<subsection id="HB9D04F8BA33C4B36AF620C12D66E37A1"><enum>(a)</enum><header>State water quality standards</header><text display-inline="yes-display-inline">Section 303(c) (<external-xref legal-doc="usc" parsable-cite="usc/33/1313">33 U.S.C. 1313(c)</external-xref>) of the Federal Water Pollution Control Act is amended—</text> <paragraph id="H1400088F244747ABB857B4E66F48A231"><enum>(1)</enum><text>in paragraph (1)—</text> 
<subparagraph id="HD86A7FA11972447FB39BD36630730B17"><enum>(A)</enum><text>by striking <quote>The Governor of a State</quote> and inserting <quote><header-in-text level="subparagraph" style="OLC"><enum-in-header>(A)</enum-in-header></header-in-text> The Governor of a State</quote>; and</text></subparagraph> <subparagraph id="H0CEE0665866A428D8281D5A1C2152AB0"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>Results of such review shall be made available to the Administrator.</quote> and inserting the following:</text> 
<quoted-block style="OLC" id="HED61607B7AC749309884E06361AC95E1" display-inline="no-display-inline"> 
<subparagraph id="HBF12869A19FA499499DA0C34FAA4EC67" indent="up2"><enum>(B)</enum><text display-inline="yes-display-inline">Reviews under this paragraph shall include review, for purposes of ensuring that combined sewer overflow controls are cost effective, of any water quality standard applicable to a body of water into which, pursuant to a permit, order, or decree issued pursuant to this Act, a municipal combined storm and sanitary sewer discharges.</text></subparagraph> <subparagraph id="H482823DD52104285BC0D7D4CECAD50FB" indent="up2"><enum>(C)</enum><text>Results of each review under this paragraph shall be made available to the Administrator.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H0D368D2E5B984653B61EC210BF4BEC34"><enum>(2)</enum><text>in paragraph (2)(A)—</text> <subparagraph id="H655B1B6D38EA420383D873BCEA13C525"><enum>(A)</enum><text>by inserting <quote><header-in-text level="clause" style="OLC"><enum-in-header>(i)</enum-in-header></header-in-text></quote> before <quote>their use and value for public water supplies</quote>;</text></subparagraph> 
<subparagraph id="H123313AA29924D1DB7AD5FDAE53DE8EF"><enum>(B)</enum><text>by striking <quote>, and also taking into consideration</quote> and inserting <quote>; <header-in-text level="clause" style="OLC"><enum-in-header>(ii)</enum-in-header></header-in-text></quote>; and</text></subparagraph> <subparagraph id="H72A14826653F45D09713CC3F8B645D1C" commented="no"><enum>(C)</enum><text>by inserting before the period at the end the following: <quote>; and <header-in-text level="clause" style="OLC"><enum-in-header>(iii)</enum-in-header></header-in-text> the cost and commercial availability in the United States of treatment technologies (including whether the technologies have been demonstrated at an applicable scale) that may be required to be applied to point sources in order to result in compliance with such standards</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H88CE5F03EA414314A079C89C8A57C052" commented="no"><enum>(b)</enum><header>State water quality criteria</header><text>Section 304(a) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1314">33 U.S.C. 1314(a)</external-xref>) is amended by adding at the end the following new paragraph:</text> <quoted-block style="OLC" id="HF21F038F12AE4E64A3585ABE6BBBD4B1" display-inline="no-display-inline"> <paragraph id="HE931EA17DFA64C9EA78814A39EFB32F4" commented="no"><enum>(10)</enum><header>Consideration of treatment technologies</header><text display-inline="yes-display-inline">In developing or revising water quality criteria under this subsection, the Administrator shall take into consideration the cost and commercial availability in the United States of treatment technologies (including whether the technologies have been demonstrated at an applicable scale) that may be required to be applied to point sources in order to result in compliance with water quality standards adopted or promulgated under section 303.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HCE00F9C2E18E45BCBE4F7503F7F05533"><enum>3.</enum><header>Water quality criteria development and transparency</header> 
<subsection id="H538A7A9B910A48D4B5A21D5C835BB614" commented="no"><enum>(a)</enum><header>Information and guidelines</header><text>Section 304(a) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1314">33 U.S.C. 1314(a)</external-xref>) is further amended by adding at the end the following:</text> <quoted-block id="H938776D552644B578FFBFCD78D24C01B" style="OLC"> <paragraph id="H0B0FD1284A2748A8BE8BCEDEAA8BA078" commented="no"><enum>(11)</enum><header>Administrative procedure</header><text>After the date of enactment of this paragraph, the Administrator shall issue any new or revised water quality criteria under paragraph (1) or (9) by rule.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H9D1480A535E741ABB4E547F028424124"><enum>(b)</enum><header>Administrative procedure and judicial review</header><text>Section 509(b)(1) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1369">33 U.S.C. 1369(b)(1)</external-xref>) is amended—</text> <paragraph id="H62728D3544A943D09B47CD4264F1C9A6"><enum>(1)</enum><text>by striking <quote>section 402, and</quote> and inserting <quote>section 402,</quote>; and</text></paragraph> 
<paragraph id="H080F3FB078A846F3AB2103AFE89A5295"><enum>(2)</enum><text>by inserting <quote>and (H) in issuing any criteria for water quality pursuant to section 304(a)(11),</quote> after <quote>strategy under section 304(l),</quote>.</text></paragraph></subsection></section> <section id="HC93696137B0740CAAEB184F7B3C38448"><enum>4.</enum><header>Water quality technology availability</header><text display-inline="no-display-inline">Section 304(b) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1314">33 U.S.C. 1314(b)</external-xref>) is amended—</text> 
<paragraph id="H930F99A3213A4E13A5238A814A52F080"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)(B), by inserting <quote>the commercial availability in the United States of the technology (including whether the technology has been demonstrated at an applicable scale),</quote> before <quote>and such other factors</quote>;</text></paragraph> <paragraph id="H8DA60352F2924BFAA7EE5A074967DD87"><enum>(2)</enum><text>in paragraph (2)(B), by inserting <quote>the commercial availability in the United States of the technology (including whether the technology has been demonstrated at an applicable scale),</quote> before <quote>and such other factors</quote>; and</text></paragraph> 
<paragraph id="HE188069AFB634509BD95BB8EE68F5BBB"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (4)(B), by inserting <quote>the commercial availability in the United States of the technology (including whether the technology has been demonstrated at an applicable scale),</quote> before <quote>and such other factors</quote>.</text></paragraph></section> <section id="HD74B9D8AD0564B46A974D88FB3E57982"><enum>5.</enum><header>Improving water quality certifications and American energy infrastructure</header><text display-inline="no-display-inline">Section 401 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1341">33 U.S.C. 1341</external-xref>) is amended—</text> 
<paragraph id="H05E0616E72D447CA96B5F3395FF7A818"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="H71A02EB8DDA44B65A41FCD39A9756862"><enum>(A)</enum><text>in paragraph (1)—</text> 
