<section id="H3F6EBB9DF7784FBCB1C6CC1E6500680A" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Confidence in Clean Water Permits Act</short-title></quote>.</text></section> 
<section id="H16DCD3E4F39D471495A9563E209A94D5"><enum>2.</enum><header>Confidence in clean water permits</header> 
<subsection id="HA454AF1A9E944C1C97CACC52E68A14A5"><enum>(a)</enum><header>Compliance with permits</header><text>Section 402(k) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342(k)</external-xref>) is amended—</text> <paragraph id="HDD599F9B0B144F19B913716DECFC00E7"><enum>(1)</enum><text>by striking <quote>(k) Compliance with</quote> and inserting the following:</text>

<subsection id="HA7B98588DE6C4AA78003AF2F5A5703DD"><enum>(k)</enum><header>Compliance with permits</header> 
<paragraph id="H2EED511652AF4A4D9A20C1F11EF7645A"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), compliance with</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H95DDECAEE0004EA8A9F81AE86583DC4A"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H80A60BA2E9A4471EAC375402BBC1A4CA" style="OLC"> 
<paragraph id="H310B2F15494D4913B5D5CCC15C1C58B7"><enum>(2)</enum><header>Scope</header><text>For purposes of paragraph (1), compliance with the conditions of a permit issued under this section shall be considered compliance with respect to a discharge of—</text> <subparagraph id="H7FC06FF5632F452286D3328F2F21E754"><enum>(A)</enum><text>any pollutant for which an effluent limitation is included in the permit; and</text></subparagraph> 
<subparagraph id="HE4B11E52380D4A388E94A257C2077424"><enum>(B)</enum><text>any pollutant for which an effluent limitation is not included in the permit that is—</text> <clause id="HFA0556C7EC244C1F86D0099F43F518F6"><enum>(i)</enum><text>specifically identified as controlled or monitored through indicator parameters in the permit, the fact sheet for the permit, or the administrative record relating to the permit;</text></clause> 
<clause id="H7A1DE00654AA4CE88CEC72CF067C6AD0"><enum>(ii)</enum><text>specifically identified during the permit application process as present in discharges to which the permit will apply; or</text></clause> <clause id="H90E17DCB41D5456598A9F18F32948E11"><enum>(iii)</enum><text>whether or not specifically identified in the permit or during the permit application process—</text> 
<subclause id="H0B9D6C79C8A0454A9864C786EC355A6D"><enum>(I)</enum><text>present in any waste streams or processes of the point source to which the permit applies, which waste streams or processes are specifically identified during the permit application process; or</text></subclause> <subclause id="H8E9E1D37B3DC48E48CDE8C8D2E26BE43"><enum>(II)</enum><text>otherwise within the scope of any operations of the point source to which the permit applies, which scope of operations is specifically identified during the permit application process.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HDCA47E79C5264CEAACFE7B9A69467665"><enum>(b)</enum><header>Technical corrections</header><text>Section 402(l)(3) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342(l)(3)</external-xref>) is amended—</text> <paragraph id="H87202948C36949448EC28BEF631798DC"><enum>(1)</enum><text>in subparagraph (B)—</text> 
<subparagraph id="H775CD182407A4106BBA740A7B3C45084"><enum>(A)</enum><text>by striking <quote>section 402</quote> and inserting <quote>this section</quote>; and</text></subparagraph> <subparagraph id="H6F64D47B175B4FFD84571A63491BB6BB"><enum>(B)</enum><text>by striking <quote>federal</quote> and inserting <quote>Federal</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H875C63AD7E1549868DE48A1574CF8887"><enum>(2)</enum><text>in subparagraph (C)—</text> <subparagraph id="H340955CF58224ADE9D6F7C7F40B87933"><enum>(A)</enum><text>by striking <quote>Section</quote> and inserting <quote>section</quote>;</text></subparagraph> 
<subparagraph id="H7D992810232D4E799A9B32DB9F96DA95"><enum>(B)</enum><text>by striking <quote>402(p)(6)</quote> and inserting <quote>subsection (p)(6)</quote>;</text></subparagraph> <subparagraph id="H50666457721148EAB1F3286CFDB3AED9"><enum>(C)</enum><text>by striking <quote>402(l)(3)(A),</quote> and inserting <quote>subparagraph (A),</quote>; and</text></subparagraph> 
<subparagraph id="H0FFA57F266EB4B769BE1EE1167CFE9E6"><enum>(D)</enum><text>by striking <quote>402(l)(3)(A).</quote> and inserting <quote>such subparagraph.</quote>.</text></subparagraph></paragraph></subsection> <subsection id="H602FA36650BA4C0198B85696278660DF"> <enum>(c)</enum> <header>Expression of water quality-Based effluent limitations</header> <text>Section 402 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342</external-xref>) is amended by adding at the end the following:</text>

            <enum>(t)</enum>
            <header>Expression of water quality-Based effluent limitations</header>
 <text display-inline="yes-display-inline">If the Administrator (or a State, in the case of a permit program approved by the Administrator) determines that a water quality-based limitation on a discharge of a pollutant is necessary to include in a permit under this section in addition to any appropriate technology-based effluent limitations included in such permit, the Administrator (or the State) may include such water quality-based limitation in such permit only in the form of a limitation that—</text>
            <paragraph id="H84DF387FFF4D48BF960E2B42069FA82A">
              <enum>(1)</enum>
 <text>specifies the pollutant to which it applies; and</text> </paragraph> <paragraph id="HAAB65FE2A93240D38649101C8D97C583"> <enum>(2)</enum> <text>clearly describes the manner in which compliance with the limitation may be achieved, which shall include—</text>
              <subparagraph id="H4A475F80401A4E708ABADFF3192A4A0B">
                <enum>(A)</enum>
 <text display-inline="yes-display-inline">a numerical limit on the discharge of such pollutant; or</text>
              </subparagraph>
              <subparagraph id="HFEB6F5386D7A4E9AAA6F385B61231335">
                <enum>(B)</enum>
 <text>a narrative description of required actions (including any measures or practices required to be applied).</text>
              </subparagraph>
            </paragraph>
          </subsection>
