<section id="H3B718F31B3044373B8318BE42FE20062" section-type="section-one"><enum>1.</enum><header>Definitions of cargo handling equipment and marine terminal</header><text display-inline="no-display-inline">Section 53501 of title 46, United States Code, is amended—</text> <paragraph id="HFC07987E11894B1E9329CA4C08EC2778"><enum>(1)</enum><text>by redesignating—</text>
<subparagraph id="HCC24D50B94644D32A887A295F7738C7C"><enum>(A)</enum><text>subsections (2) and (3), as subsections (3) and (4), respectively; and</text></subparagraph> <subparagraph id="H5CE637BDDF5F4E4A8CBD8445E2E9BFE7"><enum>(B)</enum><text>subsections (4), (5), (6), (7), (8), and (9), as subsections (6), (7), (8), (9), (10), and (11), respectively;</text></subparagraph></paragraph>
<paragraph id="HF6857A6035B54A69A6CEF69351014572"><enum>(2)</enum><text>by inserting after subsection (1), the following:</text> <quoted-block id="H5B11CED36C934285AF3D653BDE548DE8" style="OLC"> <paragraph id="HEECC3E35F5BB4F3BBA728966C958A4B3"><enum>(2)</enum><header>Cargo handling equipment</header><text>The term <quote>cargo handling equipment</quote> means any vehicle or land-based equipment, and the associated marine terminal or port landside infrastructure, used at a marine terminal to lift or move cargo—</text>
<subparagraph id="H74D11855F7C04B72A1732B64D53B7D06"><enum>(A)</enum><text>manufactured in the United States; or</text></subparagraph> <subparagraph id="HAFBB2139A6E14609BA19A3FD62929C46"><enum>(B)</enum><text>manufactured outside of the United States, if such equipment is not produced in the United States in sufficient and reasonably available quantities or of a satisfactory quality as determined by the marine terminal operator.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>
<paragraph id="H46E5FA2561534CD9BA714FDEBE03C62A"><enum>(3)</enum><text>by inserting after subsection (4), as redesignated by paragraph (1), the following:</text> <quoted-block id="H47FECD262FCD440A96EFBEFD85CCDA21" style="OLC"> <paragraph id="HEB18BE533FA6460F9664424B7B8DBD39"><enum>(5)</enum><header>Marine terminal</header><text>The term <quote>marine terminal</quote> means wharves, bulkheads, quays, piers, docks and other berthing locations and adjacent storage or adjacent areas and structures associated with the primary movement of cargo or materials from vessel to shore, or from shore to vessel, including structures which are devoted to receiving, handling, holding, consolidating, loading, or delivery of waterborne shipments, including areas devoted to the maintenance of the terminal or equipment.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="HD0A2549819DF45A8B02AC376F02B8842"><enum>2.</enum><header>Establishing a capital construction fund</header><text display-inline="no-display-inline">Section 53503 of title 46, United States Code, is amended—</text> <paragraph id="HFA948D972A124FA197442B3CFA9CD31D"><enum>(1)</enum><text>by striking subsection (a) and inserting the following:</text>

<subsection id="HC42B40FC63F042B4BBF6E0878658228F"><enum>(a)</enum><header>In general</header>
<paragraph id="H3C2C9CFC58D34DA0AA7FC0CAE55B616D"><enum>(1)</enum><text>A citizen of the United States owning or leasing an eligible vessel may make an agreement with the Secretary under this chapter to establish a capital construction fund for the vessel.</text></paragraph> <paragraph id="H06B800BF1B6F4796A322D3AA3D2E224F"><enum>(2)</enum><text>An operator of a United States marine terminal may make an agreement with the Secretary under this chapter to establish a capital construction fund for the marine terminal.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>
<paragraph id="H3A178FBCEBB34C1395A165829436E458"><enum>(2)</enum><text>by striking subsection (b) and inserting the following:</text> <quoted-block id="HDAA1214E661949819561A51928B96673" style="OLC"> <subsection id="HF4509C27B9604E49A7BAEBB46D77F669"><enum>(b)</enum><header>Allowable purpose</header><text>The purpose of the agreement shall be to provide—</text>
<paragraph id="H9E66B08B76144D46AC74A653C9A73EA6"><enum>(1)</enum><text>replacement vessels, additional vessels, or reconstructed vessels, built in the United States and documented under the laws of the United States, for operation in the foreign or domestic trade of the United States; or</text></paragraph> <paragraph id="H6DB4952666594B4B81F4F4694AA3FE65"><enum>(2)</enum><text>replacement cargo handling equipment, additional cargo handling equipment, or reconstructed cargo handling equipment for operation at marine terminals in the United States.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="H751B11FBC9894254A77D3020A90E7DE7"><enum>3.</enum><header>Deposits and withdrawals</header><text display-inline="no-display-inline">Section 53504(b) of title 46, United States Code, is amended by inserting <quote>or United States marine terminal</quote> after <quote>agreement vessel</quote>.</text></section> <section id="H1FDE97BE4DFA44929CFE396E90171D15"><enum>4.</enum><header>Ceiling on deposits</header><text display-inline="no-display-inline">Section 53505(a) of title 46, United States Code, is amended—</text>
