which was referred to the <committee-name committee-id="HED00">Committee on Education and Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To authorize the Secretary of Education to award grants to eligible entities to carry out professional development for arts educators and creative arts therapists to learn how to best accommodate children with disabilities, and for other purposes.</official-title></form><legis-body id="H8418940DA5724BFB936E50335BA543C3" style="OLC"><section id="HBB3BB57FD5CB4402BD0BEC51DC6BB484" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reimagining Inclusive Arts Education Act</short-title></quote>.</text></section><section id="H8B33B99EC0364BFFB2ED728E78026B57"><enum>2.</enum><header>Inclusive arts education grant program</header><subsection id="HE81921E6777F4CEEB95FF84FB904E459"><enum>(a)</enum><header>In general</header><text>Not later than 120 days after the date of the enactment of this Act, the Secretary shall award, on a competitive basis, grants to eligible entities to carry out the activities described in subsection (d).</text></subsection><subsection id="HA2103903FC1D43A68DC89D5C8C1FAE9E"><enum>(b)</enum><header>Applications</header><text>To be considered for a grant under this section, an eligible entity shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require.</text></subsection><subsection id="H8CC2F27926A245FB955CDEE44D8A19F6"><enum>(c)</enum><header>Limitation</header><text>The Secretary shall not award a grant to—</text><paragraph id="HEF3ADF019BF34E9286024809EE01C4BC"><enum>(1)</enum><text display-inline="yes-display-inline">a local educational agency that is served by a State educational agency that is awarded a grant under this section; or</text></paragraph><paragraph id="H89BF7DD3027D49499018733CCC4DC853"><enum>(2)</enum><text>a partnership that includes an entity described in clause (i), (ii), or (iii) of subsection (f)(2)(c) if such entity is a member of a partnership that is awarded a grant under this section.</text></paragraph></subsection><subsection id="HE788783C7CB34E3794D6CDFF87D15EAD"><enum>(d)</enum><header>Grant uses</header><text display-inline="yes-display-inline">An eligible entity that receives a grant under this section shall use such funds to promote curricula, best practices, professional development for arts educators and creative arts therapists, and innovative approaches, including creative arts therapies in elementary schools and secondary schools, that—</text><paragraph id="H4ED070CE25ED4D2A93CD34E887D9AC8F"><enum>(1)</enum><text display-inline="yes-display-inline">increase access for, and improve inclusion of, children with disabilities in such arts education; and</text></paragraph><paragraph id="HC19C08B317F943278D0E9F6750A3160D"><enum>(2)</enum><text>adapt classroom materials and lessons to accommodate children with disabilities.</text></paragraph></subsection><subsection id="H3AF308E2FC354D51A6DE2EDF915253E4"><enum>(e)</enum><header>Program periods and diversity of projects</header><paragraph id="HC4AF6713546A4235AB5E6CB3EC57C4C3"><enum>(1)</enum><header>Grant period</header><text>A grant awarded under this section shall be for a period of not more than 3 years.</text></paragraph><paragraph id="HAD4E7659FA654346AF94D0D34EBD76C0"><enum>(2)</enum><header>Reapplication</header><text>In a case in which an eligible entity submits an application under subsection (b) and is not awarded a grant under this section—</text><subparagraph id="H4C5A9CEF6A574478A5EE10E39AB3088A"><enum>(A)</enum><text>the Secretary shall provide to such eligible entity—</text><clause id="HE585CE9300B340D0A323830B97D6A171" commented="no"><enum>(i)</enum><text>the reasons for denial of such application, including a list of any selection criteria that the eligible entity did not meet; and</text></clause><clause id="H4C8B3175F9854CC4A564FD1B539B48E2" commented="no"><enum>(ii)</enum><text>a list of recommended changes to be made by the eligible entity to such application before resubmission in order to meet such selection criteria; and</text></clause></subparagraph><subparagraph id="H6603B0F0E3FB455890B8D2F946D59D50"><enum>(B)</enum><text display-inline="yes-display-inline">the eligible entity may resubmit such application in accordance with subsection (b) not earlier than 1 year after such entity receives the information required under subparagraph (A).</text></subparagraph></paragraph><paragraph id="H31E3CD3B6308418DADC127AAF39A34B0"><enum>(3)</enum><header>Renewal</header><text display-inline="yes-display-inline">The Secretary may renew a grant awarded under this section for one 2-year period for an eligible entity that demonstrates to the Secretary the success of the program funded under the grant, such as through student, parent, or teacher satisfaction, or program efficacy.