<clause id="H070A91DCC7C64522B9C7B99A4D28C0F1"><enum>(i)</enum><text>in the first sentence, by striking <quote>may result</quote> and inserting <quote>may directly result</quote>;</text></clause> <clause id="H635BB0C0785B453B8EA0B581477DBAA7"><enum>(ii)</enum><text>in the second sentence, by striking <quote>activity</quote> and inserting <quote>discharge</quote>;</text></clause> 
<clause id="HBD115B1F386E49C39399BA8B088DD27C"><enum>(iii)</enum><text>in the third sentence, by striking <quote>applications</quote> each place it appears and inserting <quote>requests</quote>;</text></clause> <clause id="H077C14A7D5474532857E9A9793321EC8" commented="no"><enum>(iv)</enum><text>in the fifth sentence, by striking <quote>act on a request for certification, within a reasonable period of time (which shall not exceed one year) after receipt of such request, the certification requirements of this subsection</quote> and inserting <quote>grant the request for certification with or without conditions, deny the request for certification, or waive the requirement for certification under this subsection with respect to such Federal application, within a reasonable period of time to be determined by the licensing or permitting agency (which shall not exceed one year) after receipt of such request, the requirement for certification under this subsection</quote>;</text></clause> 
<clause id="H651CDEEEB42244E283949075F40B11ED"><enum>(v)</enum><text>in the sixth sentence, by striking <quote>waived as provided in the preceding sentence</quote> and inserting <quote>waived under this paragraph</quote>; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="H019335A0789E415BB7A34D36901E272C"><enum>(vi)</enum><text display-inline="yes-display-inline">by inserting after the fourth sentence the following: <quote>Not later than 30 days after the date of enactment of the <short-title>PERMIT Act</short-title>, each State and interstate agency that has authority to give such a certification, and the Administrator, shall publish requirements for certification to demonstrate to such State, such interstate agency, or the Administrator, as the case may be, compliance with the applicable provisions of sections 301, 302, 303, 306, and 307. A decision to grant or deny a request for certification shall be based only on compliance with the applicable provisions of sections 301, 302, 303, 306, and 307, and the grounds for the decision shall be set forth in writing and provided to the applicant. Not later than 90 days after receipt of a request for certification, the State, interstate agency, or Administrator, as the case may be, shall identify in writing all specific additional materials or information necessary for the request for certification to be complete, as described in subsection (g). The State, interstate agency, or the Administrator, as the case may be, may grant a request for certification with or without conditions, deny a request for certification, or waive the requirement for certification under this subsection with respect to such Federal application.</quote>;</text></clause></subparagraph> 
<subparagraph id="H4FD8C7813B3F4E0A92A19667E79D0E97" commented="no"><enum>(B)</enum><text>in paragraph (2)—</text> <clause id="HEA92ACDB09FC418CB430E7AE6FDF5818" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">in the second sentence, by striking <quote>notice of application for such Federal license or permit</quote> and inserting <quote>receipt of a notice under the preceding sentence</quote>;</text></clause> 
<clause id="H991ACC98383C48529B6943F4B9DB062B"><enum>(ii)</enum><text display-inline="yes-display-inline">in the third sentence—</text> <subclause id="H2FF028274D9A490EA088319B6513CBA4"><enum>(I)</enum><text>by striking <quote>any water quality requirement in such State</quote> and inserting <quote>any water quality standard in effect for the State under section 303</quote>; and </text></subclause> 
<subclause id="H01860AC1D7ED4DB6BC98628C8E93BD20"><enum>(II)</enum><text>by inserting before the period <quote>at a time that is agreed to by such State and the applicant</quote>;</text></subclause></clause> <clause id="HA0069F6FF173451DAA2345C743C50011" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">in the fifth sentence, by striking <quote>insure compliance with applicable water quality requirements.</quote> and inserting <quote>ensure compliance with the applicable provisions of sections 301, 302, 303, 306, and 307.</quote>;</text></clause> 
<clause id="HC97E1307065B4BBFA35FB4F03F2DDE38" commented="no"><enum>(iv)</enum><text>in the final sentence, by striking <quote>insure</quote> and inserting <quote>ensure</quote>;</text></clause> <clause commented="no" display-inline="no-display-inline" id="H25F8745C7DC746ABBF48C3AA891522AF"><enum>(v)</enum><text display-inline="yes-display-inline">by striking the first sentence and inserting <quote>On receipt of a request for certification, the certifying State or interstate agency, as applicable, shall immediately notify the Administrator of the request.</quote>; and</text></clause> 
<clause id="HB306A22671B54F84906E3F5B5D32513A" commented="no"><enum>(vi)</enum><text>by inserting after the second sentence the following: <quote>If the Administrator determines under the preceding sentence that such a discharge will not affect the waters of any other State, no such notification is required.</quote>;</text></clause></subparagraph> <subparagraph id="H177C7F0650134D549DBB7667F4161076" commented="no"><enum>(C)</enum><text>in paragraph (3)—</text> 
<clause id="H7D5B32024A0F43EE8B2A6BBEF284E78E" commented="no"><enum>(i)</enum><text>in the first sentence, by striking <quote>there will be compliance</quote> and inserting <quote>any such discharge will comply</quote>; and </text></clause> <clause id="HE0ED1FC62FA5449CAE476721819054CB" commented="no"><enum>(ii)</enum><text>in the second sentence, by striking <quote>section</quote> and inserting <quote>any applicable provision of section</quote>;</text></clause></subparagraph>

<clause id="H78C456217CC04B3F8A161E6513217462" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">in the second sentence, by striking <quote>will violate applicable effluent limitations or other limitations or other water quality requirements</quote> and inserting <quote>will directly result in a discharge that violates an applicable provision of section 301, 302, 303, 306, or 307,</quote>; and</text></clause> <clause id="H9F0CAB953EB140BD9F333223194C7D91" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">in the third sentence, by striking <quote>such facility or activity will not violate the applicable provisions</quote> and inserting <quote>operation of such facility or activity will not directly result in a discharge that violates any applicable provision</quote>; and</text></clause></subparagraph>

