<section id="H55833D34FEDA4E0D98550A0528F2E92D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Government Reform Act of 2025</short-title></quote>.</text></section> <section id="HC8146B7DF1B648CF929F5348576B0FFA"><enum>2.</enum><header>Federal Government operations</header> <subsection id="H6D35DE5882D14C7AB5A265E3E2AAA8EA" commented="no"><enum>(a)</enum><header>Elimination of the Federal Executive Institute</header><text>Not later than 90 days after the date of the enactment of this Act, the Director of the Office of Personnel Management shall permanently close the Federal Executive Institute located in Charlottesville, Virginia, and beginning on the date of such closure, no Federal funds may be obligated or expended for any activities of the Institute.</text> </subsection> 
<subsection id="H6DC927B9254E437D8C74B1F954075697" commented="no"><enum>(b)</enum><header>Probationary period</header> 
<paragraph id="H6C008EDCA7B64E198F4812B7901C7E1A" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, rule, or regulation, the first year of service of an employee who is given a career or career-conditional appointment in the competitive service under the Civil Service Regulations is a probationary period when the employee—</text> <subparagraph id="HD98A2CBFEA09466CA1762FE67BB317C7" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">was appointed from a competitive list of eligibles; or</text></subparagraph> 
<subparagraph id="H3527D56D2B2041A4BEFDD939E27A486F" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">was reinstated (including reinstatement from a Reinstatement Priority List), unless during any period of service that affords a current basis for reinstatement the employee completed a probationary period of at least 1 year or served with competitive status under an appointment that did not require a probationary period; provided that the date of reinstatement begins a new 12-month probationary period if one is required under this subsection.</text></subparagraph></paragraph> <paragraph id="H0F5EFADD6C1542EF9466B0A22D8D81CE"><enum>(2)</enum><header>Certification</header><text display-inline="yes-display-inline">An individual shall not complete any probationary period under this subsection unless the employing agency certifies, within the 30-day period prior to the conclusion of period, that the continued employment of the individual is in the public interest. If such certification is not made, the employee shall be separated from the civil service.</text></paragraph> 
<paragraph id="H1127EAE8CC2E4377B4EE1946AF73D761" commented="no"><enum>(3)</enum><header>New position</header><text display-inline="yes-display-inline">A person who is required to go through a probationary period and then is transferred, promoted, demoted, or reassigned in accordance with the Civil Service Regulations before he or she completes such period is required to complete the remainder of the probationary period in the new position.</text></paragraph> <paragraph id="HC8257DEDBBA84EB8843D565C87426260" commented="no"><enum>(4)</enum><header>USPS</header><text display-inline="yes-display-inline">Upon noncompetitive appointment to the competitive service under title 39, United States Code, an employee of the Postal Career Service (including a substitute or part-time flexible employee) who has not completed 1 year of Postal service shall serve the remainder of a 1-year probationary period in the new agency.</text></paragraph> 
<paragraph id="H5DCE7598CD9D478FB6D7C63F362CDB6A">
          <enum>(5)</enum>
          <header>Special appointing authority or conversion</header>
 <text display-inline="yes-display-inline">A person who is appointed to the competitive service either by a special appointing authority or by conversion to a career or career-conditional appointment under the Civil Service Regulations must serve a 1-year probationary period unless specifically exempt from such period by the special appointing authority itself.</text>
        </paragraph> 
<paragraph id="H382C1205BBDF40B986650A5CE501BC56" commented="no"><enum>(6)</enum><header>Supervisors and managers</header><text display-inline="yes-display-inline">Employees promoted, transferred, or otherwise assigned, for the first time, to supervisory or managerial positions shall be required to serve a probationary period under terms and conditions prescribed by the Office of Personnel Management. If an employee is required to concurrently serve both a probationary period in a supervisory or managerial position under subpart I of part 315 of title 5, Code of Federal Regulations, and a probationary or trial period following initial appointment or reinstatement under this Civil Service Rule, the latter takes precedence and fulfills the requirements of this paragraph.</text> </paragraph></subsection> <subsection id="HE04DEAF94919496D8787B1E19E85F9A9"><enum>(c)</enum><header>Reducing overcriminalization in Federal regulations</header> <paragraph id="HE46EAD3DD57445CF9C38391828199BB6"><enum>(1)</enum><header>Agency reports to OIRA</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the head of each agency shall submit to the Administrator of the Office of Information and Regulatory Affairs a report that—</text> 
