R. 3817</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250606">June 6, 2025</action-date><action-desc><sponsor name-id="M001199">Mr. Mast</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Corps of Engineers to notify affected communities before releasing water contaminated with cyanotoxins from flood risk management structures, and for other purposes.</official-title></form><legis-body id="H7B23DF6912EC42A78D7BB4846AC1378E" style="OLC"><section id="H557ABE78E8A545F19BAB2D590A1947BB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Toxic Health Threat Warning Act of 2025</short-title></quote>.</text></section><section id="HC74A7272ACAF437CB948E5CD0822F2BD"><enum>2.</enum><header>Releases of water contaminated with cyanotoxins</header><subsection id="HD90931425B4F49EB8486FBF23FBB09AC"><enum>(a)</enum><header>Determination</header><text display-inline="yes-display-inline">Before any planned release of water from a flood risk management structure, the Secretary shall determine whether the water is contaminated with cyanotoxins, based on tests conducted by the Secretary, another Federal agency, or the State in which the flood risk management structure is located.</text></subsection><subsection id="HA83CA7B2780143B1A3332F8ED27C84D9"><enum>(b)</enum><header>Notification</header><text display-inline="yes-display-inline">If the Secretary determines under subsection (a) that water to be released from a flood risk management structure contains cyanotoxins at levels greater than 8 parts-per-billion, the Secretary shall notify the public and affected governments of the determination and planned release, and any potential effects on human health, before releasing the water.</text></subsection><subsection id="HE486F15F7CCD4D6B88E55B34D886356F"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H7952FBAFBD0445D9B59D98D63D48FA7E"><enum>(1)</enum><header>Affected government</header><text display-inline="yes-display-inline">The term <term>affected government</term> means a State, local, or Tribal government with jurisdiction over an area that will be affected by a release of water from a flood risk management structure.</text></paragraph><paragraph id="H6DFF178C5BC24C8989D0742E24E4699C"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Army, acting through the Chief of Engineers.</text></paragraph></subsection></section></legis-body></bill>
