287B0A44032904D56"><enum>(E)</enum><text>a violation of section 2252(a)(4) or 2252A(a)(5), or an attempt or conspiracy to violate either of those sections under section 2252(b)(2) or 2252A(b)(2), to the extent such conduct involves child pornography—</text> <clause id="H4FBA0AFA58C94650AF7AA71C19CA393F"><enum>(i)</enum><text>not produced by the defendant; or</text></clause>
<clause id="H59D1264F49CB4D8B88B543365AE0BD09"><enum>(ii)</enum><text>that the defendant did not attempt or conspire to produce;</text></clause></subparagraph> <subparagraph id="H615DB36567E84FFD8179F9A5DA015546"><enum>(F)</enum><text>a violation of paragraph (1), (2), (3), (4), or (6) of subsection (a) of section 2252A, or an attempt or conspiracy to violate any of those paragraphs under subsection (b)(1) of that section;</text></subparagraph>
<subparagraph id="HCB08EC1FCE544A5BBDE362C5A94D4FE6"><enum>(G)</enum><text>a violation of subsection (a)(7) of section 2252A, or an attempt or conspiracy to violate that subsection under subsection (b)(3) of that section, to the extent the conduct involves distribution;</text></subparagraph> <subparagraph id="H87488745BBEC48EBAAC3DE56531AD1E6"><enum>(H)</enum><text>a violation of section 2252A(g) if the series of felony violations exclusively involves violations described in this paragraph (except subparagraphs (A) and (B));</text></subparagraph>
<subparagraph id="H1486C540B67B4DA0B8B7EECFF6C3CD0E"><enum>(I)</enum><text>a violation of subsection (b) of section 2260, or an attempt or conspiracy to violate that subsection under subsection (c)(2) of that section; and</text></subparagraph> <subparagraph id="HFECE8F2C799147B4B3CD3D225A66E327"><enum>(J)</enum><text>a violation of subsection (a)(1) of section 2260B, or a violation of subsection (a)(2) of that section for promoting or facilitating an offense described in this paragraph (except subparagraphs (A) and (B)).</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause>
<clause id="HA35D4D19D9BA49848215FC3B15A9CA35" commented="no"><enum>(iii)</enum><text>in paragraph (4), in the first sentence, by inserting <quote>or an identifiable minor harmed as a result of the commission of a crime under section 1466A</quote> after <quote>under this chapter</quote>;</text></clause></subparagraph></paragraph> <paragraph id="HF25087CE59D94A4088BD4CF3CD48A31F"><enum>(4)</enum><text>in section 2259A(a)—</text>
<subparagraph id="HA2EF921298964EB9976922155082BBA9"><enum>(A)</enum><text>in paragraph (1), by striking <quote>under section 2252(a)(4) or 2252A(a)(5)</quote> and inserting <quote>described in subparagraph (B) or (E) of section 2259(c)(3)</quote>; and</text></subparagraph> <subparagraph id="HF4B2FBF21F954D3080A153F727B47A7C"><enum>(B)</enum><text>in paragraph (2), by striking <quote>any other offense for trafficking in child pornography</quote> and inserting <quote>any offense for trafficking in child pornography other than an offense described in subparagraph (B) or (E) of section 2259(c)(3)</quote>;</text></subparagraph></paragraph>

<paragraph id="H0DAD51AD594E437386A9AEFB8027645B" indent="up1"><enum>(2)</enum><text>In</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause> <clause commented="no" display-inline="no-display-inline" id="H586BF679625C45BEBB8B98737EF1C6A2"><enum>(iii)</enum><text>in paragraph (2), as so designated, by inserting <quote>may assume the rights of the victim under this section</quote> after <quote>suitable by the court</quote>; and</text></clause></subparagraph></paragraph>
<paragraph id="H8C3D5CD07E5A4D23884AAFF37CF19960"><enum>(6)</enum><text>in section 3664, by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H9A51E2D8CC9642F98724069C624136D9"> <subsection id="H1126796B2A2548DCA082AAE555557276"><enum>(q)</enum><header>Trustee or other fiduciary</header> <paragraph id="HC91C2AB7A250407DB22B32A6D86848F3"><enum>(1)</enum><header>In general</header> <subparagraph id="HBCC2D248EF6441BF858822C35E87A8BB"><enum>(A)</enum><header>Appointment of trustee or other fiduciary</header><text>When the court issues an order of restitution under section 1593, 2248, 2259, 2429, or 3663, or subparagraphs (A)(i) and (B) of section 3663A(c)(1), for a victim described in subparagraph (B) of this paragraph, the court, at its own discretion or upon motion by the Government, may appoint a trustee or other fiduciary to hold any amount paid for restitution in a trust or other official account for the benefit of the victim.</text></subparagraph>
<subparagraph id="H3910447F0B4742D7B28C21469AFC83B6"><enum>(B)</enum><header>Covered victims</header><text>A victim referred to in subparagraph (A) is a victim who is—</text> <clause id="H88468CEE7C3748E09DA4C9793ED48D2E"><enum>(i)</enum><text>under the age of 18 at the time of the proceeding;</text></clause>
<clause id="H61301AC4E9D7408AA8C3947A71312555"><enum>(ii)</enum><text>incompetent or incapacitated; or</text></clause> <clause id="H1F904A70245049B88C7A4BB3756BCE95"><enum>(iii)</enum><text>subject to paragraph (3), a foreign citizen or stateless person residing outside the United States.</text></clause></subparagraph></paragraph>
<paragraph id="H142ED7D1A52044D89352DCB948849532"><enum>(2)</enum><header>Order</header><text>When the court appoints a trustee or other fiduciary under paragraph (1), the court shall issue an order specifying—</text> <subparagraph id="H79D6AF9F8BA645679EE74AB4AA89D3A1"><enum>(A)</enum><text>the duties of the trustee or other fiduciary, which shall require—</text>
<clause id="H637A128B467648F2A47020D60EE600DC"><enum>(i)</enum><text>the administration of the trust or maintaining an official account in the best interests of the victim; and</text></clause> <clause id="H3B0D279B37CD4A3D90C69816BEB00E2B"><enum>(ii)</enum><text>disbursing payments from the trust or account—</text>
<subclause id="H80FA5DAB066E4DF5B2973AEFDD6A6FDE"><enum>(I)</enum><text>to the victim; or</text></subclause> <subclause id="H1AAF80156E5640CEBDD307D7491AB0A0"><enum>(II)</enum><text>to any individual or entity on behalf of the victim;</text></subclause></clause></subparagraph>
<subparagraph id="HE7FAFB93E35C44D2A4325516E8AC82A2"><enum>(B)</enum><text>that the trustee or other fiduciary—</text> <clause id="HE7A80D1BC05B48C8813FC749CAE2E741"><enum>(i)</enum><text>shall avoid any conflict of interest;</text></clause>
<clause id="H80807BBCBEA745318B3A55C1A8C38321"><enum>(ii)</enum><text>may not profit from the administration of the trust or maintaining an official account for the benefit of the victim other than as specified in the order; and</text></clause> <clause id="H9FC647BD894E44EF9A67FE83FB0C0790"><enum>(iii)</enum><text>may not delegate administration of the trust or maintaining the official account to any other person;</text></clause></subparagraph>
<subparagraph id="H14CCB64E0B57446F9D149DA2A5298D6C"><enum>(C)</enum><text>if and when the trust or the duties of the other fiduciary will expire; and</text></subparagraph> <subparagraph id="H49EF7F867AFF4430B226690C6DC6E2E4"><enum>(D)</enum><text>the fees payable to the trustee or other fiduciary to cover expenses of administering the trust or maintaining the official account for the benefit of the victim, and the schedule for payment of those fees.</text></subparagraph></paragraph>
<paragraph id="H5C7ED179F23F4FFFBF8321AF677409B7"><enum>(3)</enum><header>Fact-finding regarding foreign citizens and stateless person</header><text>In the case of a victim who is a foreign citizen or stateless person residing outside the United States and is not under the age of 18 at the time of the proceeding or incompetent or incapacitated, the court may appoint a trustee or other fiduciary under paragraph (1) only if the court finds it necessary to—</text> <subparagraph id="H2D712D06DBB64013B6E335EC464D2FCF"><enum>(A)</enum><text>protect the safety or security of the victim; or</text></subparagraph>
<subparagraph id="HA99F2F33FD5A4CCEB9BAF4C0F01EF5A6"><enum>(B)</enum><text>provide a reliable means for the victim to access or benefit from the restitution payments.</text></subparagraph></paragraph> <paragraph id="H5F8BC6A4F1CF48BD9A3666C0D729D24F"><enum>(4)</enum><header>Payment of fees</header> <subparagraph id="H63C1001F4DB54D22B3EE9BD08B0F51ED"><enum>(A)</enum><header>In general</header><text>The court may, with respect to the fees of the trustee or other fiduciary—</text>
<clause id="HC25FEE1E0C61444EAA395C1FB4AB3A5C"><enum>(i)</enum><text>pay the fees in whole or in part; or</text></clause> <clause id="H17837C9FE8A24292860767F96EB96438"><enum>(ii)</enum><text>order the defendant to pay the fees in whole or in part.</text></clause></subparagraph>
<subparagraph id="H2866988CC5A84B3FBA2F4AEED2A870C2"><enum>(B)</enum><header>Applicability of other provisions</header><text>With respect to a court order under subparagraph (A)(ii) requiring a defendant to pay fees—</text> <clause id="H8C37066B408341BE813F8BB4E7DEE284"><enum>(i)</enum><text>subsection (f)(3) shall apply to the court order in the same manner as that subsection applies to a restitution order;</text></clause>
<clause id="H974B534A7FEA47F0A6DCDCC2262D9CA7"><enum>(ii)</enum><text>subchapter C of chapter 227 (other than section 3571) shall apply to the court order in the same manner as that subchapter applies to a sentence of a fine; and</text></clause> <clause id="H899346C82E344A1BB77897D6CB08694E"><enum>(iii)</enum><text>subchapter B of chapter 229 shall apply to the court order in the same manner as that subchapter applies to the implementation of a sentence of a fine.</text></clause></subparagraph>
