<section id="H93100393888542D38F9D05F9E6778818" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Valor Has No Expiration Act</short-title></quote>.</text></section> <section id="HE8258099E1E04B48B4ADD35289346B70"><enum>2.</enum><header>Review of requests for decorations not timely awarded to members of certain Armed Forces serving on active duty because relevant records were classified or otherwise restricted</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/57">Chapter 57</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/1130">section 1130</external-xref> the following new section:</text>

<section id="H8176A154D16C4D59869FF2D622CFE0D6" section-type="subsequent-section"><enum>1130a.</enum><header>Consideration of proposals for certain decorations not previously submitted in timely fashion because relevant records were classified or otherwise restricted</header> 
<subsection id="H058C8D51CA59470B8204F90349C774D6" display-inline="no-display-inline"><enum>(a)</enum><header>Waiver of time limitations</header><text display-inline="yes-display-inline">Notwithstanding section 1130 of this title, a decoration (including any device in lieu of a decoration), authorized by law or under the regulations of the Department of Defense or the military department concerned, may be awarded, without regard to any time limitation imposed by law or regulation for a recommendation for such award—</text> <paragraph id="HF732ADDA4C77464A929D331FCF43DE7F"><enum>(1)</enum><text>to any person for service—</text> 
<subparagraph id="H22B19271CB3D4D168CC0799EAAF4BA6B"><enum>(A)</enum><text display-inline="yes-display-inline">while on active duty in the Army, Navy, Marine Corps, Air Force, or Space Force;</text></subparagraph> <subparagraph id="H2CF93870078948D19B9DA4B4A989C4E8"><enum>(B)</enum><text>during the period beginning on January 1, 1940; and</text></subparagraph> 
<subparagraph id="H1327F84EC89A41B689CD25742657B218"><enum>(C)</enum><text>the records of which were classified, withheld from the public record due to sensitivity, or redacted for national security purposes; and</text></subparagraph></paragraph> <paragraph id="HE456D550F65E4FC2B0DB7DA4D86B78EF"><enum>(2)</enum><text display-inline="yes-display-inline">based on a request for consideration of such award received by the Secretary of a military department.</text> </paragraph></subsection> 
<subsection id="HE7DCB8FAF22341AD9E09729E31272478"><enum>(b)</enum><header>Review of requests</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary of a military department—</text> <paragraph id="HEA19D74B397C401CAB2B746F5C645426" display-inline="no-display-inline"><enum>(1)</enum><text>shall—</text> 
<subparagraph id="H85146200B8794BD9B5B3F63D57A0E562"><enum>(A)</enum><text display-inline="yes-display-inline">begin a review of a request under subsection (a)(2) not later than 30 days after the Secretary receives such request; and</text></subparagraph> <subparagraph id="H08F3C82254834673A326689AAB9A5688"><enum>(B)</enum><text>complete such a review not later than one year after the date of such receipt; and</text></subparagraph></paragraph> 
<paragraph id="HDA5C23B462CB469EA8C2AB21077EA835"><enum>(2)</enum><text display-inline="yes-display-inline">may use the process under subsections (b) and (c) of section 1130 of this title to carry out such a review.</text></paragraph></subsection> <subsection id="H14CD4455A1BF436DB71AB691533AAB4B"><enum>(c)</enum><header>Rules of construction</header> <paragraph id="HF76A7EB9CD0C49E6A6D9E2F7F99895AF" display-inline="yes-display-inline"><enum>(1)</enum><text>The failure of the Secretary of a military department to complete the review of a request under subsection (a)(2) within the time limitations under subsection (b) shall not be construed to limit the authority to award a decoration under this section.</text></paragraph> 
<paragraph id="H27AEAC7039C0453E848CF2D157F4AEA8" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In the case of a decoration the President may award, the recommendation of the Secretary of the military department concerned to not award such decoration shall not be construed to prohibit the President from awarding such decoration.</text></paragraph></subsection> <subsection id="HF99B3CA612724BADB94CF050FDAD7A0F"><enum>(d)</enum><header>Reports</header> <paragraph id="H15B9C4ECBB3A47109639B447AF8FCE79" display-inline="yes-display-inline"><enum>(1)</enum> <subparagraph id="HFD6D5230461E4054B98CD3C95A911396" display-inline="yes-display-inline"><enum>(A)</enum><text>Not later than 30 days after completing the review of a request under subsection (b), the Secretary of a military department shall submit to the Committees on Armed Services of the Senate and House of Representatives a report regarding such review.</text></subparagraph> 
<subparagraph id="H667E4FA1D69B4140BEEA853D97474AF8" indent="up2"><enum>(B)</enum><text>In the case of a review of a request for a decoration the President may award, the Secretary of the military department concerned shall, subject to subparagraph (C), also submit such report to the President.</text></subparagraph> <subparagraph id="H3DDB3367BD12492FBB80C62997F571BD" indent="up2"><enum>(C)</enum><text display-inline="yes-display-inline">In the case of a review of a request for a Medal of Honor, the Secretary of Defense shall submit the report under this paragraph.</text></subparagraph></paragraph> 
<paragraph id="H7797AB95D764406E9BE96E7C7BE940E6" indent="up1"><enum>(2)</enum><text>Such a report shall include, with respect to the request reviewed, the following elements:</text> <subparagraph id="HD7C1C6C51D554F5F84D44196F873399E"><enum>(A)</enum><text>A summary of the request.</text></subparagraph>
<subparagraph id="HCF68B65006784DD7BF6CB13D4F53C399"><enum>(B)</enum><text>The findings of the review.</text></subparagraph> <subparagraph id="H6227F6E3E05D47918AC9700A3C680EEB"><enum>(C)</enum><text display-inline="yes-display-inline">The final action or recommendation of the submitting Secretary regarding such request.</text></subparagraph>
<subparagraph id="H382F6BA5FA2E456995C11F46FA4946C5"><enum>(D)</enum><text display-inline="yes-display-inline">Any recommendation of the submitting Secretary to improve award procedures with respect to military intelligence personnel.</text></subparagraph></paragraph> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body></bill>