<paragraph id="HA984F41750FF432A8C3271D2632EB4B6" commented="no"><enum>(3)</enum><text>in subsection (d), by striking <quote>applicant for a Federal license or permit will comply with any applicable effluent limitations and other limitations, under section 301 or 302 of this Act, standard of performance under section 306 of this Act, or prohibition, effluent standard, or pretreatment standard under section 307 of this Act, and with any other appropriate requirement of State law set forth in such certification, and shall become a condition on any Federal license or permit subject to the provisions of this section</quote> and inserting <quote>discharge subject to this section will comply with the applicable provisions of sections 301, 302, 303, 306, and 307, and any such limitations or requirements shall be imposed by the licensing or permitting agency as a condition on any Federal license or permit subject to the provisions of this section</quote>; and</text></paragraph> <paragraph id="HF47FB9DE0F1C4E41A879E67D3D0601AA" commented="no"><enum>(4)</enum><text>by adding at the end the following:</text>

<subsection id="H6A19E75122CE4517A9B2890AF91CF1AE" commented="no"><enum>(e)</enum><text>Notwithstanding section 505, any condition imposed on a Federal license or permit by a licensing or permitting agency under this section may be enforced only by such licensing or permitting agency.</text></subsection> <subsection id="H204F0165D20B45119D327177483BACB3" commented="no"><enum>(f)</enum><text display-inline="yes-display-inline">For purposes of this section, the applicable provisions of sections 301, 302, 303, 306, and 307 are any applicable effluent limitations and other limitations under section 301 or 302, any water quality standard in effect for a State under section 303, any standard of performance under section 306, and any prohibition, effluent standard, or pretreatment standard under section 307. </text></subsection> 
<subsection id="H1CC12AD070ED4A8CBEFB9EDCC6022AD0" commented="no"><enum>(g)</enum><text display-inline="yes-display-inline">A request for certification under this section shall be made in writing to the State, interstate agency, or Administrator, as the case may be. A complete request for certification shall consist of the following:</text> <paragraph id="HBB9C17BE246F4122A8476CD7F4C48B70" commented="no"><enum>(1)</enum><text>Identification of each applicant for the Federal license or permit with respect to which the certification is requested.</text></paragraph> 
<paragraph id="HFD43F127EC844F11BAFE27D091298A62" commented="no"><enum>(2)</enum><text>A statement that information included in the request for certification is truthful, accurate, and complete, to the best knowledge of each such applicant.</text></paragraph> <paragraph id="H7ACE86FE6C4C4494999861E82712CF3D" commented="no"><enum>(3)</enum><text>In the case of a request for certification with respect to an individual permit or license—</text> 
<subparagraph id="HA6FB976F2C064618825D9537E1E03DAC" commented="no"><enum>(A)</enum><text>identification of the Federal license or permit that is the subject of the application with respect to which the certification is requested;</text></subparagraph> <subparagraph id="H875C513960E34259BEE432404999C8E0" commented="no"><enum>(B)</enum><text>identification of any activity the conduct of which is subject to such Federal license or permit;</text></subparagraph> 
<subparagraph id="H4A19F18CC4274449BD3E0CE2B33D3F4F" commented="no"><enum>(C)</enum><text>identification of the location and nature of any discharge that may directly result from such activity, and the location of the receiving waters;</text></subparagraph> <subparagraph id="HBC28E8DF12A444BCBDD513659BFBD2AB" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">a description of means that may be used to monitor, control, or manage any such discharge; and</text></subparagraph> 
<subparagraph id="H4B7C8608E3A7497CBFD54D2FE2F1E54E" commented="no"><enum>(E)</enum><text>a list of all other Federal, interstate, Tribal, State, or local agency authorizations required for the conduct of such activity, and any approval or denial of such an authorization already received.</text></subparagraph></paragraph> <paragraph id="HD5CA5CABA95640B4B1EDDA6CDF9E11A9" commented="no"><enum>(4)</enum><text>In the case of a request for certification with respect to the issuance of a general license or general permit—</text> 
<subparagraph id="H9B1BF70B1C9B498B805AD6D92D4A65BD" commented="no"><enum>(A)</enum><text>identification of the proposed categories of activities to be covered by the general license or general permit for which certification is requested;</text></subparagraph> <subparagraph id="H8B762DC46144448BB445B91FDB3C6E21" commented="no"><enum>(B)</enum><text>a description of the proposed general license or general permit, which may include a draft of the proposed general license or permit; and</text></subparagraph> 
<subparagraph id="H77DF8EEA6CCE45B1A75E244D45C5CB8E" commented="no"><enum>(C)</enum><text>an estimate of the number of discharges expected to result from the proposed general license or general permit annually.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="HF38769CF71A64F52BC1BC2040C896444"><enum>6.</enum><header>Clarifying Federal general permits</header><text display-inline="no-display-inline">Section 402(a) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342(a)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="HA51DA25376524BA0B3DFDB55CB3F973D" display-inline="no-display-inline"> 
<paragraph id="H36CCA44CC43841B5B0EB015FCE9F54F5"><enum>(6)</enum><header>General permits</header> 
<subparagraph id="HDFE4C1D1F3574EE685E85157F5FE6552"><enum>(A)</enum><header>Permits authorized</header><text display-inline="yes-display-inline">The Administrator may issue general permits under this section on a State, regional, or nationwide basis, or for a delineated area, for discharges associated with any category of activities, which discharges are of similar types and from similar sources.</text></subparagraph> <subparagraph id="H9ECD73DED996442D919BD5C228BF38CB"><enum>(B)</enum><header>Permit expiration notification requirement</header><text display-inline="yes-display-inline">If a general permit issued under this section will expire and the Administrator decides not to issue a new general permit for discharges similar to those covered by the expiring general permit, the Administrator shall publish in the Federal Register a notice of such decision at least two years prior to the expiration of the general permit.</text></subparagraph> 
<subparagraph id="H47C518277867472DA0FBDB209AB6DFAB"><enum>(C)</enum><header>Application of permit terms of an expired permit</header> 
<clause id="H479726A115B548F5A0BB5138F4A49FE6"><enum>(i)</enum><header>In general</header><text>If a general permit issued under this section expires and the Administrator has not published a notice in accordance with subparagraph (B), the Administrator shall, until the date described in clause (ii)—</text> <subclause id="HF87A993531674E448E3E1BF80DA323D6"><enum>(I)</enum><text>continue to apply the terms, conditions, and requirements of the expired general permit to any discharge that was covered by the expired general permit; and</text></subclause> 
<subclause id="H1D78FB8290A245068BAC22C20D054F45" commented="no"><enum>(II)</enum><text>apply such terms, conditions, and requirements to any discharge that would have been covered by the expired general permit (in accordance with any relevant requirements for such coverage) if the discharge had occurred before such expiration.</text></subclause></clause> <clause id="HD516098F399E4FDB94E759D4F2C1D93F"><enum>(ii)</enum><header>Date described</header><text>The date described in this clause is the earlier of—</text> 