<subparagraph id="H846BEA17DDBF47258386DF1135E39D81"><enum>(C)</enum><header>Effect on other penalties</header><text>Imposition of payment under subparagraph (A)(ii) shall not relieve a defendant of, or entitle a defendant to a reduction in the amount of, any special assessment, restitution, other fines, penalties, or costs, or other payments required under the defendant's sentence.</text></subparagraph> <subparagraph id="HF226804C46054E5BAC0FB3AEB4B1AF95"><enum>(D)</enum><header>Schedule</header><text>Notwithstanding any other provision of law, if the court orders the defendant to make any payment under subparagraph (A)(ii), the court may provide a payment schedule that is concurrent with the payment of any other financial obligation described in subparagraph (C).</text></subparagraph></paragraph>
<paragraph id="HD6E38FF65E784B86A1944408C77BDE73"><enum>(5)</enum><header>Authorization of appropriations</header>
<subparagraph id="H0BFE2A3E29444A4B805BD7F391479430"><enum>(A)</enum><header>In general</header><text>There is authorized to be appropriated to the United States courts to carry out this subsection $15,000,000 for each fiscal year.</text></subparagraph> <subparagraph id="H52FFF95EA5604828A61EFA187D9F8DE7"><enum>(B)</enum><header>Supervision of payments</header><text>Payments from appropriations authorized under subparagraph (A) shall be made under the supervision of the Director of the Administrative Office of the United States Courts.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="HEDAC305B766940F8A853567AA0A61CDC"><enum>4.</enum><header>Cybertipline improvements, and accountability and transparency by the tech industry</header>
<subsection id="HE55616A168CE4F51A8F1EE8642B11318"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">Chapter 110</external-xref> of title 18, United States Code, is amended—</text> <paragraph id="H9C64E66B87744B3DAB7A0462227DFADB"><enum>(1)</enum><text>in section 2258A—</text>
<subparagraph id="H11CA3B4F47FF4E459B2340719F74C2A6"><enum>(A)</enum><text>by striking subsections (a), (b), and (c) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H6235B71CFD8E493291FF9326A42BCC88"> <subsection id="HC68AB112280E4C5680EAE03FEF48FB65"><enum>(a)</enum><header>Duty To report</header> <paragraph id="HED935DFF46DA467B8AB05D193A93EB20"><enum>(1)</enum><header>Duty</header><text>In order to reduce the proliferation of online child sexual exploitation and to prevent the online sexual exploitation of children, as soon as reasonably possible after obtaining actual knowledge of any facts or circumstances described in paragraph (2) or any apparent child pornography on the provider’s service, and in any event not later than 60 days after obtaining such knowledge, a provider shall submit to the CyberTipline of NCMEC, or any successor to the CyberTipline operated by NCMEC, a report that— </text>
<subparagraph commented="no" display-inline="no-display-inline" id="H1B798F790A4943FBB1B55F65DB8DE278"><enum>(A)</enum><text>shall contain—</text> <clause commented="no" display-inline="no-display-inline" id="H87BC0BDE80244C0991D42194728CF035"><enum>(i)</enum><text display-inline="yes-display-inline">the mailing address, telephone number, facsimile number, electronic mailing address of, and individual point of contact for, such provider; and</text></clause>
<clause id="H1A37668921D2471E9CBE647E724554DE"><enum>(ii)</enum><text>information or material described in subsection (b)(1)(A) concerning such facts or circumstances or apparent child pornography; and</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H84DD0119A39541E49F1C810B32C4B9D8"><enum>(B)</enum><text display-inline="yes-display-inline">may contain information described in subsection (b)(2), including any available information to identify or locate any involved minor.</text></subparagraph></paragraph>
<paragraph id="HB7C9BECAEF6B405CA6DE335C0E5EED7D"><enum>(2)</enum><header>Facts or circumstances</header><text>The facts or circumstances described in this paragraph are any facts or circumstances indicating an apparent, planned, or imminent violation of section 1591 (if the violation involves a minor), 2251, 2251A, 2252, 2252A, 2252B, 2260, or 2422(b).</text></paragraph> <paragraph id="H9061E7DCA3E84BD7981C264CB3686CFF" commented="no"><enum>(3)</enum><header>Complainant information</header><text>For a report premised on a complaint or notification submitted to a provider by a user of the provider’s product or service, or a parent, guardian, or representative of such user, the provider shall take reasonable measures to determine what information or material in the user’s account shall be included in the report as provided in subsection (b)(1)(A)(vi).</text></paragraph></subsection>
<subsection id="HA59DFA4DDD544356A5FC991FA01DD2B8"><enum>(b)</enum><header>Contents of report</header>
<paragraph id="H112C537554904B4CB4BA0683194B3965"><enum>(1)</enum><header>In general</header><text>In an effort to prevent the future sexual victimization of children, and to the extent the information is within the custody or control of a provider, each report provided under subsection (a)(1)—</text> <subparagraph id="HF4AFC55F6E99402D82A1728E064B46C4"><enum>(A)</enum><text>shall include, to the extent that it is applicable and reasonably available—</text>
<clause id="H0952E8A19CE5438883D794C68E4EE96D"><enum>(i)</enum><text>the name, address, electronic mail address, user or account identification, Internet Protocol address, port number, and uniform resource locator of any individual who is a subject of the report;</text></clause> <clause id="H842DEFF9137F4D5592445FFE009935FF"><enum>(ii)</enum><text>the terms of service in effect at the time of—</text>
<subclause id="H3247CCFA5E1F45B4A0B899B6604C3BE0"><enum>(I)</enum><text>the apparent violation; or</text></subclause> <subclause id="HC226C89D5CE54A049C1ADDFD97476CA7"><enum>(II)</enum><text>the detection of apparent child pornography or a planned or imminent violation;</text></subclause></clause>
<clause id="H5FBBC6C8FD534235848F153E4728CE99"><enum>(iii)</enum><text>a copy of any apparent child pornography that is the subject of the report, or all accessible chats, messages, or text exchanges that are related to the report, that were identified in a publicly available location;</text></clause> <clause id="HFABD1130A83647DA8FAB29604A1D9213"><enum>(iv)</enum><text>for each item of apparent child pornography included in the report under clause (iii) or paragraph (2)(E), information indicating whether—</text>
<subclause id="HEA4C9C76B15B4016BAF29B38A600D1C9"><enum>(I)</enum><text>the apparent child pornography was publicly available; or</text></subclause> <subclause id="H7695A96A9FCB4E09A7B53749E6204BAB"><enum>(II)</enum><text>the provider, in its sole discretion, viewed the apparent child pornography, or any copy thereof, at any point concurrent with or prior to the submission of the report;</text></subclause></clause>
<clause id="HF98B884537294771A9D9144D725ECD91"><enum>(v)</enum><text>for each item of apparent child pornography that is the subject of the report, an indication as to whether the apparent child pornography—</text> <subclause id="HE7FBE80CB73B40508E1D53AC42A425BB"><enum>(I)</enum><text>is created in whole or in part through the use of software, machine learning, artificial intelligence, or any other computer-generated or technological means, including by adapting, modifying, manipulating, or altering an authentic visual depiction;</text></subclause>
<subclause id="H4B53B6E6E1104E50B950F82CA189012C"><enum>(II)</enum><text>has previously been the subject of a report under subsection (a)(1); or</text></subclause> <subclause id="H88FA4DA289A949A7977BA7A0E88BF435"><enum>(III)</enum><text>is the subject of multiple contemporaneous reports due to rapid and widespread distribution; and</text></subclause></clause>
<clause id="HB72F4A87F9EE423497EA685C0A01C560"><enum>(vi)</enum><text>any and all information or material (including apparent child pornography, chats, messages, or text exchanges) relating to the subject of the report in the account of a user of the provider’s product or service, if the user, or the parent, guardian, or representative of such user—</text> <subclause id="HD9D8C12642D6416F8AEEDF4E21800E5C"><enum>(I)</enum><text>provided the information or material in a notification or complaint to the provider;</text></subclause>
<subclause id="H8313B072AD21450892926ED6ED8D3D57"><enum>(II)</enum><text>indicates that such information or material should be included in the report; or</text></subclause> <subclause id="H9227A816D94A441CA664588DED98C953"><enum>(III)</enum><text>consents to the inclusion of such information or material in the report; and</text></subclause></clause></subparagraph>
<subparagraph id="H45FDE62915EC49C29BC63CCC468E6861"><enum>(B)</enum><text>may, at the sole discretion of the provider, include the information described in paragraph (2) of this subsection.</text></subparagraph></paragraph> <paragraph id="HCDCE7FFC739B43699B4D51261EF02B73"><enum>(2)</enum><header>Other information</header><text>The information referred to in paragraph (1)(B) is the following:</text>
<subparagraph id="H3F0F3D64301F4D5A8F1ECA4F1CF0B4BE"><enum>(A)</enum><header>Information about any involved individual</header><text>Any information relating to the identity or location of any individual who is a subject of the report, including payment or financial information (excluding personally identifiable information) and self-reported identifying or locating information.</text></subparagraph> <subparagraph id="H5E30560A0D0C4DBF83133300648B7A21"><enum>(B)</enum><header>Information about any involved minor</header><text>Information relating to the identity or location of any involved minor, which may include an address, electronic mail address, Internet Protocol address, port number, uniform resource locator, payment or financial information (excluding personally identifiable information), or any other information that may identify or locate any involved minor, including self-reported identifying or locating information.</text></subparagraph>
