<official-title display="yes">To amend the Immigration and Nationality Act to provide for the removal and permanent inadmissibility of certain aliens convicted of assaulting law enforcement officers, and for other purposes.</official-title>

<section id="H5EB4F8799A554EFE82CC007B99B2B78E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>Returning Illegals over Turmoil Act</short-title></quote>.</text></section> <section id="HF8F9A5A56D9B42309CEFC28401B43EAB"><enum>2.</enum><header>Removal of aliens who incite or participate in assaults against law enforcement during civil unrest</header><text display-inline="no-display-inline">Section 237(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="H8B49ACAE50F149C8BC9948A989934D55"><enum>(8)</enum><header>Aliens who incite or participate in assaults during civil unrest</header>
<subparagraph id="H4EE1CDE15CDD4BC68958DE0D3FA3D465"><enum>(A)</enum><header>In general</header><text>Any alien described in subparagraph (B) shall be deportable;</text></subparagraph> <subparagraph id="HF963AEC9888C4EDAA7A8DD1ADE431C1B"><enum>(B)</enum><header>Aliens described</header><text>An alien is described in this subparagraph if—</text>
<clause id="H77BA6489007E4460B4F2DFA8C8F6B2D8"><enum>(i)</enum><text>the alien has been convicted of, or admits to having committed acts that constitute, incitement to violence or physical participation in a riot or civil disturbance under Federal, State, and local law; or</text></clause> <clause id="H2837A478603744EE8F8181B22A4F8010"><enum>(ii)</enum><text>the acts involved—</text>
<subclause id="H37A98A042C22426382FFC5F188A8CC24"><enum>(I)</enum><text>an actual or attempted assault, battery, or use of force against a law enforcement officer, including officers of the United States, a State, municipality, or tribal government; and</text></subclause> <subclause id="H5648B748C50841CCB5CB61DEC6F47437"><enum>(II)</enum><text>an actual or attempted assault, battery, or use of force against a member of the Armed Forces of the United States, including during the performance of official duties or while in uniform; or</text></subclause>
<subclause id="H089169DA371F4FCB95DC38BE2CF7441C"><enum>(III)</enum><text>the willful destruction, defacement, or vandalism of public property, including structures, vehicles, or facilities owned or operated by the Federal Government, a State or local government, including law enforcement or emergency service vehicles, government buildings, transit systems, and monuments, and</text></subclause></clause> <clause id="H40616573216F46F190CA87F1FE7FD587"><enum>(iii)</enum><text>the alien was unlawfully present in the United States, was a recipient of deferred action under the Deferred Action for Childhood Arrivals (DACA) Policy, or a lawful permanent resident at the time of the offense.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="HED720F9D97C243DD9B59A2ADA8680524"><enum>3.</enum><header>Permanent inadmissibility</header><text display-inline="no-display-inline">Section 212(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(2)</external-xref>) is amended by adding at the end:</text> <quoted-block style="OLC" id="H3B3842AA174446F395588E8DC537446E" display-inline="no-display-inline"> <subparagraph id="H2A25F9C96FD94471BDCFCF0F0B2DFC01"><enum>(J)</enum><header>Aliens convicted of riot-related offenses against law enforcement</header><text>Any alien who has been removed under section 237(a)(8) shall be permanently inadmissible to the United States.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H6A3FCAB4FB09456292AFFA61A25F7133"><enum>4.</enum><header>No waivers or relief</header>
<subsection id="H77131141D77B4CE985FF507527F20A6B"><enum>(a)</enum><header>Ineligibility for discretionary relief</header><text>An alien described under section 237(a)(8) shall not be eligible for any form of relief from removal or adjustment of status, including but not limited to—</text> <paragraph id="HDC49272339974895823C0B203DAB96D4"><enum>(1)</enum><text>asylum,</text></paragraph>
<paragraph id="H727AE46911F64528B8A8223BFBC61FC0"><enum>(2)</enum><text>cancellation of removal,</text></paragraph> <paragraph id="HE64073C873CC4CE68AE6CD972173599A"><enum>(3)</enum><text>adjustment of status,</text></paragraph>
<paragraph id="H90E264D7A657457F8EEA234DB11A2B17"><enum>(4)</enum><text>withholding of removal, or</text></paragraph> <paragraph id="HEC81A0B119344C26993669A032EE9F6D"><enum>(5)</enum><text>deferred action or prosecutorial discretion.</text></paragraph></subsection>
<subsection id="HFA49A5330A804C02B9B52075F9ABC4D2"><enum>(b)</enum><header>D<enum-in-header>ACA</enum-in-header> barred</header><text>No alien removed under this act shall be eligible for future benefits under DACA.</text></subsection></section> <section id="HC792EF9871D84383A76A071DF97211D9"><enum>5.</enum><header>Enhanced enforcement during declared emergencies</header> <subsection id="H43233B3FB4244445AE3503C443FCF754"><enum>(a)</enum><header>mandatory enforcement during emergencies</header><text>The provisions of this act shall be applied without discretion during any period in which:</text>
<paragraph id="HDC49452339974895823C0B203DAB96D4"><enum>(1)</enum><text>The President has declared a national emergency under the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601 et seq.</external-xref>);</text></paragraph> <paragraph id="HDC49272339974895823C0B203DAB96D7"><enum>(2)</enum><text>A major disaster is in effect under the Stafford Act (<external-xref legal-doc="usc" parsable-cite="usc/42/68">42 U.S.C. 68 et seq.</external-xref>); or </text></paragraph>
<paragraph id="HDC49272339974895823C0B203DAB96D1"><enum>(3)</enum><text>A state of emergency has been declared by a Governor or mayor in the jurisdiction where the offense occurred. </text></paragraph></subsection></section> <section id="id8e2994fd7b0b4dd9aa0fd77c48c2189c"><enum>6.</enum><header>Expedited removal authority</header> <paragraph id="id3520dba8d6f848a7a38e496cc0b9bb4d"><enum/><text>During the pendency of any emergency described in section 5, the Secretary of Homeland Security may designate offenses described in section 237(a)(8) as grounds for expedited removal under section 238 of the Immigration and Nationality Act. </text></paragraph></section>
<section id="idf3983bd6d8e845418d34f1145a56f138"><enum>7.</enum><header>Mandatory detention of aliens pending approval</header>
<paragraph id="id63980d9fe9374941802925dd1ef57637"><enum/><text>Section 236(c)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1226">8 U.S.C. 1226(c)(1)</external-xref>) is amended by adding at the end the following new subparagraph: </text> <quoted-block style="OLC" id="idF3D15EF33BC94E549FE46EF445394600" display-inline="no-display-inline"> <paragraph id="idfc116b2ff4eb4a43ab95c748936c5c11"><enum>(F)</enum><text>is described in section in section 237(a)(8) (aliens who incite or participate in assaults against law enforcement or military personnel during civil unrest). </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="id30c7c7653d284a3b98aff7feb4f4f86e"><enum>8.</enum><header>Effective date</header>
<paragraph id="id3893aa280b764f55b162c2baae24106c"><enum/><text>This Act shall take effect upon enactment and shall apply to offenses committed on or after such date.</text></paragraph></section> </legis-body> </bill>