<subclause id="H51E3152993F645D28B30385DF3E3FD66"><enum>(I)</enum><text display-inline="yes-display-inline">the date on which the Administrator issues a new general permit for discharges similar to those covered by the expired general permit; or</text></subclause> <subclause id="H307D1597F3E84FBCB39B41950C791604"><enum>(II)</enum><text display-inline="yes-display-inline">the date that is two years after the date on which the Administrator publishes in the Federal Register a notice of a decision not to issue a new general permit for discharges similar to those covered by the expired general permit.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HE985CDB761FE4DC4BCD44477CD4F41C6"><enum>7.</enum><header>NPDES permit terms</header><text display-inline="no-display-inline">Section 402(b)(1)(B) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342(b)(1)(B)</external-xref>) is amended by striking <quote>five years</quote> and inserting <quote>ten years</quote>. </text></section> <section id="HD898633A98964796AFFD5DD9B8D2C7D4"><enum>8.</enum><header>Confidence in clean water permits</header> <subsection id="H3FB8A4EB0320491EB018C4D1A87CC0C1"><enum>(a)</enum><header>Compliance with permits</header><text>Section 402(k) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342(k)</external-xref>) is amended—</text> 
<paragraph id="HFEA3E8BAD7004C6FBDD35E15346032D7"><enum>(1)</enum><text>by striking <quote>(k) Compliance with</quote> and inserting the following:</text> <quoted-block id="HC42FEC6E754640C388D62048EEF79F33" style="OLC"> <subsection id="H078A1C7F23F64AE9BAAFFBA38A203168"><enum>(k)</enum><header>Compliance with permits</header> <paragraph id="HB005F73E213E4A169AABEAFCA836CDC1"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), compliance with</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HBFD2E24B158E4E0CB63F094289F50837"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block id="H00A2225756B340FB9AEC2ECE818FEE9E" style="OLC"> <paragraph id="HC2CD34B611BC4A22BD701EEDA46B302E"><enum>(2)</enum><header>Scope</header><text>For purposes of paragraph (1), compliance with the conditions of a permit issued under this section shall be considered compliance with respect to a discharge of—</text> 
<subparagraph id="H75A004C57A9144FE98DCFB6B197BCEC7"><enum>(A)</enum><text>any pollutant for which an effluent limitation is included in the permit; and</text></subparagraph> <subparagraph id="HADFB8C898E1A401DAC82687E19C58745"><enum>(B)</enum><text>any pollutant for which an effluent limitation is not included in the permit that is—</text> 
<clause id="HAD8837153FAD41CB80852C5DE85084FC"><enum>(i)</enum><text>specifically identified as controlled or monitored through indicator parameters in the permit, the fact sheet for the permit, or the administrative record relating to the permit;</text></clause> <clause id="HCFD8C6EFBEEA4B3CB19D88EB14455988"><enum>(ii)</enum><text>specifically identified during the permit application process as present in discharges to which the permit will apply; or</text></clause> 
<clause id="H059C66F3F6AE47B2A3F57A880B0FA92D"><enum>(iii)</enum><text>whether or not specifically identified in the permit or during the permit application process—</text> <subclause id="H6E4033C2340C4C7ABE2AF20EF7DEB9FF"><enum>(I)</enum><text>present in any waste streams or processes of the point source to which the permit applies, which waste streams or processes are specifically identified during the permit application process; or</text></subclause> 
<subclause id="HD33445C114B34B929CE5A98723D2C90E"><enum>(II)</enum><text>otherwise within the scope of any operations of the point source to which the permit applies, which scope of operations is specifically identified during the permit application process.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HDC1DFAD215294B2092EF66B6009F0C99" commented="no"><enum>(b)</enum><header>Expression of water quality-Based effluent limitations</header><text>Section 402 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block id="HD27FBD9D919541E1BC34AD62544C3F50" style="OLC"> 
<subsection id="H35077F14DC6D4A9FB48AE46EA9C01943" commented="no"><enum>(t)</enum><header>Expression of water quality-Based effluent limitations</header><text display-inline="yes-display-inline">If the Administrator (or a State, in the case of a permit program approved by the Administrator) determines that a water quality-based limitation on a discharge of a pollutant is necessary to include in a permit under this section in addition to any appropriate technology-based effluent limitations included in such permit, the Administrator (or the State) may include such water quality-based limitation in such permit only in the form of a limitation that—</text> <paragraph id="HC80D8CA29B104164A1A8C4D20A101987" commented="no"><enum>(1)</enum><text>specifies the pollutant to which it applies; and</text></paragraph> 
<paragraph id="HEB66742C6DF04E82A68AEB46D1E179A6" commented="no"><enum>(2)</enum><text>clearly describes the manner in which compliance with the limitation may be achieved, which shall include—</text> <subparagraph id="H6BFAA8ECAE5C41B09AB6D6AB4B3DC297" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">a numerical limit on the discharge of such pollutant;</text></subparagraph> 
<subparagraph id="HEF508B3B89174C859E75A74B27A70793" commented="no"><enum>(B)</enum><text>a narrative description of required actions to be applied to the discharge (including any measures or practices required to be applied); or</text></subparagraph> <subparagraph id="H179B1DD9D8C84000A983954AA3C50F82"><enum>(C)</enum><text>a narrative description of a limitation on the discharge that specifies the level of control to be applied.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section section-type="subsequent-section" id="H7AA4DF3A0CBB4DD88F553D4C5EE0EC28"><enum>9.</enum><header>Forest protection and wildland firefighter safety</header><text display-inline="no-display-inline">Section 402(l)(3)(A) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342(l)(3)(A)</external-xref>) is amended—</text> <paragraph id="HBC56D3CD20094B6BAAC7EC85CF85A52B" display-inline="no-display-inline"><enum>(1)</enum><text>by striking <quote>for a discharge from</quote> and inserting the following:</text>

<paragraph id="H1FC8952295594823AEAFEC83AD2C7ACD"><enum>(2)</enum><text>in clause (i) (as so designated), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph> <paragraph id="HCD17F5055F114B2984F85F22618930E9"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HD0831F438E5E44EEAD44CA14A70671A5"> 
<clause id="HCE25DDDB6354421E92AD26AC8736981E"><enum>(ii)</enum><text display-inline="yes-display-inline">a discharge resulting from the aerial application of a product used for fire control and suppression purposes that appears on the most current Forest Service Qualified Products List (or any successor list).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H0BAE41E9A19841409782131AE3E9657F" section-type="subsequent-section"><enum>10.</enum><header>Agricultural stormwater discharge</header><text display-inline="no-display-inline">Section 402(l) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342(l)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H77F9B9F329D74291A5B121A1A7391D32" display-inline="no-display-inline"> 