<subparagraph commented="no" id="HCDE243CCD6344E60A20FFDDC5997B6D5"><enum>(C)</enum><header>Historical reference</header><text>Information relating to when and how a customer or subscriber of a provider uploaded, transmitted, or received content relating to the report or when and how content relating to the report was reported to, or discovered by the provider, including a date and time stamp and time zone.</text></subparagraph> <subparagraph commented="no" id="H6F8EBC71F38E4750B6ED27C387569F7F"><enum>(D)</enum><header>Geographic location information</header><text>Information relating to the geographic location of the involved individual or website, which may include the Internet Protocol address, port number, or verified address, or, if not reasonably available, at least one form of geographic identifying information, including area code or ZIP Code, provided by the customer or subscriber, or stored or obtained by the provider.</text></subparagraph>
<subparagraph commented="no" id="H7CCA312778AB43108317FB49373A688E"><enum>(E)</enum><header>Apparent child pornography</header><text>Any apparent child pornography not described in paragraph (1)(A)(iii), or other content related to the subject of the report.</text></subparagraph> <subparagraph commented="no" id="H687BE5D099B041E9A8907DF75F9A5CB1"><enum>(F)</enum><header>Complete communication</header><text>The complete communication containing any apparent child pornography or other content, including—</text>
<clause commented="no" id="HA591929D6E554387936F31ACD7BF8D98"><enum>(i)</enum><text>any data or information regarding the transmission of the communication; and</text></clause> <clause commented="no" id="HECC58E16377941EC9F8C5D71549BEDE6"><enum>(ii)</enum><text>any visual depictions, data, or other digital files contained in, or attached to, the communication.</text></clause></subparagraph>
<subparagraph commented="no" id="H8075439406544C788FD04E0CC7E3C59C"><enum>(G)</enum><header>Technical identifier</header><text>An industry-standard hash value or other similar industry-standard technical identifier for any reported visual depiction as it existed on the provider’s service.</text></subparagraph> <subparagraph commented="no" id="H4A0DD3A080AB42A19A0AE2AFA8C529E2"><enum>(H)</enum><header>Description</header><text>For any item of apparent child pornography that is the subject of the report, an indication of whether—</text>
<clause commented="no" id="H265C27BF461F4605A4528B328C993220"><enum>(i)</enum><text>the depicted sexually explicit conduct involves—</text> <subclause commented="no" id="H7555F52AA92F46658B9D29978E1DCFB1"><enum>(I)</enum><text>genital, oral, or anal sexual intercourse;</text></subclause>
<subclause commented="no" id="HB8C1395D5DE7445E88FCF671D0F0E424"><enum>(II)</enum><text>bestiality;</text></subclause> <subclause commented="no" id="H271DBC4D8CF64970B42E50DEA66CDD00"><enum>(III)</enum><text>masturbation;</text></subclause>
<subclause commented="no" id="H8D37930631C64BD4BDDCC941FEF8F3C4"><enum>(IV)</enum><text>sadistic or masochistic abuse; or</text></subclause> <subclause commented="no" id="HA979FDC6F8F7421992ED3144F68FE1B9"><enum>(V)</enum><text>lascivious exhibition of the anus, genitals, or pubic area of any person; and</text></subclause></clause>
<clause commented="no" id="HD8193C71E21D4A30B1250DE4AAC0F622"><enum>(ii)</enum><text>the depicted minor is—</text> <subclause commented="no" id="HC7A3980B6D59429580133455DFD41AF4"><enum>(I)</enum><text>an infant or toddler;</text></subclause>
<subclause commented="no" id="H07C35604FB5642A99CB3A027F05694C8"><enum>(II)</enum><text>prepubescent;</text></subclause> <subclause commented="no" id="HC2A969D6D18A4C8D90999DF3B542DF40"><enum>(III)</enum><text>pubescent;</text></subclause>
<subclause commented="no" id="H7513B458E90341C49682A5496C149B7A"><enum>(IV)</enum><text>post-pubescent; or</text></subclause> <subclause commented="no" id="H7AB445C63EA24C428A01FA67EC8D8667"><enum>(V)</enum><text>of an indeterminate age or developmental stage.</text></subclause></clause></subparagraph>
<subparagraph id="HBD0144E8AAAC47EEB18A76D2E1F9F5CF"><enum>(I)</enum><header>Chats, messages, or text exchanges</header><text>Chats, messages, or text exchanges that fully provide the context for the report.</text></subparagraph></paragraph> <paragraph id="HB51A6AA4DAE44A64A9778D240BB5C2E7"><enum>(3)</enum><header>Formatting of reports</header><text>When a provider includes any information described in paragraph (1) or, at its sole discretion, any information described in paragraph (2) in a report to the CyberTipline of NCMEC, or any successor to the CyberTipline operated by NCMEC, the provider shall use best efforts to ensure that the report conforms with the structure of the CyberTipline or the successor, as applicable.</text></paragraph></subsection>
<subsection id="H4C09829EFF164376A48D48ABC7ADB632"><enum>(c)</enum><header>Forwarding of report and other information to law enforcement</header>
<paragraph id="HAE8C3F0E4BE848D3A0427056AE0A1A1C"><enum>(1)</enum><header>In general</header><text>Pursuant to its clearinghouse role as a private, nonprofit organization, and at the conclusion of its review in furtherance of its nonprofit mission, NCMEC shall make available each report submitted under subsection (a)(1) to one or more of the following law enforcement agencies:</text> <subparagraph id="H47934562348542CD9325EE5E456BC6B2"><enum>(A)</enum><text>Any Federal law enforcement agency that is involved in the investigation of child sexual exploitation, kidnapping, or enticement crimes.</text></subparagraph>
<subparagraph id="HA1C32C4EEDFF467A84C68C0DC930AA17"><enum>(B)</enum><text>Any State or local law enforcement agency that is involved in the investigation of child sexual exploitation.</text></subparagraph> <subparagraph id="HA5F28BB59ECB4CC1999119E91635F06B"><enum>(C)</enum><text>A foreign law enforcement agency designated by the Attorney General under subsection (d)(3) or a foreign law enforcement agency that has an established relationship with the Federal Bureau of Investigation, Immigration and Customs Enforcement, or INTERPOL, and is involved in the investigation of child sexual exploitation, kidnapping, or enticement crimes.</text></subparagraph></paragraph>
<paragraph id="H250B41F29F604A8EA0A39B0BC8FA827E"><enum>(2)</enum><header>Technical identifiers</header><text>If a report submitted under subsection (a)(1) contains an industry-standard hash value or other similar industry-standard technical identifier—</text> <subparagraph id="H9A6C02E11CD9468C89670B7C74716E1D"><enum>(A)</enum><text>NCMEC may compare that hash value or identifier with any database or repository of visual depictions owned or operated by NCMEC; and</text></subparagraph>
<subparagraph id="HD48906B074784F01B0FDC7FC0DDF865B"><enum>(B)</enum><text>if the comparison under subparagraph (A) results in a match, NCMEC may include the matching visual depiction from its database or repository when forwarding the report to an agency described in subparagraph (A) or (B) of paragraph (1).</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HE5A775E21445488191CD9EF0C4FF9DB6"><enum>(B)</enum><text>in subsection (d)—</text>
<clause id="HAC0D43A3940346BA85ABA6C7E1E2B2E4" commented="no"><enum>(i)</enum><text>in paragraph (2), by striking <quote>subsection (c)(1)</quote> and inserting <quote>subsection (c)(1)(A)</quote>;</text></clause> <clause id="HDCAAE71306CA4581A1A4A005B904F625" commented="no"><enum>(ii)</enum><text>in paragraph (3)—</text>
<subclause commented="no" display-inline="no-display-inline" id="HE270B8647D5447A39F2FF21682CA4F20"><enum>(I)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>subsection (c)(3)</quote> and inserting <quote>subsection (c)(1)(C)</quote>; and</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="HFB8537D2A3CA4A88945CFD722B3AA0C7"><enum>(II)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking <quote>subsection (c)(3)</quote> and inserting <quote>subsection (c)(1)(C)</quote>; and</text></subclause></clause>
<clause id="HDB1F5A62BEC648B583CEEC4FFA86E7C0" commented="no"><enum>(iii)</enum><text>in paragraph (5)(B)—</text> <subclause id="H5D52D69DCE7047088415A8E50BF3BCF0" commented="no"><enum>(I)</enum><text>in clause (i), by striking <quote>forwarded</quote> and inserting <quote>made available</quote>; and</text></subclause>
<subclause id="H3E34ED502FE24D7A981717F9A21AEF1C" commented="no"><enum>(II)</enum><text>in clause (ii), by striking <quote>forwarded</quote> and inserting <quote>made available</quote>;</text></subclause></clause></subparagraph> <subparagraph id="HB4F0151628A145678931A8871BAF30B1" commented="no"><enum>(C)</enum><text>by striking subsection (e) and inserting the following:</text>

<subsection id="HA8BD194354AD4C7D87CFD9EB8A65FFF1"><enum>(e)</enum><header>Failure To comply with requirements</header>
<paragraph id="HF2317A0D0A394101954B1DC73F7E2B18"><enum>(1)</enum><header>Criminal penalty</header>
<subparagraph id="H12ADDC4B571F4960AB7AD6C3B7109E8A"><enum>(A)</enum><header>Offense</header><text>It shall be unlawful for a provider to knowingly—</text> <clause id="H54FAD30E91334CC6B841B12D0FFD4240"><enum>(i)</enum><text>fail to submit a report under subsection (a)(1) within the time period required by that subsection; or</text></clause>