<paragraph id="HE983E8F0C0604D52B6B6CE71A7BB9DB0"><enum>(1)</enum><text>in subparagraph (1) by inserting <quote>, or the operation of a marine terminal in the United States</quote> after <quote>in the fisheries of the United States</quote>;</text></paragraph> <paragraph id="H849FC3293D52465B8DBCEEFE2B4AEDF4"><enum>(2)</enum><text>in subparagraph (2) by inserting <quote>or cargo handling equipment</quote> after <quote>agreement vessels</quote>; and</text></paragraph>
<paragraph id="H0A2077050F934A1B8A1B808F2558C0DC"><enum>(3)</enum><text>in subparagraph (3) by inserting <quote>or cargo handling equipment</quote> after both instances of <quote>agreement vessel</quote>.</text></paragraph></section> <section id="H8CDC2EE3B78042708675D85A1AB064A9"><enum>5.</enum><header>Qualified withdrawals</header><text display-inline="no-display-inline">Section 53509 of the title 46, United States Code, is amended—</text>
<paragraph id="H000D01B15451464BB83CBCA1C3C8BFE7"><enum>(1)</enum><text>by striking subsection (a) and inserting the following:</text> <quoted-block id="H030B56EA19D84AB6BD4BBDDEED9A9379" style="OLC"> <subsection id="H7969D578527C48549434290CFCCD1831"><enum>(a)</enum><header>In general</header><text>Subject to subsections (b) and (c), a withdrawal from a capital construction fund is a qualified withdrawal if it is made under the terms of the agreement and is for—</text>
<paragraph id="HD52E994678BE45C187833B2183F16B62"><enum>(1)</enum><text>the acquisition, construction, or reconstruction of—</text> <subparagraph id="H0D0D535072F54D98A05CAF09C175BD68"><enum>(A)</enum><text>a qualified vessel or a barge or container that is part of the complement of a qualified vessel; or</text></subparagraph>
<subparagraph id="HB36906F428A949618FACC77ED1C3CB84"><enum>(B)</enum><text>cargo handling equipment; or</text></subparagraph></paragraph> <paragraph id="H43C2FDCD82054BC6951F8429A05B596F"><enum>(2)</enum><text>the payment of the principal on indebtedness incurred in the acquisition, construction, or reconstruction of—</text>
<subparagraph id="H8F071860B3E042F28F674F3E32A8E791"><enum>(A)</enum><text>a qualified vessel or a barge or container that is part of the complement of a qualified vessel; or</text></subparagraph> <subparagraph id="H25CB30AC0D7744E5964DAE42D0F8EA07"><enum>(B)</enum><text>cargo handling equipment.</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>
<paragraph id="H103B6E5185EC4D39B00871DB2AFDACEA"><enum>(2)</enum><text>by redesignating subsection (c) as subsection (e); and</text></paragraph> <paragraph id="H86C2679423DB49C28AAA5ACA5783ED85"><enum>(3)</enum><text>by inserting after subsection (b) the following:</text>
<quoted-block id="H5B367BD6DB624CC3BB12A8579E830ED4" style="OLC">
<subsection id="H1D48B66EF1EC4A01B97C932CDDBECEF5"><enum>(c)</enum><header>Fully automated cargo handling equipment</header><text>No withdrawals may be made from a capital construction fund to purchase fully automated cargo handling equipment that is remotely operated or remotely monitored with or without the exercise of human intervention or control, if the Secretary determines such equipment would result in a net loss of jobs within a marine terminal.</text></subsection> <subsection id="HFC0B17190C6044F1945E9148274498E3"><enum>(d)</enum><header>Prohibition on PRC cranes</header><text display-inline="yes-display-inline">No withdrawals may be made from a capital construction fund to purchase cranes manufactured in the People's Republic of China.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="HB124B8B55EB8444A824DB29654AAF263"><enum>6.</enum><header>Treatment of qualified withdrawals and basis of property</header><text display-inline="no-display-inline">Section 53510 of title 46, United States Code, is amended—</text> <paragraph id="HBABA7B7D7CC44069ACCECFEE4153A446"><enum>(1)</enum><text>in subsection (b) by inserting <quote>cargo handling equipment,</quote> after both instances of <quote>barge,</quote>;</text></paragraph>
<paragraph id="HA4FEFE9E522549EA9CC0632DCE2CBC43"><enum>(2)</enum><text>in subsection (c) by inserting <quote>cargo handling equipment,</quote> after both instances of <quote>barge,</quote>; and</text></paragraph> <paragraph id="HF3AC19ED9C0A4C609A5A12965578BBB1"><enum>(3)</enum><text>in subsection (d) by inserting <quote>cargo handling equipment,</quote> after <quote>barges,</quote>.</text></paragraph></section>
<section id="HC51C1C7ADC9C45D09A84355C4014D0D9"><enum>7.</enum><header>FIFO and LIFO withdrawals</header><text display-inline="no-display-inline">Section 53512 of title 46, United States Code, is amended by adding <quote>cargo handling equipment,</quote> after <quote>advanced</quote>.</text></section> <section id="H459924DD29664717A3641001F2B8471C"><enum>8.</enum><header>Cargo handling equipment availability</header><text display-inline="no-display-inline">The Secretary shall annually publish in the Federal Register a request for information regarding the availability of cargo handling equipment manufactured in the United States and shall share the results of such request for information with capital construction fund holders.</text></section>