<paragraph id="HB654B555729740B89529926F2C0F8441"><enum>(4)</enum><header>Agricultural stormwater discharge</header> 
<subparagraph id="H619B60B083144A6999E8433D9A3785E7"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall not require a permit, nor directly or indirectly require any State to require a permit, under this section for discharges of stormwater, including from subsurface drainage, from agricultural land that occur in direct response to a precipitation event. </text></subparagraph> <subparagraph id="HE5A2329E6D0E47C39B3815EAA8A60E61"><enum>(B)</enum><header>Agricultural land defined</header><text>In this paragraph, the term <term>agricultural land</term> includes—</text> 
<clause id="H3FFB851B037143D084122926B15C5E47"><enum>(i)</enum><text>land on which an agricultural input (such as manure and other crop nutrients, crop protection, or seed) is applied; </text></clause> <clause id="HDF9F83BABD2F47558C7048DAB35D544C"><enum>(ii)</enum><text display-inline="yes-display-inline">land on which animals (including fish and shellfish), crops (including fruit and nut trees), crop residue, plants, seed, or vegetation are present for purposes of farming or ranching; and</text></clause> 
<clause id="H17A0F1227297461D9AF7C731B3A580D8"><enum>(iii)</enum><text>land that is—</text> <subclause id="HF1E4A58CF46A41EEB43E59080CCDFBD5"><enum>(I)</enum><text>immediately adjacent to, and functionally related to, land described in clause (i) or (ii); and</text></subclause> 
<subclause id="HEC94AF6A379443EFBF791E6884DBD987"><enum>(II)</enum><text>necessary to support agricultural production, soil conservation, flood control, or water quality.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H60DA10CB92FB41878AFC285F771B09B6"><enum>11.</enum><header>Reducing regulatory burdens</header><text display-inline="no-display-inline">Section 402 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342</external-xref>) is further amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H04422659D71340DFB74A3B511BFBB56A" style="OLC"> 
<subsection id="H2F8BE3E48E2D4084A01BF08F15F59E6D" commented="no"><enum>(u)</enum><header>Discharges of pesticides</header> 
<paragraph id="H4539413DC1254CC7BEB54F87AB8E911F" commented="no"><enum>(1)</enum><header>No permit requirement</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), a permit shall not be required by the Administrator or a State under this Act for a discharge from a point source into navigable waters of a pesticide authorized for sale, distribution, or use under the Federal Insecticide, Fungicide, and Rodenticide Act, or the residue of such a pesticide, resulting from the application of such pesticide.</text></paragraph> <paragraph id="H08E243178E624007BAB68177A0E01392" commented="no"><enum>(2)</enum><header>Exceptions</header><text>Paragraph (1) shall not apply to the following discharges of a pesticide or pesticide residue:</text> 
<subparagraph id="H094699660EB043BEB529FABEDEB6D56B" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">A discharge resulting from the application of a pesticide in violation of a provision of the Federal Insecticide, Fungicide, and Rodenticide Act that is relevant to protecting water quality, if—</text> <clause id="H6B4FCF93684744958A6551F1F8625054" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">the discharge would not have occurred but for the violation; or</text></clause> 
<clause id="H39E52A12B0F24EF3A591BA7E2EAAC2C4" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">the amount of pesticide or pesticide residue in the discharge is greater than would have occurred without the violation.</text></clause></subparagraph> <subparagraph commented="no" id="H63072BA3DBAB4A839D90371BAE5A0C43"><enum>(B)</enum><text display-inline="yes-display-inline">Stormwater discharges subject to regulation under subsection (p).</text></subparagraph> 
<subparagraph commented="no" id="H22141B46ADD04976ADADE6DDD196450D"><enum>(C)</enum><text display-inline="yes-display-inline">The following discharges subject to regulation under this section:</text> <clause commented="no" id="HC9CA457E15ED4ABC962B9694729A6BC7"><enum>(i)</enum><text>Manufacturing or industrial effluent.</text></clause> 
<clause commented="no" id="H5BED47FE78DE41C28EFBDE44663145EF"><enum>(ii)</enum><text>Treatment works effluent.</text></clause> <clause commented="no" id="HB2B4FC2B9CC44965B9D11FEB0964EA03"><enum>(iii)</enum><text>Discharges incidental to the normal operation of a vessel, including a discharge resulting from ballasting operations or vessel biofouling prevention.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HF2272A6106E04A6CAC9A350C07F2DA83"><enum>12.</enum><header>Reducing permitting uncertainty</header> 
<subsection id="H1B10FAD337BD40EA9FF7A4A1512ABB12"><enum>(a)</enum><header>In general</header><text>Section 404(c) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344(c)</external-xref>) is amended—</text> <paragraph id="H76C0A343D04040B199D5D3CA6340BF6D"><enum>(1)</enum><text>by striking <quote>(c) The Administrator</quote> and inserting the following:</text>

<paragraph id="H2AA535CDEC2848DABAE06751B97A1549"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block id="H8F2C8017E1AC4B9D92EFA07496E58DBE" style="OLC"> <paragraph id="H9CC8380EE4D841538DEC35F796287929"><enum>(2)</enum><header>Period of prohibition</header><text>The period during which the Administrator may prohibit the specification (including the withdrawal of specification) of any defined area as a disposal site, or deny or restrict the use of any defined area for specification (including the withdrawal of specification) as a disposal site, under paragraph (1) shall—</text> 
<subparagraph id="H53B765856A0147848B6C19A41A61D4C9"><enum>(A)</enum><text>begin on the date on which an applicant submits all the information required to complete an application for a permit under this section; and</text></subparagraph> <subparagraph id="HBD673AA290B342A9AA7F6704D7C72171"><enum>(B)</enum><text>end on the date on which the Secretary issues the permit.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H8404759D6A364F6EAB2E1B2AACA0D36D"><enum>(b)</enum><header>Applicability</header><text>The amendments made by subsection (a) shall apply to a permit application submitted under section 404 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344</external-xref>) after the date of enactment of this Act.</text></subsection></section> <section id="H8994C039E8164012B233F9DB31004525"><enum>13.</enum><header>Nationwide permitting improvement</header> <subsection id="H7707EDE5F8CB457AA246B040679F7413"><enum>(a)</enum><header>In general</header><text>Section 404(e) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344</external-xref>) is amended—</text>

<paragraph id="H47C291989295428EAE0DAD20D97A91F5"><enum>(2)</enum><header>Term</header><text>No general</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H00100AFC529A4C35BCFBBBA47E840A46"><enum>(B)</enum><text>by striking <quote>five years</quote> and inserting <quote>ten years</quote>; and</text></subparagraph></paragraph> 
<paragraph id="HFA466FB6FC424FFE881F4FE3D3D1B5D9"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block id="HB407C93650524BC59D7B8A41C5BB78EC" style="OLC"> <paragraph id="HED7B4F730C194F7EA5E8F3A96139AAF6"><enum>(3)</enum><header>Considerations</header><text>In determining the environmental effects of an activity under paragraph (1) or (2), the Secretary—</text> 