<clause id="HD110DDFCAB854C7E809ADFFC74DB6D90"><enum>(ii)</enum><text>fail to preserve material as required under subsection (h).</text></clause></subparagraph> <subparagraph id="HBDCC8C1259DF4BCDA3CC28046BC94E17"><enum>(B)</enum><header>Penalty</header> <clause id="H3BAEE1C4E5704FA4A8D771DBF567CCB0"><enum>(i)</enum><header>In general</header><text>A provider that violates subparagraph (A) shall be fined—</text>
<subclause id="HCADBC73E720F4D48B13ADE1C8A1A35F5"><enum>(I)</enum><text>in the case of an initial violation, not more than—</text> <item commented="no" display-inline="no-display-inline" id="H17A83BE2E1C9441BA4AA61577F2D8421"><enum>(aa)</enum><text display-inline="yes-display-inline">$850,000 if the provider has not fewer than 100,000,000 monthly active users; or</text></item>
<item commented="no" display-inline="no-display-inline" id="H547CAEAD120142F480DE661AD30A34AC"><enum>(bb)</enum><text display-inline="yes-display-inline">$600,000 if the provider has fewer than 100,000,000 monthly active users; and</text></item></subclause> <subclause id="H803791BCA15A465F9964867FDE8FBFEE"><enum>(II)</enum><text>in the case of any second or subsequent violation, not more than—</text>
<item commented="no" display-inline="no-display-inline" id="H0B2416E5A0074EF288967B1D792DCA33"><enum>(aa)</enum><text display-inline="yes-display-inline">$1,000,000 if the provider has not fewer than 100,000,000 monthly active users; or</text></item> <item commented="no" display-inline="no-display-inline" id="H81585AC81C024E6EA9D45B5BB66BB7CE"><enum>(bb)</enum><text display-inline="yes-display-inline">$850,000 if the provider has fewer than 100,000,000 monthly active users.</text></item></subclause></clause>
<clause id="HDE8D034DE7E3447DB0A859698B7FF88C"><enum>(ii)</enum><header>Harm to individuals</header><text>The maximum fine under clause (i) shall be doubled if an individual is harmed as a direct and proximate result of the applicable violation.</text></clause></subparagraph></paragraph> <paragraph id="H6B82C10408474F8AA4AE9E760B6E3FB1"><enum>(2)</enum><header>Civil penalty</header> <subparagraph id="H378DDF035DC646A4813803FE56083DB8"><enum>(A)</enum><header>Violations relating to CyberTipline reports and material preservation</header><text>A provider shall be liable to the United States Government for a civil penalty in an amount of not less than $50,000 and not more than $250,000 if the provider knowingly—</text>
<clause id="HD9389D499C57488B8593B99B712EA91E"><enum>(i)</enum><text>fails to submit a report under subsection (a)(1) within the time period required by that subsection;</text></clause> <clause id="H70ADA5AE29894C4CAF6250DBBD6D9D4F"><enum>(ii)</enum><text>fails to preserve material as required under subsection (h); or</text></clause>
<clause id="HC3E22AAB7FBC49339A920CD8294B0EAF"><enum>(iii)</enum><text>submits a report under subsection (a)(1) that—</text> <subclause id="H6207518FBF634E5B97E1C0C72CDB3997"><enum>(I)</enum><text>contains materially false or fraudulent information; or</text></subclause>
<subclause id="H48BD262F8A1C4581B544C3828C0893EA"><enum>(II)</enum><text>omits information described in subsection (b)(1)(A) that is reasonably available.</text></subclause></clause></subparagraph> <subparagraph id="H8AEFB76E879F47C89B9484395B1534D9"><enum>(B)</enum><header>Annual report violations</header><text>A provider shall be liable to the United States Government for a civil penalty in an amount of not less than $100,000 and not more than $1,000,000 if the provider knowingly—</text>
<clause id="HE25899F98A4C44628FD8D9D5175B0708"><enum>(i)</enum><text>fails to submit an annual report as required under subsection (i); or</text></clause> <clause id="H2127F13167C44FA9A00F4DACCB3C1E66"><enum>(ii)</enum><text>submits an annual report under subsection (i) that—</text>
<subclause id="H0AD81ABE537C49B8A5F4BBDBF9BAF890"><enum>(I)</enum><text>contains a materially false, fraudulent, or misleading statement; or</text></subclause> <subclause id="HAA70BB9ACEDF4112AD4441C980987CBC"><enum>(II)</enum><text>omits information described in subsection (i)(1) that is reasonably available. </text></subclause></clause></subparagraph>
<subparagraph id="HDD02CD11DB384D899C602B9B881CD1CB"><enum>(C)</enum><header>Harm to individuals</header><text>The amount of a civil penalty under subparagraph (A) or (B) shall be tripled if an individual is harmed as a direct and proximate result of the applicable violation.</text></subparagraph> <subparagraph id="H0FB5B4186D1048F5A9D4F6CB1570570B"><enum>(D)</enum><header>Costs of civil actions</header><text>A provider that commits a violation described in subparagraph (A) or (B) shall be liable to the United States Government for the costs of a civil action brought to recover a civil penalty under that subparagraph.</text></subparagraph>
<subparagraph id="H86B76BA317264550A301A588366D7348"><enum>(E)</enum><header>Enforcement</header><text>This paragraph shall be enforced in accordance with sections 3731, 3732, and 3733 of title 31, except that a civil action to recover a civil penalty under subparagraph (A) or (B) of this paragraph may only be brought by the United States Government.</text></subparagraph></paragraph> <paragraph id="HE34C9560DFE04E32A9355F6331499601"><enum>(3)</enum><header>Deposit of fines and penalties</header><text>Notwithstanding any other provision of law, any criminal fine or civil penalty collected under this subsection shall be deposited into the Child Pornography Victims Reserve as provided in section 2259B.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H4CF4BE7159624F0D8455681C5ED05082"><enum>(D)</enum><text>in subsection (f), by striking paragraph (3) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HD7DD472C39FF42AAB67813CAA6F9D9AD"> <paragraph id="H32A2E9E555A64781BE074776D4DE8BFF"><enum>(3)</enum><text>affirmatively search, screen, or scan for—</text>
<subparagraph id="HFBF5C2B3ABEA43A9A58964590921BF42"><enum>(A)</enum><text>facts or circumstances described in subsection (a)(2);</text></subparagraph> <subparagraph id="H74A88278093648B4B9C59E4E762FF3A5"><enum>(B)</enum><text>information described in subsection (b)(2); or</text></subparagraph>
<subparagraph id="HB42541ACB7E44A2F909AF70BE5F68A1C" commented="no"><enum>(C)</enum><text>any apparent child pornography.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H060C2C12D2E14F2697BDD78B23FA2105"><enum>(E)</enum><text>in subsection (g)—</text>
<clause commented="no" display-inline="no-display-inline" id="H96813168BE9C4E99A705333D669D630B"><enum>(i)</enum><text display-inline="yes-display-inline">in paragraph (2)(A)—</text> <subclause id="H5BC72A6612954167B510B208FA54ECD4"><enum>(I)</enum><text>in clause (iii), by inserting <quote>or personnel at a children's advocacy center</quote> after <quote>State)</quote>; and</text></subclause>
<subclause id="H5BC1D225520443D1A3BB4DEC1626D069"><enum>(II)</enum><text>in clause (iv), by striking <quote>State or subdivision of a State</quote> and inserting <quote>State, subdivision of a State, or children's advocacy center</quote>; and</text></subclause></clause> <clause commented="no" display-inline="no-display-inline" id="HEF6AE0E4917C423CB91E25E460F3BD02"><enum>(ii)</enum><text>in paragraph (3), in the matter preceding subparagraph (A), by striking <quote>subsection (a)</quote> and inserting <quote>subsection (a)(1)</quote>;</text></clause></subparagraph>
<subparagraph id="H829E12D89DB046039A799694D551CBFF"><enum>(F)</enum><text>in subsection (h), by striking paragraph (5) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H1865F1322FC44975A14AC6D5659F1747"> <paragraph id="H4DC5C0FD3FE041B0B94D309FD14BCFF2"><enum>(5)</enum><header>Relation to reporting requirement</header><text>Submission of a report as described in subsection (a)(1) does not satisfy the obligations under this subsection.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph>
<subparagraph id="H7AA6781703C245048F71E3F1ACDBD1DC"><enum>(G)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H3661F5B2574A4C5090DD77769F6F62D8"> <subsection id="H55CA94BFA5DD456C8D40A071F3AEE519"><enum>(i)</enum><header>Annual report</header> <paragraph id="H9D45824BBD634A9CAAA9B16F6A7C789E"><enum>(1)</enum><header>In general</header><text>Not later than March 31 of the second year beginning after the date of enactment of the <short-title>STOP CSAM Act of 2025</short-title>, and of each year thereafter, a provider that had more than 1,000,000 unique monthly visitors or users during each month of the preceding year and accrued revenue of more than $50,000,000 during the preceding year shall submit to the Attorney General and the Chair of the Federal Trade Commission a report, disaggregated by subsidiary, that provides the following information for the preceding year to the extent such information is applicable and reasonably available:</text>
<subparagraph id="HC6D1E372CC1F4E7D8632F84EDCFBA2C1"><enum>(A)</enum><header>Cybertipline data</header>
<clause id="HE886148FA2684A26AC1921CB6CF127B7"><enum>(i)</enum><text>The total number of reports that the provider submitted under subsection (a)(1).</text></clause> <clause id="H2D0B2441B3504BB9BE263D0FF6741465"><enum>(ii)</enum><text>Which items of information described in subsection (b)(2) are routinely included in the reports submitted by the provider under subsection (a)(1).</text></clause></subparagraph>
<subparagraph id="H3E9502991DA942DEB1AC19698F568D83"><enum>(B)</enum><header>Other reporting to the provider</header>
<clause id="H19F3DBE9FFDE40E08E10C06430F29485"><enum>(i)</enum><text>The measures the provider has in place to receive other reports concerning child sexual exploitation and abuse using the provider's product or on the provider's service.</text></clause> <clause id="H6A44FBC8B35D45DA84125BE4AE222B9E"><enum>(ii)</enum><text>The average time for responding to reports described in clause (i).</text></clause>
