<section id="HF4C1309C85B545D892A0059B8B9C6D03" section-type="section-one"><enum>1.</enum><header>Smoke and carbon monoxide detectors required</header> 
<subsection id="HB8D73BA9D6E34C498B33DACE09B21077"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">No person may rent or offer for rent, or facilitate the rental of, a short-term rental unless such short-term rental is equipped with a smoke detector and a carbon monoxide detector.</text></subsection> <subsection id="HE35BF93FB4134CECA139B5C2ECD16CC4" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Regulations</header><text>The Federal Trade Commission may promulgate, in accordance with section 553 of title 5, United States Code, such regulations as may be necessary to carry out this section.</text> </subsection> 
<subsection id="H26A77ED214C84AD9A902C7288B6FF897" display-inline="no-display-inline"><enum>(c)</enum><header>Enforcement by Federal Trade Commission</header> 
<paragraph id="H73B7C417367C4F98A3074717A0FE66C7"><enum>(1)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of this section or a regulation promulgated under this section shall be treated as a violation of a regulation under section 18(a)(1)(B) of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>) regarding unfair or deceptive acts or practices.</text></paragraph> <paragraph id="H3080508CE78E4760845763D1D0EE3A0D"><enum>(2)</enum><header>Powers of Commission</header><text display-inline="yes-display-inline">The Federal Trade Commission shall enforce this section and the regulations promulgated under this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this section. Any person who violates this section or a regulation promulgated under this section shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act.</text> </paragraph></subsection> 
<subsection id="H6C11764AAB2D4ED994FCEFB08FB89F95" display-inline="no-display-inline"><enum>(d)</enum><header>Effective date</header><text>Subsection (a) shall take effect on the date that is 1 year after the date of the enactment of this Act.</text></subsection> <subsection id="H04CCCDE0B52A4EDA98B8385125EE0D0A"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H2594B86927A1404BA1D9400646F22AA5"><enum>(1)</enum><header>Covered services</header><text>The term <quote>covered services</quote>—</text> <subparagraph id="HAE41147585604E33BD4B12D4106E55BA"><enum>(A)</enum><text>means the temporary provision of a room, building, or other lodging facility; and</text></subparagraph> 
<subparagraph id="HEBE4A723E71D4FB3BEAA786F778F0A89"><enum>(B)</enum><text>does not include the provision of a meeting room, banquet services, or catering services.</text></subparagraph></paragraph> <paragraph id="HD16A13EA53374984B0C790CA3708E7A5"><enum>(2)</enum><header>Short-term rental</header><text>The term <quote>short-term rental</quote> means a property, including a single-family dwelling or a unit in a condominium, cooperative, or time-share, that provides covered services (either with respect to the entire property or a part of the property)—</text> 
<subparagraph id="HFED693BED3E542DA8B5C40BFEB4C239E"><enum>(A)</enum><text>to the general public;</text> </subparagraph> <subparagraph id="HA9EDAA5B77254145808A2635960A74E9"><enum>(B)</enum><text>in exchange for a fee;</text></subparagraph> 
<subparagraph id="H3A9F5DFAA79B4DD098A5D4866BAB7D6C"><enum>(C)</enum><text>for periods shorter than 30 consecutive days; and</text></subparagraph> <subparagraph id="H510625075EFA40CC8FF9D60FB7B7E020"><enum>(D)</enum><text>promoted, advertised, or marketed in interstate commerce or sold in interstate commerce.</text> </subparagraph></paragraph> </subsection></section>