<subparagraph id="HA6C165208D334E95A1F81D6A013D063E"><enum>(A)</enum><text>shall consider only the effects of any discharge of dredged or fill material resulting from such activity;</text></subparagraph> <subparagraph id="H5032570BADB84DF8B18925834FAFA25F" commented="no"><enum>(B)</enum><text>shall consider any effects of a discharge of dredged or fill material into less than 3 acres of navigable waters to be a minimal adverse environmental effect; and</text></subparagraph> 
<subparagraph id="H5B4F454773AC4258A4407EAE2DEE7E20" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">may consider any effects of a discharge of dredged or fill material into 3 acres or more of navigable waters to be a minimal adverse environmental effect.</text></subparagraph></paragraph> <paragraph id="HDBD7C9F511714719B2F8BE9D1831217A"><enum>(4)</enum><header>Nationwide permits for linear projects</header> <subparagraph id="H09D939B45F034B35A6B6375D31F0FF66"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of this section, the Secretary shall maintain general permits on a nationwide basis for—</text> 
<clause id="H3BFF3A6DF75C4C72A152B05C441F84C9"><enum>(i)</enum><text>linear infrastructure projects that result in a discharge of dredged or fill material into less than 3 acres of navigable waters for each single and complete project; and</text></clause> <clause id="HADA1E23228E843199E0D441E77D7F12C"><enum>(ii)</enum><text display-inline="yes-display-inline">linear pipeline projects that do not result in the loss of navigable waters in an amount that is greater than 0.5 acres for each single and complete project.</text></clause></subparagraph> 
<subparagraph id="H8EE2F0911A5F49F19BD8CF0E94F12F28"><enum>(B)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this paragraph:</text> <clause id="HBB8D003C7ED2425B8BBA131A6DC6969A"><enum>(i)</enum><header>Linear infrastructure project</header><text display-inline="yes-display-inline">The term <term>linear infrastructure project</term> means a project to carry out any activity required for the construction, expansion, maintenance, modification, or removal of infrastructure and associated facilities for the transmission from a point of origin to a terminal point of communications or electricity, or for the transportation from a point of origin to a terminal point of people, water, or wastewater.</text></clause> 
<clause id="H33B89D6F8F98410DBAFAA5623CADE8A2"><enum>(ii)</enum><header>Linear pipeline project</header><text display-inline="yes-display-inline">The term <term>linear pipeline project</term> means a project to carry out any activity required for the construction, expansion, maintenance, modification, or removal of infrastructure and associated facilities for the transportation from a point of origin to a terminal point of carbon dioxide, fuel, or hydrocarbons, in the form of a liquid, liquescent, gaseous, or slurry substance or supercritical fluid, including oil and gas pipeline facilities.</text></clause> <clause id="H179B14C42FD0489EAA38E4899A5243AC"><enum>(iii)</enum><header>Single and complete project</header><text>The term <term>single and complete project</term> has the meaning given that term in section 330.2 of title 33, Code of Federal Regulations (as in effect on the date of enactment of this paragraph).</text></clause></subparagraph></paragraph> 
<paragraph id="H0FDE9F5CBB4343C1AD6329E7C339FC76"><enum>(5)</enum><header>Reissuance of nationwide permits</header><text>In determining whether to reissue a general permit issued under this subsection on a nationwide basis—</text> <subparagraph id="H3A0CCE41C08141D2A1E6828F79A79A9C"><enum>(A)</enum><text>no consultation with an applicable State pursuant to section 6(a) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1535">16 U.S.C. 1535(a)</external-xref>) is required;</text></subparagraph> 
<subparagraph id="HEA30DB6FCFBE443481FE0A89BAD7B18F"><enum>(B)</enum><text>no consultation with a Federal agency pursuant to section 7(a)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536(a)(2)</external-xref>) is required; and</text></subparagraph> <subparagraph id="HF0C1ED574F7A4EFB98D9897B15BAD4B5"><enum>(C)</enum><text>the requirements of section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>) shall be satisfied by preparing an environmental assessment with respect to such general permit.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H6DAFA0ED63934820A631422F93E84605"><enum>(b)</enum><header>Regulatory revisions required</header><text display-inline="yes-display-inline">The Secretary of the Army, acting through the Chief of Engineers, shall expeditiously revise the regulations applicable to carrying out section 404(e) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344</external-xref>) in order to streamline the processes for issuing general permits under such section to promote efficient and consistent implementation of such section.</text></subsection> <subsection id="HB7135257D5D44B588057C2B5F85F4064"><enum>(c)</enum><header>Administration of nationwide permit program</header><text>In carrying out section 404(e) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344</external-xref>), including in revising regulations under subsection (b) of this section, the Secretary of the Army, acting through the Chief of Engineers, may not finalize or implement any modification to—</text> 
<paragraph id="H56CCFD212C5F48AA8BF2E535508BC647"><enum>(1)</enum><text>general condition 15 (relating to single and complete projects), as included in the final rule titled <quote>Reissuance and Modification of Nationwide Permits</quote> and published on January 13, 2021, by the Department of the Army, Corps of Engineers (86 Fed. Reg. 2868);</text></paragraph> <paragraph id="H1BDB214CE54F4F1692B396F837173BC4"><enum>(2)</enum><text>the definition of the term <term>single and complete linear project</term>, as included in such final rule (86 Fed. Reg. 2877); or</text></paragraph> 
<paragraph id="HB528F43FE7FA49D19F4C59C11F77BD14"><enum>(3)</enum><text>the definition of the term <term>single and complete project</term>, as included in section 330.2 of title 33, Code of Federal Regulations (as in effect on the date of enactment of this Act).</text></paragraph></subsection></section> <section id="H4353C62A5C294A6B8610F034B422C0FA"><enum>14.</enum><header>Deadline for request for submission of additional information for permit programs for dredged or fill material</header><text display-inline="no-display-inline">Section 404 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344</external-xref>) is amended—</text> 
<paragraph id="H3F6F97841041485B8CB9E27E676A8C73"><enum>(1)</enum><text>in subsection (g)—</text> <subparagraph id="H4F01B259ED6A4985A5CA41F6ABF2DA7D"><enum>(A)</enum><text>by redesignating paragraph (3) as paragraph (4); and</text></subparagraph> 
