          on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to make certain improvements to the program of the Department of Veterans Affairs to provide comprehensive assistance for family caregivers of eligible veterans, and for other purposes.</official-title></form><legis-body id="H513A88B267614193B2AE5EF7967C793F" style="OLC"> 
<section id="HA88786BCB8314882B713EBBB7CE12A11" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans’ Caregiver Appeals Modernization Act of 2025</short-title></quote>.</text></section> 
<section id="HA248372EB1D648279ABF876871CA3096"><enum>2.</enum><header>Improvements to program of Department of Veterans Affairs for comprehensive assistance for family caregivers of eligible veterans</header> 
<subsection id="H7A1FEE001D0E475898419B0AC383220D"><enum>(a)</enum><header>In general</header><text>Section 1720G of title 38, United States Code, is amended—</text> <paragraph id="H1CADF564AAE447F9A12E6AFFF7F706C0"><enum>(1)</enum><text>in paragraph (4) of subsection (a)—</text> 
<subparagraph id="H1B3DC392C0EB47B387353E6A037F3B81"><enum>(A)</enum><text>by striking <quote>An eligible veteran</quote> and inserting <quote>(A) An eligible veteran</quote>; and</text></subparagraph> <subparagraph id="HA9F1D59EF0694315B8A64A2935682455"><enum>(B)</enum><text>by adding at the end the following new subparagraph:</text> 
<quoted-block style="USC" id="H4A012625E6AA4A84BD4521BD9069F27D" display-inline="no-display-inline"> 
<subparagraph id="H30106A6EB5884050BDAE2D2963E74A11" indent="up1"><enum>(B)</enum><text>The Secretary shall develop and implement a single digital system through which each employee of the Veterans Health Administration or the Board of Veterans’ Appeals responsible for evaluating such applications, or appeals of decisions of the Secretary with respect to such applications, may access—</text> <clause id="H8B09F9AAE2E34ED3B4ED492ABA63D3A6"><enum>(i)</enum><text>each such application; and</text></clause> 
<clause id="H28D8408429F541DABE9AEC6562FAE7A4"><enum>(ii)</enum><text>all documents received or submitted with respect to each such application.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="HDB7B9930CA8E4EE28C600974B50FE20F"><enum>(2)</enum><text>in subsection (c)—</text> 
<subparagraph id="HDB9F8EA84FE046DEAE41BCCF58CB231C"><enum>(A)</enum><text>in the heading, by inserting <quote><header-in-text level="subsection" style="USC">; training</header-in-text></quote> after <quote><header-in-text level="subsection" style="USC">Construction</header-in-text></quote>;</text></subparagraph> <subparagraph id="H10D7351821B049F49E5E2AA8E6FF099E"><enum>(B)</enum><text>in paragraph (2)—</text> 
<clause id="H2EEF80B8E75C4B85BD937D9CBD2663BD"><enum>(i)</enum><text>by striking <quote>construed to create—</quote> and inserting <quote>construed—</quote>;</text></clause> <clause id="H8592D7303CD048D382F2DAAE067FBAA5"><enum>(ii)</enum><text>by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively (and conforming the margins accordingly);</text></clause> 
<clause id="HE2314521F0764525A9AC2302301F3644"><enum>(iii)</enum><text>by inserting before the matter so redesignated the following new subparagraph:</text> <quoted-block style="USC" id="H5D5FFB05E1A0476B8605574F098E2072" display-inline="no-display-inline"> <subparagraph id="H57B127499EEE46D8B50F75C9087A1E9E" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">to create—</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause> 
<clause id="H7AAD590C3EFC4D23A8C62E2F7DC5465C"><enum>(iv)</enum><text>in clause (ii) of subparagraph (A), as added by clause (iii), by striking the period at the end and inserting <quote>; or</quote>; and</text></clause> <clause id="HBB817E297A3F448D8C9142020CC19EE6"><enum>(v)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (A), as added by clause (iii), the following new subparagraph:</text> 
<quoted-block style="USC" id="HFCCF04F27E8047B18DFA0FAFF7DD2044" display-inline="no-display-inline"> 
<subparagraph id="HCDDEC18BE3834745B5C160B9D5B73569" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">as affecting, if an eligible veteran dies during the pendency of an appeal of a decision of the Secretary affecting the furnishing of assistance or support services under this section, the eligibility of a family caregiver to receive monthly personal caregiver stipends under subsection (a)(3)(A)(ii)—</text> <clause id="H48DC080B2C2743469DF0FEAC1F4AA5CD"><enum>(i)</enum><text>to which the family caregiver was entitled on the date of the death of the eligible veteran based on evidence in the file on such date; and</text></clause> 
<clause id="H52FD04A4BF0B421E958C13D73B585FD3"><enum>(ii)</enum><text>due and unpaid as of such date.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph> <subparagraph id="H2CB22E9624F04EB4BB6847ABEA3E7ABF"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="H043E89529239421090996C74A4AB0F89" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">The Secretary shall ensure that any employee of the Veterans Health Administration responsible for evaluating appeals of decisions of the Secretary affecting the furnishing of assistance or support services under this section is provided the same guidance and completes the same training as a higher-level adjudicator under section 5104B of this title.</text></paragraph> <after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> <subsection id="H091BCC1BAB944F9EBBA1AD9DB0E9A7DC"><enum>(b)</enum><header>Required considerations</header> <paragraph id="HEFA51AA71FF3400A941935E0181D478E"> <enum>(1)</enum> <header>Digital systems</header> <text>In developing the digital system required by subsection (a)(4)(B) of section 1720G of title 38, United States Code, (as added by subsection (a)(1)), the Secretary shall consider—</text>
          <subparagraph id="H202FA43B135D4390A4A4FECCEA450A85" commented="no">
            <enum>(A)</enum>
 <text>lessons learned from the implementation of the Veterans Benefits Management System to process claims for benefits under laws administered by the Secretary; and</text>
          </subparagraph>
          <subparagraph id="H5A0AA54B0BD04E1E9754E6674832E423" commented="no">
            <enum>(B)</enum>
 <text>whether other programs administered by the Veterans Health Administration would improve from the development of a single digital system through which applications and documents relating to such programs may be accessed by employees of the Veterans Health Administration responsible for evaluating such applications and documents.</text>
          </subparagraph>
        </paragraph> 
<paragraph id="HB619F637D74B4E82BB31CA07BB16FD1B" commented="no"><enum>(2)</enum><header>Training</header><text display-inline="yes-display-inline">In carrying out the requirement under paragraph (5) of subsection (c) of such section (as added by subsection (a)(2)), the Secretary shall consider best practices developed from efforts of the Secretary to standardize the guidance and training available to employees of the Department responsible for the delivery of disability compensation to veterans eligible for such compensation.</text> </paragraph> </subsection> </section> </legis-body></bill>