<subparagraph id="H0C22896036C040F1A299921991A99D45"><enum>(A)</enum><text>identifies any regulation that imposes a criminal penalty without clear statutory authority; and</text></subparagraph> <subparagraph id="H6181985E28CE478E8C92E8E0750577C3"><enum>(B)</enum><text>makes recommendations about the repeal or revision of any such regulation.</text></subparagraph></paragraph> 
<paragraph id="HBAA79CCC73164264B79CFA4353A60848"><enum>(2)</enum><header>Restriction on criminal penalties in regulations</header><text>The head of an agency may not issue any regulation that includes a criminal penalty unless that same penalty or the specifics of that penalty has been described in statute.</text></paragraph></subsection> <subsection id="HD683FEBE7DF948B2A795E6024E40C2A2"><enum>(d)</enum><header>Efficiency in rule publication and digital modernization</header> <paragraph id="HDAAF76073B664E16B140AF5C7E42AFC1"><enum>(1)</enum><header>Digitization and automation of systems required</header><text>The Archivist of the United States, acting through the Director of the Federal Register, shall digitize and automate internal processes to reduce publication delays and dependence on outdated systems. In this paragraph, the term <term>outdated system</term> means a system that another agency has demonstrated the ability to perform digital and automated services in a timely manner.</text></paragraph> 
<paragraph id="H1E5E95F369DA4DFF8A6E8915C883FE95"><enum>(2)</enum><header>Benchmarks</header><text>Not later than 90 days after the date of the enactment of this Act, the Archivist of the United States, acting through the Director of the Federal Register, shall establish performance benchmarks to ensure publication of any proposed or final rule within the applicable statutory deadline or within 24 hours after the date on which any such rule is received by the Director.</text></paragraph> <paragraph id="HDE638E4506354299B39B6D8638471EB5"><enum>(3)</enum><header>Annual compliance report</header><text>Not later than one year after the date of the enactment of this Act, and annually thereafter, the Archivist of the United States, acting through the Director of the Federal Register, shall submit to Congress a report on compliance with this subsection that includes average processing times and modernization progress.</text></paragraph></subsection></section> 
<section id="H5C74AC76F1064A0DB05D8BDF44B31B45" commented="no"><enum>3.</enum><header>Modernizing payments to and from the treasury</header> 
<subsection id="H77E4C38235ED46C9B2DE1E155F863F8F" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of the Treasury shall develop and implement new technologies and partnerships to improve the speed, security, and transparency of payments made to and from the Treasury.</text></subsection> <subsection id="H645FD2DE013748418D5EE404512C06EB" commented="no"><enum>(b)</enum><header>Requirements</header><text>The new technologies and partnerships developed and implemented under subsection (a) shall—</text> 
<paragraph id="H4EF076CC7136448584B6BAB9A4236F4B" commented="no"><enum>(1)</enum><text>reduce reliance on paper-based transactions and information technology systems created before the year 2000; and</text></paragraph> <paragraph id="H5C367205183F4C31ACADE883BC00AD8C" commented="no"><enum>(2)</enum><text>provide secure digital payment infrastructure for persons, businesses, and agencies.</text> </paragraph></subsection></section> 
<section id="H061308D13E8642DFAFBBB5A1EFA9417A"><enum>4.</enum><header>Implementation and oversight</header> 
<subsection id="HDFBD686E868A46C49F8A019C83AF3C5B"><enum>(a)</enum><header>Oversight by OMB</header><text display-inline="yes-display-inline">The Director of the Office of Management and Budget shall oversee agency implementation of this Act.</text></subsection> <subsection id="H8B269011FBC84076B91671FB62BB8B63"><enum>(b)</enum><header>Agency compliance updates</header><text>The head of each agency affected by this Act shall submit to the Director of the Office of Management and Budget a quarterly update on any update, reform, and efficiency as a result of this Act.</text></subsection> 
<subsection id="H5CA1E473FB62483EB9DC97DBB01ED034"><enum>(c)</enum><header>Implementation report required</header><text>Not later than 180 days after the date of the enactment of this Act, the Director of the Office of Management and Budget shall submit to Congress a comprehensive implementation report on each agency affected by the requirements of this Act.</text></subsection></section> <section id="H9CE456A0550D493C9D175714D937197F" commented="no"><enum>5.</enum><header>Agency; rule defined</header><text display-inline="no-display-inline">In this Act, the terms <term>agency</term> and <term>rule</term> have the meaning given those terms in section 551 of title 5, United States Code.</text></section>