<subparagraph id="HC466C99A3EA649BC87E1BAC0A24AD38A"><enum>(B)</enum><text>by inserting after paragraph (2) the following:</text> <quoted-block style="OLC" id="H0CF7A5BB87FF4E64A1AEA8A0442F6B68" display-inline="no-display-inline"> <paragraph id="HE1D6A340504E44F4A09A38807E7FF3A4" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">If the Administrator determines that additional information is necessary for the description of a program submitted by a State to be full and complete under paragraph (1), the Administrator shall, not later than 45 days after the date of the receipt of the program and statement submitted by the State under such paragraph, submit to the State a written request for all such information.</text></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H7E62AC642DE6466FADFA347DF4E89366"><enum>(2)</enum><text>in subsection (h)(1), by striking <quote>paragraph (1) of this subsection</quote> and inserting <quote>subsection (g)(1)</quote>. </text></paragraph></section> <section id="H895D1F240EBA496FBDD2875A39D09DAD" commented="no"><enum>15.</enum><header>Judicial review timeline clarity</header><text display-inline="no-display-inline">Section 404 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344</external-xref>) is amended—</text> 
<paragraph id="HDCF635488AEC4AE3ABF9E8E404A867C0" commented="no"><enum>(1)</enum><text>by redesignating subsection (t) as subsection (u);</text></paragraph> <paragraph id="H107A3CB98E644BC5A2A522B441EAE9C2" commented="no"><enum>(2)</enum><text>in subsection (u), as so redesignated, by striking <quote>Nothing in the section</quote> and inserting <quote><header-in-text level="subsection" style="OLC">Savings provision.—</header-in-text>Nothing in this section</quote>; and</text></paragraph> 
<paragraph id="H724E1EFA1AB04CDF900147CA56F2E0AD" commented="no"><enum>(3)</enum><text>by inserting after subsection (s) the following:</text> <quoted-block id="HD3DBEC4BFEC64569A028A2A45FFE0E02" style="OLC"> <subsection id="H43B81B1D5D3D40699CEF9129C42C00A8" commented="no"><enum>(t)</enum><header>Judicial review</header> <paragraph id="H92D967DC81BA45AB99D8C3445C31B1A9" commented="no"><enum>(1)</enum><header>Statute of limitations</header><text>Notwithstanding any applicable provision of law relating to statutes of limitations—</text> 
<subparagraph id="HC3C66419BEC740B5A589C61309E5607D" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">an action seeking judicial review of the approval by the Administrator of a State permit program pursuant to this section shall be filed not later than the date that is 60 days after the date on which the approval was issued;</text></subparagraph> <subparagraph id="H274F9680F2E44B85814031D961108300" commented="no"><enum>(B)</enum><text>an action seeking judicial review of an individual permit or general permit issued under this section shall be filed not later than the date that is 60 days after the date on which the permit was issued; and</text></subparagraph> 
<subparagraph id="HE15237ECAB864074898F490713FD47E5" commented="no"><enum>(C)</enum><text>an action seeking judicial review of a verification that an activity involving a discharge of dredged or fill material is authorized by a general permit issued under this section shall be filed not later than the date that is 60 days after the date on which such verification was issued.</text></subparagraph></paragraph> <paragraph id="H3E91C11F0D6F48B49BE849DAF833A80A" commented="no"><enum>(2)</enum><header>Limitation on commencement of certain actions</header><text>Notwithstanding any other provision of law, no action described in subparagraph (A) or (B) of paragraph (1) may be commenced unless the action—</text> 
<subparagraph id="H17391BA1969C42A2927A4FA8EC265AFC" commented="no"><enum>(A)</enum><text>is filed by a party that submitted a comment—</text> <clause id="HEF2D587094144B88A906DEAA6D5C8B97" commented="no"><enum>(i)</enum><text>during the public comment period for the administrative proceedings related to the action; and</text></clause> 
<clause id="H6FD1AA99EDCA409791BC0CF75F51D3D1" commented="no"><enum>(ii)</enum><text>which was sufficiently detailed to put the Administrator, the Secretary, or the State, as applicable, on notice of the issue upon which the party seeks judicial review; and</text></clause></subparagraph> <subparagraph id="H52ADD26A14264BC9A5C188DDD2BE63A9" commented="no"><enum>(B)</enum><text>is related to such comment.</text></subparagraph></paragraph> 
<paragraph id="H74DEE751AC134787BBAF752BB376FE02" commented="no"><enum>(3)</enum><header>Remedies</header> 
<subparagraph id="H51A4C17ABC01446F93F5D2C2C879B521" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header>Actions relating to permit programs</header><text display-inline="yes-display-inline">If a court determines that the Administrator did not comply with the requirements of this section in issuing an approval of a State permit program pursuant to this section—</text> <clause id="H37B452067CFA4DDBBCE2E8ABC03533D3" commented="no"><enum>(i)</enum><text>the court shall remand the matter to the Administrator for further proceedings consistent with the determination of the court; and</text></clause> 
<clause id="HD198C6A99C2D4C96A3406AB962F008CC" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">the court may not vacate, revoke, enjoin, or otherwise limit the authority of the State to issue permits under such State permit program.</text></clause></subparagraph> <subparagraph id="H2B440227B65845689917546CFC4B70A7" commented="no"><enum>(B)</enum><header>Actions relating to permits</header><text>If a court determines that the Secretary or the State, as applicable, did not comply with the requirements of this section in issuing an individual or general permit under this section, or in verifying that an activity involving a discharge of dredged or fill material is authorized by a general permit issued under this section, as applicable—</text> 
<clause id="H83E00EE5371C488A99E3CFD4AB50734B" commented="no"><enum>(i)</enum><text>the court shall remand the matter to the Secretary or the State, as applicable, for further proceedings consistent with the determination of the court;</text></clause> <clause id="H34D2C943A2AB452EA356A168A91B0465" commented="no"><enum>(ii)</enum><text>with respect to a determination regarding the issuance of an individual or general permit under this section, the court may not vacate, revoke, enjoin, or otherwise limit the permit, unless the court finds that activities authorized under the permit would present an imminent and substantial danger to human health or the environment for which there is no other equitable remedy available under the law; and</text></clause> 
<clause id="HC2516C2E12DE4A67A6E8C4A6005E5411" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">with respect to a determination regarding a verification that an activity involving a discharge of dredged or fill material is authorized by a general permit issued under this section, the court may not enjoin or otherwise limit the discharge unless the court finds that the activity would present an imminent and substantial danger to human health or the environment for which there is no other equitable remedy available under the law.</text></clause></subparagraph></paragraph> <paragraph id="H97647AA5EA2E4D6DB4BF9CD58FCA328F" commented="no"><enum>(4)</enum><header>Timeline to act on court order</header><text>If a court remands a matter under paragraph (3), the court shall set and enforce a reasonable schedule and deadline, which may not exceed 180 days from the date on which the court remands such matter, except as otherwise required by law, for the Administrator, the Secretary, or the State, as applicable, to take such actions as the court may order.