<section id="H01E6B9F2916B43D493072815471BFE4B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clear the Reckless Obstructions And Dangers on Streets Act</short-title></quote> or the <quote><short-title>Clear the ROADS Act</short-title></quote>.</text></section> <section id="H1091C8A7686B44CB9A368303E5710B25"><enum>2.</enum><header>Roadway obstruction</header> <subsection id="H0578CD8477674D55AAA93D951951D7A4"><enum>(a)</enum><header>Withholding of apportionments for noncompliance</header> <paragraph id="H44CF17A9280F4A089ED9165D8BF14EEA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">Chapter 1</external-xref> of title 23, United States Code, is amended by adding at the end the following:</text>

<section id="H6B635C21D77E4F23A7FAAE0A28FE2182"><enum>180.</enum><header>Roadway obstruction</header> 
<subsection id="H7E3A9B940372452EA4E9ECF815C408D5"><enum>(a)</enum><header>Withholding of apportionments for noncompliance</header><text display-inline="yes-display-inline">Beginning not later than the first October 1 after the Secretary of Transportation has issued such regulations as are necessary to carry out this section or the first October 1 after a State has held a legislative session, whichever is later, and each October 1 thereafter, the Secretary shall withhold an amount equal to 10 percent of the funds to be apportioned to a State on that date under each of paragraphs (1) and (2) of section 104(b), unless the Secretary has certified on or before that date that the State has met the requirement described in subsection (b).</text></subsection> <subsection id="HD0FE1C9B99834C80A823062BC64C41DD"><enum>(b)</enum><header>Requirement</header><text display-inline="yes-display-inline">A State meets the requirement of this subsection if the Secretary determines the State has made reasonable efforts to prohibit individuals who are not performing work on behalf of a Federal, State, or local government from knowingly and recklessly obstructing lawful vehicle transportation on Federal-aid highways in the State in a manner that endangers the safety or health of the public.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H95BEAFC3DCFF4941A62DBC7DCF0ADE88"><enum>(2)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, is amended by adding at the end the following:</text> <quoted-block style="USC" id="H24DCE2E864C1438B829271451538EC3E" display-inline="no-display-inline"> <toc regeneration="no-regeneration"> <toc-entry level="section">180. Roadway obstruction.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H7D8B8763D18F438FBBD3C068B38C08BD"><enum>(b)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this section, the Secretary of Transportation shall issue such regulations as are necessary to carry out section 180 of title 23, United States Code (as added by this section).</text></subsection></section>