</text></paragraph><paragraph id="HEE0C35400F3348FEAE1000A08021C810" commented="no"><enum>(4)</enum><header>Priority</header><text>In awarding grants under this section, the Secretary shall give priority to eligible entities that serve elementary schools or secondary schools that receive funds under title I of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6301">20 U.S.C. 6301 et seq.</external-xref>).</text></paragraph><paragraph id="H91B674A43A2A4064A540E3EE6122A8C1" commented="no"><enum>(5)</enum><header>Diversity of projects</header><text display-inline="yes-display-inline">In awarding grants under this section, the Secretary shall ensure that, to the extent practicable, grants are distributed among eligible entities that serve—</text><subparagraph id="H49F422728C9E4D728E2C4AAEBE9FEC9A" commented="no"><enum>(A)</enum><text>geographically diverse areas, including urban, suburban, and rural areas;</text></subparagraph><subparagraph id="H380D280E4D224B738771656BFFE1CC3E" commented="no"><enum>(B)</enum><text>Indian tribes or tribal organizations; and</text></subparagraph><subparagraph id="H7AE44DE396BD49C08371F0DF48AC0FF7"><enum>(C)</enum><text>elementary schools and secondary schools in varying socioeconomic areas.</text></subparagraph></paragraph></subsection><subsection id="HD2B1DB31FB6C445D962CB04526CD3460"><enum>(f)</enum><header>Definitions</header><text>In this Act:</text><paragraph id="HB9B38F9A3B4446298059EBFFD0EFE650"><enum>(1)</enum><header>Child with a disability</header><text display-inline="yes-display-inline">The term <term>child with a disability</term> has the meaning given the term in section 602 of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1401">20 U.S.C. 1401(3)</external-xref>).</text></paragraph><paragraph id="H163DC514A43B4AEB813C8AD29C4BC266"><enum>(2)</enum><header>Creative arts therapists</header><text display-inline="yes-display-inline">The term <term>creative arts therapists</term> means individuals who are licensed, certified, or credentialed as one of the following—</text><subparagraph id="HA0C623AC3A6A41668A1328A8591B6E1F"><enum>(A)</enum><text>an art therapist;</text></subparagraph><subparagraph id="H5678D1B580804D6DAEDBAB46D5458E51"><enum>(B)</enum><text display-inline="yes-display-inline">a dance movement therapist;</text></subparagraph><subparagraph id="H487C3064EDEC4EE6B0ABD223BD08FB65"><enum>(C)</enum><text>a drama therapist; or</text></subparagraph><subparagraph id="HDD157DCED68B4474ADEC4D5FCD912119"><enum>(D)</enum><text>a music therapist.</text></subparagraph></paragraph><paragraph id="H52EF0F2DB0DC4A719EBE569BA0E08C26"><enum>(3)</enum><header>Creative arts therapies</header><text display-inline="yes-display-inline">The term <quote>creative arts therapies</quote> means therapeutic interventions developed and provided by an art therapist, dance movement therapist, drama therapist, or music therapist to support academic goals, facilitate communication and emotional expression, enhance self-awareness, and improve social, cognitive, and motor skills.</text></paragraph><paragraph id="H4D75E979BF6C44E9BBC8E711B6943275"><enum>(4)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means—</text><subparagraph id="H2C7CFA8A53464C50ADA6B661FEECC008"><enum>(A)</enum><text>a local educational agency;</text></subparagraph><subparagraph id="H5FA3BAA98E004BB3836F16D415A2B7EC"><enum>(B)</enum><text>a State educational agency; and</text></subparagraph><subparagraph id="H9E0BC00B03A543E088DFD169B0E75AE6"><enum>(C)</enum><text>a partnership between an entity described in subparagraph (A) or (B) and—</text><clause id="H3B66AF54813C4E0A91671C7683842327"><enum>(i)</enum><text>an institution of higher education; or</text></clause><clause id="H2BF2D6CA9AD2442FAE5CD7FB0A365067"><enum>(ii)</enum><text display-inline="yes-display-inline">a nonprofit organization with expertise relevant to the activities or practices described in subsection (d).</text></clause></subparagraph></paragraph><paragraph id="H840BF422AA7D4101A9A7B9C6A7737630"><enum>(5)</enum><header>ESEA terms</header><text>The terms <term>elementary school</term>, <term>professional development</term>, <term>secondary school</term>, and <term>Secretary</term> have the meaning given the terms, respectively, in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="H3DCA605FDED343B2A710F7CFE7D10F74"><enum>(6)</enum><header>Institution of higher education</header><text display-inline="yes-display-inline">The term <term>institution of higher education</term> has the meaning given the term in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>).</text></paragraph></subsection><subsection id="HF83D92B83C5F474E85FAA1583740B342"><enum>(g)</enum><header>Authorization of Appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated, in the aggregate, for fiscal years 2026 through 2030, $15,000,000 to the Secretary to carry out this Act.</text></subsection></section></legis-body></bill>
