BILL</legis-type><official-title display="yes">To amend title XI of the Social Security Act to prohibit the use of quality-adjusted life years and similar measures in coverage and payment determinations under Federal health care programs.</official-title></form><legis-body id="H2CF3B1340150462A8B3225EFD6E2384D" style="OLC"><section id="H30335813E26F49A09A5547D14B744D0D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Health Care for All Patients Act of 2025</short-title></quote>.</text></section><section id="H2487CA937327411CA4A3C37686B3D515"><enum>2.</enum><header>Prohibiting the use of quality-adjusted life years and similar measures in coverage and payment determinations under Federal health care programs</header><subsection id="HC30DBD3914DE4916A90BA2B76563B3E2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1182(e) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320e-1">42 U.S.C. 1320e–1(e)</external-xref>) is amended—</text><paragraph id="HF8C874C0957B4B95B95B87E656620AB9"><enum>(1)</enum><text>by inserting <quote>or treats extending the life of an elderly, disabled, or terminally ill individual as of lower value than extending the life of an individual who is younger, non-disabled, or not terminally ill</quote> after <quote>because of an individual’s disability</quote>;</text></paragraph><paragraph id="HA1AFDAA140BC4F389C47DDE85B9A81A5"><enum>(2)</enum><text>by inserting <quote>described in the preceding sentence</quote> after <quote>such a similar measure</quote>;</text></paragraph><paragraph id="H88727FE833E74C8A8F339E876CEA4AC0"><enum>(3)</enum><text>by striking <quote>The Secretary shall not</quote> and inserting <quote>A Federal agency (including the CMI (as described in section 1115A)) or State may not</quote>;</text></paragraph><paragraph id="H2AE53F8B16D444C089CAF5C58C970E60"><enum>(4)</enum><text display-inline="yes-display-inline">by striking <quote>under title XVIII.</quote> and inserting the following: <quote>under any Federal health care program (as defined in section 1128B, except that such term shall include the health program established under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/89">chapter 89</external-xref> of title 5, United States Code).</quote>; and</text></paragraph><paragraph id="HBDFF3DEBE2D74D8AAFC289D9339B0F46"><enum>(5)</enum><text>by adding at the end the following new sentence: <quote>Notwithstanding any other provision of law, a Federal agency (including the CMI) or State may not waive the application of the provisions of this subsection (or the provisions of section 1852(o), section 1860D–12(h), section 1902(a)(88), section 1932(b)(9), or section 2102(e)) under section 1115, section 1115A, or any other demonstration or waiver authority.</quote>.</text></paragraph></subsection><subsection id="H1AA8596BA8DD48CABC2F19E22E2E6294"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="HA8D046FAC6114A34B39B3BAC07121D15"><enum>(1)</enum><header>Medicaid</header><subparagraph id="H21AE84E1B6E9445DBD93062C4305D1DD"><enum>(A)</enum><header>In general</header><text>Section 1902(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)</external-xref>) is amended—</text><clause id="H18A17A254A1A42C782D462F0B4496AE4"><enum>(i)</enum><text>in paragraph (86), by striking <quote>and</quote> at the end;</text></clause><clause id="H8A99EBB4E3F84AAC91928DC417306C07"><enum>(ii)</enum><text>in paragraph (87)(D), by striking the period and inserting <quote>; and</quote>; and</text></clause><clause id="H89EB0FE5F89C41C399E8E3AFFDE610AB"><enum>(iii)</enum><text>by inserting after paragraph (87) the following new paragraph:</text><quoted-block style="OLC" id="H1DC3EC05EF3A42A7A60F8E1BA2B351D1" display-inline="no-display-inline"><paragraph id="H7AF6E2ADE5E741E7B32187A69A5B7ACA"><enum>(88)</enum><text display-inline="yes-display-inline">provide for compliance with the requirements of section 1182(e) (relating to prohibiting the use of certain measures in coverage determinations, reimbursement, and incentive programs).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HA73528EFCDCC454BA8A2E4DD8CF4E7B2" display-inline="no-display-inline"><enum>(B)</enum><header>Managed care organizations</header><text>Section 1932(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396u-2">42 U.S.C. 1396u–2(b)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H96C1381916CC4442A9202D7B21DBAC7E" display-inline="no-display-inline"><paragraph id="HA980DE1024E04B97949A6F35F50B1619"><enum>(9)</enum><header>Prohibition on use of quality-adjusted life years</header><text display-inline="yes-display-inline">The provisions of section 1182(e) shall apply to the utilization of a dollars-per-quality adjusted life year or similar measure (as described in such section) by a medicaid managed care organization under this title (or a prepaid inpatient health plan or prepaid ambulatory health plan, as defined in section 438.2 of title 42, Code of Federal Regulations (or any successor regulation), under a contract with the State) in the same manner as such provisions apply to the utilization of such a year or measure by a State under this title.