<clause id="H5E81D4001A914EB48FD3A585E4E4038D"><enum>(iii)</enum><text>The number of reports described in clause (i) that the provider received.</text></clause> <clause id="H7FA974F6B23B4E519A7E399B5AFF26E7"><enum>(iv)</enum><text>A summary description of the actions taken upon receipt of the reports described in clause (i).</text></clause></subparagraph>
<subparagraph id="H36767786930F4B29BFDFA5826A597ED0"><enum>(C)</enum><header>Policies</header>
<clause id="H70B2ED78BBC7498BAC5236C3D193B2E8"><enum>(i)</enum><text>A description of the policies of the provider with respect to the commission of child sexual exploitation and abuse using the provider's product or on the provider's service, including how child sexual exploitation and abuse is defined.</text></clause> <clause id="H2DCEDB8579FA4F228E427C78A0FD082B"><enum>(ii)</enum><text>A description of possible user consequences for violations of the policies described in clause (i).</text></clause>
<clause id="H23648051D99C4A9AB70A58220C2BC68C"><enum>(iii)</enum><text>The methods of informing users of the policies described in clause (i).</text></clause> <clause id="H4EC55705180247AB81046C2AA2244677"><enum>(iv)</enum><text>The process for adjudicating potential violations of the policies described in clause (i).</text></clause></subparagraph>
<subparagraph id="H593E441897064B60B80CEF08AFAA2BF9" commented="no"><enum>(D)</enum><header>Culture of safety</header>
<clause id="HEC7B81BC8D914C88AD70919EBB80DFF4" commented="no"><enum>(i)</enum><text>The measures, tools, and technologies that the provider deploys to—</text> <subclause id="H4114D60785594914BCA75C931F0BFE5F" commented="no"><enum>(I)</enum><text>protect children from sexual exploitation and abuse using the provider’s product or service;</text></subclause>
<subclause id="H721F71F6EB2443648D28CF16602B5727" commented="no"><enum>(II)</enum><text>prevent or interdict activity by children related to sexual exploitation and abuse, including the posting or sharing of intimate visual depictions; and</text></subclause> <subclause id="HB6FE850A2E8B46B98AB6E14024EBAC48" commented="no"><enum>(III)</enum><text>accurately identify adult and minor users.</text></subclause></clause>
<clause id="H8167A6BE35F94DD1A37AAF7804B554B0" commented="no"><enum>(ii)</enum><text>The measures, tools, and technologies that the provider deploys to empower parents and guardians to protect their children from sexual exploitation and abuse using the provider’s product or service.</text></clause> <clause id="H34B21EA478E4484D856405BDAC2FD193" commented="no"><enum>(iii)</enum><text>The measures, tools, and technologies that the provider deploys to prevent the use of the provider's product or service by individuals seeking to commit child sexual exploitation and abuse.</text></clause>
<clause id="HB75F6CD97CBF4BFAA43D6772EB6EE97D" commented="no"><enum>(iv)</enum><text>With respect to the measures, tools, and technologies described in clauses (i), (ii), and (iii)—</text> <subclause id="H40AF4FCAE0D44AA89C2C9866F5A8D359" commented="no"><enum>(I)</enum><text>an assessment of their efficacy, including any relevant quantitative information indicating when and how often they are used; and</text></subclause>
<subclause id="H0A1694854E2B4510B9163EFEC21DE1BB" commented="no"><enum>(II)</enum><text>information on any factors that limit their efficacy or create gaps in their protection and efforts by the provider to address those loopholes or gaps.</text></subclause></clause> <clause id="H8E96E79DCEF04EF7BE3CFF4258629737" commented="no"><enum>(v)</enum><text>A description of factors that interfere with the provider’s ability to detect or evaluate instances of child sexual exploitation and abuse and an analysis of the impact of those factors.</text></clause>
<clause id="HBE62AAFC7A8B4163BE840567540D9694" commented="no"><enum>(vi)</enum><text>Information shared by the provider with users about the risks to children on the provider's product or service concerning sexual exploitation and abuse and an assessment of the impact of the information on users, including any relevant quantitative information indicating how often the information is reviewed.</text></clause></subparagraph> <subparagraph id="H464B315C81CB407691D9D2A25B36F88E" commented="no"><enum>(E)</enum><header>Safety by design</header><text>The measures that the provider takes before launching a new product or service—</text>
<clause id="H0F766FFCE70E4B33906DBE06B19AAF98" commented="no"><enum>(i)</enum><text>to assess—</text> <subclause id="H50636B421D7346D1A48A4E0B63B1C23C" commented="no"><enum>(I)</enum><text>the safety risks for children with respect to sexual exploitation and abuse; and</text></subclause>
<subclause id="HCA55A6432546488891CEE54A6F344F07" commented="no"><enum>(II)</enum><text>whether and how individuals could use the new product or service to commit child sexual exploitation and abuse; and</text></subclause></clause> <clause id="HD84EA119BCCD41479BC8EDA957D4F418" commented="no"><enum>(ii)</enum><text>to determine—</text>
<subclause id="H77D3ECCCBB924F14B06BB3FDF1695F3D" commented="no"><enum>(I)</enum><text>the appropriate age for users of the new product or service; and</text></subclause> <subclause id="HA0F84494BF3C45AC812B906C5FC2A7CE" commented="no"><enum>(II)</enum><text>whether the new product or service will be adopted to commit child sexual exploitation and abuse.</text></subclause></clause></subparagraph>
<subparagraph id="H26872DB8B8CC44D3949353D371806BB8"><enum>(F)</enum><header>Prevalence, trends, and patterns</header><text>Any information concerning—</text> <clause id="H9A55B54A311F49D886B9D8C0DA793692"><enum>(i)</enum><text>the prevalence of child sexual exploitation and abuse on the provider’s product or service, including the volume of child pornography that is available and that is being accessed, distributed, or received; and</text></clause>
<clause id="HB42791D18EA44B5D8463E1EAAE50C880"><enum>(ii)</enum><text>emerging trends, risks, and changing patterns with respect to the commission of online child sexual exploitation and abuse.</text></clause></subparagraph> <subparagraph id="H6688A42638284C8B8487DC200FA857CC"><enum>(G)</enum><header>Other information</header><text>Any other information relevant to child sexual exploitation and abuse on the provider’s product or service.</text></subparagraph></paragraph>
<paragraph id="HA4FF44C257154FE78AA8DA6EE09259F8"><enum>(2)</enum><header>Avoiding duplication</header><text>Notwithstanding the requirement under the matter preceding paragraph (1) that information be submitted annually, in the case of any report submitted under that paragraph after the initial report, a provider shall submit information described in subparagraphs (C) through (F) of that paragraph not less frequently than once every 3 years or when new information is available, whichever is more frequent.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H5F42730A317748FA9D9A4C7CD7056419"><enum>(3)</enum><header display-inline="yes-display-inline">Limitation</header><text>Nothing in paragraph (1) shall require the disclosure of trade secrets or other proprietary information.</text></paragraph>
<paragraph id="H2107E38B989C450AAD732E13F43C459B"><enum>(4)</enum><header>Publication</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H07299219C71944A5930145E2C1D99BAF"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Subject to subparagraph (B), the Attorney General and the Chair of the Federal Trade Commission shall publish the reports received under this subsection.</text></subparagraph> <subparagraph id="HC5B24803CD654BB8A0ADA97844056F55"><enum>(B)</enum><header>Redaction</header> <clause commented="no" display-inline="no-display-inline" id="HA7C3C44F4A5B4569A68B9B5DBDE59F7D"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text>Whether or not such redaction is requested by the provider, the Attorney General and Chair of the Federal Trade Commission shall redact from a report published under subparagraph (A) any information as necessary to avoid—</text>
<subclause commented="no" display-inline="no-display-inline" id="H5EF6055096464C5281BE3918A1418EB7"><enum>(I)</enum><text display-inline="yes-display-inline">undermining the efficacy of a safety measure described in the report; or</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="H5C698D83B5194AAB9141CC9440CC93A6"><enum>(II)</enum><text display-inline="yes-display-inline">revealing how a product or service of a provider may be used to commit online child sexual exploitation and abuse.</text></subclause></clause>
<clause commented="no" display-inline="no-display-inline" id="HDCC82A63A9CE4A5DA76A23A84A887694"><enum>(ii)</enum><header>Additional redaction</header>
<subclause commented="no" display-inline="no-display-inline" id="H4CD315E7D11242A3AFC1191DCD130883"><enum>(I)</enum><header display-inline="yes-display-inline">Request</header><text display-inline="yes-display-inline">In addition to information redacted under clause (i), a provider may request the redaction, from a report published under subparagraph (A), of any information that is law enforcement sensitive or otherwise not suitable for public distribution.</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="H228C908EF40842FF92F61DA9E0683206"><enum>(II)</enum><header>Agency discretion</header><text display-inline="yes-display-inline">The Attorney General and Chair of the Federal Trade Commission—</text>

