<section id="HD1CEA8499D61474E81584EE792BDE072" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Flexible Acquisition of Software Technology Act</short-title></quote> or the <quote><short-title>FAST Act</short-title></quote>.</text></section> 
<section id="H36696099963B4B0F9B2B8A5C7CCBC1E5" section-type="subsequent-section"><enum>2.</enum><header>Procurement of software and data as a service to support artificial intelligence systems</header> 
<subsection id="HCEC57D5188EE4620BE2F7C94DA611DD2"><enum>(a)</enum><header>Authorization</header><text>For purposes of supporting the development and implementation of artificial intelligence systems to meet the operational needs of the Department of Defense, the Secretary of Defense may—</text> <paragraph id="H53FFC1CE23364C6A9CE277776D63A4E7"><enum>(1)</enum><text>procure software as a service or software as a product;</text></paragraph> 
<paragraph id="H95A073BA70554242A97C28781A0AC5E9"><enum>(2)</enum><text>procure data as a service or data as a supply;</text></paragraph> <paragraph id="H0B1447CA7F784013947A8ACE23E401CE"><enum>(3)</enum><text>modify software to support such systems; and</text></paragraph> 
<paragraph id="H74B01F3AF5474F95B8D4F06CBB5D1959"><enum>(4)</enum><text display-inline="yes-display-inline">research, develop, test, and evaluate such software.</text></paragraph></subsection> <subsection id="HA0C2D006196347438D312ED455D85C0D"><enum>(b)</enum><header>Funding</header><text display-inline="yes-display-inline">The Secretary of Defense may carry out subsection (a) using amounts appropriated or otherwise made available to the Secretary for any purpose.</text></subsection> 
<subsection id="H6DDF5387270A435FB48BA572F0E982B5"><enum>(c)</enum><header>Regulations</header><text>The Secretary of Defense shall issue or modify regulations as necessary to implement this section, which shall include regulations—</text> <paragraph id="HD09B6D7799D14566A18B052A175151ED"><enum>(1)</enum><text>to govern the procurement and modification of software and data for artificial intelligence systems under subsection (a); and</text></paragraph> 
<paragraph id="H64BD0414BF2E472CB9372F7E83DA0963"><enum>(2)</enum><text>to provide for the oversight of such procurements and modifications.</text></paragraph></subsection> <subsection id="H9FA25D759A16403280506D7DC72C5D9A"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H43A6EDB33377481A81A5075916853ABD"><enum>(1)</enum><header>Artificial intelligence system</header><text>The term <term>artificial intelligence system</term> means a system that is capable of performing tasks that normally require human-like cognition, including learning, decision-making, and problem-solving.</text></paragraph> <paragraph id="H55B5077619BC4DB799F5CF6BBA2E5725"><enum>(2)</enum><header>Data as a service</header><text>The term <term>data as a service</term> means a data delivery model in which data is provided on a subscription basis and is accessed remotely over the internet.</text></paragraph> 
<paragraph id="H78228C0DB8734FDFA7B3CC614E6CCB36"><enum>(3)</enum><header>Data as a supply</header><text>The term <term>data as a supply</term> means a data delivery model in which data is acquired on a nonsubscription basis and retained locally rather than accessed remotely over the internet.</text></paragraph> <paragraph id="HB35E526AE7E44632879ADC9ABBC425E1"><enum>(4)</enum><header>Software</header><text>The term <term>software</term> has the meaning given the term <term>computer software</term> in part 2.101 of the Federal Acquisition Regulation (or any successor regulation) and includes noncommercial, commercial, and commercial off-the-shelf software.</text></paragraph> 
<paragraph id="H8C525DC44A994E9BA0EE42C9BCA01E98"><enum>(5)</enum><header>Software as a service</header><text>The term <term>software as a service</term> means a software delivery model in which software is provided on a subscription basis and is accessed remotely over the internet.</text></paragraph></subsection> </section> </legis-body></bill>