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HC538190ABD4B40029184DFE32C548E8A"><enum>(2)</enum><header>CHIP</header><text>Section 2102 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397bb">42 U.S.C. 1397bb</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="H73471686751B45EF8A9521DA7F00284F" display-inline="no-display-inline"><subsection id="HF856F5DF1F9D450591C48A385944C118"><enum>(e)</enum><header>Prohibition on the use of quality-Adjusted life years and similar measures</header><text display-inline="yes-display-inline">A State child health plan shall provide for compliance with the requirements of section 1182(e) (relating to prohibiting the use of certain measures in coverage determinations, reimbursement, and incentive programs).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HF676D06AEF134DD8B4347EB406CBA246"><enum>(3)</enum><header>Medicare Advantage</header><text display-inline="yes-display-inline">Section 1852 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-22">42 U.S.C. 1395w–22</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="HE5B322085BB14EC39326AEBC508A39D9" display-inline="no-display-inline"><subsection id="HB55C5A0FA54F47DF9249DE04E720BE41"><enum>(o)</enum><header>Prohibition on use of quality-Adjusted life years</header><text display-inline="yes-display-inline">The provisions of section 1182(e) shall apply to the utilization of a dollars-per-quality adjusted life year or similar measure (as described in such section) by an MA plan in the same manner as such provisions apply to the utilization of such a year or measure by the Secretary under this title.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H492EAA4E15F6460A8576BAA3C6C9780C"><enum>(4)</enum><header>Medicare part D</header><text>Section 1860D–12 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-112">42 U.S.C. 1395w–112</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="HBCCE76DBD0144A4EB0E28B1E0696116B" display-inline="no-display-inline"><subsection id="H4948F9C362D5428E9D7B8ABD887C84CE"><enum>(h)</enum><header>Prohibition on use of quality-Adjusted life years</header><text display-inline="yes-display-inline">The provisions of section 1182(e) shall apply to the utilization of a dollars-per-quality adjusted life year or similar measure (as described in such section) by a prescription drug plan in the same manner as such provisions apply to the utilization of such a year or measure by the Secretary under this title.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H42E77DECA4694B2F981BCC5D7951E850"><enum>(c)</enum><header>Implementation</header><text>The amendments made by this section shall apply beginning on January 1, 2027.</text></subsection></section><section id="H3FA5706DBB8341818616354B6C077B12" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header>Prevention and Public Health Fund</header><text display-inline="no-display-inline">Section 4002(b) of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300u-11">42 U.S.C. 300u–11</external-xref>) is amended by striking paragraphs (7), (8), and (9) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H10E48ABC981748878067A8C6C7AFA116"><paragraph id="H24CE7FDAB96E456B90CE9DF6CF5CDC91"><enum>(7)</enum><text display-inline="yes-display-inline">for each of fiscal years 2026 and 2027, $1,102,000,000;</text></paragraph><paragraph id="HDE4BFDE455F445559E611CA3EB9150E3"><enum>(8)</enum><text>for each of fiscal years 2028 and 2029, $1,327,000,000;</text></paragraph><paragraph id="H600BE87112194EE3A54CD9074C9704F4"><enum>(9)</enum><text>for each of fiscal years 2030 and 2031, $1,526,000,000; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H09ACBA856B7744258DB52DFB075F54B4"><enum>4.</enum><header>Report</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, and annually thereafter, the Comptroller General of the United States shall submit to Congress a report on how quality-adjusted life years negatively impacts individuals with intellectual and developmental disabilities and their access to care.</text></section></legis-body></bill>