<subparagraph id="H818F84BFD2034D52869FF5D802E05B6D"><enum>(A)</enum><text>the performance of the reporting or preservation responsibilities of such provider or domain name registrar under this section, section 2258A, or section 2258C;</text></subparagraph> <subparagraph id="HC6A13F6AF6F5445EB7F96F07E0536A7D"><enum>(B)</enum><text>transmitting, distributing, or mailing child pornography to any Federal, State, or local law enforcement agency, or giving such agency access to child pornography, in response to a search warrant, court order, or other legal process issued or obtained by such agency; or</text></subparagraph>
<subparagraph id="HC7A73093E969438691761E3EA690283C"><enum>(C)</enum><text>the use by the provider or domain name registrar of any material being preserved under section 2258A(h) by such provider or registrar for research and the development and training of tools, undertaken voluntarily and in good faith for the sole and exclusive purpose of— </text> <clause id="HE2453525BE5A40189A9659C73FBE87EA"><enum>(i)</enum><text>improving or facilitating reporting under this section, section 2258A, or section 2258C; or</text></clause>
<clause id="HCBCB69C0A64E40D7AE87A7319DE4D79F"><enum>(ii)</enum><text>stopping the online sexual exploitation of children.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H1A6A7C7B325C48139550A52A418537AC"><enum>(B)</enum><text>in subsection (b)—</text>

<subparagraph id="H3B678CF09E474D4689F74DD40117A9A9"><enum>(C)</enum><text>any person employed by the provider or domain name registrar who is not conducting any research described in that subsection.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph> <paragraph id="HF33643283B1E4D638EDECFB373109DEA"><enum>(3)</enum><text>in section 2258C—</text>

<paragraph id="H4D5BFF4F33FD411CBA45E240D1CEF389"><enum>(10)</enum><text>the term <term>Child Victim Identification Program</term> means the program described in section 404(b)(1)(K)(ii) of the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/34/11293">34 U.S.C. 11293(b)(1)(K)(ii)</external-xref>).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H61EBE2E8BFB34ED4A78A6B9126B397A5"><enum>(5)</enum><text>in section 2259B(a), by inserting <quote>, any fine or penalty collected under section 2258A(e),</quote> after <quote>2259A</quote>; and</text></paragraph>
<paragraph id="H392CEA8B4BD041078ED3807EC80703DB"><enum>(6)</enum><text>by adding at the end the following:</text> <quoted-block style="USC" display-inline="no-display-inline" id="H94F4FC5B42A34306B13ADEB9F54490F4"> <section id="H08587288B54546578D68D71DBEEC602C"><enum>2260B.</enum><header>Liability for certain child sexual exploitation offenses</header> <subsection id="H007D90E6257D4C0586B7FCFC7218598E"><enum>(a)</enum><header>Offense</header><text>It shall be unlawful for a provider of an interactive computer service, as that term is defined in section 230 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230</external-xref>), that operates through the use of any facility or means of interstate or foreign commerce or in or affecting interstate or foreign commerce, through such service to—</text>
<paragraph id="HF0BEA83421754664894D65A42F2BD473"><enum>(1)</enum><text>intentionally host or store child pornography or make child pornography available to any person; or</text></paragraph> <paragraph id="H779D6194844F4CDDB7192982E0EBD745"><enum>(2)</enum><text>knowingly promote or facilitate a violation of section 2251, 2251A, 2252, 2252A, or 2422(b).</text></paragraph></subsection>
<subsection id="HBA0DB556976244E490C29AC671DC0B89"><enum>(b)</enum><header>Penalty</header><text>A provider of an interactive computer service that violates subsection (a)—</text> <paragraph commented="no" display-inline="no-display-inline" id="H9ECCB99E01A44CD9927224CDDF6BF8A8"><enum>(1)</enum><text display-inline="yes-display-inline">subject to paragraph (2), shall be fined not more than $1,000,000; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H8561E1E14E75458986BA503A4FBDFAFE"><enum>(2)</enum><text display-inline="yes-display-inline">if the offense involves a conscious or reckless risk of serious personal injury or an individual is harmed as a direct and proximate result of the violation, shall be fined not more than $5,000,000.</text></paragraph></subsection> <subsection id="HB8FA8D6D59384D39BD4665F391FFB8B4"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to apply to any good faith action by a provider of an interactive computer service that is necessary to comply with a valid court order, subpoena, search warrant, statutory obligation, or preservation request from law enforcement.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H8D03D0AC116C4ACB96ABED02288C0EDD"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">chapter 110</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H928FE841798B4F30AE848B485BA8EE33"> <toc> <toc-entry bold="off" level="section">2260B. Liability for certain child sexual exploitation offenses.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection commented="no" display-inline="no-display-inline" id="H6DA59DD5A55346A7A20B5136FC1A15BD"><enum>(c)</enum><header>Effective date for amendments to reporting requirements of providers</header><text>The amendments made by subsection (a)(1) of this section shall take effect on the date that is 120 days after the date of enactment of this Act.</text></subsection></section>
<section id="H662328B371AB4F809B2324041246159D"><enum>5.</enum><header>Expanding civil remedies for victims of online child sexual exploitation</header>
<subsection id="H450F39E3179A47EF8D094588C4FE2251"><enum>(a)</enum><header>Statement of intent</header><text>Nothing in this section shall be construed to abrogate or narrow any case law concerning section 2255 of title 18, United States Code.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="H46DA4A8041B344E295EE706CB2D3D4A6"><enum>(b)</enum><header display-inline="yes-display-inline">Civil remedy for personal injuries</header><text display-inline="yes-display-inline">Section 2255(a) of title 18, United States Code, is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="HA8DDB304ED694386BC78A09E1B8D42E4"><enum>(1)</enum><text>by striking <quote><header-in-text style="USC" level="subsection">In general</header-in-text>.—Any person who, while a minor, was a victim of a violation of section 1589, 1590, 1591, 2241(c), 2242, 2243, 2251, 2251A, 2252, 2252A, 2260, 2421, 2422, or 2423 of this title and who suffers personal injury as a result of such violation, regardless of whether the injury occurred while such person was a minor, may sue</quote> and inserting the following:</text> <quoted-block style="OLC" display-inline="yes-display-inline" id="H52C370260CEE4430A69D19E938FA3EBF"><text><header-in-text style="USC" level="subsection">Private right of action</header-in-text>.—</text>
<paragraph id="H024682F106A74687B4853319FEECB337"><enum>(1)</enum><header>In general</header><text>Any person described in subparagraph (A), (B), or (C) of paragraph (2) who suffers personal injury as a result of a violation described in that subparagraph, regardless of whether the injury occurred while such person was a minor, may bring a civil action</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="HA737E4AECDF448468D2EEFAD64471349"><enum>(2)</enum><text>by adding at the end the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="HB4C4C5061D8F4273A8895026C3BB2740">
<paragraph id="HBC120D17791843C08EBD00AFCD4B5344"><enum>(2)</enum><header>Eligible persons</header><text>Paragraph (1) shall apply to any person—</text> <subparagraph id="HC0381456A48E4BCE9585E1C67ADC708A"><enum>(A)</enum><text>who, while a minor, was a victim of—</text>
<clause id="H03853D45EF154CA58BAC49008DA6876D"><enum>(i)</enum><text>a violation of section 1589, 1590, 1591, 2241, 2242, 2243, 2251, 2251A, 2260(a), 2421, 2422, or 2423;</text></clause> <clause id="H3A1E922396D943B7ABEC8F9842F7CA65"><enum>(ii)</enum><text>an attempt to violate section 1589, 1590, or 1591 under section 1594(a);</text></clause>
<clause id="H91D3FCBBE86440AA8874DFD4DD32F4F5"><enum>(iii)</enum><text>a conspiracy to violate section 1589 or 1590 under section 1594(b); or</text></clause> <clause id="H1E1066E62D734CD0B9492C414EAAF0F6"><enum>(iv)</enum><text>a conspiracy to violate section 1591 under section 1594(c);</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HF4A770CEBE1C410EAF0A1FA63ABCB6E8"><enum>(B)</enum><text display-inline="yes-display-inline">who—</text> <clause commented="no" display-inline="no-display-inline" id="H281B7AF4C2CA4E248B1567F0743E8DCE"><enum>(i)</enum><text display-inline="yes-display-inline">is depicted as a minor in child pornography; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H8D64A5FA2AED4861ADAA396B1C0DA2B8"><enum>(ii)</enum><text>is a victim of a violation of 2252, 2252A, or 2260(b) (regardless of when the violation occurs); or</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HBF7C288F15CA415FA090A7EDCAD70FEF"><enum>(C)</enum><text display-inline="yes-display-inline">who—</text>
<clause commented="no" display-inline="no-display-inline" id="H3537626A78524F218F3DDEA0E5651DFD"><enum>(i)</enum><text display-inline="yes-display-inline">is depicted as an identifiable minor in a visual depiction described in section 1466A; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="HEB7BAA259F774F31A5833262F844268A"><enum>(ii)</enum><text display-inline="yes-display-inline">is a victim of a violation of that section (regardless of when the violation occurs).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HC58005FBC58E4DDE9CF95484A1C0B754"><enum>(c)</enum><header>Civil remedy against online platforms and app stores</header>