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H97F029CDAFE44CB4BFF8193185B50E20"><enum>16.</enum><header>Restoring federalism in clean water permitting</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator of the Environmental Protection Agency shall complete a review of the regulations applicable to the approval of State permit programs under section 404 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344</external-xref>) in order to identify revisions to such regulations necessary to streamline the approval process, reduce administrative burdens, and encourage additional States to administer a permit program under such section, and the Administrator shall implement any such revisions as appropriate.</text></section> <section id="H30B57B34A5E54642B03C4BE03E33C6C1"><enum>17.</enum><header>Jurisdictional determination backlog reduction</header><text display-inline="no-display-inline">Not later than 60 days after the date of enactment of this Act, the Secretary of the Army, acting through the Chief of Engineers, shall expedite such procedures and reallocate or augment such personnel and resources of the Corps of Engineers as the Secretary determines necessary to eliminate any backlog existing as of June 5, 2025, of—</text> 
<paragraph id="H603734D94B344FF585F0DD5F49274E23"><enum>(1)</enum><text display-inline="yes-display-inline">applications for permits under section 404 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344</external-xref>); or</text></paragraph> <paragraph id="H6523C13DF107413FB8FD318FDAD08554"><enum>(2)</enum><text>requests for jurisdictional determinations or wetlands delineations under the jurisdiction of the Secretary.</text></paragraph></section> 
<section id="H5C188A8A6F124143B6FED088E13F2AFE" section-type="subsequent-section"><enum>18.</enum><header>Definition of navigable waters</header><text display-inline="no-display-inline">Section 502(7) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1362">33 U.S.C. 1362(7)</external-xref>) is amended—</text> <paragraph id="H66B77997BDF44892A0059DF63F0BBE1B"><enum>(1)</enum><text>by striking <quote>(7) The term</quote> and inserting the following:</text>

<subparagraph id="H3B33A93AFE2A4D9A8E4B4F537D0090B9"><enum>(B)</enum><header>Exclusions</header><text display-inline="yes-display-inline">The term <term>navigable waters</term> does not include the following:</text> <clause id="H49082BAF87E34AA08D4B413AF4D6E85B" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">Any component of a waste treatment system, including any lagoon or treatment pond (such as a settling or cooling pond), designed to actively or passively—</text> 
<subclause id="H79D8272D7AC5436D9DD9E93AE7E4BED8" commented="no"><enum>(I)</enum><text>convey or retain wastewater; or</text></subclause> <subclause id="HE8895E7B5CE647DAA36B625585677C1D" commented="no"><enum>(II)</enum><text>concentrate, settle, reduce, or remove pollutants from wastewater.</text></subclause></clause> 
<clause id="H82EAC42856554F02B7EC8F59C0AF7F94"><enum>(ii)</enum><text display-inline="yes-display-inline">Ephemeral features that flow only in direct response to precipitation.</text></clause> <clause id="HA0EDD6A749CE434EA3F67E88AF6B4A0F" display-inline="no-display-inline"><enum>(iii)</enum><text>Any area that—</text> 
<subclause id="H07892C59734444FDA63FC1894E77D26C"><enum>(I)</enum><text>prior to December 23, 1985, was drained or otherwise manipulated for the purpose, or having the effect, of making production of an agricultural product possible, as determined by the Administrator and the Secretary of the Army, acting through the Chief of Engineers, which determinations shall be consistent with any designations of prior converted cropland made by the Secretary of Agriculture; and</text></subclause> <subclause id="H6226D78AB34F4774838B56A1254911BF"><enum>(II)</enum><text>as determined by the Administrator—</text> 
<item id="HC78C97690ACF4186A916EC21B4084963" commented="no"><enum>(aa)</enum><text>at least once in the immediately preceding five years has been used for, or in support of, agricultural purposes, including grazing, haying, idling land for conservation use (such as habitat management, pollinator and wildlife management, water storage and supply management, and flood management), irrigation tailwater storage, farm-raised fish production, cranberry production, nutrient retention, and idling land for soil recovery after natural disasters such as hurricanes and drought; and</text></item> <item id="H7B83F4CBFED640A288059A3C53484F9D"><enum>(bb)</enum><text>has not reverted to wetlands (as defined in section 120.2 of title 40, Code of Federal Regulations, as in effect on the date of enactment of this clause).</text></item></subclause></clause> 
<clause id="H889E4DF4886D41B3A5F68A4AF79132B4"><enum>(iv)</enum><text>Groundwater.</text></clause> <clause id="HEC6103B0B9B746A3A7FA765589151515"><enum>(v)</enum><text>Any other features determined to be excluded by the Administrator and the Secretary of the Army, acting through the Chief of Engineers.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H3E05CBA813BD4837B62A05003BFCF348"><enum>19.</enum><header>Applicability of Spill Prevention, Control, and Countermeasure rule</header><text display-inline="no-display-inline">Section 1049 of the Water Resources Reform and Development Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/1361">33 U.S.C. 1361</external-xref> note) is amended—</text> <paragraph id="HD136BC368B414EC1A695F07B43700396"><enum>(1)</enum><text>in subsection (b)—</text> 
<subparagraph id="H1235F1ED8E0F4738820B709C021811BB"><enum>(A)</enum><text>in paragraph (1)(B), by striking <quote>20,000</quote> and inserting <quote>42,000</quote>;</text></subparagraph> <subparagraph id="H26F8C0B3F6C44AED8B3E5CBEFBF0AE64"><enum>(B)</enum><text>by amending paragraph (2)(A) to read as follows:</text>

<section id="HF13E15CE38A04DFFBC07FB9939C350AB"><enum>20.</enum><header>Coordination with Federal Permitting Improvement Steering Council</header><text display-inline="no-display-inline">With respect to any covered project (as defined under section 41001 of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m">42 U.S.C. 4370m</external-xref>)) for which a certification or permit from a State under section 401, 402, or 404 of the Federal Water Pollution Control Act is required, the State is encouraged to choose to participate, to the maximum extent practicable, in the environmental review and authorization process under section 41003(c) of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m-2">42 U.S.C. 4370m–2(c)</external-xref>), pursuant to paragraph (3)(A) of such section.</text></section> <section id="HAE41662C6C324D9D99758A5E4D0ECF14"><enum>21.</enum><header>Sense of Congress on Chesapeake Bay Watershed Agreement</header><text display-inline="no-display-inline">It is the sense of Congress that the Chesapeake Bay Watershed Agreement is a voluntary, cooperative agreement between the Federal Government, the State of Delaware, the District of Columbia, the State of Maryland, the Commonwealth of Pennsylvania, the State of New York, the Commonwealth of Virginia, and the State of West Virginia. As such, the Federal Government should take a collaborative and cooperative approach to the parties with regard to their compliance with the Chesapeake Bay Total Maximum Daily Load outlined in such agreement.</text></section>
