<section id="H00333AE13CCC45B7B6A31774CA0E05D4" section-type="section-one"><enum>1.</enum><header>Prohibition on smoking in facilities of the Veterans Health Administration</header> 
<subsection id="HCFA8351CEEB04FBC8F1DFA59B6E1084A"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Section 1715 of title 38, United States Code, is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H5982D66D43564714B03363ACECA76C4C" style="USC"> <section id="H3A7ACBEA072D4E248A1CC10584E324DC"><enum>1715.</enum><header>Prohibition on smoking in facilities of the Veterans Health Administration</header> <subsection id="H875144563850453B9E014C1A79F8D087"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">No person (including any veteran, patient, resident, employee of the Department, contractor, or visitor) may smoke on the premises of any facility of the Veterans Health Administration.</text></subsection> 
<subsection id="H8B9F0629B5074C4EB1D41FEE8A436068"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H01814DD4591B42798AED717AB8DADC00"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>smoke</term> includes—</text> 
<subparagraph id="H3A824DD6EB954D03A03AE8ECA7AB3782"><enum>(A)</enum><text>the use of cigarettes, cigars, pipes, and any other combustion or heating of tobacco; and</text></subparagraph> <subparagraph id="H0F24EAA883AE4AF5B887D566933D3ABB"><enum>(B)</enum><text display-inline="yes-display-inline">the use of any electronic nicotine delivery system, including electronic or e-cigarettes, vape pens, and e-cigars.</text></subparagraph></paragraph> 
<paragraph id="H3E92BFA5B06149A2AC393757F0E7BD43"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>facility of the Veterans Health Administration</term> means any land or building (including any medical center, nursing home, domiciliary facility, outpatient clinic, or center that provides readjustment counseling) that is—</text> <subparagraph id="HE9F5E2848B1E4535910BDE4360B6466D"><enum>(A)</enum><text>under the jurisdiction of the Department of Veterans Affairs;</text></subparagraph> 
<subparagraph id="HD089981074BB497F93FB96788E4E7267"><enum>(B)</enum><text>under the control of the Veterans Health Administration; and</text></subparagraph> <subparagraph id="HDB86B5327EE24AD2B9EF12EF2D70BD09"><enum>(C)</enum><text>not under the control of the General Services Administration.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF2B95450100F4484A0A0517D4D8A2153"><enum>(b)</enum><header>Conforming amendments</header> 
<paragraph id="HB52E3F5632314313A13E1A7D007FF5E0"><enum>(1)</enum><header>Table of sections</header><text display-inline="yes-display-inline">The table of sections at the beginning of chapter 17 of such title is amended by striking the item relating to section 1715 and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H161419AD46AD47F59DCB4CD5213EAE30" style="USC"> <toc regeneration="no-regeneration"> <toc-entry level="section">1715. Prohibition on smoking in facilities of the Veterans Health Administration.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="H7D612DC51EFF4CB98DBC1C3B24BEABEB"><enum>(2)</enum><header>Veterans Health Care Act of 1992</header><text display-inline="yes-display-inline">Section 526 of the Veterans Health Care Act of 1992 (<external-xref legal-doc="public-law" parsable-cite="pl/102/585">Public Law 102–585</external-xref>) is repealed.</text></paragraph></subsection></section>