<paragraph commented="no" display-inline="no-display-inline" id="H0E326B1F39854FBD80BA3E21BE0342B4"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">Chapter 110</external-xref> of title 18, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/18/2255">section 2255</external-xref> the following:</text> <quoted-block style="USC" display-inline="no-display-inline" id="HB69EB41CC9CE487DAEB2DAE7112109A7"> <section id="HF92A8573E81F40F1899EF16785C58062"><enum>2255A.</enum><header>Additional remedy for certain victims of child pornography or child sexual exploitation</header> <subsection id="H2879BDF922F4493FBB035BD89DF5330B"><enum>(a)</enum><header>In general</header> <paragraph id="H57495C54DC0147F4AC18308EADA6A2E7"><enum>(1)</enum><header>Promotion or aiding and abetting of certain violations</header><text>Any person who is a victim of the intentional, knowing, or reckless promotion, or aiding and abetting, of a violation of section 1591 or 1594(c) (involving a minor), or section 2251, 2251A, 2252, 2252A, or 2422(b), where such promotion, or aiding and abetting, is by a provider of an interactive computer service or an app store, and who suffers personal injury as a result of such promotion or aiding and abetting, regardless of when the injury occurred, may bring a civil action in any appropriate United States District Court for relief set forth in subsection (b).</text></paragraph>
<paragraph id="HD17D05D3D2E4422DAFABB3DA6BFD8613"><enum>(2)</enum><header>Activities involving child pornography</header><text>Any person who is a victim of the intentional, knowing, or reckless hosting or storing of child pornography or making child pornography available to any person by a provider of an interactive computer service, and who suffers personal injury as a result of such hosting, storing, or making available, regardless of when the injury occurred, may bring a civil action in any appropriate United States District Court for relief set forth in subsection (b).</text></paragraph></subsection> <subsection id="H7EB7D100FA414AA7ACA61CE30D6F0D90"><enum>(b)</enum><header>Relief</header><text>In a civil action brought by a person under subsection (a)—</text>
<paragraph id="H621F5132175147B3BD6BE293F16A7DDA"><enum>(1)</enum><text>the person shall recover the actual damages the person sustains or liquidated damages in the amount of $300,000, and the cost of the action, including reasonable attorney fees and other litigation costs reasonably incurred; and</text></paragraph> <paragraph id="H3D502C5768F24E818EB25ED3E9F8BF8C"><enum>(2)</enum><text>the court may, in addition to any other relief available at law, award punitive damages and such other preliminary and equitable relief as the court determines to be appropriate, including a temporary restraining order, a preliminary injunction, or a permanent injunction ordering the defendant to cease the offending conduct.</text></paragraph></subsection>
<subsection id="H460F283831FA44BCA5A11F716BE1636A"><enum>(c)</enum><header>Statute of limitations</header><text>There shall be no time limit for the filing of a complaint commencing an action under subsection (a).</text></subsection> <subsection id="HEC21CCDBD3B747AF8CC67F5E83573D3E"><enum>(d)</enum><header>Venue; service of process</header> <paragraph id="H99D5EB17DCB6484680F8C22DB9A5FF95"><enum>(1)</enum><header>Venue</header><text>Any action brought under subsection (a) may be brought in the district court of the United States that meets applicable requirements relating to venue under section 1391 of title 28.</text></paragraph>
<paragraph id="HA28FFA25675D4265839F2D57FB782B5D"><enum>(2)</enum><header>Service of process</header><text>In an action brought under subsection (a), process may be served in any district in which the defendant—</text> <subparagraph id="H220A9C9E789C4B589383FBDE1D6E3CAB"><enum>(A)</enum><text>is an inhabitant; or</text></subparagraph>
<subparagraph id="H8911114F0F11427EA5518029F8583161"><enum>(B)</enum><text>may be found.</text></subparagraph></paragraph></subsection> <subsection id="HA0B55FF0E83C473A9F1C095C67A8D8A7"> <enum>(e)</enum> <header>Relation to section 230 of the Communications Act of 1934</header> <text>Nothing in section 230 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230</external-xref>) shall be construed to impair or limit any claim brought under subsection (a).</text>
              </subsection>
<subsection id="HAFD8E5DA98F949D583A1A030EB59F361"><enum>(f)</enum><header>Rules of construction</header>
<paragraph commented="no" display-inline="no-display-inline" id="HCB6F31FC1DFD4816B1F3DC14FEB8CDB8"><enum>(1)</enum><header display-inline="yes-display-inline">Applicability to legal process or obligation</header><text>Nothing in this section shall be construed to apply to any good faith action that is necessary to comply with a valid court order, subpoena, search warrant, statutory obligation, or preservation request from law enforcement.</text></paragraph> <paragraph id="HAFA6637F9E6B4108A1507F0322614E17"><enum>(2)</enum><header>Application of section 2258B</header><text>A civil action brought under subsection (a) shall be subject to section 2258B.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H5FB342E12032465EA480C1C98801AAB0"><enum>(g)</enum><header>Encryption technologies</header>
<paragraph commented="no" display-inline="no-display-inline" id="H4F1EA4B3899243859F532112C1D594A7"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>None of the following actions or circumstances shall serve as an independent basis for liability under subsection (a):</text> <subparagraph commented="no" display-inline="no-display-inline" id="H7C117B2AEC8A4647A89A719EEE1C3448"><enum>(A)</enum><text display-inline="yes-display-inline">Utilizing full end-to-end encrypted messaging services, device encryption, or other encryption services.</text></subparagraph>
<subparagraph id="H00F9DE2DB788432F980F3E70A42FC22B"><enum>(B)</enum><text>Not possessing the information necessary to decrypt a communication.</text></subparagraph> <subparagraph id="H1644CECD0128441A9FB7405E8572609D"><enum>(C)</enum><text>Failing to take an action that would otherwise undermine the ability to offer full end-to-end encrypted messaging services, device encryption, or other encryption services.</text></subparagraph></paragraph>
<paragraph id="H2D7105FF6D404FE29F2DA76C92B92597" commented="no"><enum>(2)</enum><header>Consideration of evidence</header><text>Evidence of actions or circumstances described in paragraph (1) shall be admissible in a civil action brought under subsection (a) if—</text> <subparagraph id="H44E6EACAF48C43B0BD42B4C16E34620F" commented="no"><enum>(A)</enum><text>the actions or circumstances are relevant under rules 401 and 402 of the Federal Rules of Evidence to—</text>
<clause id="HB4479EA2927245DC9E921D0DB5094124" commented="no"><enum>(i)</enum><text>prove motive, intent, preparation, plan, absence of mistake, or lack of accident; or</text></clause> <clause id="H4329E19B90EE491DBE52D343D2F0176B" commented="no"><enum>(ii)</enum><text>rebut any evidence or factual or legal claim; and</text></clause></subparagraph>
<subparagraph id="HE2DDCC9EDB0B45AAA4B49D318B869784" commented="no"><enum>(B)</enum><text>the actions or circumstances—</text> <clause id="HA717EE56F562462ABBD8F29F8D4B106F" commented="no"><enum>(i)</enum><text>are otherwise admissible under the Federal Rules of Evidence; and</text></clause>
<clause id="HEE60471743E54C52863AEA487705B104" commented="no"><enum>(ii)</enum><text>are not subject to exclusion under rule 403 or any other rule of the Federal Rules of Evidence.</text></clause></subparagraph></paragraph> <paragraph id="HD3697A91EE5B457DA65D9A835B675701"><enum>(3)</enum><header>No effect on discovery</header><text>Nothing in paragraph (1) or (2) shall be construed to create a defense to a discovery request or otherwise limit or affect discovery in any civil action brought under subsection (a).</text></paragraph></subsection>
<subsection id="H5E3736DBEE43437DA6E851D1B156B16A"><enum>(h)</enum><header>Defense</header><text>In a civil action under subsection (a)(2) involving knowing or reckless conduct, it shall be a defense at trial, which the provider of an interactive computer service must establish by a preponderance of the evidence as determined by the finder of fact, that—</text> <paragraph id="HDC6EA4EE61754C22B582DB656CE31F81"><enum>(1)</enum><text>the provider disabled access to or removed the child pornography within a reasonable timeframe, and in any event not later than 48 hours after obtaining knowledge that the child pornography was being hosted, stored, or made available by the provider (or, in the case of a provider that, for the most recent calendar year, averaged fewer than 10,000,000 active users on a monthly basis in the United States, within a reasonable timeframe, and in any event not later than 2 business days after obtaining such knowledge);</text></paragraph>
<paragraph id="H9D74581B27E4448197CC348589560093"><enum>(2)</enum><text>the provider exercised a reasonable, good faith effort to disable access to or remove the child pornography but was unable to do so for reasons outside the provider’s control; or</text></paragraph> <paragraph id="H1590829313614F95823024D64114E2D2"><enum>(3)</enum><text>it is technologically impossible for the provider to disable access to or remove the child pornography without compromising encryption technologies.</text></paragraph></subsection>
<subsection id="H78E3A06D130B4277BA08388FDA88F9B4"><enum>(i)</enum><header>Sanctions for repeated bad faith civil actions or defenses</header>
<paragraph id="H9622C0345E2444DDA019FBEFDE1CDA1E"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text> <subparagraph id="HC92530404F7B4356BBD3C381914115DF"><enum>(A)</enum><header>Bad faith civil action</header><text>The term <term>bad faith civil action</term> means a civil action brought under subsection (a) in bad faith where the finder of fact determines that at the time the civil action was filed, the party, attorney, or law firm described in paragraph (2) had actual knowledge that—</text>
