R. 3892</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250610">June 10, 2025</action-date><action-desc><sponsor name-id="T000478">Ms. Tenney</sponsor> (for herself, <cosponsor name-id="M001160">Ms. Moore of Wisconsin</cosponsor>, <cosponsor name-id="K000376">Mr. Kelly of Pennsylvania</cosponsor>, and <cosponsor name-id="S001215">Ms. Stevens</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to modify the private business use requirements for bonds issued for lead service line replacement projects.</official-title></form><legis-body id="HBAB9821408114C5D921E5750777E67CA" style="OLC"><section id="H50942AF18EF5434597437F6F68CAB21C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Financing Lead Out of Water Act of 2025</short-title></quote>, or the <quote><short-title>Flow Act</short-title></quote>.</text></section><section id="H77452F62C77A4E19B9A0DD533D797E5D"><enum>2.</enum><header>Modification of private business use requirements for certain bonds</header><subsection id="H3916AFBC1BC14371A5DAF8437B6C3A2F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/141">Section 141(b)(6)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subparagraph: </text><quoted-block style="OLC" display-inline="no-display-inline" id="HADA2F0E75EA146C29539AEDA6AA03955"><subparagraph id="H25ECE941490D4A0585CEF8F56974998F"><enum>(D)</enum><header>Clarification relating to qualified lead service line replacement use</header><clause id="H85404A1472844A6892A1A218177D4BC6"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of this subsection, qualified lead service line replacement use shall not constitute private business use.</text></clause><clause id="H661EFD082D734C5293282B83CCE268AC"><enum>(ii)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this subparagraph—</text><subclause id="H246A1338309F46C5AEC7162C3FD0A65F"><enum>(I)</enum><header>Qualified lead service line replacement use</header><text display-inline="yes-display-inline">The term <quote>qualified lead service line replacement use</quote> means, with respect to any public water system, use of the proceeds of an issue to replace any privately-owned portion of a lead service line connected to such system to facilitate, achieve or maintain compliance with a national primary drinking water regulation for lead.</text></subclause><subclause id="H3C66AFF863A04FA4945EB062E97851B2"><enum>(II)</enum><header>Lead service line</header><text display-inline="yes-display-inline">The term <quote>lead service line</quote> has the meaning given such term in section 1459B(a)(4) of the Safe Drinking Water Act, as amended.</text></subclause><subclause id="H9F9AC924A7AE457BBA86E971865B561D"><enum>(III)</enum><header>National primary drinking water regulation for lead</header><text display-inline="yes-display-inline">The term <quote>national primary drinking water regulation for lead</quote> means a national primary drinking water regulation for lead promulgated under section 1412 of such Act.</text></subclause><subclause id="H0A52F2EC625F46A6A72CBE4449E930A2"><enum>(IV)</enum><header>Public water system</header><text display-inline="yes-display-inline">The term <quote>public water system</quote> has the meaning given such term in section 1401(4) of such Act. </text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H017D7A192330494EBB7EC183CF7027D3"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply to obligations issued after December 31, 2025. </text></subsection></section></legis-body></bill>