<clause id="H8E53A74A661B4D75AF575044A3932BCC"><enum>(i)</enum><text>the alleged conduct did not involve any minor; or</text></clause> <clause id="HAB15DAC93EEE43249DF0AFE91ADC013D"><enum>(ii)</enum><text>the alleged child pornography did not depict—</text>
<subclause id="HCCE385F4A057467B8E248AC02A7DDDFD"><enum>(I)</enum><text>any minor; or</text></subclause> <subclause id="H8A4955BE17254A2EB929870DF63EA084"><enum>(II)</enum><text>sexually explicit conduct, sexual suggestiveness, full or partial nudity, or implied sexual activity.</text></subclause></clause></subparagraph>
<subparagraph id="H01FCE02CD0A149EEA2FA39F04F838611"><enum>(B)</enum><header>Bad faith defense</header><text>The term <term>bad faith defense</term> means a defense in a civil action brought under subsection (a) raised in bad faith where the finder of fact determines that at the time the defense was raised, the party, attorney, or law firm described in paragraph (3) had actual knowledge that the defense—</text> <clause id="H52175534A2FC4077A67A453848AF2F3B"><enum>(i)</enum><text>was made solely for the purpose of delaying the civil action or increasing the costs of the civil action; or</text></clause>
<clause id="H6DF070D4795F4390B534D3040812F842"><enum>(ii)</enum><text>was objectively baseless in light of the applicable law or facts at issue.</text></clause></subparagraph></paragraph> <paragraph id="H6FC16BF3A5744297A9C243D0047B89A6"><enum>(2)</enum><header>Bad faith civil action</header><text>In the case of a civil action brought under subsection (a), the court may impose sanctions on—</text>
<subparagraph id="HE347E03CF4C6493BBAF44789D206AD19"><enum>(A)</enum><text>the party bringing the civil action if the court finds that the party has brought 2 or more bad faith civil actions (which may include the instant civil action); or</text></subparagraph> <subparagraph id="H537D3EB158FB41528FC08EC0EE6E64C7"><enum>(B)</enum><text>an attorney or law firm representing the party bringing the civil action if the court finds that the attorney or law firm has represented—</text>
<clause id="HE123ED34E6EB461FB5CCD1DCB0CD14EB"><enum>(i)</enum><text>a party who has brought 2 or more bad faith civil actions (which may include the instant civil action); or</text></clause> <clause id="H02AB70B29E244154B0DBB43B56B134FF"><enum>(ii)</enum><text>2 or more parties who have each brought a bad faith civil action (which may include the instant civil action).</text></clause></subparagraph></paragraph>
<paragraph id="H48DBE4F0382840378D374DC5270A6533"><enum>(3)</enum><header>Bad faith defense</header><text>In the case of a civil action brought under subsection (a), the court may impose sanctions on—</text> <subparagraph id="H18CCAF52057C4E168E0EF35178679AD2"><enum>(A)</enum><text>the party defending the civil action if the court finds that the party has raised 2 or more bad faith defenses (which may include 1 or more defenses raised in the instant civil action); or</text></subparagraph>
<subparagraph id="HE458D3CC1A0A48D185EF30A36AA955DF"><enum>(B)</enum><text>an attorney or law firm representing the party defending the civil action if the court finds that the attorney or law firm has represented—</text> <clause id="H722B488DBC6B4407A363C56A7FCB90A8"><enum>(i)</enum><text>a party who has raised 2 or more bad faith defenses (which may include 1 or more defenses raised in the instant civil action); or</text></clause>
<clause id="HF4CF8E0888A54EFD87114764CBD8B615"><enum>(ii)</enum><text>2 or more parties who have each raised a bad faith defense (which may include a defense raised in the instant civil action).</text></clause></subparagraph></paragraph> <paragraph id="H17DD3C374CEE4C14BDB6FAA93A848197"><enum>(4)</enum><header>Implementation</header><text>Rule 11(c) of the Federal Rules of Civil Procedure shall apply to sanctions imposed under this subsection in the same manner as that rule applies to sanctions imposed for a violation of rule 11(b) of those Rules.</text></paragraph>
<paragraph id="HCA3C307C56824489B56A2EA98D387BC2"><enum>(5)</enum><header>Rules of construction</header>
<subparagraph id="H6E843575FC754EA3A822D6EFB26BD1E8"><enum>(A)</enum><header>Rule 11</header><text>This subsection shall not be construed to limit or expand the application of rule 11 of the Federal Rules of Civil Procedure.</text></subparagraph> <subparagraph id="HEE2ED2D6ADAF40CDBAE09216FCFC4393" commented="no"><enum>(B)</enum><header>Definition change</header><text>Paragraph (1)(A)(ii) shall not be construed to apply to a civil action affected by a contemporaneous change in the law with respect to the definition of <quote>child pornography</quote>.</text></subparagraph></paragraph></subsection>
<subsection id="H0045203566E442778079C5AD6E08B3B2"><enum>(j)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HCD7604F3760E4AE088EC5CA15DF1831F"><enum>(1)</enum><header>App</header><text>The term <term>app</term> means a software application or electronic service that may be run or directed by a user on a computer, a mobile device, or any other general purpose computing device.</text></paragraph>
<paragraph id="H85C7F158D588433AAC0EA52548BCAA73"><enum>(2)</enum><header>App store</header><text>The term <term>app store</term> means a publicly available website, software application, or other electronic service that—</text> <subparagraph id="H75F4E18B842246178030F28566262161"><enum>(A)</enum><text>distributes apps from third-party developers to users of a computer, a mobile device, or any other general purpose computing device; and</text></subparagraph>
<subparagraph id="H8B74C98998A740269B75C4DE9FBEBE45"><enum>(B)</enum><text>operates—</text> <clause commented="no" display-inline="no-display-inline" id="HEDB993B692AD424FB588892A6B984DD7"><enum>(i)</enum><text display-inline="yes-display-inline">through the use of any means or facility of interstate or foreign commerce; or</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HE3B92E09570B4201879CF405CB8558AD"><enum>(ii)</enum><text display-inline="yes-display-inline">in or affecting interstate or foreign commerce.</text></clause></subparagraph></paragraph> <paragraph id="H906AFDB89081487981A5384BFC6A68BA"><enum>(3)</enum><header>Interactive computer service</header><text>The term <term>interactive computer service</term> means an interactive computer service, as defined in section 230(f) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)</external-xref>), that operates—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HE5F4496FA6854745A75336A927D9128B"><enum>(A)</enum><text display-inline="yes-display-inline">through the use of any means or facility of interstate or foreign commerce; or</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H228F268791F54ADDACBBF38A1223E5DE"><enum>(B)</enum><text display-inline="yes-display-inline">in or affecting interstate or foreign commerce.</text></subparagraph></paragraph></subsection>
<subsection id="H1303A3403925490EBF26020BB44E3EA7"><enum>(k)</enum><header>Savings clause</header><text>Nothing in this section, including the defenses under this section, shall be construed to apply to any civil action brought under any other Federal law, rule, or regulation, including any civil action brought against a provider of an interactive computer service or an app store under section 1595 or 2255.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H153B02BB124F4AC78ACE63FE51257AE8"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">chapter 110</external-xref> of title 18, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/18/2255">section 2255</external-xref> the following:</text>

<section id="H4D2BD20E76A6474D8544F8BAC02F828E"><enum>6.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, an amendment made by this Act, or the application of such provision or amendment to any person or circumstance is held to be unconstitutional, the remainder of this Act and the amendments made by this Act, and the application of the provision or amendment to any other person or circumstance, shall not be affected.</text></section> <section id="H5F4C2DEF64474593B667DD19CAB3E048"><enum>7.</enum><header>Continued applicability of Federal, State, and Tribal law</header> <subsection id="H9AEB3565BC4D4FF19797B79DD680BCA4"><enum>(a)</enum><header>Federal law</header><text>Nothing in this Act or the amendments made by this Act, nor any rule or regulation issued pursuant to this Act or the amendments made by this Act, shall affect or diminish any right or remedy for a victim of child pornography or child sexual exploitation under any other Federal law, rule, or regulation, including any claim under section 2255 of title 18, United States Code, with respect to any individual or entity.</text></subsection>
<subsection id="H7FEFB0C90E7842E1874B76B043ADE0F4"><enum>(b)</enum><header>State or Tribal law</header><text>Nothing in this Act or the amendments made by this Act, nor any rule or regulation issued pursuant to this Act or the amendments made by this Act, shall—</text> <paragraph id="H7EAA102599AA4FACA51A6211E4522216"><enum>(1)</enum><text>preempt, diminish, or supplant any right or remedy for a victim of child pornography or child sexual exploitation under any State or Tribal common or statutory law; or</text></paragraph>
<paragraph id="H9F9D1166683A431E9439998D5B60B344"><enum>(2)</enum><text>prohibit the enforcement of a law governing child pornography or child sexual exploitation that is at least as protective of the rights of a victim as this Act and the amendments made by this Act.</text></paragraph></subsection></section> </legis-body></bill>
